This letter of authorization is in reference to your 27 March 2019 email requesting a
modification of work authorized under Major CAMA/Dredge and Fill Permit No. 115-18 issued to you
on 11 July 2018 for redevelopment of a former commercial fishhouse property located at 785 Pantego
Street in the Town of Belhaven at the head of Battalina Creek in Beaufort County, North Carolina.
Major CAMA/Dredge and Fill permit no. 115-18 authorized a marina with 13 slips, a boat maintenance
yard with travel lift slip, wash down pad and a boat ramp. The permit also authorized the widening of
two canals, excavation of a travel lift slip and excavation of the channel in Battalina Creek and
bulkheading along the project site shoreline.
Your request is to modify Major CAMA/Dredge and Fill Permit No. 115-18 to excavate an
additional ±900 ft2 of uplands for the purpose of reducing the amount of bulkhead construction by
more than 100 linear feet. This additional upland excavation will convert uplands to open water and
will require the finger piers adjacent the travel lift slip on both sides to be extended over newly created
open water 3' x 54', in a landward direction and the 6' wide dock that was landward of a proposed
bulkhead accessing slips 12 and 13 will now be over open water for a distance of ±48'. These
aforementioned changes are hereby authorized.
Your modified plat dated 2 April 2019 illustrating the authorized changes will become a part
of the permit file and construction should be accomplished accordingly. Thank you for your time and

Mr. Tetterton:
This email confirms receipt of your 28 March 2019 letter and Addendum to the aforementioned letter requesting
temporary relief to condition number 1 of Major CAMA/Dredge and Fill permit no.115-18. Condition number 1 states in
part " no excavation or filling within open water areas shall be permitted between April 1 and September 30 of any year
without prior approval of the Division of Coastal Management, in consultation with appropriate resource agencies." I
have discussed this request with Mr. Shane Staples, Habitat Specialist with the Division of Marine Fisheries, and have
confirmed two weeks relief to the excavation and filling moratorium. You may currently continue to undertake the
authorized excavation activities of open water areas until 15 April 2019. This is a one- time temporary relief to
excavation and filling activities within the April 1 to September 30 moratorium. Please continue to coordinate any
future need to excavate or fill open water areas with DCM staff per condition no. 1.

Below is a listing of determinations for future permit application context.
Spoil deposition within the 50 foot Tar -Pam buffer.
o Though not noted in the bio report the workplans do indicate that the site is existing
impervious. DWR exemption verified.
Potential for new dredging determination within Battalina Creek
o Discussed with Doug and the due to the location and historic use of the area DCM would
consider the dredging maintenance. DMF agreed.
• Proposed Marina
o Quarter Width was not addressed concerning the rail system's dolphins. After a
discussion with Steve Trowell on 9/27/18 he believes that the dolphins are not to scale
on the scaled drawings. Spoke to Joe Lassiter (Agent) and he believes the same and is
OK with meeting the''/<width. Permit was conditioned accordingly (Condition No. 17).
o The mooring pilings (18) were not addressed in the bio report, but each one along
Baker's Canal is in line with the finger pier alignment and satisfies the % width.
• DWR
Requested a marina operations plan in the 8/20/18 hold for additional information. The
permit was conditioned accordingly (Condition No. 29).
