Shoreline Stabilization — Offshore Sills Unless specifically altered herein, this permit authorizes the construction of the offshore sills and support structures, all as specifically and expressly set forth in the attached workplan drawings. The alignment of the authorized offshore sills shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. No portion of the offshore sills located within the riparian corridors to the east and west of the authorized offshore sill shall be positioned more than 25 feet from the normal high water line. Signature of Permittee of Swansboro t Permit No. 64-18 Page 2 of 3 ADDITIONAL CONDITIONS The offshore sill material shall consist of clean oyster shell, rock, granite, marl, or broken concrete. Sill materials shall be of a size sufficient and design to prevent its movement from the approved alignment by wave or current action. The permittee shall be responsible for immediate removal of any materials or debris that becomes dislodged or moves outside the authorized alignment. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted offshore sills for the purpose of Coastal Wetland s plantings. The backfill authorized by this permit shall be graded to a sufficient elevation and slope, related to normal low water, to allow for the successful planting and colonization of native Coastal Wetland species. Coastal Wetland plantings are authorized within the authorized fill area, landward of the offshore sills. No fill is authorized within any existing marsh areas or outside of the project's property boundaries. No part of the fill placed waterward of the derelict bulkhead shall be placed above the normal high water elevation. In accordance with commitments made by the permittee, upon completion of the offshore sills, the Estuarine Waters located between the offshore sills and the existing bulkhead shall be planted with native Coastal Wetland species, all expressly and specifically detailed in the attached narrative and workplan drawings. This Coastal Wetland planting area shall be monitored by the permittee, and the permittee shall be responsible for replanting if deemed necessary by the Division of Coastal Management (DCM), for a minimum period of 5 years after the first planting event, or until the DCM has notified the permittee in writing that the Coastal Wetland plantings have acclimatized or naturalized. Documentation of the monitoring results shall be provided annually.to the DCM prior to December 31" of any year. If, after 5 years, the DCM determines the plantings have not acclimatized or naturalized, remediation of the planting area or removal of the sand fill may be required. All fill material to be placed below normal water high level shall be confined to the area behind the permitted offshore sills. The height of the permitted offshore sills shall not exceed 12 inches above normal high water level. The offshore sills shall be marked at 50-foot intervals with yellow reflectors extending at least three feet above normal high water. The permittee shall maintain the offshore sills in conformance with the terms and conditions of this permit or the remaining structure shall be removed within 90 days of notification from the Division of Coastal Management. of Swansboro a Permit No. 64-18 Page 3 of 3 ADDITIONAL CONDITIONS General In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee_guidelines.pdf. This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. Any mitigative measures or environmental commitments specifically made by the applicant in the narrative for this project shall be implemented, regardless of whether or not such commitments are addressed by individual conditions of this permit. In order to ensure compliance with the conditions of this Permit, the permittee and his contractor shall schedule a pre -construction conference with the Division of Coastal Management prior to the initiation of any mobilization activities. E: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit 54 (Action ID SAW-2017-02084). 'E: The N.C. Division of Water Resources authorized the proposed project by way of General Water 1. Quality Certification 4144 and assigned the project DWR Project No. 2018-0568. 'E: Future development of the pemrittee's property may require a modification of this permit. Contact a representative of the Division at (252) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. ITE: An application processing fee of $400 was received by DCM for this project. This fee alsc satisfied the Section 401 application processing fee requirements of the Division of Water Resources. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located adjacent the shoreline of Ward Shore Park in Swansboro, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G. S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct a living shoreline by installing a series of offshore sills and backfilling before planting coastal wetland plants. The granite sills would have a 16' base width and a 3' top width. The positioning of the five sills would be between 22' and 42' waterward the existing derelict bulkhead, ranging in lengths between 25' and 112'. Nine cubic yards of material is proposed to be placed landward the sills to increase elevation to plant coastal wetland species. Eroded areas behind the bulkhead will be excavated to appropriate grade to plant "high marsh" species. Water depths in the project area are -I' to -2' NLW. Ward Creek in this area is classified SA and is not designated a primary nursery area (PNA). However, Ward Creek becomes a designated PNA 670' west the project area. The NCWRC has reviewed the permit application and does not object to the construction of the living shoreline. A scoping meeting was conducted and recommendations were given to the applicant that have been incorporated into the project design. PROJECT SUMMARY: The City of Swansboro is proposing to construct a living shoreline adjacent to Ward Shore Park. NARRATIVE DESCRIPTION: The Ward Shore Park project is located at the 400 block of Water St. in Swansboro adjacent to Bogue Sound. Ward Shore Park is located near the terminus of Water St. on the South side of a sharp bend. The AIWW setback line borders the park 220' to the South. Ward Shore Park is 8,847ft2 in size and is mostly undeveloped. The park is vegetated with grasses and various landscape plants. Existing along the 295' shoreline is a dilapidated bulkhead. The bottom of Bogue Sound adjacent to the bulkhead is mostly sand and silt with broken debris scattered in the sediment. Water depths in the area are -1' to -2' at NLW. Ward creek PNA is 670' west of project area. The Division of Water Resources classifies this area of Bogue Sound as SA waters. This is not a Primary Nursery Area. This portion of Bogue Sound is closed to harvesting shellfish. There are no SAV's or significant shellfish populations in the areas to be disturbed. The parcel is classified in the Swansboro LUP as Conservation. 10. PROJECT DESCRIPTION: The City of Swansboro is proposing to create a living shoreline by constructing a series of offshore sills and backfilling before planting Coastal Wetland Plants. Each Granite sill would have a base width of 16' and a top with of 3'. Sill A would be 84' long and range from 35' to 40' waterward of the bulkhead. Sill B would be 25' long and be located 25' waterward of the bulkhead. Sill C would be 100' long and be located 42' waterward of the bulkhead. Located on the White Oak River, the site has traditionally served as a neighborhood water access site for children and adults and currently features picnic tables, seating, and swings. The park provides opportunities for pedestrian and visual access to the water and has functioned in recent years as a component of the Town's Parks and Recreation Department. It is located a short walk from the downtown area and is an element of the White Oak River Trail, a long-term plan for development of a walking route along the Swansboro waterfront. A wooden bulkhead installed at the park several years ago to address an eroding shoreline has now deteriorated. As a result additional erosion is occurring landward of the bulkhead. The Town has received a Water Resources Development Project Grant, administered by the NC Division of Water Resources, for development of a Living Shoreline at the site. The shoreline stabilization project began as a bulkhead replacement project. However, with encouragement from Division of Water Resources staff the Town has chosen to stabilize and protect the shoreline with a Living Shoreline rather than a new bulkhead. The Town initially conducted an evaluation of the appropriateness of the site for a Living Shoreline with assistance from Dr. Lexia Weaver and Sam Bland of the North Carolina Coastal Federation. After several onsite visits it was determined by Coastal Federation staff that the site is conducive for creation of a Living Shoreline. Dr. Ken Riley of the National Marine Fisheries Service and Spencer Rogers of the North Carolina Sea Grant were also consulted in the development of project plans, and along with Dr. Weaver provided technical assistance to the project engineer and planner in designing the Living Shoreline. The Living Shoreline project was reviewed at a multi -agency scoping meeting in September at the NC Department of Environmental Quality Wilmington Regional Office. It was confirmed at the meeting that a major CAMA permit will be required to build the project. Town of Swansboro Ward Shore Park Living Shoreline Project Major CAMA Permit Application March 27, 2018 RECEIVED MAR 2 7 2018 DCNI- MHD CITY Page 1 The project involves strategic placement of plants and limited amounts of stone and sand fill to provide the protection of a traditional bulkhead while encouraging development of a natural shoreline. In addition to halting erosion and preserving the parcel for continuing public access, project goals include enhancement of the public water access experience of park visitors. The Town proposes to accomplish these goals by developing a Living Shoreline that will provide shoreline access to wildlife, provide shallow water habitat for aquatic and terrestrial animals, and improve water quality. The project is consistent with policies for improving public water access and other recreational opportunities contained in several Town plans and policy documents. The project will implement policies contained in the Town of Swansboro CAMA Land Use Plan, Waterfront Access and Development Plan, Comprehensive Parks and Recreation Plan, and report of the Downtown Renaissance Committee. Land use and recreation policies support preservation and maintenance of areas that have traditionally been used for public access and protection of waterfront shoreline areas and valuable scenic areas. The Downtown Renaissance Committee recommended continued efforts to improve public pedestrian access to the waterfront, while the waterfront access plan specifically supports Ward Shore Park. Ward Shore Park was dedicated as a beach area on the recorded map of Edgewater Heights subdivision in 1940. It is listed by the Onslow County Tax Assessor in the name of the Town of Swansboro. It is believed that the Town has been listed as such since the mid-1980s. The Town has maintained control of the park since that time. Correspondence from the Town's current and former attorneys is included with this application in support of the Town's claim to the project site. Site Description Ward Shore Park is situated directly on the White Oak River near the "turning basin" of the Intracoastal Waterway. It is located in the 400 block of Water Street just south of the Swansboro downtown area, outside the National Registered Historic District and the Town - designated urban waterfront area. The site is located four blocks from NC Highway 24, the principal transportation artery in Swansboro. The project site measures 8,847 square feet, based on a recent (2017) survey of the site. The entire parcel is located in the 75' Coastal Shoreline Area of Environmental Concern (AEC), with Town of Swansboro Ward Shore Park Living Shoreline Project Major CAMA Permit Application March 27. 2018 RECEIVED MAR 2 7 2018 Page 2 DCM- MHD CITY 295 linear feet of shoreline. Average elevation of the tract above Normal High Water (NHW) is approximately 3.5'. Low water depths within 50' of the shoreline range from -0.9' Normal Low Water (NLW) to -1.9' NLW. Grasses and landscape plants are located on the property, including a rain garden area. A small area of coastal wetlands is located along the western end of the shoreline. In addition to the failing wooden bulkhead, a wooden high ground deck, post fence, picnic tables, seating, and swings are located on the property. A retaining wall and fence associated with the adjacent property is encroaching on the park property on the western end. Adjacent uses are residential, with a commercial marina located within close proximity of the park. The Town of Swansboro zones the property as GE Government -Educational. Division of Water Resources Surface Water Classification of the White Oak River at the project site is SC. The park is served by underground electrical service for existing street lights. No wastewater or drinking water services are associated with the Park, although central water and sewer are provided to adjacent properties by Onslow Water and Sewer Authority (ONWASA). A search of CAMA permit records did not identify any history of dredging at the site or at adjacent properties. Dr. Ken Riley confirmed that a generalized assessment was conducted on September 18, 2017 to determine the presence of submerged aquatic vegetation (SAVs) and shellfish at the site. No SAVs were detected and very few oysters were observed. The small number of oysters was found on the existing bulkhead. It is noted that the area is closed to the harvesting of shellfish. A comparison of maps of the site from 1940, 2011, and 2017 shows a steadily eroding shoreline. Areas behind the existing bulkhead measuring 2 linear feet are identified on the 2017 survey as washouts. The total estimated volume of erosion (washouts) in the previous 12 months is 9 cubic yards. The 2017 survey shows a monument in the water just offshore of the park. It is believed that the monument is related to the property corner at the time the parcel was platted, but is now in the water due to erosion of the property. The State Historic Preservation Office was requested to assess any potential impacts to the monument that might affect the project. Maurice and Penny Johnson are the owners of the adjacent riparian property to the west of the project site. Kirby L. Everette, Jr. owns the adjacent riparian property to the east. Project Description The Town of Swansboro proposes to stabilize and protect the shoreline of Ward Shore Park by utilizing alternative shoreline protection methods. The Town proposes to develop a Living Shoreline at the public waterfront access facility by constructing a series of rock sills, placing sand between the shoreline and sills and in eroded areas behind the existing bulkhead, and planting of marsh vegetation. Sand placement in the water will be contained by support structures associated with the sills as shown on project plans. Low marsh vegetation (Spartina alterniflora) will be planted between the bulkhead and sills, with high marsh plants (a combination of Spartina patens and Juncus roemerianus) established landward of the existing bulkhead. Currently stormwater runoff from adjoining properties and streets appears to sheet flow over and through the existing bulkhead, contributing to the instability of the park shoreline and carrying sediment and other pollutants into the river. The Town proposes to leave the failing bulkhead in place to minimize construction land disturbance and decrease the erosion potential of runoff. As flow patterns become evident openings may be created in the bulkhead to more evenly disperse the runoff. The existing bulkhead will also provide some interim degree of stability to the shoreline during the period needed to establish the marsh plantings. During the scoping meeting and other preliminary discussions with regulatory agencies, a kayak launch was considered for placement at the site. The Town has opted not to provide a kayak launch at this time. The primary goal of the current project is to protect, maintain, and restore the shoreline of the public access facility in the most ecologically suitable manner. The system of sills will extend for a distance of 305' parallel to the shoreline. The width of the sills will range from 12' to 16'. The proposed sill system extends into the 15' riparian corridor setback on the east side of the project site. A copy of a waiver to the setback dated December 15, 2017 provided by adjacent riparian property owner Kirby L. Everette, Jr. is included with this permit application. Town of Swansboro Ward Shore Park Living Shoreline Project Major CAMA Permit Application March 27. 2018 RECEIVED MAR 2 7 2018 Page 4 DCM- MHD CITY The sill system also extends into the 15' riparian corridor setback on the west side. No waiver has been provided by the owner of the adjacent riparian property owner on this side. The portion of the proposed sill within the western setback is located a maximum of 24' from mean high or normal water level, consistent with guidance contained in 15A NCAC 7H .2700 for construction of riprap sills in locations where waivers are not available. The outermost extent of the proposed sills will extend an average distance of 38' waterward of NHW with a maximum distance of 46' from NHW. The landward edge of the proposed sills will be less than 30' from NHW. The sills will be constructed of granite rock placed over woven geotextile fabric. A total of 4,920 square feet of stone will be placed below the water level in the construction of the sills, with an additional 145 square feet of stone placed below the water level to construct the associated sand fill support structures described later in this narrative. The area to be filled with sand below the water level (between the existing bulkhead and sill sections) measures 5,600 square feet. Washed granite rock and clean sandy material will be brought to the project site by the contractor. A total of five sills are proposed. Sill A measures 84' in length, with a width of 16' narrowing to 12'. The waterward extent of the sill section within the 15' riparian corridor setback is located 24' from NHW. The landward side of the sill within the setback is located 12' from NHW. Sill B is off -set closer to the shoreline and overlaps both Sill A and Sill C by 10' to provide for a 5' opening. It measures 25' long and 12' wide with the landward edge located 12' from NHW. Sill C is aligned with Sill A and is located 26' on the landward side from NHW. This section measures 100' long by 16' wide. Sill D is offset and overlaps Sills C and E, both by 10', to provide a minimum 5' opening in the same manner as Sill B. Sill D measures 25' by 15'. It is located 7' from NHW on the landward side. Sill E is aligned with Sills A and C and curves to tie into the existing bulkhead at the edge of the neighboring property. The sill section measures 112' long and is 16' wide narrowing to 12' at the point it joins the bulkhead. A 5' minimum drop -down 6" above the fill is located mid -way of the sill. Town of Swansboro Ward Shore Park Living Shoreline Project Major CAMA Permit Application March 27. 2018 RECEIVED MAR 2 7 2018 Page 5 DCM- MHD CITY All sill sections are designed with 1.5:2 slopes on the landward side, and 1.25:2 slopes on the waterward side. The sills are designed to be constructed with 300- to 900-pound granite stones, with the smaller stones distributed internally. The sills will be porous to allow water circulation through the structures. The crest elevation is 3' NLW (unless noted otherwise on plans) or slightly less than 1' above NLW. The sills are to be marked at 50' intervals with yellow reflectors extending at least 3' above the mean high water level. Clean sand fill is proposed for placement between the existing bulkhead and waterward edge of sill sections. The purpose of the fill is to provide a suitable substrate for the establishment of wetland vegetation and an area of open water landward of the sills. The fill will be contained by the sill sections and three support structures, as shown on project plans. The water area to be filled with clean sand for preparation of the substrate for planting and growing low marsh vegetation measures 230' along the centerline of the fill between the bulkhead and the proposed mid -tide level to the point of Sill E intersection with the existing bulkhead. The width of the fill area for low marsh plantings varies from 0' to 20'. The average existing water depth for this fill area is -1.0 NLW, with final average project depth in the low marsh planting zone of +1.6 NLW. Fill volume in this area totals 400 cubic yards placed in 4,000 square feet of water. In order to maintain an open water area deeper than mid -tide level (MTL) landward of the sill, fill depths will be shallower in the area between the landward edge of Sills A, C, and E and the area proposed for low marsh plants. The area proposed for open water measures 215' with widths ranging from 0' to 8'. From the "Proposed MTL" (on project plans) to the landward edges of Sills A, C, and E, average existing depths are -1.2' NLW, with final average project depth in this zone of + 0.5 NLW. The open water area landward of the sills and below MTL measures 1600 square feet. Fill volume will be 100 cubic yards of sand placed below mean tide level. Support Structure 1 is located at the western edge of the sand fill area. It measures 20' long and 6' wide narrowing to 3' with a 2:1 slope. The top elevation of Support Structure 1 at intersection with bulkhead is 2.07' NLW. This support structure also prevents filling of the coastal wetlands located parallel to the shoreline on the western portion of the project site. Support Structures 2 and 3 each measure 10' long and 3' wide. Structure 2 is located between Sills A and C and will protect the fill edge with granite stone over geotextile fabric. Structure 3 is located between Sills C and E. The design slope for both structures is 2:1. The finished top elevation of Support Structures 2 is -0.12' NLW. The top finished elevation of Support Structure 3 is -0.2' NLW. Sand will be placed in the washed out areas behind the bulkhead to prepare the site for high marsh plantings. It is anticipated that 9 cubic yards of fill sand will be required. No fill will be placed in existing wetlands or in in areas affecting SAVs or shellfish. The measurements of the sills and support sections are also found on a table attached to Form DCM MP-2 Excavation and Fill provided with this submission. The project involves no excavation. Construction Methods Sand and stone will be delivered to th site by dump truck. Materials will be staged for placement with a rubber tire loader and placed by track hoe from land or shallow draft barge. A sediment fence will be used on high ground to keep the fill material onsite and control erosion. A turbidity curtain will be used in the water. The barge will be stored in deep water. Other equipment will be stored on highground. An existing wooden bulkhead at the site is failing, resulting in continuing erosion of the site. The purpose of the project is to stabilize and protect the eroding shoreline by utilizing "Living Shoreline" methods as an alternative to replacing the bulkhead. Additional benefits include provision of habitat and water quality improvements by trapping sediment from high ground runoff. The site will continue to provide visual access to the White Oak River and other recreational benefits for residents and visitors to Swansboro. c.
