Signature of Permittee Jennifer Stewart ADDITIONAL CONDITIONS Permit No. 99-18 Page 2 of 3 The bulkhead shall be constructed prior to any backfilling activities. The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The fill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. Sedimentation and Erosion Control A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Docking Facility -This permit authorizes only the docks, piers, and other structures and uses located in or over the water ;that are expressly and specifically set forth in the permit application. No other, structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as .'measured from the bottom of the decking. The pemrittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes a maximum of 5 formalized boat slips, four located at the facility in Myrtle Grove Sound and one located at the facility in man-made canal. The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. The roof of the covered platform shall not be designed for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Conditions In order to further protect the endangered West Indian Manatee, Tricheehus manatus, the applicant must implementthe U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. 'E: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2018-1401/201) issued 8/23/18. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-0956. Future development of the permittee's property may require a modification of this permit. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. REGAN Seentmy BRAXTON DAVIS Dinaor A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The applicant is proposing to construct a new 310' linear foot bulkhead around the perimeter of their properly landward of existing coastal wetlands connecting to the Carolina Beach Yacht Basin. The applicant is also proposing to construct two private docking facilities. These docking facilities will consist of a shared 375' access pier which leads to a 20' x 20' gazebo and terminates in a 10' x 20' open platform. Each side of the gazebo, northern and southern, will have an access pier, leading to a ramp and a 60' long by 6' wide floating dock oriented perpendicular to the shoreline. In total, this project would incorporate 1,410 square feet of public trust waters classified as SB by the North Carolina Division of Water Resources. Coastal wetlands are some of most valued productive habitat types in the State. Coastal wetlands are a productive detritus based system that trap nutrients, toxins and sediment, aid in shoreline erosion control, dissipate wave and storm action, provides a barrier to flood damage, and provide nursery functions and support fish production. Recent research indicates that even narrow fringes of wetlands are essential factors for fish utilization and erosion control. An estimated 95% of commercial finfish and shellfish species in the US are wetland dependent. Species common to coastal wetlands include sheepshead, red drum, flounder, spot, Atlantic croaker, menhaden, oysters and penaeid shrimp; with a myriad of prey species as well. Wetlands can enhance foraging functions of adjacent habitats, and additionally, these wetlands are important to waterfowl feeding and nesting activities. Construction of a bulkhead along coastal wetlands has the potential to have negative physical, biological, and hydrological impacts associated with hardened vertical shorelines. Vertical hard structures alter the bathymetry and hydrodynamics of the adjacent bottom, with potentially negative effects on wetlands and shallow water nursery functions. These structures can increase reflective wave energy and cause scouring at the toe of the bulkhead, eroding adjacent shorelines, and deepening adjacent water; ultimately reducing or eliminating wetland vegetation. Marsh Vegetation has been shown to experience up to 63% mortality post -construction due to stress from increased turbulence and scour (Garbish et al. 1973). This could result in increased erosion of the shoreline. Because the applicant stated in the project narrative that the construction of the bulkhead is only a . secondary purpose of the whole project aimed to protect the property in the event of a major hurricane. A study by Gittman et al. (2014) evaluated the effects of shorelines after Hutticane Irene in 2011. Their findings suggest marshes and sills were more durable and could protect shorelines better than bulkheads; while 76% of bulkheads were damaged to varying extents, marsh elevations were not affected and any vegetation density was reduction recovered within one year. At this time, it is difficult to justify the degradation of a functioning transitional shoreline without active and documented erosion. CRC rules state that sloping riprap, gabions, or vegetation, rather than vertical seawalls/ bulkheads should be used where possible [T15A NCAC 07H .0208 (b)(7)(E)j. If the applicant would be willing to reconsider the need of a hardened vertical structure, and seek alternatives which allow for a more biologically productive transitional shoreline, this office would be supportive of any efforts to minimize or avoid impacts. The attached notice requests federal agency comments on this project by August 19, 2018. The applicant proposes to add to the existing docking facility and construct a bulkhead landward of the wetlands, at 201 Peninsula Drive, Carolina Beach, New Hanover County, North Carolina. Coordinates in Decimal Degrees are: 34.0532 N - 77.8912 W. The applicant proposes to construct two 6' X 20' fixed piers, one to the north, and one to the south of the 20' X 20'gazebo (which is currently under construction -previously authorized via CAMA GP) in order to provide access to proposed floating docks (each 6' X 60'). The applicant proposes adding a 10' X 20' uncovered deck at the end of the gazebo. Additionally, the applicant proposes to replace a 5'X 50' floating dock along the southern portion of the property (adjacent to Pleasure Cay subdivision basin). According to the application, existing water depths within the project area range from -6' to -12' NLW. No SAV was observed in the project area. Dredging is not proposed. The federal channel setback is approximately 180 feet water ward of the project. The applicant also intends to construct a 310' long bulkhead, measuring 2.5' in height, landward of onsite wetlands. EFH: This notice initiates the Essential Fish Habitat (EFH) consultation requirements of the Magnuson -Stevens Fishery Conservation and Management Act. The Corps' initial determination is that the proposed project may affect, but is not likely to adversely affect EFH or associated fisheries managed by the South Atlantic or Mid Atlantic Fishery Management Councils or the National Marine Fisheries Service. The waters within the project area designated SB by the Division of Water Resources. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.Pov/nc- es/mammal/manatee auidelines.pdf. 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772- 2191. J -2- 3. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 4. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3 feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of the aquatic environment. 5.The permittee understands and agrees that, if future operations by the United States require the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or obstructions caused thereby, without expense to the United States. 6. Approval of the structure is based on determinations that there would be no obstruction to navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats will not be damaged by wave wash. 7.The authorized structure and associated activity must not interfere with the public's right to free navigation on all navigable waters of the United States. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work for reason other than safety. 8.Except as specified in the plans attached to this permit, no excavation, fill or mechanized land - clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 9. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 10. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act 4 -3- will be followed. 11. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 12. If the permittce discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 13. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 14. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4). 15. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 16. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 17. PROJECT DESCRIPTION: JUL 0 6 2018 DCM-MHD CITY The project site is located at 201 Peninsula Drive in the Pleasure Cay Subdivision, adjacent to the Carolina Beach Yacht Basin/Myrtle Grove Sound and the Pleasure Cay boat basin, in Carolina Beach, New Hanover County. The project site consists of one lot located at the terminal end of Peninsula Drive. To locate the project site from the Wilmington Regional Office (WiRO), travel from Wilmington into Carolina Beach on Carolina Beach Road (NC Hwy 421) for approximately 12 miles south. Continue over Snows Cut Bridge for approximately 1 mile south until you reach Lewis Drive and turn left. Lewis Drive immediately turns in a northerly direction (almost a U-turn from Carolina Beach Road) and becomes Access Road. Continue on Access Road north approximately 0.12 miles until you reach Peninsula Drive, which will be located on the right. Turn right and continue to the end of Peninsula Drive, approximately 0.5 miles, until you reach 201 Peninsula Drive. The areas adjacent to the project site are developed with residential properties and docking facilities. South of the project site is a single-family residence with an existing private docking facility along the Pleasure Cay S/D basin. To the north, there are several condominium buildings which make up Harbour Point Yacht Club and an associated open water marina. Existing structures on the highground portion of the site consist of a single-family residence with associated parking. The lot is approximately 1.8 acres and averages 2 feet above normal high water. Upland vegetation on the lot consists of lawn grass with native trees and shrubs. The eastern shoreline of the property borders the Carolina Beach Yacht Basin/Myrtle Grove Sound. The high ground transitions abruptly from lawn grass to low marsh consisting primarily of Smooth Cordgrass (Spartina alterniflora). The low marsh extends towards to Carolina Beach Yacht Basin for approximately 125' then transitions to an area approximately 20' wide of higher marsh consisting primarily of Saltmeadow Cordgrass (Spartina patens). The elevation drops again to low marsh for approximately 40' until you reach the waters of the Carolina Beach Yacht Basin/Myrtle Grove Sound. Along the southern shore of the property is an existing observation pier measuring approximately 22' by 22' that is located within the Pleasure Cay S/D basin canal. The facility is shared with the neighboring lot, and until recently also included a 5' by 50' floating platform that was oriented along the existing canal bulkhead. This facility was authorized via GP-49258D issued to the property owner on 8/20/2007. The 5' by 50' float was recently removed so that the property owner could apply for a General Permit to install an observation pier along the eastern shoreline. Removal of the floating platform was necessary to comply with the rules of 07H .1200, with the knowledge that the property owner would be pursuing a Major Permit. General Permit 70881 D was issued to the property owner on 4/27/18 for the construction of a 375' by 6' fixed pier with a 20' by 20' fixed "T-head" covered platform extending in an easterly direction into Carolina Beach Yacht Basin/Myrtle Grove Sound. The structures authorized by GP 70881 D are currently under construction. No SAV or shellfish resources was observed in the project area. The Carolina Beach Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Carolina Beach Yacht Basin/Myrtle Grove Sound are classified SB by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. 10. PROPOSED PROJECT: The applicant proposes to construct a new wooden bulkhead and two private docking facilities. The eastern shoreline would be stabilized with a wooden bulkhead measuring approximately 310' in length and would be installed landward of all Coastal Wetlands. The wall would measure approximately 2.5' in height and the associated tie back system would disturb approximately 6,200 ftz of high ground. Ste*art Page 3 The application states the bulkhead would be backfilled with clean sand material that will be delivered by truck. The applicant proposes to add to the pier structure, authorized via GP 70881 D, that is currently under construction. The application states a 10' by 20' open platform area would be added to the waterward end of the authorized gazebo. A fixed pier measuring 20' by 6' would extend from the northern edge of the authorized gazebo, parallel to the channel. At the terminus of the fixed pier would be a ramp extending toward Carolina Beach Yacht Basin, perpendicular to the channel, which would provide access to a 60' by 6' floating dock. A fixed pier measuring 20' by 6' would also extend from the southern edge of the authorized gazebo, parallel to the channel. At the terminus of the fixed pier would be a ramp extending toward Carolina Beach Yacht Basin, perpendicular to the channel, which would provide access to another 60' by 6' floating dock. Halfway between the two floating docks would be three tie -pilings (See Sheets 1-2 of 2). The application states that water depths along the floating docks would range from -6.0' to-12.0'at NLW. The applicant also proposes to re -install the 5' by 50' floating dock located on the southern shore along the bulkhead for the Pleasure Cay S/D that was recently removed. As proposed the facility along the eastern shoreline would extend approximately 240' into a waterbody measuring approximately 1,650' across which would meet the''/4 width distance. The facility would also be approximately 90' landward of the existing Town of Carolina Beach Pierhead Line and approximately 180' landward of the Federal AIWW channel setback. The proposed pier would be approximately 185' away from the marina to the north, and 206' away from the facility to the south. There would be no encroachment into either adjacent 15' riparian corridor setback area. The re- installation of the floating dock within the Pleasure Cay S/D basin on the southern shore would extend approximately 7' into a canal measuring approximately 75' in width, which meets the % width distance. The application states that the two facilities would accommodate 5 vessels total, 1 vessel at the 50' floating dock and 2 vessels each at the two (2) 60' floating docks. 11. ANTICIPATED IMPACTS: The proposed bulkhead would result in the disturbance of approximately 6,200 ftz of high ground, and would be constructed landward of all wetlands. The enlargement of the two docking facilities would result in the incorporation of approximately 1,410 ft2 of Public Trust Area and Estuarine Waters. As proposed the facility along the eastern shoreline would extend approximately 240' into a waterbody measuring approximately 1,650' across which would meet the ''%width distance. The proposed pier would be approximately 185' away from the marina to the north, and 206' away from the facility to the south. Agent: Charles Duncan Location: The project site is located at 201 Peninsula drive (subdivision- Pleasure Cay) Carolina Beach, NC 28428. The shoreline distance is 363.4feet. The proposed project is adjacent to Myrtle Grove Sound and is located in the Carolina Beach Yacht Basin. Purpose & Need The primary objective of this project is to provide the property owner with a safe, functional residential docking facility for his wife, and four children (Teenagers). The proposed 2- 6'x20' fixed piers that come off the side of existing gazebo (north & south side) will only be used for access to proposed floating dock system. The proposed 2- 6'x60' floating dock system will accurately accommodate 4- 34' run about boats, and a couple of jet skis. With the current, and wind, it is nearly impossible to safely dock boats on top of one another. Especially kids. Mr. Stewart is looking to purchase a 45' boat for himself, and family providing this application is approved. In this event family, and kids will have to trailer wave runners as they see fit. If and when this takes place the larger boat will be docked inside the two &Y floating docks to provide protection for the boat and a safer loading and off- loading of family and/or goods. The property had an existing S'x50' floating dock on the canal side of property as well (south side). However, we removed the existing floating dock to come in compliance with the GP1200 in order to get started building the new 375' pier, and gazebo. (LAMA GP#i70881 Issued 4/27/2018). The new pier is currently under construction. We obtained the CAMA GP1200 to construct the pier & gazebo, while awaiting approval for this proposed CAMA Major Permit Application. The proposed floating dock system is well within the pier headline and is also 40 plus feet from either side riparian corridor line. We are also proposing to replace and reinstall the 5'x50' floating dock that will be located on the south side of property in the man-made creek. The property owner & his wife have elderly parents, that visit them time to time. With this said by reinstalling the new 5x50' floating dock will eliminate the elderly folks from walking down a 400' pier. This dock will also be used for the kids to tie up temporarily if the wind and/or current is moving the same direction. Another words the 5'x50' floating dock will be used for temporary use only. This dock is labeled transit dock on proposed drawings. We are proposing to construct a small wood bulkhead to protect the said property in the event of a major hurricane. Also, the water currently enters the backyard during full moon tides. This proposed wood bulkhead will only be 2.5' tall but will serve a great deal of protection to property. This proposed bulkhead will be constructed landward of any coastal wetlands. All proposed construction will occur well within the designated pier headline, and clear of any local or federal navigation channel setbacks. The proposed bulkhead will have tiebacks every 8' that will run MY landward of proposed bulkhead. We are proposing to bring in a clean sandy type material for backfill of this proposed bulkhead prior to construction. Lastly we are proposing to add 10'x20' platform / open deck on the east end of the 21Yx2U gazebo.
