Drive, in Carolina Beach as requested in the permittee's application letter dated 10/16/18, including
attached workplan drawing (1) Sheet 1 dated revised 10/16/18.
This permit, issued on October 18, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

or civil action; or may cause the permit to oe nun ana vota.
1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
docking facility, all as expressly and specifically set forth in the attached letter and workplan
drawings. Any additional land disturbing activities and/or construction may require a modification of
this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this
determination.
2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
(See Attached Sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DEQ and the
Chairman of the Coastal Resources Commission.

ADDITIONAL CONDITIONS
3) This Minor Modification shall be attached to the original of Permit 99-18, which was issued on 8/27/18,
and copies of both documents shall be readily available on site when Division personnel inspect the
project for compliance;
4) All conditions and stipulations of the active permit remain.in force under this Minor Modification unless
specifically altered herein.
NOTE: This permit does not eliminate the, need to obtain any additional state, federal or local. permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity.for this determination. The-permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action ID No. SAW-2018-
1401/201.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018-
0956.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

SUBJECT Permit Modification Request to State Permit No. 9948, Jeff and Jennifer Stewart, 201
Peninsula Drive, Carolina Beach, in New Hanover County
Mr. Charles Duncan, acting as agent for Jeff and Jennifer Stewart, is requesting a Minor Modification to
State Permit No. 99-18 for the reconfiguration of their authorized docking facility located at 201
Peninsula Drive in the Pleasure Cay S/D, Carolina Beach. This request was submitted in a letter dated
October 16, 2018. The applicant is requesting to shift two authorized 6' by 20' fixed walkways and the
associated 60' by 6' floats out to the waterward end of the existing fixed platform (See attached drawing
page 1 of 2). The two - 6' by 20' fixed walkways extend parallel to the shoreline from the north and south
edges of the fixed platform. From the waterward end of each of the fixed walkways a 6' by 60' float
extends perpendicularly to the shoreline. This configuration creates a U-shaped docking facility, and
would result in the floats being in deeper water. All proposed work would occur landward of the USACE
Federal Channel setback and the Town of Carolina Beach pierhead line. No other work is proposed.
State Permit No. 99-18 was originally issued August 27, 2018 for the construction of a new private
docking facility within the Carolina Beach Yacht basin, and construction of a second docking facility
within the Pleasure Cay S/D boat basin. At this time, the Yacht Basin facility is currently under
construction. State Permit No. 99-18 is due to expire on December 31, 2021. This office has no objection
to the modification of State Permit No. 99-18, provided it is consistent with all other state and federal
regulations. Mr. Charles Duncan has submitted a check (check No. 8260) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE provide any comments that your agency
may have on the proposed project to Courtney Spears of DCM's Wilmington office within 14 days
of receipt of this memo.

Dear Patrick,
I am requesting to modify active major permit number 99-18 Issued to Jeff & Jennifer
Stewart, PO Box 315 Carolina Beach, NC 28428. The project address is 201 Peninsula
Drive, Carolina Beach, NC 28428.
On the original drawings we showed the 2- 6'x2O' fixed piers coming off middle of
gazebo. Now that we have gazebo built, and open deck on end built, it will work a lot
safer for the 2- 6'x20' fixed piers to come off the sides of the open deck end of platform
as shown on attached drawing. In moving the fixed piers out waterward will mean the
floating docks will move waterward as well. The total move waterward is approx. 20'
feet, which is well within all setbacks.
The above stated is the only change we are proposing for this major permit #99-18 at this
time. If you need anything further please let me know. Thank you much.

As long as they do not encroach in the setback we have no comments or objections on the project. Again, on their
drawing they have something called existing pierheadline. The corps of engineers does not recognize any pierheadlines
in this areas. I think they are calling the setback pierhead but hard to know for sure.

Please see attached revised plan for the proposed docking facility at 201 Peninsula Drive in Carolina Beach. Looks like
they want to push the floats further out towards the channel, but will still be outside the setback. Does Nav have any
comments or objections?

Hope you fared the storm well and are on the way back to normal. Just got a quick question for you. We issued a CAMA
Major Permit to Jeff and Jennifer Stewart at 201 Peninsula Drive in CB (you processed it as a 291- Action ID SAW-2018-
1401/201). Charles Duncan, the contractor is asking if they can move the floats out further into the water body (see
attached). Would this require additional authorization from the Corps? I know you're probably swamped, but Debbie
wanted me to run it by you before we can determine with we can do a refinement or a modification.
