Docking Facility Expansion 1) This permit authorizes only the mooring pilings and uses located in or over the water that are expressly and specifically set forth, in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to . project initiation. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2018-01715) issued 9/24/18. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 18-1190. Future development of the permittee's property may require amodification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any .such activity for this determination, The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. Mr. Stallings is planning to purchase a larger vessel 36' to 40' and is requesting to drive three pilings for a third slip, a wet slip, with the dimensions of 20' wide x 50' long. Normal water levels/depths in the vicinity of the proposed slip will support the use of this slip by a vessel proposed by the applicant. When the tide is blown out, movement of this vessel could result is some minor bottom disturbance but in my opinion, those impacts will minimal. Therefore, DCM staff in the Washington office recommend issuance of the permit. Stallings DATE: August 21, 2018 RECEIVE® AUG 2 1 2018 MP SECTION MH© Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood Damage Prevention Ordinance (see policy 2.23). Overview: The 3-acre site is -located at 646 Mordecia Lane adjacent to Ashton Gut off North Creek in Beaufort County. The site has 180' of shoreline. Existing site improvements include a modular home on pilings, a septic system, bulkhead, pier with a L-head platform, and a catwalk between two open boatlifts. The site is approximately ±3' above NWL. The site is mostly vegetated with mature hardwood trees including loblolly pines, various oaks, and sweet gum. The high ground adjacent the shoreline where the bulkhead was built is flanked by a high march vegetated primarily with black needlerush (Juncus roemerionus). The applicant is proposing to drive three (3) pilings to create a third slip (20' wide x 50' long). The third slip will be a wet slip located on the north side of the pier. The pilings will be offset from the pier to the north 20' and will be spaced 25' apart. AECs involved include: Estuarine Water and Public Trust Area. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Ashton Gut is classified as C Sw NSW, is a Primary Nursery Area, and is closed to shellfishing. The site is in Special Flood Hazard Area AE (EL7) according to the Beaufort County FIRM (Map # 3720569400J Panel 6682). There was no SAV observed in the nearshore of the project area, however DCM staff observed its presence nearby. A review of shellfish and archaeological/cultural resources in the area was not provided. Basis for Determination: The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land Use Map (FLUM) classifies the site as Transition (land), Conservation I (Estuarine Waters AEC and water protected by Tar -Pam Buffer), and Conservation II (100-year flood plain). The following LUP policies may be applicable to this request: 2.1 Conservation I 2.1.3 Only development and land/water use activities that are consistent with the use standards for coastal wetlands, estuarine waters, and public trust areas (15A NCAC 07H .0208) are allowed in this classification. The proposed project involves the installation of pilings for a boat slip located at the Fisherman Cove Subdivision near Bath, NC. Staff review of the plans and specifications has determined that the project, as proposed, consists of activities that will not pose surface water quality threats from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing water quality threats from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 2H.1000. For this reason, we are informing you by way of this letter that the current project will not require a State Stormwater management permit. The stormwater rules require the Division to permit the common plan of development, therefore, any future development on the property, regardless of whether a SEC plan or CAMA Major permit is also required, will require a Stormwater Management Permit application and permit issuance from the Division of Energy, Mineral, and Land Resources prior to any construction. Any construction on the subject site, prior to receipt of the required permit, will constitute a violation of 15A NCAC 2H.1000 and may result in appropriate enforcement actions by this Office. RECEIVED AUG 2 0 2018 nrm-P"F1D CITY Jimmy Stallings Ashton Gut Bath Beaufort County Project Setting The 3-acre project site is lot 1 in the Fisherman Cove residential subdivision located off SR 1732 at 646 Mordecia Lane adjacent Ashton Gut off North Creek near Bath in Beaufort County, North Carolina. Fisherman Cove is a wooded tract that has been subdivided recently. A modular home on pilings has just been constructed on the project site. CAMA/Dredge and Fill general permit no. 70612-B issued on 8 November 2017 authorized the construction of a bulkhead and a 6' x 100' pier with a 16' x 24' L-head platform, a 3' x 24' catwalk between 2- 13' x 13' open boatlifts. All authorized work has been completed in compliance with the permit. The lot has an elevation of t3' above the normal water level (NWL) and is vegetated with mature hardwood trees including loblolly pines, various oaks and sweet gum. The lot has 180' of shoreline. The highground adjacent the shoreline where the bulkhead was built is flanked by a high marsh vegetated primarily with black needlerush Quncus roemerianus). The highground forms a point on the shoreline and is where the pier was constructed. Water depths in the location of the new pier range from 4' to 5' in the vicinity of the existing boatlifts. There was no submerged aquatic vegetation (SAV) observed in the nearshore of the project area, however DCM staff have observed its presence nearby. The bottom of Ashton Gut in the project area is best characterized as soft, dark and organic sediment. Ashton Gut is designated as a primary nursery area (PNA) by the Marine Fisheries Commission and C Sw NSW by the Environmental Management Commission and is closed to shellfishing. Project Description The applicant is proposing to drive three pilings to create a third slip with the dimensions 20' wide x 50' long. The third slip will be a wet slip located on the north side of the pier. The pilings will offset from the pier to the north 20' and will be spaced 25' apart. The applicant is interested in purchasing a motorboat 36' to 40' long, with abeam of t14' and a draft of f3.3'.
