Bay Drive, Southport , as requested in the permittee's application dated 0/18 (MP-1), 4/10/18 (MP-4), incl. attached workplan drawings (2), 2 of 4 dated 3/22/18, and 4 of 4 dated 2/19/18. This permit, issued on May 10, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to lines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Southport Waterfront Properties, LLC Permit No. 47 •18_ Page 2 of 3 ADDITIONAL CONDITIONS 3) The pennittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 8 formalized boat slips. Docking space on the landward side of the floating dock is not authorized under this permit. Cleats shall not be installed on the landward side of the floating dock. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility shall extend into the federal channel setback. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. Easement 9) The permittee is required to apply for and receive an Easement from the Department of Administration's State Property Office as required under N.C.G.S. 146-12(e). The easement shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. General 10) Prior to the occupancy of any of the slips authorized under this permit, the permittee shall remove all existing pilings within the permittee's riparian corridor. 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. Recommendations for State Permit — Southport Waterfront Properties, LLC 2/26/2018 The total platform area was calculated as follows: Shoreline length = 110' x 8' = 880 ftZ (max allowable) Access pier = not calculated due to alignment and dimensions Finger piers (5) = 2 (68' x 4') and 3 (20' x 4') = 784 ftZ Total = 784 It" It is the staff s recommendation the construction of the docking facility would provide docking space for a total of twenty (20) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(bx6), including the similar pier length rule, the eight -square foot rule and the pier width rule. The docking facility would not encroach into either 15' riparian setback nor the USACE setback. Water depths at slips 1 through 3 on the landward side of the 4' x 68' finger pier may be inadequate during the lower stages of the tide. Patrons wishing to dock or leave this area when water depths are insufficient may cause propeller kicking to the river bottom. This would result in temporary suspended sediments and deepening on the natural shoreline which may have impacts on biological processes and organisms within the immediate area. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. It is recommended that any permit issued should include standard conditions for docking facilities. In general, Southport allows development in CBD/Mixed Use classified AECs, which is consistent with the State's minimum use standards. The Southport Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. The project site is located at 319 W. Bay Street adjacent the Cape Fear River in Southport, NC. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stai 401, as amended; 16 U.S.C. 661 et soil). The applicant proposes to construct a 20-slip commercial docking facility associated with the Frying Pan Restaurant. The facility is proposed to only be used during restaurant hours and not for overnight docking. Current water depths are stated to be between 2' and -I I' NLW for Slips 4-20 and between -1' to -2' NLW for Slips 1-3. The Cape Fear River at this location is classified SC by the Environmental Management Commission. The NCWRC has reviewed the project proposal and has concern with several of the slips and their water depths. Slips 1-7, 19, and 20 appear to have minimal water depths and likely would lead to hull scraping, prop scow, and chronic bottom disturbance if constructed. We recommend the applicant consider reconfiguring or reducing the number of slips to address this concern. Since the facility can moor greater than 10 vessels, a marina management plan should also be developed that addresses docking, spills, what spill control and clean-up equipment will be available, and minimally identifies whether a trained dock master will monitor the area. Page 2 9. PROJECT DESCRIPTION: The project site is located at 319 West Bay Street, adjacent to the Cape Fear River, in Southport, Brunswick County. To find this project site, travel south on US Highway 17 to NC Highway 133 South. Travel approximately 23.75 miles south and turn left on to N. Howe St./NC Highway 211. Turn right at the end of N. Howe St. on to West Bay Street. Travel approximately 0.2 miles to the end of West Bay Street and the property will be located on the left at the intersection of West Bay Street and Yacht Basin Drive. The project site consists of four adjacent parcels with a total area of approximately 0.68 acres and consists of an existing restaurant and gravel/dirt parking area. West Bay Street lies to the north of the property and Yacht Basin Drive lies to the West. The adjacent property to the east is currently used as an overflow parking area and has a 3- slip private docking facility that lies 2 P from the property line. To the south of the property is the Cape Fear River and remnant pilings from a previous docking facility. The application states that project site has approximately 110 linear feet of shoreline frontage and averages 6' above the Normal Water Level. The area waterward of Frying Pan Restaurant contains highground vegetation consisting of ornamental palm trees, a wax myrtle (Myrica cerifera), and a few woody shrubs. The property also contains a patch of high coastal marsh vegetation consisting of Common Reed (Phragmites australis), Salt Meadow Hay (Spartina patens), and Spikegrass (Distichlis spicata)._There is also a berm between the marsh area and NHW that consists of Sea Oats (Uniola paniculata) and Goldenrod (Solidago sempervirens). Flooding of the marsh seems to originate from the properties immediately to the east. The project site was previously the location of the American Fish Company owned by Charles H. Perry and contained a dock and fish house operating back to before the 1980's. To the west side of the property adjacent to where Yacht Basin Drive is currently was a railway that lead to a commercial boat slip that was originally used for boat repairs. In 1981, state permit #26-81 authorized access dredging to convert the old boat repair rail in to an access channel for offloading and shipping wholesale fish and shellfish. The permit also included a new bulkhead and new docking area and mooring pilings to improve fish unloading operations. The City of Southport 2016 Land Use Plan classifies the highground as Commercial the adjacent waters of the Cape Fear River are classified SC by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a 20-slip commercial docking facility for use by the public to access the restaurant during open hours. The application states that the structure would consist of a fixed elevated pier measuring 48' in length by 6' in width with a fixed finger pier measuring 68' in length and 4' in width located in the middle of the 6' wide pier and running parallel to the AIW W heading east. Continuing from the end of the 6' wide fixed access pier would be a fixed pier measuring 40' in length and 4' in width with an "L"-head pier measuring 68' in length and 4' in width running parallel to the AIWW. The 68' by 4' fixed pier would also have three 20' in length by 4' in width finger piers extending landward towards shore. According to Sheet 2 and 3 of 4, the current water depths at the proposed docking facility would range between 2' above NLW and -I 1' below NLW. Slips 1-3 on the landward side of the 4' x 68' finger pier would have a water depth of -1' to 2' at NLW. The applicant states that the docking facility will only operate during restaurant hours and will not be used for overnight docking.
