This permit, issued on November 14, 2018 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
)i mese terms may De suoject to nnes, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) The perrnittee shall install and maintain at his expense any signal lights or signals prescribed by the
U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum,
permanent reflectors shall be attached to the structure in order to make it more visible during hours of
darkness or inclement weather.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
This permit authorizes a maximum of 1 formalized boat slip.
The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides,along with benches and knee walls are
permitted. Lattice is specifically excluded from being used under this authorization.
The roof of the gazebo shall not be designed for second story use.
" .No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
Groin Field
The locations of the authorized groins shall be verified by a representative of the Division of Coastal
Management within a maximum of 30 days prior to the start of construction. Failure to initiate
construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the
alignment to be re -staked by DCM within a maximum of 30 days prior to the new expected start of
construction.
The groins, as depicted on the attached workplans, shall not extend more than 25 feet waterward of the
normal water level at the time of construction.
Upland Development
Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities
associated with the development of the above referenced property, including the removal and
construction of the two sets of stairs and the removal of the attached deck associated with the single
:family residence, all as expressly and specifically set forth in the attached permit application and
workplan drawings.
General
No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved groin field
alignment.
If the crossing of wetlands with mechanized construction equipment is necessary, temporary
construction mats shall be utilized for the areas to be crossed. The temporary mats shall be removed
immediately upon completion of construction.
This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.

The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
E: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2018-01480) issued 11/13/18. .
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 18-1009.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 264-3901 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water"level.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit —
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Recommendations
The applicant proposes to stabilize the property's natural shoreline by installing 12 groins and
then constructing a 200' long, one -slip docking facility within the waters of the Albemarle
Sound.
The site of the proposed development is located at 212 Harbinger Ridge Road (SR#1103),
Harbinger, Currituck County, adjacent to the Albemarle Sound.
The development proposal involves the Public Trust Area (PTA), Estuarine Waters (EW), and
Estuarine Shoreline (ES) Areas of Environmental Concern (AEC's).
I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this
project and my findings are as follows:
15A NCAC 07H.0208 Use Standards
Paragraph (a) addresses General Use Standards, and sub -paragraph (1) precludes uses that are
not water dependent within the EW and PTA and lists uses that may be considered water
dependent.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(A) states that the location, design, and need for development, as well as the
construction activities involved shall be consistent with the management objective of the
Estuarine and Ocean System AEC and shall be sited and designed to avoid significant adverse
impacts upon the productivity and biologic integrity of coastal wetlands, shellfish beds, RECEIVED

submerged aquatic vegetation as defined by the Marine Fisheries Commission, and spawning
and nursery areas.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(B) states that development shall comply with state and federal water and air
quality standards.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(C) states that development shall not cause irreversible damage to documented
archaeological or historic resources as identified by the N.C. Department of Cultural Resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(D) states that development shall not increase siltation.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(E) states that development shall not create stagnant water bodies.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(F) states that development shall be timed to avoid significant adverse impacts
on life cycles of estuarine and ocean resources.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (a)(2)(G) states that development shall not jeopardize the use of the waters for
navigation or for other public trust rights in public trust areas including estuarine waters.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (b) addresses Specific Use Standards. Of these, subparagraphs (6) Piers and Docking
Facilities and 9 Groins pertain to this project, and those subparagraphs not listed are not
applicable to this project.
Paragraph (6) Piers and Docking Facilities
Subparagraph (6)(A) states that piers shall not exceed six feet in width. Piers greater than six
feet in width shall be permitted only if the greater width is necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur.
Consistent: The proposed development is consistent with the intent of this rule.

Subparagraph (6)(B) states that the total square footage of shaded impact for docks and mooring
facilities (excluding the pier) allowed shall be 8 square feet per linear foot of shoreline with a
maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips
shall not be counted in the total. Projects requiring dimensions greater than those stated in this
Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve
public access, or to support a water dependent use that cannot otherwise occur. Size restrictions
do not apply to marinas.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(C) states that piers and docking facilities over coastal wetlands shall be no
wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as
measured from the bottom of the decking.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(E) states that the total area enclosed by an individual boat lift shall not exceed
400 square feet except to accommodate a documented need for a larger boat lift.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(F) states that piers and docking facilities shall be single story. They may be
roofed but shall not be designed to allow second story use.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(G) states that pier and docking facility length shall be limited by:
(i) not extending beyond the established pier or docking facility length along the same shoreline
for similar use; (This restriction does not apply to piers 100 feet or less in length unless
necessary to avoid unreasonable interference with navigation or other uses of the waters by the
public);
Consistent: The proposed development is consistent with the intent of this rule.
(ii) not extending into the channel portion of the water body;
Consistent: The proposed development is consistent with the intent of this rule.
(iii) not extending more than one-fourth the width of a natural water body, or human -made canal
or basin. Measurements to determine widths of the water body, canals or basins shall be made
from the waterward edge of any coastal wetland vegetation that borders the water body. The
one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or
a local government in consultation with the Corps of Engineers, has established an official
pier -head line. The one-fourth length limitation does not apply when the proposed pier is located
between longer piers or docking facilities within 200 feet of the applicant's property. However,

the proposed pier or docking facility shall not be longer than the pier head line established by the
adjacent piers or docking facilities, nor longer than one-third the width of the water body.
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (6)(I) states that piers and docking facilities shall not interfere with the access to
any riparian property and shall have a minimum setback of 15 feet between any part of the pier
or docking facility and the adjacent property owner's areas of riparian access.
Consistent: The proposed development is consistent with the intent of this rule.
Paragraph (9) Groins
Subparagraph (9)(A) states, "Groins shall not extend more than 25 feet waterward of the normal
high water or normal water level unless a longer structure is justified by site specific conditions
and by an individual who meets any North Carolina occupational licensing requirements for the
type of structure being proposed and approved during the application process."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (9)(B) states, "Groins shall be set back a minimum of 15 feet from the adjoining
riparian lines. The setback for rock groins shall be measured from the toe of the structure. This
setback may be waived by written agreement of the adjacent riparian owner(s) or when two
adjoining riparian owners are co -applicants. Should the adjacent property be sold before
construction of the groin commences, the applicant shall obtain a written agreement with the new
owner waiving the minimum setback and submit it to the permitting agency prior to initiating
any development of the groin."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (9)(C) states, "Groins shall pose no threat to navigation."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (9)(D) states, "The height of groins shall not exceed one foot above normal high
water or normal water level."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (9)(E) states, "No more than two structures shall be allowed per 100 feet of
shoreline unless the applicant provides evidence that more structures are needed for shoreline
stabilization."
Consistent: The proposed development is consistent with the intent of this rule.

Subparagraph (9)(F) states, ""L" and "T" sections shall not be allowed at the end of groins."
Consistent: The proposed development is consistent with the intent of this rule.
Subparagraph (9)(G) states, " Riprap material used for groin construction shall be free from loose
dirt or any other pollutant and of a size sufficient to prevent its movement from the site by wave
and current action."
Not applicable: The proposed groins will be constructed with wood sheeting.
Based on my review of the applicable subsections of the North Carolina Administrative Code,
the permit application and plans, I recommend a permit be issued to Southern Properties of
Virginia, LLC, c/o Rick Sumner for the development as proposed.

You have our approval for the impacts listed below for the purpose described in your application dated July 17, 2018
and received by the Division of Water Resources (Division) on July 20, 2018. These impacts are covered by the
attached Water Quality General Certification Number 4144 and the conditions listed below. This certification is
associated with the use of CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of
Engineers (USACE). This Certification allows you to use the CAMA Major Permit when the Division of Coastal
Management Issues it. Please note that you should get any other federal, state or local permits before proceeding
with your project, including those required by (but not limited to) Sediment and Erosion Control, Non -Discharge,
and Water Supply Watershed regulations.

4. Turbidity Standard
The Permittee shall adhere to Title 15A NCAC 02B .0222 Tidal Salt Water Quality for SB Waters and
the water quality standards applicable to Class SC waters as described in Rule .220, including but
not limited to:
(g) pH: shall be normal waters for the waters in the area, which generally shall range between
6.8 and 8.5 except that swamp waters may have a pH as low as 4.3 if it is the result of natural
conditions; [15A NCAC 02B .0220(g)]
(1) Turbidity: the turbidity in the receiving waters shall not exceed 25 NTU; if turbidity exceeds
this level due to natural background conditions, the existing turbidity level shall not be
increased. Compliance with this turbidity standard can be met when land management
activities employ Best Management Practices (BMPs) [as defined by Rule .0202 of this
Section]. BMPs must be in full compliance with all specifications governing the proper design,
installation, operation and maintenance of such BMPs; [35A NCAC 02B .0220(I)]

SUBJECT: Major Permit Request by Southern Properties of Virginia, LLC to install twelve (12)
groins and a 6 foot wide by 188 foot long pier with an 18 foot by 12 foot platform,
a 14 foot by 14 foot roof, and a 13 foot by 13 foot boat lift; on the Albemarle Sound
at 212 Harbinger Ridge Road, in the Harbinger community, in Currituck County.
DATE: July 26, 2018
Consistency Determination: The request is consistent with/not in conflict with the Currituck
County 2006 Core Land Use Plan (LUP) certified by the CRC on
May 18, 2007 as amended through June 24, 2009.
Overview: The 33.7 acre subject property has 1,400 linear feet of shoreline along the Albemarle
Sound. Approximately 370 linear feet of shoreline contains highground, with the remainder
consisting of Section 404 Wetlands. The property is primarily made up of Section 404 Wetlands.
The highground has an elevation of 3 feet above Normal Water Level (NWL). The property is
located in the AE floodzone. The outlet of a large drainage ditch is located on the southeast area
of the property. The ditch is .5 mile in length and extends from the north side of Harbinger Ridge
Road, through wetlands, across 515 feet of the subject property to the Albemarle Sound. The
ditch was open to the sound as recently as March 2017, but is current disconnected from the
sound by a 50 long naturally formed sand plug.
Existing site improvements consist of a single-family house and two (2) man-made ponds. AA
mile dirt driveway connects the house, located on highground adjacent to the sound, with
Harbinger Ridge Road. Existing shoreline improvements consist of 80 linear feet of bulkhead and
six (6) groins extending 25 feet waterward of NWL. The bulkhead is located along highground
shoreline near the house. The groins are spaced 50 feet apart. The remaining shoreline is natural
and adjacent to Section 404 wetlands or sandy beach areas. CAMA Minor Permit #M18-01 was
issued in February 2018 to raise the house and place fill underneath.

Installation of twelve (12) groins and a 6 foot wide by 188 foot long pier with an 18 foot by 12 foot
platform, a 14 foot by 14 foot roof, and a 13 foot by 13 foot boat lift is proposed. The groins will
extend 25 feet waterward of NWL, 5 feet landward, and will be spaced 50 feet apart. Groin height
will be 1 foot above NWL. Water depths at the groin locations range from .5 to 1.5 feet above
NWL. Eight (8) of the groins will extend landward into Section 404 wetlands. One (1) boat slip
will be provided. Water depths at the pier terminus are approximately 3.5 feet below NWL.
The waters of the Albemarle Sound in this area are classified as Joint and SB and are closed to
shellfish taking. Submerged Aquatic Vegetation (SAV) was not observed growing in the project
area. Based on available information, there are no archaeological sites on this property or nearby.
A review of potential historic resources was not provided.
Anticipated Impacts resulting from this project are expected to include: the disturbance of 300
sq. ft. of Public Trust Area/Estuarine Waters Area of Environmental Concern (AEC), 40 sq. ft. of
Section 404 Wetlands within the Estuarine Shoreline AEC, and 20 sq. ft. of Estuarine Shoreline
AEC, and, the shading of 1,386 sq. ft. of Public Trust Area/Estuarine Waters AEC.
Basis for Determination:
The site is designated as "Limited Service Areas (Areas Preferred for Low Density Development)"
on the Currituck County Future Land Use Map (FLUM); with Areas of Environmental Concern
(AECs) designated as "Conservation Areas' as indicated on Page 11-1. Section 404 wetlands are
also included in the Conservation designation. The site is also located within the "Point Harbor'
sub area.
As indicate on Page 11-1, "(t)he purpose of the Conservation class is to provide for the long-term
management and protection of significant, limited, or irreplaceable areas. Proper management is
needed to conserve the natural, cultural, recreational, scenic or biologically productive values of
these areas. The Conservation class should be applied to areas that should not be developed at
all (preserved), or if developed, done so in a very limited manner characterized by careful planning
and cautious attention to the conservation of environmental features."
Definitions of key words are provided on page 9-2. These words include "Encourage: to favor or
foster", "Should: Ought to, if no valid reason not to", and "Support: to shore up, may imply financial
support".

Policy ES2, Page 9-5.
"NON -COASTAL WETLANDS, including FRESHWATER SWAMPS, AND
INLAND, NON -TIDAL WETLANDS, shall be conserved for the important role
they play in absorbing floodwaters, filtering pollutants from stormwater runoff,
recharging the ground water table, and providing critical habitat for many
plant and animal species. Currituck County supports the efforts of the U. S.
Army Corps of Engineers in protecting such wetlands through the Section
404 permit program of the Clean Water Management Act as well as Section
403 water quality certifications by the State of North Carolina."
Policy ES4, Page 9-6.
"in approving new developments, Currituck County shall support the retention
or creation of a vegetated buffer along ESTUARINE SHORELINES as a
simple, effective and low-cost means of preventing pollutants from entering
estuarine waters. Exceptions to this requirement may include developments
involving pre-existing man-made features such as hardened shorelines,
ditches, and canals. ...The County also supports CAMA use standards for all
COASTAL SHORELINES, whether estuarine or otherwise."

"Uses allowed in ESTUARINE WATERS must be water dependent (public
access, docks, piers, erosion control, and other CAMA-approved uses) and
must not interfere with the proper function, cleanliness, salinity, and
circulation of the resource..."
Policy ES6, Page 9-6.
"The location and design of piers and docks shall not unduly interfere with the
rights of the public to the free and unobstructed use of PUBLIC TRUST
WATERS for navigation, fishing, and other uses. Efforts to limit the length of
piers into public trust waters shall be supported."
Natural Hazard Areas:

'The County recognizes the risks to life and property that exist within
SPECIAL FLOOD HAZARD AREAS (i.e. areas having a 1 % chance of

Dear Mr. Huggett:
Reference the application of Mr. Rick Sumner to construct twelve 25-foot groins and
construct a 188' x 6' dock with an associated 12' by 18' dock along the shoreline located at 212
Harbinger Ridge Road, adjacent to the Currituck Sound, in Harbinger, Currituck County, North
CarolinaCounty, North Carolina.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. All work authorized by this permit must be performed in strict compliance with the
attached plans, which are a part of this permit. Any modification to these plans must be approved
by the US Army Corps of Engineers (USACE) prior to implementation.
2. The permittee understands and agrees that, if future operations by the United States
require the removal, relocation, or other alteration, of the structure or work herein authorized, or
if, in the opinion of the Secretary of the Army or his authorized representative, said structure or
work shall cause unreasonable obstruction to the free navigation of the navigable waters, the
permittee will be required, upon due notice from the U.S. Army Corps of Engineers, to remove,
relocate, or alter the structural work or obstructions caused thereby, without expense to the
United States. No claim shall be made against the United States on account of any such removal,
relocation, or alteration. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE
Chief Source Data Unit N CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-
3282 at least two weeks prior to beginning work and upon completion of work.
3. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
4. Except as authorized by this permit or any USACE approved modification to this permit,
no excavation, fill or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project, within waters or wetlands. This permit does not
authorize temporary placement or double handling of excavated or fill material within waters or
wetlands outside the permitted area. This prohibition applies to all borrow and fill activities
connected with this project.
5. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in
trace quantities. Metal products, organic materials (including debris from land clearing
activities), or unsightly debris will not be used.
6. The authorized structure and associated activity must not interfere with the public's right
to free navigation on all navigable waters of the United States. No attempt will be made by the
permittee to prevent the full and free use by the public of all navigable waters at or adjacent to
the authorized work for reason other than safety.
7. The permittee shall advise the Corps in writing at least two weeks prior to beginning the
work authorized by this permit and again upon completion of the work authorized by this permit.
8. The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide
each of its contractors and/or agents associated with the construction or maintenance of this
project with a copy of this permit. A copy of this permit, including all conditions, shall be
available at the project site during construction and maintenance of this project.
9. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit
area. This shall include, but is not limited to, the immediate installation of silt fencing or similar
appropriate devices around all areas subject to soil disturbance or the movement of earthen fill,
and the immediate stabilization of all disturbed areas. Additionally, the project must remain in
full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North
Carolina General Statutes Chapter 113A Article 4).
10. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that
the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by
the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all
saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not
considered significant.
11. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District
U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation.

8. PROJECT SUMMARY: The applicant proposes to stabilize the property's natural
shoreline by installing 12 groins and then constructing a 200' long, one -slip docking
facility within the waters of the Albemarle Sound.
Proiect Settin
The site of the proposed development is located at 212 Harbinger Ridge Road (SR#1103),
Harbinger, Currituck County, adjacent to the Albemarle Sound.
The property is±33.7 acres in size and is predominantly made up of USACE 404-wetlands. An
existing soil road located on the eastern side of the property extends ±.4 miles from Harbinger
Ridge Road to highground area adjacent to the Albemarle Sound. The highground area has an
elevation of ±3' above NWL and is the location of a single-family dwelling and two man-made
ponds. CAMA Minor Permit #M18-01 was issued on 2/9/2018 to raise the dwelling and place fill
material under it. According to the USDA's Natural Resources Conservation Service's Web Soil
Survey, the nearshore soil on the property is made up of Conetoe loamy sand (CnA), Tomotley
fine sandy loam (To) and Wasda muck (Ws). Based on available information, there appears to
be no archaeological sites on this property or nearby.
The properties shoreline is ±1,400' in length, of which ±370' is adjacent to the non -wetland
highground area. This section has been hardened with ±80' of bulkhead located adjacent to the
dwelling and has 6 existing groins that extend 25' waterward of normal water level (NWL) that
are spaced 50' apart. The remaining shoreline is natural and adjacent to USACE 404-wetlands
or sandy beach areas.
The outlet of a large drainage ditch known as Owens Ditch is located in the southeast area of
the property. This ditch is ±0.5 miles in length and extends from the north side of Harbinger
Ridge Road through wetlands to the Albemarle Sound. Google earth imagery shows the ditch
open to the Sound in March of 2017; however, the ditch is currently disconnected from the
Sound by a naturally formed sand plug that is >_50' in length.
The Albemarle Sound is classified as Joint Waters by agreement with the Marine Fisheries
Commission and Wildlife Resources Commission. The Division of Environmental
Management's water quality classification for the Albemarle Sound is SB and it is closed to
shellfish taking. Water depths within the project area range from ±0.5' to ±3.5' below NWL and
the bottom substrate is predominantly fine sands with some exposed areas of clay and has
extensive areas of cypress and other tree stumps located in the nearshore area.
A Submerged Aquatic Vegetation (SAV) survey was conducted 5/24/2018 by Quible &
associates, P.C. that found no SAV growing within the project area.
The adjacent riparian property to the northwest has a natural shoreline that is adjacent to 404-
wetlands and is similarly developed in the highground areas. The adjacent property to the
southeast is undeveloped wetlands designated as open space for the Cypress Point II
subdivision.

Development Proposal
The applicant proposes to further stabilize the shoreline through the addition of 12 groins to the
north and south of the existing groins. The groins will extend 25' waterward of NWL and 5'
landward and will be spaced ±50' apart. The proposed groin height is V above NWL and water
depths at the groin locations range from ±.5' to 1.5' below NWL. Eight of the proposed groins
will extend landward into USACE 404-wetlands.
To provide water access, the applicant is proposing a one -slip docking facility that will extend
from the center of the existing bulkhead. The facility will be comprised of a 188'x6' pier with an
18'x12' platform in a "L" configuration (partially covered with a 14'x14' roof) and a 13'x13'
boatlift.
Water depths at the docking facility location are shallow near shore and gradually reach a
depth of ±3.5' below NWL approximately 80' waterward of NWL. A sandbar is located ±100'
waterward of NWL where water depths become ±2.5'. Water depths begin to increase again
±150' waterward of NWL where depths gradually reach ±-3.5' below NWL and remain
consistent. It should be noted that the area between NWL and the sandbar is full of remnant
tree roots and stumps. SAV was not observed growing within the area of the proposed docking
facility (Water depths and SAV presence field verified on 7/11/2018). The proposed docking
facility meets the Y4 width rule and does not encroach within the 15' setback. The nearest
docking facility of a similar length is located ±1.8 miles to the north.
Anticipated Impacts
The construction of the groins will result in the disturbance of ±300 ft2 of shallow bottom
located in the Estuarine Waters and Public Trust Area AEC's.
The construction of the groins will result in ±20 ft2 of non -wetland area disturbance within
the Estuarine Shoreline AEC.
The construction of the groins will result in ±40 ft2 of USACE 404-wetland disturbance within
the Estuarine Shoreline AEC.
. The proposed docking facility will result in one boat slip and the shading of ±1,386 ftz of
Estuarine Waters and Public Trust Area AEC's.

SAV Survey
On Thursday May 24, 2018, Rubino from Quible performed an SAV survey of the Project Area.
The substrate of the nearshore area was predominately a rippled sand with some exposed clay,
with extensive cypress and other submerged tree stumps from the existing shoreline, extending
at least 75 ft into the Sound. The water depths along the proposed jetties is 0.5 ft to 1.5 ft deep
on average. When the wind tides are low in this area, there is little to no water where these
jetties are proposed. These water depths do not allow SAV to grow due to fluctuations in low
water level. There was no SAV observed in these areas on May 24'h. Along the proposed pier
alignment, there was no SAV encountered either. In this area, a snorkel and mask was used to
clearly view the bottom conditions since water visibility was only about 1.5 ft deep. The finding
of no SAV in this area is consistent with an SAV survey of a broad area along the same water
body in a nearby area from 2017. While no SAV has been observed in this area, SAV is well
documented several miles to the north near the mouth of the North River and several miles to
the east, on the east shore of the Albemarle and Currituck Sounds.

Existina Conditions
The site is a 33.7 acre tract located at 212 Harbinger Ridge Rd. in Harbinger, Currituck County,
NC. The tract fronts along the Albemarle Sound and the owner of the tract is Southern
Properties of Virginia, LLC, C/O Mr. Rick Sumner.
Current site conditions consist of a long soil drive leading from Harbinger Ridge Rd. to the
sound frontage of the tract. There is an old single family home on the waterfront. In 2017, Rick
Sumner purchased the property with the intent to renovate the existing structure, including
replacement of the existing pilings. At the time of the property transaction, there was no
shoreline stabilization in place and the shoreline had been eroding at a rapid rate. Mr. Sumner
received a CAMA General Permit (GP) to construct a bulkhead with backfill and a second GP to
construct six (6) timber jetties adjacent to uplands on the property. Two manmade ponds are
also present onsite (landward of CAMA AECs). Mr. Sumner has also received a minor permit for
fill and raising of the existing home.
Erosion has become an issue along the shoreline of this property. Marsh, other wetlands, and
sand beaches have been retreating in recent years on this property, an is visible from aerial
photography review and physical observation on -site. In November 2017, the jurisdictional
wetland/upland area adjacent to the homesite and Sound was delineated by Quible, and this
delineation was field -approved by Krysta Stygar from USACE. Based on the wetland
delineation, it was determined that there were minor amounts of fill in Section 404 wetlands. Mr.
Sumner restored the Section 404 wetland impacts per USACE requirements and this was
inspected by David Lekson and Krysta Stygar on December 19, 2017. A letter was issued by
USACE on January 3, 2017 indicating that restoration was satisfactorily completed.
Proposed Work
Mr. Sumner wishes to construct additional jetties along the shoreline of his property. Mr.
Sumner wishes to add 12 more to help stabilize and protect the rest of the shoreline on his tract.
The proposed jetties would be placed +/-50 feet apart and would extend 25 LF into the
Albermarle Sound with an additional 5 feet return into the shore. This was discussed with Ron
Renaldi, NCDCM representative at the subject property with the marine contractor and Brian
Rubino from Quible in April 2018.
Mr. Sumner also wishes to add a 188 LF by 6 feet wide pier (extending from the center of the
existing bulkhead) into the Albemarle Sound. The proposed pier would include a 12 ft by 18 ft
platform (12 ft x 12 ft roofed area) with a single slip, served by all ft by 13 ft boat lift. A 188 LF
pier with end platform extending out an additional 12 ft is necessary to reach adequate water
depths for a boat slip, due to a nearshore shallow sand bar.
As recommended by NCDCM, Rubino met with USACE representative, Josh Pelletier to review
the proposed project, including the jetties and pier. Mr. Pelletier indicated that the proposed
work was consistent with what the federal agencies could review under the 291 process.

The NC Department of Environmental Quality hereby gives public notice as
required by NCGS 113A-119(b) that application for a development permit in an AEC as
designated under the CAMA was received on 07/05/18. Southern Properties of Virginia,
LLC proposes to stabilize the property's natural shoreline by installing 12 groins and
constructing a 200' long, one -slip docking facility within the waters of the Albemarle Sound

The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located 212 Harbinger Ridge Road in Currituck
County. It was received complete on July 5, 2018, and appears to be adequate for processing at
this time. The projected deadline for making a decision is September 18, 2018. An additional 75-
day review period is provided by law when such time is necessary to complete the review. If you
have not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice of an
extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from July 5, 2018, you may request
a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of
your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted
at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be:
Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
