Marina Expansion This permit authorizes only the platform, floating docks, tie pilings, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No :. other structure, whether floating or stationary, shall become a permanent part of this expanded marina facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the marina shall be considered a violation of this permit for which the pernuttee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. Permit No. 84-18 Page 2 of 3 ADDITIONAL CONDITIONS The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. This permit authorizes an additional three formalized boat slips maximum for a of 14 formalized boat •Slips. The new portions of the marina and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. " No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. USACE Conditions In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/manunal/manatee_guidelines.pdf. Easement An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. -Fish Market and Restaurant Inc. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No, 2018-0818. E: Future development of the pernuttee's property may require a modification of this permit. The proposal is for the re -design of existing slip areas within the existing docking facility footprint ( two large slips converted to 3 new slip areas, the addition of a fixed platform as well as the addition of three floating platforms). The most waterward portion of the development would be within the existing docking facility footprint (existing outertie pilings) and a distance of 80' to 100' landward of the USACOE channel setback depending on location. All proposed development would not exceed the allowable 1/3 distance (135' beyond nhw) within the 405' wide waterbody ( longer adjacent piers to east and west). The proposed development would be located below nhw, however is within an urban waterfront area. All of the proposed work is consistent with 15A NCAC 7H.0208, therefore the Morehead City District Office recommends the project be authorized as proposed on plats dated received 5/7/18 and contingent upon all applicable general conditions and the following standard conditions: • There is a max of 14 total slips authorized. • All portions of the development shall remain within the existing docking facility footprint (approximately 95' as proposed from nhw) as well as not exceed the existing pier head length. • No work shall hinder navigation in any way. • All portions of the development shall meet the minimum 15' setback from the riparian access lines. DATE: June 21, 2018 Consistency Determination: The request is consistent with/not in conflict with the Town of Morehead City Land Use Plan certified by the CRC on September 28, 2007. Overview: The project is located at 501 Evans St adjacent to Bogue Sound in Morehead City, Carteret County. The applicant is proposing to reconfigure two existing larger slips with a fixed platform and three floating platforms. A total of 14 slips (11 existing and 3 new) would be in place after construction. The Sanitary property is .28 acres (12,275 ft'), and has a shoreline of 491', and is an average of 6' above NHW. Existing development includes a restaurant building, bulkhead, deli, bar and 11-slip marina. There are no coastal wetlands or high -ground vegetation on site. Areas of Environmental Concern (AEC) in the project area include Estuarine Waters (EW) and Public Trust Areas (PTA). This section of Bogue Sound has a classification of SC. The site is not a Primary Nursery Area, and is closed to taking of shellfish. No areas of Submerged Aquatic Vegetation (SAV) or shellfish beds were observed in the area. A review of cultural resources and archaeological resources was not provided. There is a USACOE channel setback in the area, all portions of the proposed development would be 85' landward of the setback. Anticipated impacts The proposed platform would shade 1,488 ft' and incorporate 4,900 ft' of open waters. The setting of pilings would create temporary turbidity. There would be no hindrance to navigation as the docking facility is 85' landward of the USACOE channel setback. <— "Nothing Compares,_ . PROJECT SUMMARY: The proposed project is located along the east side of the Sanitary Fish Market and Restaurant and along the Morehead City Waterfront at 501 Evans St. There is an existing restaurant building, bulkhead, deli, bar and 11-slip manna. The current proposal is to add a staging area for existing charter boats and tour boats to load and unload as well as reconfigure two of the existing larger slips into three smaller ones for a total slip count of 14. The applicant is also proposing to add three floating platforms within this area. This area is designated as Urban Waterfront however, no high groundwork is proposed. Field Investigative Report The Sanitary Fish Market and Restaurant, Inc. Page 2 of 3 9. Narrative Description The Sanitary Fish Market and Restaurant, Inc. project is located along the Morehead City waterfront (designated as urban waterfront area) within the Morehead City Harbor area of Bogue Sound at 501 Evans Street. The tract is bordered by 5113 LLC (Jacks) to the West and privately -owned boat docks to the east. The Sanitary property is 12,275 square feet (.28 acres) in its entirety, has a shoreline length of 491' and is an average of 6' above NHW. Presently there is an existing restaurant building, bulkhead, deli, bar and 11-slip marina. There are no coastal wetlands or high ground vegetation on this tract. The Morehead City Land Use Plan classifies this property as Downtown Mixed Use, with all AEC's classified Conservation. This section of the Bogue Sound (Morehead City Harbor) is not designated as Primary Nursery Area, is closed to the taking of shellfish and carries a water classification of SC. The historic riparian corridors were determined through an original permit # 74-11. The property also received a CRC Variance to their existing Minor Permit 17-06 on 5/16/17 for the second story deli deck. Substrate in the Morehead City Harbor is mostly sand and silt. No SAV's or shellfish beds were observed within the proposal project area. There is a USACOE federal within the project vicinity (app. 112' to 200' from existing bulkhead depending on location). Water depths within the location are -6' plus nlw. 10. Project Description: The applicant's current proposal is to reconfigure 2- larger slips with a fixed platform and three floating platforms. A total of 14 slips (11 existing and 3 new) for the parcel would be in place after construction. The applicant is proposing the placement of a fixed platform in order to accommodate patrons waiting for charter and tour boats that utilize the existing docking facility. The platform would be 12' x 55' and would be located along the northeast section of the existing dock area in front of the outside bar. There would be a gangway that extends from the proposed fixed platform to a 6' x 38' shore parallel floating platform. The final portion would be two 6' x 50' perpendicular floating platforms that would extend to the south. All portions of the proposed development would be located approximately 85' landward of the USACOE channel setback. All portions of the docking facility would meet the minimum 15' setback from the riparian access lines. The average existing water depths within the slip areas is an average of-6'plus at normal low water. The tidal amplitude within this area is 3'. The total length of the shoreline is 491'. The width of the Morehead City Harbor is approximately 430' in this area. The proposed development would extend a maximum of 95' waterward of nhw within a 430' wide waterbody, however there are longer piers adjacent to this site (to the east and west), therefore the 1/3 distance can be used. The proposed development would remain within the docking facility footprint as well as the establish pier head length. Anticipated Impacts: The proposed platform additions would shade 1,488 Wand incorporate 4,900ft2of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be located a distance of 85' landward of the USACOE channel setback. All portions of the development would be a max of 95'within a 430' wide waterbody, however there are longer adjacent piers, therefore the 1/3 distance may be utilized. The proposed docking facility would also remain within the existing footprint as well as the existing pier head length within this area.
