This permit, issued on January 10, 2018, is subject to compliance with the application and site drawing (where consistent with the permit), ail applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void. This permit authorizes: the construction of a fence along the property line and associated landscaping. (1) (2) (3) (4) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on November 21, 2017. All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations. Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. A copy of this permit shall be posted or available on site. Contact this office at 910-798-7116 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. (6) Unless specifically allowed in 15A NCAC 07H. 0209(d)(10), and shown on the permitted plan drawing, all development/construction shall be located a distance of 30 feet landward of Normal High Water. No portion of the roof overhang shall encroach into the 30 ft. buffer. Per the above referenced code, in section (10)(C) Post or r0ils- supported fences are allowed within the 30 ft. buffer. (7) Ail unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwator runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (10)DCM StW New Hanover Co. LPO are aware of the Easement recorded at Book 984, Page 254. However, the terms of that Easement are not for DCM Staff/New Hanover Co. LPO to determine as they lack jurisdiction to do so. if a court of competent jurisdiction finds that the proposed fence authorized by this permit violates the terms of the Easement, this permit shall be null and void based on the coutfs ruling. This condidon shall take effect on the date such courtjudgment becomes final. In such event the permittee shaft consult DCM/CAMA LPO prior to initiating or continuing any further development under this permit. The Chairman of the Coastal Resources Commission will consider each case and determine whether to grant your request to fife for a Contested Case Hearing. My clients include the following persons: Dr. Kevin S. Scully, James L. "Jim" Whitaker and wife, Jacqueline L. Whitaker, Cynthia Lea, Angela Dentiste, Harry Pridgeon, Jon Mark. McPhail as the Trustee of the Clara H. Fales Trust (collectively, "Fales Interests"). (collectively, "Harkin Application"). It is my understanding Mr. McPhail has already submitted a written notice to you of the objections by the Fales Interests to the Harkin Application. The Seabreeze Neighbors are all owners of dedicated access &8NkAiP 4&Q4NG rights of ingress, egress and regress over, though, into and across all of Seabreeze Boulevard which was formerly known as `Benton Avenue" (collectively, "Access Road") generally located immediately adjacent to the southern property line(s) of the purported property claimed to be owned by Ms. Harkin and generally north of the property owned by the Fales Interests. Continuously since 1912, the Access Road has been depicted on the plat map entitled, "Map of Seabreeze Park at Masonboro Sound", which is of record in Map Book 69 at page I I I of the New Hanover County Registry (hereinafter, "Map"). A true and correct copy of the Map is attached hereto as Exhibit A and incorporated herein by reference. As can be plainly seen on the Map, the Access Road extends all the way to the waters of Masonboro Sound. All of the deeds in the respective chains of title of my Seabreeze Neighbors and the deed to Ms. Harkin's urpQrted_prope�rt all reference the Map and the individual lots of ownership in reference to said Map. The Harkin Application's fence would seek to block the Seabreeze Neighbors' full rights of access to and from the Access Road to which they are clearly entitled by virtue of, inter alia, the Map. As a result, the Harkin Application should be denied. 2. The Harkin Application's desired fence height of eight (8') feet would directly violate the Deed of [Sight] Easement ("Sight Easement") that burdens Ms. Harkin's purported property that is of record in Deed Book 984 at Pages 254-55 in the New Hanover County Registry. A true and correct copy of this Sight Easement is attached hereto as Exhibit B and is fully incorporated herein by reference. The Sight Easement expressly prohibits the erection of "any buildings or structures of any kind" on the property or from planting any shrubs or trees which will grow to more than six (6') feet in height such that there shall be preserved "clear and unobstructed view across said property." The desired fence constitutes a structure that is expressly prohibited under the Sight Easement, and it would also violate the 6' foot maximum height restriction. For these additional reasons, the Harkin Application should be denied. 3. The notices provided to Dr. Scully and the Fales Interests in connection with the Harkin Application were legally insufficient and not proper. Given that all of the Seabreeze Neighbors I represent (as well as others who may not be represented at this time) own and possess property rights in and to the Access Road, they should have all been afforded notice from Ms. Harkin of her Harkin Application. The Harkin Application was not complete when it was submitted and it is still not a complete application. There are no details of the fence's appearance, specific locations by metes and bounds description of the fence's desired location, and no specific site survey depicting where the desired fence is to be located. The Harkin Application should not even be considered by you and your staff until a full and complete application is submitted and new notices provided to Dr. Scully, the Fales Interests, the Seabreeze Neighbors that I represent, and all of the property owners located within the entire Seabreeze Park. For these additional reasons the Harkin Application should be denied. 5. It is my understanding Ms. Harkin previously sought to build a fence that was similar to the one in the current Harkin Application and that it was denied by the County and CAMA officials based on the grounds I am again reiterating in this letter for and on behalf of my clients. For this additional reason, the Harkin Application should be denied. I reserve the right to assert additional objections in opposition to the Harkin Application as information regarding the same develops and/or in the event that you and your department ever receive a full and complete application.
