Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Dave Rizzo Permit No.15-IS Page 2 of 5 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this -requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 8) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 9) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. NOTE: The permittee is advised that submerged aquatic vegetation (SAV) habitat exists in close proximity to the authorized project. All available precautions should be utilized to ensure that damage to SAV habitat does not result from the construction and/or operation of the authorized facilities. Should dredging of these areas be proposed in the future, the permittee is further advised that the Rules of the Coastal Resources Commission prohibit new dredging within SAV 'beds. U.S. Army Corps of Engineers Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant shall implement the U.S. Fish & Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements within. IssuaMQW' should not be construed as relieving the permittee of taking proper steps to ensure the structure and m]Ks will not be damaged by wave wash. 14) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre - project condition. 15) Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. Bulkhead 16) The alignment of the authorized bulkhead/riprap shall be staked by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Failure to initiate construction within 30 days, or erosion of the shoreline by adverse weather conditions, shall require the alignment to be restaked by DCM within a maximum of 30 days prior to the new expected start of construction. 17) The bulkhead shall be constructed prior to any backfrlling activities. 18) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 19) The bulkhead shall be solid and constructed of treated wood, concrete slabs, metal sheet piles or other suitable materials approved by department personnel. No excavation is permitted except for that which may be required for the construction of the bulkhead wall, riprap, deadmen cables, etc. This permit does not authorize any excavation waterward of the approved alignment. 20) The fill material shall be clean and free of any pollutants except in trace quantities. 21) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. Dave Rizzo Permit No.15-18 y i Page 4 of 5 r ADDITIONAL CONDITIONS Upland Development 22) Unless specifically altered herein, this permit authorizes the land disturbing activities associated with the development of the above referenced property, including the single-family residence and associated development, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910)796-7215 for this determination. 23) Impervious surfaces on the property shall not exceed 9,745 square feet, or 24.2% of the area of the lot. Erosion & Sedimentation Control 24) In order to protect water quality, runoff from construction shall not visibly increase the amount of suspended sediments in adjacent waters. 25) Appropriate sedimentation and erosion control devices, measures. or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses and property (e.g. silt fence, diversion swales or berms, etc.). At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. 26) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of any phase of grading on cut or filled slopes. Stormwater Management 27) A stormwater management permit from the Division of Energy, Mineral and Land Resources will be required for the authorized project. A copy of the stormwater management approval shall be obtained and a copy provided to the Division of Coastal Management prior to the initiation of any development activities authorized by this permit. General 28) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 29) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 30) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 31) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The pemrittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Interim Director Subject: Fast Track Authorization to Construct (ATC) Permit No. SWA 000019 8516 Bald Eagle Lane New Hanover County Dear Mr. Rizzo: On February 19, 2018, the Wilmington Regional Office received a complete "Authorization to Construct" (ATC) Permit Application Form for the subject project to be permitted under the State Stormwater Fast Track Process. Staff have reviewed the application materials and have determined that the project, as proposed, complies with the Stormwater Regulations set forth in Rule 15A NCAC 02H.1043. We are hereby forwarding Authorization to Construct Permit No. SWA 000019 dated February 21, 2018, for the construction of the stormwater control measures (SCMs) and built -upon area associated with the subject project. This Authorization to Construct Permit does not constitute an approval of the project at its completion. Approval of this project at completion will be based on Division review and approval of the final permit application completed by a North Carolina licensed professional. It shall be the Petmittee's and the licensed professional's responsibility to ensure that the as -built project meets the appropriate stormwater rules. Failure to comply may result in penalties in accordance with North Carolina General Statute § 143-215.6A through § 143-215.6C and/or referral of the licensed professional to the appropriate North Carolina licensing board. This Authorization to Construct Permit shall be effective from the date of issuance until February 21, 2023, shall be subject to the conditions and limitations as specified therein, and shall not supersede any other agency permit that may be required. This cover letter, attachments, and all documents on file with DEMLR shall be considered part of this ATC Permit and is herein incorporated by reference. Please note that this Authorization to Construct Permit is not transferable except after notice to and approval by the Division. The Division may require rescission and/or revocation and reissuance of this permit. MINERAL AND LAND RESOURCES TATE STORMWATER FAST TRACK PROCESS: AUTHORIZATION TO CONSTRUCT (ATC) PERMIT In compliance with the provisions of Article 21 of Chapter 143, General Statutes of North Carolina as amended, and other applicable Laws, Rules and Regulations promulgated and adopted by the North Carolina Environmental Management Commission, including 15A NCAC 02H.1000 ("stormwater rules"), PERMISSION IS HEREBY GRANTED TO David P. Rizzo Trust 8516 Bald Eagle Lane 8516 Bald Eagle Lane, Wilmington, New Hanover County FOR THE construction of a fast track project and its associated stormwater control measures (SCMs) as outlined in the approved Fast -Track application, site plan, and supporting documentation (the "preliminarily approved documentation") as attached and/or on file with the Division of Energy, Mineral and Land Resources (the "Division" or "DEMLR"). The preliminarily approved documentation is incorporated by reference and are enforceable parts of this permit. This project is located within 575 feet of and discharging to receiving waters designated as Topsail Sound ORW, a class SA-ORW water in the White Oak River Basin and is to be designed in compliance with the provisions of 15A NCAC 02H.1000 and the minimum design criteria (MDC) specified therein (the "stormwater rules") and enforced by the Division. This permit shall be effective from the date of issuance until February 21, 2023, and shall be subject to the following specified conditions and limitations: COMPLIANCE WITH THE STORMWATER RULES. The project and all SCMs (including existing SCMs associated with the project) shall meet all applicable requirements of 15A NCAC 02H .1000 through .1062, including the Minimum Design Criteria (MDC), upon project completion. This includes the following Sections of 15A NCAC 02H .1000: .1003 Requirements that Apply to All Projects .1019 Coastal Counties Program .1043 Fast Track Permitting Process: Authorization to Construct 1044 Fast Track Permitting Process: Final Permit 1045 Requirements for Permit Transfers and Permit Renewals .1050 MDC for All Stormwater Control Measures .1051-.1062 MDC for Specific Stormwater Control Measures, as applicable 2. HIGHLIGHT OF SPECIFIC RULE REQUIREMENTS. The project shall comply with all applicable provisions of the stormwater rules listed above. Some specific rule requirements to be aware of include: a. HIGH DENSITY REQUIREMENTS. The information provided in REGEt E(Dates that this is a high density project and, as such, shall comply with all applicable high density requirements of the stormwater rules. FFR 2 8 2018 DC :.. The overall percent of built -upon area permitted for the portion of project within 575 feet of SA-ORW waters must not exceed 25% per the requirements of Rule 15A NCAC 021­1.1019(8). c. PROJECT AREA. The attached site plan depicts this project as a single project with a project area of 35,917 square feet. The locations of all SCMs, streams, wetlands and buffers are shown on the site plan. d. VEGETATED SETBACKS. A vegetated setback shall be provided adjacent to surface waters per the requirements of Rule 15A NCAC 02H .1003(4) and other applicable stormwater rules to which the project is subject. e. RECORDED DOCUMENT REQUIREMENTS. The stormwater rules require the following documents to be recorded and must be submitted to obtain the final permit as stated in 15A NCAC 02H.1044: i. Deed restrictions and protective covenants. Please note that the final permit will be issued a separate permit number; ii. Access and/or easements, iii. Operation and maintenance agreement; iv. Final plat must include a reference to the recorded operation and maintenance agreement; v. Deeds for individual lots with a reference to the deed restrictions and protective covenants. OPERATION AND MAINTENANCE. During the term of the ATC, all operation and maintenance for the project shall follow the Erosion Control Plan requirements until the Sediment -Erosion Control devices are converted to SCMs. Once the devices are converted to SCMs, the permittee shall provide and perform the operation and maintenance necessary, as listed in the recorded operation and maintenance agreement, to assure that all components of the permitted on -site stormwater system function at the intended design condition. g. NO ALTERNATIVES TO THE MDC. The project shall not propose an alternative design, nor shall it claim an exemption from the MDC based on vested rights, a waiver or a Director's Certification. 3. ATC PERMIT ADMINISTRATION. In accordance with 15A NCAC 02H .1043 and .1044, the following administrative procedures shall apply: a. PROJECT AREA CHANGES. If the project area changes, then this ATC permit shall be rendered null and void and the project must either apply for a new ATC or standard permit. b. LICENSED PROFESSIONAL. A licensed professional of record must be maintained for the duration of the project and who will prepare, certify, and submit the as -built package to obtain the final permit. If another licensed professional is retained before the project is complete, then an updated guaranty must be submitted. The original licensed professional is required to inform the Division that they are no longer associated with the project. c. TRANSFER. This permit is not transferable to any person or entity except after notice to and approval by the Director. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the ATC stormwater permit. The permittee is responsible for compliance with all permit conditions until such time as the Division approves the transfer request. To transfer this permit, either submit a new ATC application form (with all required items) or apply for a standard stormwater permit through the standard permitting process. Full or partial designers' certifications must be completed and submitted with the new ATC application or the new standard permit application for any SCMs that were already completed under the ATC. If the project is sold without notification to DEMLR, then this ATC permit shall be rendered null and void, the project will be out of compliance, and construction will not be allowed until a new standard permit application is submitted and approved for the project. This ATC permit may be renewed by providing a renewal application with all required items at least 180 days prior to the expiration date of this permit. e. EXPIRATION. If the ATC permit expires, the project shall be considered out of compliance, and thus shall be disqualified from renewal through the fast track permitting process. In this case, the permittee shall obtain a permit through the standard permitting process to complete the project. Full or partial designer certifications must be completed and submitted with the standard permit application for any SCMs that were already completed under the ATC. 4, DOCUMENTATION AND INSPECTION. The ATC application and required items and technical design documents shall be available upon request by the Division throughout the life of this permit. A copy of the ATC application and permit shall be maintained on file by the Permittee at all times. In addition, the permittee grants Division staff permission to enter the property during normal business hours to inspect the project and all components of the stormwater management facility. 5. COMMENCEMENT OF CONSTRUCTION. DEMLR shall be notified at least 48 hours in advance of constructing the approved project by submitting the completed Construction Commencement Form found in Attachment A. 6. FINAL FAST -TRACK PERMIT APPLICATION. Within 45 days of completion of the project, a Final Fast Track Stormwater Permit Application and all required items shall be submitted to DEMLR in accordance with Rule 15A NCAC 02H .1044(3). Approval of the as -built stormwater plans shall be required before the Erosion and Sedimentation Control Plan for the project may be closed out. 7. ENFORCEMENT. Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement action as set forth in NCGS 143, Article 21. Any of the following actions shall be considered a violation of the stormwater rules and are grounds for enforcement action in accordance with NCGS 143-215.6A: a. Failure to abide by the conditions contained in this permit. b. Knowingly making false statement, representation, or certification regarding this project. c. Failure to maintain a licensed professional of record for the duration of the project. 8. DIRECTOR'S AUTHORITY. The Director may modify, revoke, reissue or terminate this permit for cause as allowed by 15A NCAC 02H.1000 and NCGS 143-215.1. 9. OTHER REQUIREMENTS AND/OR PERMITS. The issuance of this permit does not preclude the permittee from obtaining and complying with any and all other permits or approvals that are required in order for this development to take place, as required by any statutes, rules, regulations, or ordinances, which are imposed by any other Local, State or Federal government agency having jurisdiction. The proposed structures would be located entirely over open water and would provide docking space for four (4) vessels in water depths measuring approximately -4 at NLW. The proposed structures would not encroach into the adjacent riparian corridor setback requirements to the north or south. It is the staff's recommendation that the applicant's proposal to install approximately 100 linear feet of bulkhead appears to be CONSISTENT with the Rules of 15 NCAC 7H.0208 (b) (7) (D) Use Standards for Bulkheads and Shore Stabilization Measures. PROJECT DESCRIPTION The applicant's property is located at 8516 Bald Eagle Lane, adjacent to Middle Sound and the Atlantic Intracoastal Waterway (AIWW) near Wilmington, New Hanover County. To locate the property from the Wilmington Regional Office, travel north on Market St. / US-17 Bus N for approximately 5.30 miles. Turn right onto Porters Neck Rd. and continue straight through the first roundabout. Take a slight right to stay on Porters Neck Rd. and travel approximately 1.42 miles. Turn left on to Bald Eagle Ln. and travel approximately 0.5 miles. The project site will be located on the right-hand side of the street. The project site is a residential lot with approximately 137' of shoreline frontage along the AIWW and Middle Sound. The elevation of the high ground area of the lot averages approximately 15' above normal water level (NWL). High ground vegetation consists primarily of lawn grasses, woody shrubs, and landscape vegetation. The upland area is currently developed with a single-family home, detached garage, and driveway. The shoreline of the property has not been stabilized and slopes steeply to a small fringe of 404 wetlands approximately 20' in width which transition to Coastal Wetlands approximately 80' in width. The Coastal Wetlands are primarily Smooth Cord Grass (Spartina alterniflora) with Glasswort (Salicornia spp.) and Sea Lavender (Limonium caroliniana) also present on site. Mean High Water (MHW) ranges from approximately 50' to 60' waterward of the wetlands. An existing docking facility extends from the center of the property in a southeasterly direction into Middle Sound. Leading to the docking facility is a elevated wooden walkway and a gazebo approximately 45' from NHW and measuring approximately 20' by 20'. The docking facility consists of a fixed pier measuring approximately 190' by 6', a fixed i-head' platform measuring approximately 16' by 16' and a floating platform measuring approximately 16' by 8'. There are two existing tie pilings approximately 13' south of the floating platform. There is an existing 13' in width by 13' in length boatlift that extends off the north side of the existing fixed platform. The existing docking facility allows for two (2) formalized slips. The shoreline to the south has been stabilized with a bulkhead that extends approximately 50' waterward of the upper limits of coastal wetlands on the project site. The adjacent shoreline to the north has not been stabilized. Both of the adjacent properties to the north and south are developed with single-family residences and docking facilities. No known archaeological sites are within the project vicinity. Previous owner, Mr. James Holderfield obtained LAMA General Permit No. 4915D to construct the docking facility on 5/15/1989. Mr. Dave Rizzo obtained CAMA Minor Permit No. 17- 45 to demolish the existing residence on November 22, 2017. The City of Wilmington/ New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area Conservation/Residential. The waters of the AIWW are classified SA; ORW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PrRW1 EN1k1fiDn of Marine Fisheries. They are OPEN to the harvest of shellfish. DEC 12 2017 PROPOSED PROJECT The applicant proposes to reconfigure and expand an existing private docking facility, constru�aggr vih�saQd construct a new single-family residence, pool and shed. Approximately 10' from the terminus of the pier along the southern edge would be a 20' by 20' covered platform. Extending from the terminus of the fixed pier would be a ramp leading to a "U-shaped" floating platform. The main spine would run parallel to the channel and measure approximately 36' by 8'. Extending landward from the western edge of each end of the main spine would be two additional floats. The float on the northern end would measure approximately 32' by 8' and the float along the southern end would measure approximately 12' by 8'. Along southern edge of the floating dock measuring 12' by 8' would be a boat lift measuring approximately 16' by 16'. The configuration would provide docking space for up to four (4) vessels at this location within water depths of approximately -4' at NLW. The docking facility would extend approximately 130' into a waterbody which measures approximately 598' across and would meet the X width distance and the established pierhead line (see Page 2 of 5). As proposed, the new bulkhead would be aligned landward of 404 and Coastal Wetlands. The proposed bulkhead alignment would be approximately 50 feet landward of the adjacent property's bulkhead to the south. The limits of disturbance would be located approximately 20 feet landward of the proposed new bulkhead alignment for the tie back system, however, there will be additional disturbance for the addition of fill material, which will be located immediately landward of the bulkhead to approximately 40' landward of the new bulkhead. The applicant proposes to construct a new single-family residence approximately 80' in length by 50' in width, a pervious paver driveway, a detached garage, covered porches, an open terrace, a swimming pool area, and a 12' by 12' storage shed approximately SO'landward of NHW. The application states that the two-story home would be located in flood zone X and that the wastewater would be treated by a septic system. According to the application package, approximately 9,745 ftZ (24.2%) of impervious surface would cover the property, all of which would be located within the 575' Coastal Shoreline/ORW Area of Environmental Concern (AEC). All proposed upland development would be located landward of the Coastal Shoreline 30' Buffer (See Page 3 of 5). 10. ANTICIPATED IMPACTS The docking facility structures would incorporate approximately 2,568 ftZ of Estuarine Waters and Public Trust Area, and would shade approximately 60 ft2 of Coastal Wetlands. The proposed docking facility structures would extend approximately 130' into a waterbody which measures approximately 598' across and would meet the established pierhead line and conform to the Y, width distance rule and the federal channel setback. The proposed docking facility would accommodate up to four (4) vessels in water depths of approximately 4 at NLW. Based on the application, the proposed docking facility would not encroach into either adjacent 15' riparian corridor setback area. Minor increases in turbidity should be expected during construction. The proposed new bulkhead construction with associated backfill and tie back/anchor system would result in the disturbance of approximately 2,000 ftZ of high ground in the Coastal Shorelines/ORW AEC. The proposed upland development for the single-family residence and associated structures would disturb approximately 40,231 ftZ of highground, of which approximately 24.2%would be covered by built upon area within the 575' Coastal Shoreline/ORW AEC. The permeameter is used to determine field saturated hydraulic conductivity in centimeters per second for soil at a specified depth. This testing involves advancing a borehole to the desired infiltration depth and introducing water at a constant head to determine the steady state flow rate from which the hydraulic conductivity can be calculated. Our testing was performed approximately 15 inches below the existing ground surface. The results of our permeameter testing are presented in Table 2. RECOMMENDATIONS Based on the results of our field testing and soil classifications at the test location, we offer the following recommendations for stormwater infiltration design: At the test location INF-1 it is our opinion that in order to achieve the steady state flow rate obtained during our testing; the areas of infiltration galleries or other infiltration structures should introduce stormwater at approximately 15 inches below the existing ground surface elevation. For purposes of sizing the structures we recommend an ultimate application rate of 1.9 inches per hour. These recommendations should be reviewed by appropriate regulatory authorities before finalizing the details of any civil design.
