Wilmington as requested in the permittee's application dated 10/19/17. incl. attached
workplan drawings (2), labeled 2-3 of 4, both dated 10/19/17.
This permit, issued on January 2, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
to rmes, amprrsomnent or civil action; or may cause the
Docking Facility
to tie null ana voia.
1) This permit authorizes only the reconstructed docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconstructed docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconstructed docking facility. Any sewage discharge at the reconstructed docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires fiurther Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 3 formalized boat slips.
6) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.

8) The pemvttee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
MUTE: F+his permit does not eliminate the need to obtain any additional state, federal or local permits,
Mprovals or authorizations that may be required.
NOTE: c Zhe U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
Z7800056 (Action ID No. SAW-2017-02355), which was issued on 11/15/17.

The total platform area was calculated as follows:
Shoreline length = 110' x 8 ft2 = 880 ft2 allowable
Proposed covered platform = 10' x 16' = 160 ft2 (6' subtracted for access)
Proposed floating platform 1 = 10' x 20' = 200 ft2
Proposed floating platform 2 = 8' x 24' = 192 ft2
Total = 552 ft2 proposed
The construction of the facility would provide docking space for a total of three (3) vessels. The docking
facility appears to be consistent with all use standards set forth in NCAC 07H .0208(b)(6), including
the 8-square foot rule, the % width rule, the 6' width & 3' height limit over Coastal Wetlands, and it
would not encroach into either 15' riparian setback nor exceed the adjacent pierhead alignment. This
office has no objection to the proposed work. Provided it is consistent with all other state and federal
permitting requirements, this office recommends a permit be issued with the standard docking facility
conditions.

This project is consistent with the 2006 Wilmington -New Hanover County Joint
Land Use Plan Update.
The applicant proposes to replace and expand an existing docking facility in Banks
Channel. The project is located at 10 Backfm Point on Figure Eight Island in New
Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The
Wilmington -New Hanover County Land Use Plan contains some policies, which exceed
the State's minimum use standards, however none of these policies are applicable to this
project.
This.project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

The project site is located at 10 Backfin Point on Figure Eight Island, adjacent to Banks Channel, in New Hanover
County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private
bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle
Sound. Heading east on the causeway, turn right on Beach Road South and travel approximately 0.4 miles south
and turn right on Backfin Point. Travel approximately 0.1 miles to 10 Backfin point, the project site, which will be
located on the right side of the road.
Existing structures on the project site include a single-family home (currently under construction), bulkhead, and
private docking facility. The project site is approximately 0.4 acres in size and has an approximate elevation of
5' above NHW. The vegetation currently on the project area consists of native bushes and some lawn grass,
however, due to the construction on site, most of the lot was cleared of vegetation at the time of the site visit.
The project site has approximately 110 feet of shoreline frontage along Banks Channel. Located waterward of
the existing timber bulkhead is a sandy area above normal high water that measures approximately 10' in width.
There are high marsh Coastal Wetland species in this area measuring and extending approximately 20' in width
from NHW consisting of Saltmeadow Cordgrass (Spartina patens), Glasswort (Salicornia spp.), and Sea
Lavender (Limonium carolinianum). Waterward of the high marsh is a band of Smooth Cordgrass (Spartina
alterniflora) measuring approximately 10' in width. Mixed among the Smooth Cordgrass are oysters growing in
the sandy bottom. No SAV was present during the site visit. Extending waterward from the bulkhead is an existing
private docking facility, which consists of a 47'x6' access pier, a 15'x3' gangway, and a 20'x10' floating dock.
Based on aerial photography the docking facility appears to have been constructed prior to 1993 and no previous
permits were located.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion
of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the
Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division
of Marine Fisheries and they are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to replace and expand an existing docking facility in Banks Channel. The old docking
facility would be removed entirely, and a new 30'x6' fixed pier would be constructed at the same angle as the
existing fixed pier. A 16'xl6' covered platform would be constructed at the end of the fixed pier in an "L-head
configuration. From the covered platform extending in an easterly direction into Banks Channel a ramp would
lead to a floating platform measuring 10'x20'. From the waterward end of the south side of that floating platform,
a second floating platform measuring 8'x24' would extend in a southerly direction creating an "L-shaped" floating
platform. Along the northern side of the floating platform measuring 10'x20' would be a boat lift measuring
12'xl3'. The water depths in the vicinity of the project area are -6' at NLW. The application states that the floating
dock and boatlift will be constructed using a floating work barge to be stored on site.
10. ANTICIPATED IMPACTS:
The proposed docking facility would incorporate approximately 984 ft2 of Estuarine Waters and Pubic Trust Area
and would result in the shading of approximately 120 ft2 of coastal wetland consisting primarily of Smooth
Cordgrass (Spartina alterniflora). The newly constructed docking facility would meet the adjacent pierhead line.
The application states the water body width is +600', however, using aerial imagery DCM determined the water
body width in this area is 375'. The proposed facility would extend approximately 55' into a waterbody measuring
approximately 375' which would meet the'/4 width rule. The proposed facility would not encroach into either 15'
riparian corridor setback area. The facility would consist of three formalized slips in waters measuring
approximately -6' at NLW. The applicant's proposal has the potential to increase disturbance, sedimentation and
turbidity into the adjacent marsh. Minor increases in turbidity should be expected during construction.

BEING ALL OF Lot 10, Section 4, Block "A" of the
property of The Figure Eight Island Company, as the same
is shown and described on map thereof recorded in Map
Book 13 at Page 12 in the office of the Register of
Deeds of New Hanover County, North Carolina, and subject
to those Restrictive Covenants recorded in Book 933 at

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent
for Scott Poole, for State approval for development of the subject property located at 10 Backfin Point,
adjacent to Banks Channel, on Figure Eight Island near Wilmington in New Hanover County. It was
received as complete on October 20, 2017 and appears to be adequate for processing at this time. The
projected deadline for making a decision is January 3, 2018. An additional 75-day review period is
provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from October 20, 2017, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written request
and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in

The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern as designated under the CAMA: On October 20, 2017, Scott
Poole proposed to expand an existing docking facility at 10 Backfin Point, adjacent to Banks
Channel, on Figure Eight Island, New Hanover County, and on October 24, 2017, Kingfrsh
Bay Development, LLC proposed to construct two separate access piers at 1228 Kingf+sh Blvd,
adjacent to the Calabash River, in Calabash, Brunswick County. Copies of these applications
can be examined or copied at the office of Courtney Spears (NH) or Sean Farrell (BR Co.),
N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext.,
Wilmington, NC 28405, (910-796-7215) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to November 23, 2017 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in these matters will be
provided upon written request.
