RECEIVED NOV 0 2 2017 ®CM- MH® CITY 0 MEMORANDUM To: Heather Coats From: Michael Christenbury, Wilmington District Planner Subject: Consistency Determination, Major Permit Application, Scott Poole, New Hanover County Date: December 12, 2017 R1Y This project is consistent with the 2006 Wilmington -New Hanover County Joint Land Use Plan Update. The applicant proposes to replace and expand an existing docking facility in Banks Channel. The project is located at 10 Backfm Point on Figure Eight Island in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. In general, Wilmington -New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The Wilmington -New Hanover County Land Use Plan contains some policies, which exceed the State's minimum use standards, however none of these policies are applicable to this project. This.project appears to be consistent with the 2006 Wilmington -New Hanover County Joint Land Use Plan Update. RECEIVED Scott Poole c/o Ed Flynn Page Two NOV 0 2 2017 9. PROJECT DESCRIPTIONf gT'I y' The project site is located at 10 Backfin Point on Figure Eight Island, adjacent to Banks Channel, in New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading east on the causeway, turn right on Beach Road South and travel approximately 0.4 miles south and turn right on Backfin Point. Travel approximately 0.1 miles to 10 Backfin point, the project site, which will be located on the right side of the road. Existing structures on the project site include a single-family home (currently under construction), bulkhead, and private docking facility. The project site is approximately 0.4 acres in size and has an approximate elevation of 5' above NHW. The vegetation currently on the project area consists of native bushes and some lawn grass, however, due to the construction on site, most of the lot was cleared of vegetation at the time of the site visit. The project site has approximately 110 feet of shoreline frontage along Banks Channel. Located waterward of the existing timber bulkhead is a sandy area above normal high water that measures approximately 10' in width. There are high marsh Coastal Wetland species in this area measuring and extending approximately 20' in width from NHW consisting of Saltmeadow Cordgrass (Spartina patens), Glasswort (Salicornia spp.), and Sea Lavender (Limonium carolinianum). Waterward of the high marsh is a band of Smooth Cordgrass (Spartina alterniflora) measuring approximately 10' in width. Mixed among the Smooth Cordgrass are oysters growing in the sandy bottom. No SAV was present during the site visit. Extending waterward from the bulkhead is an existing private docking facility, which consists of a 47'x6' access pier, a 15'x3' gangway, and a 20'x10' floating dock. Based on aerial photography the docking facility appears to have been constructed prior to 1993 and no previous permits were located. The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT The applicant proposes to replace and expand an existing docking facility in Banks Channel. The old docking facility would be removed entirely, and a new 30'x6' fixed pier would be constructed at the same angle as the existing fixed pier. A 16'xl6' covered platform would be constructed at the end of the fixed pier in an "L-head configuration. From the covered platform extending in an easterly direction into Banks Channel a ramp would lead to a floating platform measuring 10'x20'. From the waterward end of the south side of that floating platform, a second floating platform measuring 8'x24' would extend in a southerly direction creating an "L-shaped" floating platform. Along the northern side of the floating platform measuring 10'x20' would be a boat lift measuring 12'xl3'. The water depths in the vicinity of the project area are -6' at NLW. The application states that the floating dock and boatlift will be constructed using a floating work barge to be stored on site. 10. ANTICIPATED IMPACTS: The proposed docking facility would incorporate approximately 984 ft2 of Estuarine Waters and Pubic Trust Area and would result in the shading of approximately 120 ft2 of coastal wetland consisting primarily of Smooth Cordgrass (Spartina alterniflora). The newly constructed docking facility would meet the adjacent pierhead line. The application states the water body width is +600', however, using aerial imagery DCM determined the water body width in this area is 375'. The proposed facility would extend approximately 55' into a waterbody measuring approximately 375' which would meet the'/4 width rule. The proposed facility would not encroach into either 15' riparian corridor setback area. The facility would consist of three formalized slips in waters measuring approximately -6' at NLW. The applicant's proposal has the potential to increase disturbance, sedimentation and turbidity into the adjacent marsh. Minor increases in turbidity should be expected during construction. REGAN Secretor BRAXTON DAVIS Coastal Management ENVIRONMENTAL QUALITY October 26, 2017 F&S Marine Contractors, Inc. c/o Ed Flynn P.O. Box 868 Wrightsville Beach, NC 28480 Dear Mr. Flynn: The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Scott Poole, for State approval for development of the subject property located at 10 Backfin Point, adjacent to Banks Channel, on Figure Eight Island near Wilmington in New Hanover County. It was received as complete on October 20, 2017 and appears to be adequate for processing at this time. The projected deadline for making a decision is January 3, 2018. An additional 75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th day. If this agency does not render a permit decision within 70 days from October 20, 2017, you may request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will be held within five working days from the receipt of your written request and shall include the property owner, developer, and project designer/consultant. NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed development. You should post this notice at a conspicuous point along your property where it can be observed from a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this notice could result in an incomplete application. An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive a copy of my field report and/or comments from reviewing agencies. cc: Heather Coats, DCM Doug Huggett, MHC Christine Bouffard, LPO Tyler Crumbley, COE Scott Poole, Applicant Chad Coburn, DWR RECEIVED NOV 0 2 Z017 DCM- MHD CITY State of North Carolina I Enwronmental Quality J Coastal Management 127 Cardinal Drive Ext., Wilmington, NC 29405 910-796-7215 NOT 1 (0100 1 70A RECEIVED NOV 0 2 2017 DCM- MHD CITY CAMA PERMIT APPLIED FOR PRa replace and expand an existirn Mr 100VOIA111"Mikeli"I LIMe,I E►yf%1[•PI►[arliL=1I[•Lai•1!/ COMMENTS ACCEPTED THROUGH November 23, 2017 APPLICANT: FOR MORE DETAILS CONTACT THE LOCAL PERMIT OFFICER BELOW: Scott Poole NC Div. of Coastal Management 1 10 Backfin Point 127 Cardinal Dr. Extension Wilmington, NC 28411 Wilmington, NC 28405 Courtney Spears, Field Representative Agent: Ed Flynn (910) 256-3062 910-796-7423 NC Division of Coastal Management Major Permit Application Computer Sheet AEC: Mason Channel / At Oc Fee: $250 p6672 / CDAITS ✓ MHC cc V_ Applicant: Scott Poole Aaw Agent/Contractor: F & S Marine Contractors, Inc. cJo Ed Fty Project Site County: New Hanover Staff: Courtney Spears District: Wilmington Project Name: Poole Docking Facility NW Rover File: We River Basin: Cape Fear Initial date of application submittal: 10-20-17 Date application "received as complete" in the Field office: Permit Authorization: N CAMA LJ Dredge & Fill LJBoth SITE DEISCRIPTION/PERMIT INFORMATION DCM- MHD CITY i f ORW: Yes ❑No PNA: Yes No Photos Taken: Yes No Setback Required (riparian): DYes No Critical Habitat: ❑Yes ❑No of Sure 15 foot waiver obtained: Yes No Hazard Notification Returned: ❑Yes No SAV: ❑Yes Ir o ❑Not Sure Shell Bottom: ❑Yes No ❑ Not Temporary Impacts: as ❑No Sure Sandbags: ❑Yes No ❑ Not Sure Did the land use atqssification come from LUP❑No Mitigati equired (optional): ❑Yes No county TTTTTTYes Moratorium Conditions: Environment I sse```"`ssment Done: Length of Shoreline: ❑Yes []NoA []Yes❑NoNNA FT.
