Shoreline Stabilization - Bulkhead The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction. Signature of Permittee nd Vickie Pollard ADDITIONAL CONDITIONS Permit No. 57-18 Page 2 of 3 The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. The fill material shall be clean and free of any pollutants except in trace quantities. All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. =All fill material to be placed below normal water level shall be confined behind the permitted bulkhead. A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of-backfilling activities.- ._ _ Docking Facility This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether I oating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. .The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor. This permit authorizes a maximum of 2 formalized boat slips. .The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the €';:permitted activity without having it transferred to a third party. and Vickie Pollard ::. - Permit No. 5748 Page 3 of 3 ADDITIONAL CONDITIONS General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. _ The U.S. Army Corps of Engineers authorized the project by way of Programmatic General - Permit 198000291 (Action ID SAW-2018-00924), issued 6/6/18.- - - The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-0621. TE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. lTE: An application processing fee of $400 was received by DCM for this project. MEMORANDUM TO: Doug Huggett THROUGH: Jonathan Howell'! * FROM: Kelly Spivey DATE: 23 April 2018 SUBJECT: Michael & Vickie Pollard Beaufort County CAMA Major Permit Application Mr. & Mrs. Michael Pollard has submitted a Major CAMA and State Dredge and Fill permit application for development located off SR 1358 at 597 Duck Creek Rd. on the northern side of the Pamlico River near Bath in Beaufort County, North Carolina. The applicants propose to bulkhead and backfill f 100' of shoreline on the same alignment as the upstream and downstream bulkheads. This alignment will place the bulkhead on average t9' waterward and a maximum distance of±20' waterward of the Normal Water Level. The applicant also proposes to construct a 150' long X 5' wide pier with a 12' x 12' L-head platform. Additionally, the applicant proposes to construct a 14' x 28' (dripline) boathouse. A 8' x 12' uncovered Personal watercraft lift (PWC) will be located adjacent to the pier. I have reviewed the proposed project with regard to rules found in Subchapter 7H concerning development in a Public Trust Area, Coastal Shoreline and Estuarine Waters. It is staff recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(7)(D)(ii) which states in part "the bulkhead alignment extends no further below approximate mean high water or normal water level than necessary to align with adjacent bulkheads". The proposed alignment will tie in with the corners of both the upstream and downstream bulkheads. Evidence exist of a previously existing bulkhead that is located mostly waterward of the proposed bulkhead alignment. The proposed alignment will not project any further waterward than the adjacent bulkheads. This office also feels the project is consistent with 15A NCAC .0208(b)(6) for piers and docking facilities. Mr. & Mrs. Michael Pollard recently purchased this property. The project site totals 0.34-acres with an elevation of approximately 5' above Normal Water Level (NWL). The lot has approximately 100 linear feet of shoreline. Historically, there has been a bulkhead on the property. Approximately 55' of the bulkhead remains on the western portion of the lot while the remaining 46' has been destroyed by numerous storms. The alignment of the bulkhead is evident but only remnants remain along the eastern half of the lot and the structure has virtually been destroyed by natural elements and is no longer serving as shoreline stabilization. Since the time the bulkhead was damaged the shoreline has experienced severe erosion. The average erosion escarpment is t9' landward of the previous bulkhead. Man-made features on the lot consist of a house, septic system and remnants ofthe bulkhead. The lot is mostly vegetated with lawn grasses, ornamental shrubs, loblolly pines and various hardwoods. The existing septic system will be replaced 50' landward of the current Normal Water Level (MWL). Both adjacent properties on the downstream (east) side and upstream (west) side are previously developed lots with bulkheaded shorelines. The upstream property has a 200' long pier with a T-head platform. The Pamlico River is classified as SB NSW by the Environmental Management Commission at the project site. The Pamlico River is Coastal Waters and is not open to shell fishing. No Submerged Aquatic Vegetation was observed during the on -site visit The property is subject to the Tar -Pamlico River Basin Buffer Rules enforced by the N.C. Division of Water Resources. Project description The applicant proposes to replace the damaged 100' bulkhead landward of the previously existing bulkhead. This new alignment will be along the same alignment as the upstream and downstream bulkheads. The proposed bulkhead will tie into the adjacent bulkhead comers on both adjacent lots. This alignment will place the bulkhead on average t9' water ward and a maximum distance of±20' waterward of the normal water level. The applicant also proposes to construct a 150' long X 5' wide pier with a 12' x 12' L-head platform. Additionally, the applicant proposes to construct a 14' x 28' (dripline) boathouse. A 8' x 12' uncovered Personal watercraft lift (PWC) will be located adjacent to the pier. The final number of defined slips for this pier will be two. The proposed pier will terminate in approximately 4.0' deep water, will not interfere with any traditional navigation channels and doesn't exceed one quarter width of the Pamlico River. The pier will be not be located within the 15' setback of the riparian line. Anticipated impacts The construction of the bulkhead and installation of backfill as proposed will result in the filling of approximately 900 ft' of River bottom. The project will result in localized turbidity as a result of the construction of the bulkhead and installation of the pier pilings. The construction of the pier, platform, PWC lift and boathouse will result in the construction of 536 ft' of platform and total shading impacts of 1,382 ft'. It has a house on the property which is in disrepair. If the house can be repaired, we will proceed with that project. The bulkhead on the lot failed, and the shoreline is eroded. There is +/- 50 feet of existing bulkhead that will be removed. This erosion has compromised the bulkheads of the adjacent property to the east and west of our lot. We propose to rebuild the bulkhead landward of the existing bulkhead and tying directly into the bulkheads of the adjacent properties which will allow us to backfill. This will stabilize those bulkheads and stop the erosion. The bulkhead will be 4` 8" from the river bottom to match up with the height of the adjacent bulkheads. The NWL at the bulkheads is 2 feet. We will also be building a 150 foot pier which will have boathouse with a lift and a PWC lift. The pier will be less than the average length of the 2 adjacent piers.
