This permit, issued on January 24, 2018 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

Docking Facility
1) This permit authorizes only the reconfigured docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this reconfigured docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be
considered a violation of this permit for which the permittee is responsible: This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit, must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum bf 4 formalized boat slips.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' riparian access corridors.
7) No portion of the authorized docking facility shall extend past the adjacent pier line, as depicted on the
plans.
8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
General
9) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) This permit does not authorize the interference with any existing or proposed Federal project; and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public
interest.
12) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require'a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is.further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way o%rraP
197800056 (Action ID No. SAW-2006-40490), which was issued on 12/11/17.

The total square footage of the platform and floating dock was calculated as follows:
Shoreline length = 100' x 8 sq. ft. = 800 sq. ft. allowable.
Proposed fixed platform = 10' x 10' = 40 sq. ft. (6' not calculated due to alignment)
Proposed new floating docks = (50' x 8') + (6' x 4') = 424 sq. ft.
Total = 464 sq. ft.
It is the staffs recommendation that the replacement, reconfiguration, and expansion of the existing docking facility
appears to be CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight -square foot rule,
the pier width rule, and the % width rule. The proposed structures would be located entirely over open water. This office
has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements.
It is recommended that any permit issued should include standard conditions for docking facilities.

The applicant proposes to reconfigure and expand an existing private docking facility in
Banks Channel. The project is located at 65 Beach Road South, adjacent to Banks
Channel and Middle Sound on Figure Eight Island in New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, Wilmington -New Hanover County allows development in Conservation
classified AECs, which is consistent with the State's minimum use standards. The
Wilmington -New Hanover County Land Use Plan contains some policies, which exceed
the State's minimum use standards, however none of these policies are applicable to this
project.
This project appears to be consistent with the 2006 Wilmington -New Hanover
County Joint Land Use Plan Update.

On January 1, 2017, we renewed General (Regional) Permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and boat
shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the United States
in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act of 1899. General
Permit No. 197800056 expires December 31, 2021.

9. PROJECT DESCRIPTION DC M- M H D CITY
The project site is located at 65 Beach Road South on Figure Eight Island, adjacent to Banks Channel and Middle Sound, in
New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private
bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading
east on the causeway, turn right on Beach Road South and travel approximately 0.5 miles until you reach the property of
interest located on the right side of the road.
The property is adjacent to residential properties on the south and north sides. The property is bordered on the east side
by Beach Road South and Banks Channel to the west. The project site is approximately 0.39 acres in size and has an average
elevation of approximately 5' above Normal High Water (NHW) and is vegetated with maintained lawn grass and
ornamental landscaping. The project site has approximately 100 linear feet of shoreline frontage along Banks Channel,
which is currently stabilized by a timber bulkhead. Waterward of the existing bulkhead is a small strip of sandy uplands
with an area of sparse Salt Meadow Grass (Spartina patens), measuring approximately 30' in length by 3' in width, along
the northern portion of the bulkhead, the sandy uplands gently transitions to the open water area of Middle Sound.
Extending in a northwesterly direction from the timber bulkhead towards Banks Channel is an existing private docking
facility, which consists of an access pier (96' x 6% uncovered "T-head" fixed platform (10' x 10') and a "U-shaped" floating
dock, the primary spine of which runs parallel to Banks Channel and measures approximately 40' x 8'. Two finger piers
extend from the eastern edge of the main spine on the northern and southern ends, each measuring approximately 6' x
4'. There are two existing boatlifts each measuring approximately 13' x 14' located on the northern and southern side of
the "U-shaped" floating dock (see Sheet 4 of 4). The application states the existing docking facility currently accommodates
up to three (3) vessels in water depths of approximately -6' at Normal Low Water (NLW). The current docking facility was
authorized under LAMA Major Permit No. 168-06 which was issued 10/19/2006. The docking facility currently extends
approximately 70' into a waterbody measuring approximately 460' across.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the
property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they
are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to reconfigure and expand an existing private docking facility. The applicant proposes to replace
the 96' x 6' fixed pier in the same footprint. The applicant also proposes to remove the 6' x4' floating finger pier on the
northern end of the "U-shaped" float and extend the main spine using a 10' x 8' section of floating dock. The resulting
total measurement of the main spine would be 50' x 8'. The existing 13' x 14' boat lift along the northern end of the facility
would be moved to the east of the main spine expansion and a new 13' x 14' boat lift would be installed on the western
side of the main spine expansion, which would result in a total of three (3) boat lifts at the docking facility. All otheraspects
of the docking facility would remain the same. The docking configuration would provide docking space for up to four (4)
vessels at this location within water depths of approximately -6' at NLW. The docking facility would extend approximately
115' into a waterbody which measures approximately 460' across and would meet the established pierhead line (see Sheet
2 of 4).
10. ANTICIPATED IMPACTS
The structures would incorporate approximately 262 sq. ft. of additional Estuarine Waters and Public Trust Area. The
proposed structures would extend approximately 115' into a waterbody which measures approximately 460' across and
would meet the established pierhead line. This distance would conform to the % width distance rule. The proposed
structures would allow the existing docking facilityto accommodate up to four (4) vessels in water depths of approximately
-6' at NLW. Based on the application, the proposed structures would not encroach into either adjacent 15' riparian corridor
setback area. Minor increases in turbidity should be expected during construction.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent
for Karen Pigman, for State approval for development of the subject property located at 65 Beach Road
South, adjacent to Banks Channel, on Figure 8 Island, New Hanover County. It was received as complete
on November 13, 2017 and appears to be adequate for processing at this time. The projected deadline
for making a decision is January 27, 2018. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional letter
will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from November 13, 2017, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss
the status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property; or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following application was submitted for a development permit in an
Area of Environmental Concern as designated under the CAMA: On November 13, 2017
Karen Pigman proposed to reconfigure and expand an existing private docking facility at
65 Beach Road S., adjacent to Banks Channel, on Figure Eight Island, in New Hanover
County. A copy of the application can be examined or copied at the office of Courtney Spears,
N.C. Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext.,
Wilmington, NC 28405, (910) 796-7423 during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to December 29, 2017 will be
considered in making the permit decision. Later comments will be accepted and considered up
to the time of permit decision. Project modification may occur based on review and comment by
the public and state and federal agencies. Notice of the permit decision in these matters will be
provided upon written request.

I am so sorry. It has been a difficult adjustment since the change has happened internally. One thing we have done tc
eliminate this type of confusion is that from this point forward I will be handling all.the legal ads, we will not be taking
turns and alternating. The only exception will be if I am out for some reason. I hope this will help you.
