This is with reference to your request to modify State Permit No. 10-18, in order to allow
construction of the docking facility prior to issuance of an Easement from the Department of
Administration's State Property Office. The permit was issued on January 25, 2018 and will
expire on December 31, 2021. The action proposed is to modify Condition No. 25 of the permit,
which requires an Easement from the Department of Administration's State Property Office prior
to the construction of any new boat slips or other docking facilities under the permit.
In reviewing correspondence sent by the State Property Office on February 19, 2018, the
Division of Coastal Management has determined that the proposed action is consistent with
existing State rules and regulations and is in keeping with the original purpose and intent of the
permit. This Letter of Refinement hereby authorizes the modification of Condition No. 25 of
State Permit No. 10-18, subject to the following:
An Easement from the Department of Administration's State Property Office is required
under N.C.G.S. 146-12(e). The required easements shall be obtained, and a copy provided
to the Division of Coastal Management, prior to the occupancy of any new boat slips or
the docking facilities authorized under this permit.
Please note this refinement does not authorize any work not expressly described above, nor does
it eliminate the need to obtain any other additional state, federal or local permits, approvals or
authorizations that may be required. By copy of this letter we are also notifying the U. S. Army
Corps of Engineers of our action. If you have any questions concerning the above or if I can be
of any other assistance, please advise.

The State Property Office is in the process of preparing and executing a submerged land easement to Pea Landing, LLC as
required by CAMA Permit 10-18 for the 14 slips located in the Calabash River at 9973 Beach Drive, Calabash, NC The
applicant has requested this letter in hope that their construction could begin on the pier prior to receipt of the
Submerged Land Easement from the State, with all work subject to receipt of a submerged land easement. I have
reviewed the file and see no problem with the application, the file has been forwarded to the Attorney General's Office
for review and preparation of the easement. This request was made in the interest of time, as I understand the
situation, the construction barge is on site. Please let me know if I can answer any questions or be of assistance.
