This permit authorizes: Construction of a 1,429 sq. ft. single family residential home, includes driveway, uncovered deck, and associated landscaping. (1) All proposed development and associated construction must be done in accordance with the permitted work plat drawings(s) dated received on November 21, 2017. (2) All construction must conform to the N.C. Building Code requirements and all other local, State and Federal regulations, applicable local ordinances and FEMA Flood Regulations, including no structural fill per section G(6) of the New Hanover County Flood Damage Prevention Ordinance. (3) Any change or changes in the plans for development, construction, or land use activities will require a re- evaluation and modification of this permit. (6) Unless specifically allowed in 15A NCAC 07H, 0209(d)(10), and shown on the permitted plan drawing, all developmenticonstruction shall be located a distance of 30 feet landward of Normal High Water. No portion of the roof overhang shall encroach into the 30 ft. buffer. This permit authorizes an elevated, slated, wooden deck up to 200 sq. ft. within the 30' buffer. (7) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Prior to any land -disturbing activities, a barrtier line of filter cloth must be installed between the land disturbing activity and the adjacent marsh or water areas, until such time as the area has been properly stabilized with a vegetative cover. (8) Any proposed for grading within the 30' buffer from the Normal High Water must be contoured to prevent additional stormwater runoff to the adjacent marsh. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (9) All other disturbed areas shall be vegetatively stabilized (planted and mulched) within 14 days of construction completion. (10) This permit does authorize development within any wetlands or open water. (11) Prior to any development, silt fence shall be properly installed between all planned land disturbance and the adjacent marsh and open water areas; the silt fence shall be property maintained throughout the construction period. Silt fence shall be installed such that it is properly toed -in to the soil. Our objection is related to the insufficient information contained in the permit application that renders an inadequate evaluation of the proposed development. The lack of information contained in the permit application makes it impossible to determine how the proposed development may adversely impact our property_ The submitted drawings appear to be deficient of Items listed on the CAMA Minor Development — Site 0rawing/Application Checklist including but not limited to, the normal high water line, the AEC, all wetland lines (coastal and any 404 that may be present along the property), landscaped areas (proposed fill), disturbed areas, house footprint, decks, porches and driveways. The submitted drawing labeled Phillip Brooks appears to be a reproduction of the drawing labeled 'LOT SURVEY' and does not appear to accurately depict the shared property boundary nor the 'MHW line flagged by NHC on 19Sep17'. Which appears to be flagged incorrectly. The MHW flag is under water during high tide. The submitted drawing labeled 'LOT SURVEY' is not a true survey and appears to be based on a 2003 survey from Hobbs Surveying. This drawing specifically states it is not a true representation of the boundary information. Additionally, the LOT SURVEY appears to depict a line based on Mean High Water for the 2003 survey which may differ from the line now labeled 'MHW line flagged by NHC on 19Sep17' found on the Phillips Brooks drawing. The Brooks drawing also notes "pilings ... 13'above mean sea level". Based on the NFIP Flood Plain maps this property is in a VE 16 flood zone. The drawing lacks information necessary to determine if any fill will be brought to the site that will directly impact flood waters and my adjacent property. We are also concerned about the possible impacts to the adjacent Outstanding Resource Waters and wetlands. The area shown "within setbacks" may contain coastal wetlands and therefore should be excluded from the area calculations for density of development. This would be consistent with the State regulations for stormwater 15A NCAC 02H .1003 which state that the "total project area shall exclude the following: areas below the Normal High Water Line AND areas defined as 'coastal wetlands' pursuant to 15A NCAC 07H 0205". Given the County's conservation overlay district adjacent to wetlands, it would seem that the County would also exclude coastal wetlands for the area calculations for density of development. Additionally, fill in the way of yard waste, including pine straw, crepe myrtle cuttings, grass cuttings, have been placed (dumped) along the shoreline in the submerged wetlands for years in an attempt to create additional high ground on the property. It is our understanding that historical surveys of the property may contain information that would identify areas of fill that should also be excluded from the areas calculations for density. We have informed both adjacent property owners via certified mail with renderings of the new site plan and survey along with required letters of explanation of their rights. We are confident that we have fully addressed and satisfied the objections posed by Mr. Sink, adjacent riparian property owner, in his letter received by you on October 20, 2017. Note we are submitting a sealed survey by Base Line Survey dated November 7, 2017. Our site plan drawing is an expanded version of this survey. The NHW and Marsh Line were verified numerous times by CAMA officials, specifically you, Ms. Courtney Spears, and finally by Ms. Debra Wilson on October 26, 2017. The site plan shows proposed fill, house footprint, decks, and driveway. We are still working toward our final architectural design but it will not exceed the boundaries of the proposed footprint; therefore, this should not affect the issuance of the permit. Mr. Sink also raised concern about our impact to adjacent Outstanding Resource Waters with regard to State Storm Water Regulations. CAMA's regulations and setbacks pursuant to this application have been met and therefore have accomplished that protection. Mr. Galloway, we regret that you, Ms. Spears, and Ms. Wilson were subject to the unnecessary verbal behavior exhibited by Mr. Sink on October 23" when you visited our parcel to validate flag positions. We also regret that multiple visits were indeed required as a result of "someone" repeatedly moving the boundary flags placed by CAMA officials. Please let it be noted that there was agreement by all three CAMA officials on established boundaries during these multiple visits.
