This permit, issued on October 26, 2017, is subject to compliance with the application and site drawing (where consistent with the permit), all applicable regulations and special conditions and notes set forth below. Any violation of these terms may subject the permittee to a fine, imprisonment or civil action, or may cause the permit to be null and void, This permit authorizes: Demolition of Existing Structure and Construction of a New Single -Family Residence. (1) All proposed development and associated construction must be done in accordance with the permitted site drawing dated received by the Town on October 12, 201T (2) All construction must conform to the N.C. Building Code requirements, the Town of Sunset Beach Unified Development Ordinance and all other local, State and Federal regulations, applicable local building and zoning ordinances and NFIP Flood Regulations. (3) Any change or changes in the plans for development, construction, or land use activities will require a re-evaluation and modification of this permit. (4) A copy of this permit shall be posted or available on site. Contact this office at 910.579.6297 for a final inspection at completion of work. (Additional Permit Conditions on Page 2) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be on the project site and accessible to the permit officer when the project is inspected for compliance. Any maintenance work or project modification not covered under this permit, require further written permit approval. All work must cease when this permit expires on: December 31, 2020 In issuing this permit it is agreed that this project is consistent with the local Land Use Plan and all applicable ordinances. All proposed development and associated construction must be done in accordance with the design specifications of the permitted innovative design, sealed by the design professional, Edward Brunner, on October 12, 2017. 1 I (6) The innovative designed system may not encroach into the 30' buffer from the normal high water line. (7) Upon completion of construction and prior to the issuance of a Certificate of Occupancy (CO), a letter of certification must be received from the designer of the innovative system installed, certifying that the permitted system has been installed in accordance with this permit, the approved plans and his design specifications. Any deviations from the approved plans and specifications must be noted on the Certification and a permit modification may be required prior to receiving a CO. (8) The landowner or permittee shall at all times provide the operation and maintenance necessary to assure the permitted stormwater system functions at optimum efficiency. The landowner or permittee shall maintain the permitted stormwater system for the life of the project. (9) All unconsolidated material resulting from associated grading and landscaping shall be retained on site by effective sedimentation and erosion control measures. Disturbed areas shall be vegetated and stabilized (planted and mulched) within 14 days of construction completion. (10) Any proposed grading within the 30' buffer from the Normal High Water level must be contoured to prevent additional stormwater runoff to the adjacent marsh and/or canal. This area shall be immediately vegetatively stabilized, and must remain in a vegetated state. (11) With exception of an elevated wooden walkway/stairs and 200 sq. ft. or less of elevated slatted uncovered wood decking, no other development is authorized within 30 feet of the normal high water line, or the line previously established by the existing structure relative to the redevelopment of the existing structure. (12) Pursuant to 15A NCAC, Subchapter 7J.0406(b), this permit may not be assigned, transferred, sold or otherwise disposed of to a third -party. (13) Projects shall not increase stormwater runoff to adjacent estuarine and public trust waters. (14) Prior to any development, silt fence shall be properly installed between all planned land disturbance and the adjacent marsh, open water areas, and adjacent properties; the silt fence shall be properly maintained throughout the construction period. Silt fence shall be installed such that it is properly toed -in to the soil. Include here any real estate that is a portion of a larger, previously unsegregated tract when that area is reasonably necessary for the convenient use and occupation of Improvements on the larger tract) DEFINITIONS: The following capitalized terms as used in this Agreement shall have the following meanings: • Improvement: All or any part of any building, structure, erection, alteration, demolition, excavation, clearing, grading, filling, or landscaping, including trees and shrubbery, driveways, and private roadways on the Property as defined below. • Labor. Reliance and Indemnification: This Agreement may be relied upon by the purchaser in the purchase of the Property, a lender to make a loan secured by a deed of trust encumbering the Property and by Company in issuance of a tifle insurance policy or policies insuring title to the Property without exception to matters certified in this Agreement The provisions of this Agreement shall survive the disbursement of funds and dosing of this transaction and shall be binding upon Owner and anyone claiming by, through or under Owner. Owner agrees to indemnify and hold purchaser, lender, and Company harmless of and from any and all loss, cost, damage and expense of every kind, and attorney's fees, costs and expenses, which the purchaser, lender or Company shall or may incur or become liable for, directly or indirectly, as a result of reliance on the certifications of Owner made herein or in enforcement of the Company's rights hereunder. 3. NCLTA Copyright and Entire Agreement: This Agreement and any attachments hereto represent the entire agreement between the Owner and the Company, and no prior or contemporaneous agreement or understanding inconsistent herewith (whether oral or written) pertaining to such matters is effective.
