SUBJECT: Moratorium Relief Request Extension for Permit No. 35-20, issued to Carteret
County, for the dredging of East Taylors Creek with placement on Radio Island,
located in Carteret County, North Carolina
Dear Sirs:
This letter is in response to the above referenced CAMA permit relief request extension received
by the DCM Morehead City office by email on April 11, 2022. The resource agencies
previously authorized a one-time relief request to April 15, 2022, to allow the applicant time to
determine daily excavation rates and to update the projected completion date accordingly. To
review this request extension, we coordinated with the NC Division of Marine Fisheries (NC
DMF), NC Wildlife Resources Commission (NC WRC), NC Division of Water Resources (NC
DWR), US Army Corps of Engineers (USACE), and the National MarineFisheries Service
(NMFS).
This moratorium relief request is to complete ongoing dredging operations to be extended to at
least April 30, 2022, with beach placement and demobilization to conclude no later than May 15,
2022. In consultation with the resource agencies, authorization was given with the following
conditions:
1. The relief request extension is granted until April 30, 2022, with complete
demobilization (dredge and beach placement operations) to occur no later than 5 days
from the end of dredging operations, or no later than May 5, 2022. Off the beach
demobilization, to include the DMCA, can occur beyond May 5, 2022.

2. When required, beach and shoreline/in-water demobilization shall occur in its entirety
and expedited to the greatest extent possible following the dates listed above. To avoid
negative impacts to beach nesting populations, demobilization efforts of the nourished
beach include the smoothing of ruts and depressions.
3. The NC DMF and NMFS requests that turbidity monitoring continue, and operations be
modified if turbidity levels are determined to be outside established thresholds.
4. The applicant or their agent shall notify the Division of Coastal Management and the
above resource agencies with weekly volume rates and total volume estimates by the
COB each Friday.
5. All other conditions and stipulations within CAMA Permit No. 35-20 remain in effect
unless altered herein.
6. The applicant or their agent shall notify the NC DCM of the following operational
milestones:
a. Completion of dredging operations.
b. Completion of dredging, beach and in -water demobilization operations.
c. Completion of beach placement and demobilization operations.
Therefore, the one-time moratorium relief request extension is granted with the above
conditions. The resource agencies have specified that further requests for relief beyond April 30,
2022, will not be considered. If you have any questions concerning these matters, please feel

Thank you Gregg. I do not have issues with their equipment or work being conducted after May 5 for
areas outside the Radio Island shoreline or in front of the reserve. From my understanding demobing
the area behind the beach will take some time and as long as the work doesn't have lights at night it
should be fine. They can get off the beach and then finish up the remaining. Thank you.

As of this morning I have only received comments from Maria (WRC) concerning the May 15th
request to place beach material. With Maria's comments seeming to be the most restrictive, in the
sense that they align with the overall moratorium relief dates provided by agencies and does not
extend past them. I will use Maria's comments that all operations must be complete by May 5th. If
there is any justification from the other agencies to the need to limit the beach placement from the
requested May 15, 2022 to the authorized May 5, 2022 please let me know.
My plan is to get this to the applicant and agent by 10am at the latest.

1 stated concerns for the original extension to May 15 during one of the weekly meetings. It was
discussed and stated that removal of equipment from the shoreline would only take a few days, but
that complete removal of the equipment from Radio Island would be the need for the longer
extension.
Therefore, May 5 is the date the equipment should be removed from the shoreline of Radio Island as
well as the alignment of the pipe near the Rachel Carson Reserve.

Thanks for the quick replies. One more question to ask...
Beach placement is still requested to continue through May 15th, with the curtain. Is this
acceptable. Below is some draft language to deal with the issues.
1. The relief request extension is granted until April 30, 2022, with complete dredge
demobilization to occur no later than 5 days from the end of dredging operations, or no
later than May 5, 2022.
2. The applicant stated that beach placement will be conducted during dredging operations
and shall cease no later than 15 days from the end of dredging operations, or no later
than May 15, 2022. This date includes all beach placement demobilization. All
stipulations concerning beach placement conditioned in the CAMA Permit remain in
effect, unless altered herein.
3. When required, demobilization shall occur in its entirety and expedited to the greatest

As requested in your March 31, 2022 letter granting in -water moratoria relief until April 15, 2022 for
the Carteret County -East Taylors Creek/Radio Island dredging project, we offer the following
information on project progress to date:
Through Sunday, April 10, 2022, approximately 4,600 CY of material has been pumped from East
Taylors Creek into the Dredge Material Containment Area (DMCA). To date, there has been no
discharge of dredge effluent from the DMCA into open water. Therefore, turbidity monitoring
within waters adjacent to the effluent discharge pipe have not yet been initiated.
It is expected that daily dredge volumes will increase as the contractor moves past equipment and
marine debris issues that have hampered dredge activities to date, and as dredge operations move
from initial areas being dredged (that require shallower cuts and therefore the removal of less
material) to areas requiring greater deeper cuts and therefore greater quantities of sand to be
removed.
Given the information provided above, Carteret County requests that the permitted window for in -
water work be extended to from April 15, 2022 to at least April 30, 2022. The County has indicated
that if the project is not completed this season, the County's Defense Community Infrastructure
Program (DCIP) grant funding will likely be terminated, and there will not be replacement funding
available for the project to continue in the fall. Therefore, your prompt attention in considering and
granting this additional extension request is greatly appreciated.
If there is any additional information that you need to allow for the timely processing of this request,
please feel free to let me know.

DMF agrees with the comments submitted by WRC. The pipeline should be removed from the

As requested in your March 31, 2022 letter granting in -water moratoria relief until April 15, 2022 for
the Carteret County -East Taylors Creek/Radio Island dredging project, we offer the following
information on project progress to date:
Through Sunday, April 10, 2022, approximately 4,600 CY of material has been pumped from East
Taylors Creek into the Dredge Material Containment Area (DMCA). To date, there has been no
discharge of dredge effluent from the DMCA into open water. Therefore, turbidity monitoring
within waters adjacent to the effluent discharge pipe have not yet been initiated.
It is expected that daily dredge volumes will increase as the contractor moves past equipment and
marine debris issues that have hampered dredge activities to date, and as dredge operations move
from initial areas being dredged (that require shallower cuts and therefore the removal of less
material) to areas requiring greater deeper cuts and therefore greater quantities of sand to be
removed.
Given the information provided above, Carteret County requests that the permitted window for in -
water work be extended to from April 15, 2022 to at least April 30, 2022. The County has indicated
that if the project is not completed this season, the County's Defense Community Infrastructure
Program (DCIP) grant funding will likely be terminated, and there will not be replacement funding
available for the project to continue in the fall. Therefore, your prompt attention in considering and
granting this additional extension request is greatly appreciated.

I stated concerns for the original extension to May 15 during one of the weekly meetings. It was discussed and stated
that removal of equipment from the shoreline would only take a few days, but that complete removal of the equipment
from Radio Island would be the need for the longer extension.
Therefore, May 5 is the date the equipment should be removed from the shoreline of Radio Island as well as the
alignment of the pipe near the Rachel Carson Reserve.

Beach placement is still requested to continue through May 151b, with the curtain. Is this acceptable. Below is some
draft language to deal with the issues.
1. The relief request extension is granted until April 30, 2022, with complete dredge demobilization to
occur no later than 5 days from the end of dredging operations, or no later than May 5, 2022.
2. The applicant stated that beach placement will be conducted during dredging operations and shall cease
no later than 15 days from the end of dredging operations, or no later than May 15, 2022. This date
includes all beach placement demobilization. All stipulations concerning beach placement conditioned
in the CAMA Permit remain in effect, unless altered herein.

I think John, Jimmy, Sarah, and Twyla can answer if they need clarification or discussion prior to the scheduled call
tomorrow. NCWRC has considered the information provided in the email and is responding accordingly.
As far as the request, I noticed the email stated they wanted relief until at least April 30. 1 do not recall discussion of
working in the water past April 30. This is already 30 days after the start of the moratorium and there are concerns with
impacts to aquatic resources in the area of the dredge activities, wildlife and public trust resource impediments along
the pipeline route, and environmental and public trust resource impacts on Radio Island. I would strongly recommend
they set their goal to be complete with dredging by April 30, if it is determined a new extension can be granted.
NCW RC's earlier statement that included removal of equipment from the shoreline and pipeline in front of the Rachel
Carson Reserve 5 days after dredge operations are complete used the original April 30 request as the maximum
consideration.
Therefore, NCWRC supports the recommendations for aquatic moratorium relief as stated by NCDMF, NMFS, and
NCDWR for the protection of their resources. However, May 5 is the latest date we support for the removal of
equipment from the Radio Island shoreline and pipeline in front of the Rachel Carson Reserve. If an extended date for
dredge activity concludes earlier than April 30, equipment should be removed within 5 days after dredge activities to
minimize impacts and impediment to environmental and public trust resources to the greatest extent possible.
Thank you for the coordination Gregg. Please continue to inform NCWRC on the determination of moratorium relief
allowance as well as project progression.

In a call yesterday Doug indicated that the dredge material has percolated into the ground and no discharged has

Good morning Gregg,
DMF is amenable to granting an additional extension through April 30, as well as the 5 days
for demobilization as detailed in WRC's response to this request. DMF would recommend that
every effort be made to ensure that in -water work is completed by April 30 and demobilization
by May 5. As noted in the response for the previous moratorium relief request, portions of the
North and Newport Rivers are designated as Secondary Nursery Areas (SNA), and many of
the creeks and tributaries branching from these rivers, as well as the upstream portions of these
rivers, are designated as Primary Nursery Areas (PNA). Many of the species of concern will
be migrating out of these creeks and into the rivers as the moratorium period continues.
Additionally, inlets - such as nearby Beaufort Inlet - begin to see peak biological productivity
during this time as well. Therefore, concerns with impacts to species of concern will be greater
if in -water work proceeds past April 30.

discharged has occurred. So no samples have been occurred due to the lack of discharge.

As requested in your March 31, 2022 letter granting in -water moratoria relief until April 15, 2022 for
the Carteret County -East Taylors Creek/Radio Island dredging project, we offer the following
information on project progress to date:
Through Sunday, April.10, 2022, approximately 4,600 CY of material has been pumped from East
Taylors Creek into the Dredge Material Containment Area (DMCA). To date, there has been no
discharge of dredge effluent from the DMCA into open water. Therefore, turbidity monitoring
within waters adjacent to the effluent discharge pipe have not yet been initiated.
It is expected that daily dredge volumes will increase as the contractor moves past equipment and
marine debris issues that have hampered dredge activities to date, and as dredge operations move
from initial areas being dredged (that require shallower cuts and therefore the removal of less
material) to areas requiring greater deeper cuts and therefore greater quantities of sand to be
removed.
Given the information provided above, Carteret County requests that the permitted window for in -
water work be extended to from April 15, 2022 to at least April 30, 2022. The County has indicated
that if the project is not completed this season, the County's Defense Community Infrastructure
Program (DCIP) grant funding will likely be terminated, and there will not be replacement funding
available for the project to continue in the fall. Therefore, your prompt attention in considering and
granting this additional extension request is greatly appreciated.
If there is any additional information that you need to allow for the timely processing of this request,
please feel free to let me know.

I think John, Jimmy, Sarah, and Twyla can answer if they need clarification or discussion prior to the
scheduled call tomorrow. NCWRC has considered the information provided in the email and is
responding accordingly.
As far as the request, I noticed the email stated they wanted relief until at least April 30. 1 do not
recall discussion of working in the water past April 30. This is already 30 days after the start of the
moratorium and there are concerns with impacts to aquatic resources in the area of the dredge
activities, wildlife and public trust resource impediments along the pipeline route, and
environmental and public trust resource impacts on Radio Island. I would strongly recommend they
set their goal to be complete with dredging by April 30, if it is determined a new extension can be
granted. NCWRC's earlier statement that included removal of equipment from the shoreline and
pipeline in front of the Rachel Carson Reserve 5 days after dredge operations are complete used the
original April 30 request as the maximum consideration.
Therefore, NCWRC supports the recommendations for aquatic moratorium relief as stated by
NCDMF, NMFS, and NCDWR for the protection of their resources. However, May 5 is the latest date
we support for the removal of equipment from the Radio Island shoreline and pipeline in front of the
Rachel Carson Reserve. If an extended date for dredge activity concludes earlier than April 30,
equipment should be removed within 5 days after dredge activities to minimize impacts and
impediment to environmental and public trust resources to the greatest extent possible.
