This permit, issued on . August 15, 2019 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
authorized community docking facility and addition of the gazebo, all as expressly and specifically
set forth in the attached email, application, and workplan drawings. Any additional land disturbing
activities and/or construction may require a modification of this permit. Contact a Division of Coastal
Management representative at (910) 796-7215 for this determination.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

2) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are
permitted. Lattice is specifically excluded .from being used under this authorization.
3) The roof of the gazebo shall not be designed for second story use.
General
3) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
4) This Minor Modification shall be attached to Permit 23-18, which was transferred to the permittee on
06/03/19 and copies of both documents shall be readily available on site when Division personnel
inspect the project for compliance.
5) All conditions and stipulations of the active permit remain in force under this Minor Modification unless
specifically altered herein.
NOTE: This permit does not convey any rights, either in real estate or material.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers assigned the project Action ID No. SAW-2018-00111.
NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. DWR-2018-0093.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

Through coordination with the North Carolina Division of Coastal Management, we have
learned of your request to modify the work associated with your Department of the Army (DA)
permit issued on March 13, 2018, which originally authorized the construction of a ten (10) slip
community docking facility situated at the southernmost edge of the riparian corridor located at
221 Summer Rest Road, New Hanover County, North Carolina. The permit was last modified on
June 17, 2019 with the latest modification request for the addition of a 16' by 16' gazebo at the
terminus of the authorized fixed pier in an "L-head" configuration. Please see two (2) drawings
dated May 15, 2019.
Your proposal continues to be consistent with the provisions and objectives of general
permit No. 19800291 (copy enclosed). The permit is hereby modified. It is understood that all
other conditions of your permit remain applicable. The expiration date of your DA permit is
December 31, 2021.

SUBJECT: Permit Modification Request to State Permit No. 23.18, Parkside WF Investors, LLC, 221 Summer Rest
Road, Wilmington, in New Hanover County
Mr. Greg Finch, acting on behalf of Parkside WF Investors, LLC, is requesting a Minor Modification to State Permit
No. 23-18. This request was submitted in a letter dated May 15, 2019 with two (2) drawings, 1-2 of 2, both dated May
14, 2019. State Permit No. 23-18 was originally issued March 13, 2018 to Susan Hale and Laurel Brooks for the
construction of a community docking facility with associated dredging. A Minor Modification was issued on April 12,
2019 to reconfigure the docking facility and reduce the number of slips to eight (8). State Permit No. 23-18 was then
transferred on June 3, 2019 to Parkside WF Investors, LLC. The construction authorized by State Permit No. 23-18
has not been completed. State Permit No. 23-18 is due to expire on December 31, 2021.
The Minor Modification request consists of the addition of a 16' by 16' gazebo at the terminus of the authorized fixed
pier in an "L-head" configuration. It appears that the facility would be shifted slightly to the north of the currently
authorized area to allow the gazebo to be positioned against the pierhead line and the 15' Riparian Corridor Setback
Area to the south. The proposed change would not extend waterward of the existing authorized facility, and there do
not appear to be any additional changes requested to the docking facility or the dredge footprint.
The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which include the use standards for
piers and docking facilities. This office has no objection to the modification of State Permit No. 23-18, provided it is
consistent with all other local, state, and federal regulations. Davey Resource Group, Inc. have submitted a check
(check No.1465) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE, NC DWR, and the City of Wilmington Zoning
Administrator to provide any comments that your agency may have on the proposed project to Courtney
Spears of DCM's Wilmington office within 14 days of receipt of this memo.

On behalf of Parkside WF Investors LLC, I would like to request a minor modification of CAMA Major
Permit Number 23-18. Parkside WF Investors LLC purchased the property on April 15, 2019 (deed
attached), and a permit transfer request was submitted on April 30, 2019. Parkside WF Investors LLC is
requesting a modification to the permit to include the addition of a 16'x16' covered gazebo at the
end of the permitted fixed pier. Due to Wilmington City restrictions, the Gazebo was not permitted to be
placed on land as proposed in the last permit modification request.
Enclosed are drawings detailing the modification items and the $100 modification fee.
The adjacent riparian landowners have been notified by mail and the certified receipts are
attached.
