i Permit Class MODIFICATION/ MAJOR STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for Permit Number 23-18 RECEIVED— OCT 08 2019 DCM-MHD CITY X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Parkside WF Investors, LLC,1902 Eastwood Road, Wilmington, NC 28403 Authorizing development in New Hanover County adj. to AIW W, at 221 Summer Rest Road, Wilmington , as requested in the permittee's application dated 06/13/19, including attached workplan drawings (4) 1-4 of 4 all dated 07/26/19. This permit, issued on September 26, 2019 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to tines, imprisonment or civil action; or may cause me permit to oe nun anu votu. Private Dockine Facility 1) Unless specifically altered herein, this Major Modification authorizes the construction of a private docking facility, in addition to the previously authorized 8-slip community docking facility on the same parcel, and dredging associated with the private docking facility, all as expressly and specifically set forth in the attached application and workplan drawings. 2) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this private docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See Attached Sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Parkside WF Investors, LLC Permit No. 23-18 Page 2 of 4, ADDITIONAL CONDITIONS 3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the private docking facility. Any sewage discharge at the private docking facility shall be considered a violation of this permit for which the pemiittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shallnot exceed six (6) feet in width and shall be elevated a minimum of three (3) feet over the wetland substrate as measured from the bottom of the decking. 5) The pemuttee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the. authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of two (2) formalized boat slips at the private docking facility in addition to the eight (8) permitted.formalized slips at the community docking facility, for a total of ten (10) formalized slips. 7) The pier and associated structures shall have a minimum setback distance of 15,feet between any parts of the structure and the adjacent property owner's area of riparian access, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the,upland property line meets the water's edge. 8) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Lattice is specifically excluded from being used under this authorization. 9). The roof of the gazebo shall not be. designed for second story use. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized structures shall not exceed the established pier head line as depicted on the attached workplan drawings. Excavation at Private'Dockine Facility 12) Excavation at the private docking facility shall not exceed -6 feet below normal low water. In no case shall the depth of excavation exceed the depth of connecting waters: 13) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 14) No excavation or filling of any vegetated wetlands is authorized by this permit. Parkside WF Investors, LLC Permit No. 23-18 Page 3 of 4 ADDITIONAL CONDITIONS Maintenance Clause 15) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Spoil Disposal 16) All excavated materials shall be confined above mean high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 17) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. General 18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 19) The permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 20) The permittee shall obtain any necessary authorizations or approvals from the US Army Corps of Engineers prior to initiation of any permitted activity. Unless specifically altered herein, the permittee shall adhere to all conditions of the Federal approval. 21) This Major Modification shall be attached to the original of Permit No. 23-18, which was transferred to the permittee on 06/03/19, as well as all the Minor Modification issued on 08/15/19, and copies of all documents shall be readily available on site when Division personnel inspect the project for compliance. 22) All conditions and stipulations of the active permit remain in force under this Major Modification, unless specifically altered herein. NOTE: The permittee is advised that future upland development of the project area may require stormwater approval. Please contact the Division of Energy, Mineral, and Land Resources at (910) 796-7215. NOTE: This permit does not convey any rights, either in real estate or material. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Conservation and Resource Protection. In general, Wilmington -New Hanover County allows development in Conservation/Resource Protection classified AECs, which is consistent with the State's minimum use standards. The Wilmington -New Hanover County Land Use Plan contains some policies, which exceed the State's minimum use standards, however none of these policies are applicable to this project. When looking back on the Susan Hale and Laurel Brooks permit application comments (February 2018), there was concern with the potential unnecessary impacts such as the ones proposed with Parkside WF Investors LLC. However, upon reading through the MP4, the expected boat length of 30'-60' would not be able to utilize the adjacent permitted docking facility with lifts, and could justifiably require a dredge depth of -6' NLW when compared to the adjacent -4' NLW next door. These impacts are unavoidable and minimized to a satisfactory degree. This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries, regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. It is the staffs recommendation that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 0711.0208 (b) (1) which states, "Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the MFC, or areas of coastal wetlands except as otherwise allowed within this subchapter." PROJECT DESCRIPTION: The project site is located at 230 Summer Rest Road (NCSR 1417), adjacent to Greenville Sound, and the Atlantic Intracoastal Waterway (AIWW), Wilmington, in New Hanover County. To locate the site from the Wilmington Regional Office (WiRO) take US Hwy 74/76 towards Wrightsville Beach just before crossing the drawbridge to Wrightsville Beach. The property is approximately 800' north of the US Highway 74/76 drawbridge to Wrightsville Beach. To locate the property from Military Cut -Off Road (NC Highwayl7), turn onto Eastwood Road towards Wrightsville Beach. Travel east approximately 1 mile and turn left onto Summer Rest Road. Travel approximately 0.15 miles and the property of interest crosses over Summer Rest Road. The project site is bordered to the north and south by existing single family homes. There is an existing 6-slip docking facility to the north and a 10-slip community docking facility to the south. The property is undeveloped, although it was previously the site of Bowden Nursing Home until it was demolished in approximately 2012. In March 2018, DCM issued State Permit No. 23-18 to Susan Hale and & Laurel Brooks, which permitted the construction of a 10 slip docking facility with a fixed pier, boat lifts, and dredging to -4 at MLW, for 221 Summer Rest Road. On April 12, 2019, DCM authorized a minor modification to State Permit No. 23-18, to the reduce the proposed 10 slip facility (not yet constructed) to 8 slips. The intent of the reduction was to allow for a major modification (this permit request) to State Permit No. 23-18, for the construction of a 2 slip facility for a newly subdivided waterfront lot at 230 Summer Rest Rd, which was parceled from the original 221 Summer Rest property on May 30, 2019. Ms. Hale and Ms. Brooks sold the property to Parkside WF Investors LLC in April 2019, and State Permit No. 23-18 was transferred accordingly. An access and riparian easement was recorded for shoreline allocation to support State Permit No. 23-18 and this current major modification request for the 2 slip facility. The application states that the project site is approximately 0.66 acres with approximately 79' of shoreline frontage and averages 6' in elevation above normal high water (NHW). The marsh area, between the hghground along Summer Rest Road, and Greenville Sound, consists primarily of Smooth Cordgrass (Spartina alterniora), and is about 110' in width at the project site location. At the transition to hghground, there is high coastal marsh vegetation, intermixed with Spike Grass (Distichlis spicata), Sea Oxeye (Borrichia frutescens), Sea Lavender (Limonium, spp.), Saltwort (Salicornia, spp.), and Salt Meadow grass (Spartina patens). Shrubs including; Marsh Elder (Iva frutescens), Grounsel-bush (Baccharus halimifolia), and Wax Myrtle (Myrica cerifera) complete the transition to the hghground. Highground vegetation consists of lawn grasses, Live Oak (Quercus virginiana), various pine species, and Red Cedar (Amiperus virgniana). The New Hanover County and the City of Wilmington 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the Motts Creek and Middle Sound are classified SB (Wrightsville Recreational Area) by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a 2-slip docking facility and excavate an open water boat basin. The application states that an access pier (29 P x 6') would be constructed along the northern edge of the riparian access corridor, extending in a south easterly direction. The eastern terminus of the fixed pier would support a covered platform (14' x 14'), extending waterward. From the southeastern edge of the covered platform, the applicant proposes a gangway extending in a southwesterly direction, landing on a floating dock (48' x 8') oriented to the southwest. Current water depths range from approximately -P to -2' at NLW in the area of the proposed floating dock. Due to the water depths being insufficient, the applicant also proposes to box cut dredge an area 58' wide by 117' long, to a final project depth of -6 at MLW, generating roughly 1000 cy of dredge spoil. The applicant proposes to mechanically excavate by bucket -to -barge method and the excavated material would then be hauled to the Agnes Beane Site, a private disposal adjacent to USACE DA 248, located approximately 0.9 miles south of the project site at the confluence of the AIW W and Motts Channel (US Army Corps of Engineers (USACE) Disposal Site No. DA-0248). The application states that the proposed docking facility would accommodate up to 2 slips for mixed type vessels between 30' to 60' in length. The proposed excavation would impact approximately 5,790 fl of shallow bottom area through the use of mechanical dredging, resulting in the removal of approximately 1,000 cubic yards of material. The disposal of the material would impact approximately 8,350 ft of highground, which would be located onto an existing spoil island at the confluence of the ARVW and Motts Channel (USACE Disposal Site No. 0248). The proposed structures would extend approximately 165' into a waterbody, which measures approximately 630' across (AIW W), which would exceed the '/. width distance, however it is within 200' of facilities to the north and south which extend a similar length into the water body, and it would not exceed the 1/3 width distance. The proposed docking facility would not encroach into either adjacent 15' riparian corridor setback requirement to the north or south. Project Narrative 4.1.1 Project Location and Existing Conditions The project is located on the Atlantic Intracoastal Waterway at 230 Summer Rest Road in Wilmington, New Hanover County. The overall property previously operated as the Bowden Nursing Home but has since been cleared and remained vacant for several years. On March 13, 2018 NC DCM issued a CAMA Major Permit to Susan B. Hale & Laurel B. Brooks for the construction of a 10-slip docking facility that included a fixed pier, boat lifts and dredging to -4MLW — located at 221 Summer Rest Road, Wilmington, NC 28405 (Permit # 23-18). On April 12, 2019 a Minor Modification was authorized which reduced the 10-slip docking facility to 8-slip so that the waterfront lot could apply for a private 2-slip docking facility. Ms. Hale & Ms. Brooks then sold the property to Parkside WF Investors, LLC, a North Carolina limited liability company on April 15, 2019, and a CAMA Major Permit transfer request was submitted on April 30, 2019. An access and riparian easement was recorded such that the shoreline allocation would support both the previously issued CAMA Major Permit # 23-18 and the current CAMA Major Permit request for the waterfront parcel. This permit request pertains only to the waterfront lot, which was parceled from the overall property by the City of Wilmington Engineering Department on May 30, 2019. Waters in the project area are classified as SA and are not open to shellfishing. There are no SAV or shellfish resources present. 4.1.2 Proposed Action There is no upland work proposed on the waterfront lot. In order to provide Intracoastal Waterway access to the waterfront lot, a 291-foot long fixed pier is proposed with a 14' x 14' covered gazebo and floating boat dock. Floating dock will be 48-feet long by 8-feet wide, see Appendix A for details. Due to water depths surrounding the proposed floating dock and the large 30-60' center console and sport fishing boats favored by premium waterfront property clientele, dredging to -6 MLW is proposed. The dredging area is not located in ORW or PNA. An approximate 58-foot wide by 117-foot long box cut to -6 MLW will generate approximately 1,000 cubic yards of dredge spoil. Dredging will extend to existing -6' MLW depths adjacent to the USACE navigation channel. Bucket -to -barge excavation is proposed and the excavated material will be placed on DA-248 outside of the USACE right-of-way along and adjacent to the existing dike. See Appendix C for details.
