This permit, issued on Jauuary 6, 2020 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
)e subject to nnes, imprisonment or ctvu action; or may cause me permit to oe mum ana vota.
1) Unless specifically altered herein, this Minor Modification authorizes the change in use of the
authorized boat slips to allow for the sale or lease, all as expressly and specifically set forth in the
attached letter. Any additional development activities may require a modification of this permit.
2) The permittee is advised that a Special Use permit from New Hanover County shall be obtained and
a copy provided to the Division of Coastal Management authorizing the change in boat slip usage
prior to any boat slip sale or lease.
3) This modification does not authorize any additional formalized boat slips.
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.
Signed by the authority of the Secretary of DEQ and the Chair
of the Coastal Resources Commission.

4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This Minor Modification shall be attached to the original Permit No. 23-18, which was transferred to the
permittee on 6/3/19, as well as all subsequent modifications, refinements, and renewals, and copies of all
documents must be readily available on site when Division personnel inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force unless specifically altered herein.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW-
2018-00111.
NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2019-1101.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

SUBJECT Permit Modification Request to State Permit No. 23.18, Parkside Investors LLC, 221 Summer Rest Road, in New
Hanover County
Mr. Greg Finch, of Land Management Group Inc, and acting on behalf of Parkside WF Investors, LLC is requesting a Minor
Modification to State Permit No. 23-18. This request was submitted in a letter received by DCM on November 8, 2019, and adjacent
riparian property notification cards were received on November 22, 2019,
State Permit No. 23-18 was originally issued March 13, 2018 to Susan Hale and Laurel Brooks for the construction of a community
docking facility with associated dredging. A Minor Modification was issued on April 12, 2019 to reconfigure the docking facility and
reduce the number of slips to eight (8), concurrent with a deed restriction that was placed on the property. Stale Permit No. 23-18
was then transferred on June 3, 2019 to Parkside WF Investors, LLC. A Minor Modification was issued on August 15, 2019 for the
addition of a 16' x 16' gazebo. A Major Modification was issued on September 26, 2019 for the construction of a separate pier,
gazebo, and two slip docking facility and associated dredging. The construction aulhodzed by Slate Permit No. 23-18 is currently
underway. State Permit No. 23-18 is due to expire on December 31, 2021
The applicant is requesting changes to the permit to allow for the sale or lease of some of the slips included in the permitted 8 slip
docking facility. New Hanover County regulations require a Special Use Permit to any docking facility serving 5 or more lots or
units. State Permit 23.18 included a condition that changes to the upland portion of the property and obtaining a Special Use
Permit from the County would require a minor modification of State Permit 23-18, Thus, with this request, the applicant is pre-
emptively applying for the minor modification, and states that they will provide a copy of the New Hanover County Special Use
Permit to the Division of Coastal Management before any sale or lease of the aforementioned lots or units occurs (see later dated
as received by DCM on November 8, 2019).
The proposed modifications appear to be consistent with NCAC 07H .0208(b)(6), which includes the specific use standards for
docking facilities. This office has no objection to the modification of Stale Permit No. 23-18, provided it is consistent with all other
local, state, and federal regulations. Parkside Investors LLC has submitted a check (check No.1338) in the fee amount of $100.
By copy of this memo, DCM is requesting that the USACE, NC DWR, the City of Wilmington, and the New Hanover County LPG provide any comments
that your agency may have on the proposed project to Greg Bodnar of DCM's Morehead City office within 14 days of receipt of this memo.
