Greenville Sound and AIW W. at 232 Summer Rest Road in Wilmington , as requested in the permittee's application dated 7/20/20, including attached workplan drawings (4), Sheets 1-3 of 3 dated revised 9/10/20 and Disposal Sheet 1 of 1 dated 6/16/20. This permit, issued on December 10, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation it tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void. Excavation 1) No excavation shall take place outside of the area indicated on the workplan drawings. 2) Excavation shall not exceed -4 feet below the mean low water (MLW) In no case shall the depth of excavation exceed the depth of connecting waters. 3) The temporary placement or double handling of excavated or fill materials within waters or vegetated wetlands is not authorized. 4) No excavation or filling of any vegetated wetlands is authorized by this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature i Parkside Waterfront Investors, LLC Permit No. 23-18 Page 2 of 3 ADDITIONAL CONDITIONS 5) No excavation shall take place within 10 feet of any Coastal Wetlands. 6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. Maintenance Clause 7) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of any maintenance excavation work authorized by this permit, and such notification shall include: A. The number of the original permit. B. A statement that no dimensional changes are proposed. C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the area to be used for spoil disposal, and the estimated amount of material to be removed. The location, design and holding capacity of the spoil disposal site shall be approved by a representative of the Division prior to the initiation of any maintenance dredging activities. D. The date of map revision and the permittee's signature shown anew on the original plan. Spoil Disposal 8) No spoil material shall be placed within 30 feet of the normal high water line. 9) All excavated materials shall be confined above normal high water and landward of regularly or irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of solids into any marsh or surrounding waters. 10) The diked disposal area shall be constructed a sufficient distance from the normal high water level or any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters. 11) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal Management prior to the commencement of any dredging activities. 12) Because the dredge material is being removed from an area that is closed to the taking of shellfish, discharges from the dewatering of spoils near any swimming areas between April 1 and October 31, or any area that is open to shellfishing, will require a swimming advisory to be posted or a shellfish closure to occur. The permittee shall contact the Division of Marine Fisheries — Shellfish Sanitation and Recreational Water Quality Section (252) 726-7021 prior to dredging any activity for this determination. USACE / FEDERAL CONDITIONS 13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at https://www.fws.gov/raleigh/pdfs/ManateeGuidelines20l7.pdf. 9 Parkside Waterfront Investors, LLC ADDITIONAL CONDITIONS General Permit No. 23-18 Page 3 of 3 14) This Major Modification shall be attached to the original Permit No. 23-18, which was transferred to the permittee on 6/3/19, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 16) The permittee shalt maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic General Permit No. 198000291 (SAW Action Id. No. 2018-00111). NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4175 and assigned the project DWR Project No. 2018-0093v2. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water. NOTE: An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. Should concerns be expressed over potential impacts from any of the resource agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location, design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas. It is the staffs recommendation that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 07H.0208 (b) (1) which states, "Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery areas, shellfish beds, beds of submerged aquatic vegetation as defined by the NYC, or areas of coastal wetlands except as otherwise allowed within this subchapter.". It also states "Any canal or boat basin shall be excavated no deeper than the depth of connecting waters. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as described in 15 A NCAC 213.0220. Appropriate sediment and erosion control practices must be used to meet this standard. Turbidity curtains shall be used as appropriate. The excavated material would be disposed at the Agnes Bean Site, a private disposal area located adjacent to USACE DA 248, located approximately 0.90 miles south of the project site at the confluence of the AI W W and Motts Channel. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: Special Conditions 1. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. 2. Prior to transporting spoil material to the Agnes Bean Site for disposal, the applicant must get a "Consent to Cross" easement (for the Navigation Channel) from the Corps of Engineers. Provide a written request and a map showing the disposal site and the crossing location to Justin Arnette at Justin.R.ArnetteC@usace.armv.mil. 3. Except as authorized by this permit or any USACE approved modification to this permit, no dredge, fill, or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project within waters outside the designated permitted boundary. This permit does not authorize temporary placement or double handling of excavated or fill material within waters outside the permitted area. 4. Work in wetlands are prohibited during the dredging, material disposal, or any other aspects of work associated with this project. All dredged material must be deposited on high ground. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973. 8. The activity must be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. PROJECT DESCRIPTION: The project site is located at 232 Summer Rest Road (NCSR 1417), adjacent to Greenville Sound, and the Atlantic Intracoastal Waterway (AIWW), Wilmington, in New Hanover County. To locate the site from the Wilmington Regional Office (WiRO) take US Hwy 74/76 towards Wrightsville Beach just before crossing the drawbridge to Wrightsville Beach. The property is approximately 800' north of the US Highway 74/76 drawbridge to Wrightsville Beach. To locate the property from Military Cut -Off Road (NC Highwayl7), turn onto Eastwood Road towards Wrightsville Beach. Travel east approximately 1 mile and turn left onto Summer Rest Road. Travel approximately 0.IS miles and the property of interest crosses over Summer Rest Road. The project site is bordered to the north and south by existing single-family homes, a vacant lot to the west and the AIW W to the east. There is an existing 6-slip docking facility to the north and a 10-slip community docking facility to the south. The property is undeveloped, although it was previously the site of Bowden Nursing Home until it was demolished in approximately 2012. In March 2018, DCM issued State Permit No. 23-18 to Susan Hale and 8a Laurel Brooks, which permitted the construction of a 10 slip docking facility with a fixed pier, boat lifts, and excavation of a 54' by 176' area to -4 at MLW, for 221 Summer Rest Road. On April 12, 2019, DCM authorized a minor modification to State Permit No. 23-18, to the reduce the proposed 10 slip facility to 8 slips. The intent of the reduction was to allow for a major modification to State Permit No. 23-18, for the construction of a 2 slip facility for a newly subdivided waterfront lot at 230 Summer Rest Rd, which was parceled from the original 221 Summer Rest property on May 30, 2019. Ms. Hale and Ms. Brooks sold the property to Parkside WF Investors LLC in April 2019, and State Permit No. 23-18 was transferred accordingly. An access and riparian easement was recorded for shoreline allocation to support State Permit No. 23-18 and the major modification request for the 2 slip facility. On September 26 2019 a major modification was issued authorizing the construction of a second docking facility with a total of two formalized slips and dredging to a depth of -6 NLW. At this time no work has been completed on the second docking facility. State permit number 23-18 is due to expire on December, 21, 2021. The application states that the project site is approximately 0.17 acres with approximately 152' of shoreline frontage and averages 6' in elevation above normal high water (NHW). Highground vegetation consists of ornamental landscaping, lawn grasses, and Live Oak (Quercur virginiana), this transitions to high marsh vegetation, intermixed with black needlerush (Jwwus roemerianus), bullrush (Scirpus sp.), and cattails (Typha sp.) into a low marsh, dominated by Smooth Cordgrass (Spartina alternij7ora) that is approximately 110 ft. wide. The New Hanover County and the City of Wilmington 2006 Land Use Plan Update classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the Molts Creek and Middle Sound are classified SB (Wrightsville Recreational Area) by the Division of Water Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to expand the authorized dredge footprint through a major modification to State Permit No. 23-18. The application proposes excavation of an additional 24' by 185' area (4,400 sq. fl.) to 4' MLW, landward and adjacent to the existing dredge footprint at the existing 8 slip docking facility (see Sheet 2, Plan View Detail). According to the applicant, the proposed dredge footprint allows for larger vessels and would connect bottom depth contours from the adjacent to the 8 slip facility, with excavation to -4 MLW permitted on March, 13, 2018, to the 2 slip facility with excavation to -6 MLW, permitted with the Major Modification on September 26, 2019. The applicant proposes to mechanically excavate an additional approximately 818 cy of dredge spoil using bucket -to -barge method. The excavated material would then be hauled to the Agnes Beane Site, a private disposal adjacent to USACE DA 248, located approximately 0.9 miles south of the project site at the confluence of the AIW W and Molts Channel (US Army Corps of Engineers (USACE) Disposal Site No. DA- 0248). The overall property previously operated as the Bowden Nursing Home but has since been cleared and remained vacant for several years. On March 13, 2018 NC DCM issued a CAMA Major Permit to Susan B. Hale & Laurel B. Brooks for the construction of a 10-slip docking facility that included a fixed pier, boat lifts and dredging to -4MLW — located at 221 Summer Rest Road, Wilmington, INC 28405 (Permit # 23-18). On April 12, 2019 a Minor Modification was authorized which reduced the 10-slip docking facility to 8-slip so that the waterfront lot could apply for a private 2-slip docking facility. Ms. Hale & Ms. Brooks then sold the property to Parkside WF Investors, LLC, a North Carolina limited liability company on April 15, 2019, and a CAMA Major Permit transfer request was granted June 3, 2019. An access and riparian easement was recorded such that the shoreline allocation would support both the previously issued CAMA Major Permit # 23-18 and the August 15, 2019 CAMA Minor Modification which allowed the reconfiguration of the authorized docking facility and the addition of a covered Gazebo. A CAMA Minor Modification was issued on January 6, 2020 which changed the use of the authorized boat slips to allow for the sale or lease of slips. Waters in the project area are classified as SA and are not open to shellfishing. There are no SAV or shellfish resources present. 3.1.2 Proposed Action There is no upland work proposed on the waterfront lot. Due to water depths surrounding the permitted 8-slip facility and the large 39 - 40' center console and sport fishing boats favored by premium waterfront property clientele, expansion of the -4 MLW dredging boundary is proposed. The original dredging footprint was designed to accommodate fixed finger piers of 24' length. After the modification reduced the facility from 10 to 8 boat slips, the finger piers were changed to floating and lengthened to 30'. However, to remain a minor modification, no change to the dredging footprint was requested at that time. To maintain the minimum backing distance of 1.5 times boat length, an expanded dredging footprint is requested. The dredging area is not located in ORW or PNA. An approximate 24-foot wide by 185-foot long box cut to -4' or -6' MLW will generate approximately 818 cubic yards of dredge spoil. Dredging will extend to existing -4' MLW depths adjacent to the existing permitted -6' MLW dredging boundary, and to -6' MLW within the existing permitted dredging boundary. Any sewage discharge at the private docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six (6) feet in width and shall be elevated a minimum of three (3) feet over the wetland substrate as measured from the bottom of the decking. 5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors should be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 6) This permit authorizes a maximum of two (2) formalized boat slips at the private docking facility in addition to the eight (8) permitted formalized slips at the community docking facility, for a total of ten (10) formalized slips. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's area of riparian access, which is determined by drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that intersects with the shore at the point where the upland property line meets the water's edge. g) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Lattice is specifically excluded from being used under this authorization. 9) The roof of the gazebo shall not be designed for second story use. 10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 11) The authorized structures shall not exceed the established pier head line as depicted on the attached workplan drawings. Excavation at Private Dockine Facility 12) Excavation at the private docking facility shall not exceed -6 feet below normal low water.
