including attached workplan drawings (4), Sheets 1-3 of 3 dated revised 9/10/20 and Disposal Sheet 1 of 1 dated 6/16/20.
This permit, issued on December 10, 2020 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
it tnese terms may be subject to tines, imprisonment or civil action; or may cause the permit to be null and void.
Excavation
1) No excavation shall take place outside of the area indicated on the workplan drawings.
2) Excavation shall not exceed -4 feet below the mean low water (MLW) In no case shall the depth of
excavation exceed the depth of connecting waters.
3) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
4) No excavation or filling of any vegetated wetlands is authorized by this permit.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2023
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
5) No excavation shall take place within 10 feet of any Coastal Wetlands.
6) All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a
spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the
National Response Center at (800) 424-8802 and provisions of the North Carolina Oil Pollution and
Hazardous Substances Control Act will be followed.
Maintenance Clause
7) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
Spoil Disposal
8) No spoil material shall be placed within 30 feet of the normal high water line.
9) All excavated materials shall be confined above normal high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
10) The diked disposal area shall be constructed a sufficient distance from the normal high water level or
any marsh to eliminate the possibility of dike erosion into surrounding wetlands or waters.
11) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
12) Because the dredge material is being removed from an area that is closed to the taking of shellfish,
discharges from the dewatering of spoils near any swimming areas between April 1 and October 31, or
any area that is open to shellfishing, will require a swimming advisory to be posted or a shellfish closure
to occur. The permittee shall contact the Division of Marine Fisheries — Shellfish Sanitation and
Recreational Water Quality Section (252) 726-7021 prior to dredging any activity for this determination.
USACE / FEDERAL CONDITIONS
13) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein.

14) This Major Modification shall be attached to the original Permit No. 23-18, which was transferred to the
permittee on 6/3/19, and copies of all documents must be readily available on site when Division
personnel inspect the project for compliance.
15) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
16) The permittee shalt maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of Programmatic
General Permit No. 198000291 (SAW Action Id. No. 2018-00111).
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4175 and assigned the project DWR Project No. 2018-0093v2.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

Recommendations for State Permit — 232 Summer Rest Road

This office supports the recommendations of the resource agencies, particularly the NC Division of Marine Fisheries,
regarding potential impacts to shallow bottom. Should concerns be expressed over potential impacts from any of the resource
agencies, the project could then be found to be inconsistent with NCAC 07H .0208(a)(2), which requires that the location,
design and need be consistent with the management objective of the Estuarine System AEC and the project be sited and
designed to avoid significant adverse impacts upon the productivity and biological integrity of spawning and nursery areas.
It is the staffs recommendation that the proposed excavation is CONSISTENT with the Rules of 15 A NCAC 07H.0208
(b) (1) which states, "Navigation channels, canals, and boat basins shall be aligned or located so as to avoid primary nursery
areas, shellfish beds, beds of submerged aquatic vegetation as defined by the NYC, or areas of coastal wetlands except as
otherwise allowed within this subchapter.". It also states "Any canal or boat basin shall be excavated no deeper than the
depth of connecting waters.
This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting
requirements. It is recommended that any permit issued should include standard conditions for excavation.

Approval of 401 Water Quality Certification with Additional Conditions
Dear Mr. Wallace:
You have our approval, in accordance with the attached conditions and those listed below to
expand your existing dredging footprint, permanently impacting approximately 0.1 acres of shallow
bottom habitat, as described in your application received by the N.C. Division of Water Resources
(DWR) on September 4, 2020. After reviewing your application, we have decided that the impacts
are covered by General Water Quality Certification Number 4175 (GC4175). Please be aware that
the cumulative permanent impacts for this project now totals approximately 0.45 acres of shallow
bottom habitat.
This Certification allows you to use the General Permit 198000291 when issued by the U.S. Army
Corps of Engineers. In addition, you should obtain or otherwise comply with any other required
federal, state or local permits before you go ahead with your project including (but not limited to)
Erosion and Sediment Control, Non -discharge, and stormwater regulations. Also, this approval to
proceed with your proposed impacts or to conduct impacts to waters as depicted in your
application shall expire upon expiration of the 404 Permit. This Certification can also be found on
line at: hitp,//portal.ncdenr.org/web/wQ/swp/`ws/401/certsandl2ermits.
This approval is for the purpose and design that you described in your application. If you change
your project, you must notify us and you may be required to send us a new application. If the
property is sold, the new owner must be given a copy of this Certification and approval letter and is
thereby responsible for complying with all conditions. If total fills for this project (now or in the
future) exceed one acre of wetland or 150 linear feet of stream, compensatory mitigation may be
required as described in 15A NCAC 2H .0506 (h). This approval requires you to follow the
conditions listed in the attached certification and any additional conditions listed below.

2. This approval is for the purpose and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certifications. If you
change your project, you must notify the Division and you may be required to submit a new
application package with the appropriate fee.
3. The applicant shall require his contractors (and/or agents) to comply with all of the
terms of these Certifications, and shall provide each of its contractors (and/or agents) a copy
of the Certifications.
4. These General Certifications shall expire on the same day as the expiration date of the
corresponding Nationwide Permit. The conditions in effect on the date of issuance of the
Certifications for a specific project shall remain in effect for the life of the project, regardless of the
expiration of the Certifications.
S. The applicant/permitee and their authorized agents shall conduct all activities in a manner
consistent with State water quality standards (including any requirements resulting from
compliance with 303(d) of the Clean Water Act), and any other appropriate requirements of State
and Federal law. If the Division determines that such standards or laws are not being met, including
failure to sustain a designated or achieved use, or that State or Federal law is being violated, or that
further conditions are necessary to assure compliance, than the Division may reevaluate and modify
these General Water Quality Certifications.
6. All mechanized equipment operated near surface waters shall be inspected and maintained
regularly to prevent contamination of surface waters from fuels, lubricants, hydraulic fluids, or
other toxic materials. Construction shall be staged in order to minimize the exposure of equipment
to surface waters to the maximum extent practicable. Fueling, lubrication and general equipment
maintenance shall be performed in a manner to prevent, to the maximum extent practicable,
contamination of surface waters by fuels and oils. (15A NCAC 02H .0506(b)(3) and (c)(3) and 15A
NCAC 0213.0211 (12)]
Moratoriums
You will comply with any moratoriums per the NC Division of Marine Fisheries and the NC
Wildlife Resources Commission. In water construction moratoriums shall be observed as
required by the NC Division of Marine Fisheries, NC Wildlife Resources, US Fish and Wildlife and
National Marine Fisheries. If such activities should take place during periods of high biological
activity (e.g. anadromous species), biological monitoring may be required at the request of other
state and federal agencies and coordinated with these dredging activities.
8. The permittee shall report to the Wilmington Regional Office at (910) 796-7215 (after
hours and on weekends call 800-858-0368) any noncompliance with these certifications, any

violation of stream or wetland standards [15A NCAC 02B .0200] including but not limited to
sediment impacts [15A NCAC 02B .0200]. Information shall be provided orally within 24 hours (or
the next business day if a weekend or holiday) from the time the applicant became aware of the
circumstances. A written submission shall also be provided within 5 business days of the time the
applicant becomes aware of the circumstances. The written submission shall contain a description
of the noncompliance, and its causes; the period of noncompliance, including exact dates and times,
if the noncompliance has not been corrected, the anticipated time compliance is expected to
continue; and steps taken or planned to reduce, eliminate, and prevent reoccurrence of the
noncompliance. The Division may waive the written submission requirement on a case -by -case
basis.
9. The turbidity standard of 25 NTUs (Nephelometric Turbidity Units) shall not be exceeded as
described in 15 A NCAC 213.0220. Appropriate sediment and erosion control practices must be used
to meet this standard. Turbidity curtains shall be used as appropriate. Please notify this Office if
any turbidity issues arise at 910.796.7215
10. Certificate of Completion
Upon completion of all work approved within the 401 Water Quality Certifications or applicable
Buffer Rules, and any subsequent modifications, the applicant and/or authorized agent is required
to return the enclosed certificate of completion form to the NCDENR DWR 401 and Buffers Unit North
Carolina Division of Water Resources, 1617 Mail Service Center, Raleigh, NC, 27699 within ten days
of project completion (the certification of completion is also available at:
https://edocs.deq.nc.gov/Forms/Certiflcate-of-Coml2letion .
Violations of any condition herein set forth may result in revocation of this Certification and
may result in criminal and/or civil penalties. The authorization to proceed with your proposed
impacts or to conduct impacts to waters as depicted in your application and as authorized by this
Certification shall expire upon expiration of the 404 or CAMA Permit.
This approval and its conditions are final and binding unless contested.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing
a written petition for an administrative hearing to the Office of Administrative Hearings (hereby
known as OAH). A petition form maybe obtained from the OAH at http://www.ncoah.com/orby
calling;the OAH Clerk's Office at (919) 431-3000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A
petition is considered filed when the original and one (1) copy along with any applicable OAH filing
fee is received in the OAH during normal office hours (Monday through Friday between 8:00 am
and 5:00 pm, excluding official state holidays).

This project is,.consistent with the 2006 Wilmington -New Hanover County Joint
Land Use Plan Update.
The applicant proposes to expand the authorized dredge footprint, through a major
modification to State Permit No. 23-18. The project is located at 232 Summer Rest Road,
adjacent to Greenville Sound and the AIWW in Wilmington, New Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as "SB" and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover
County CAMA Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation and Resource Protection.
In general, Wilmington -New Hanover County allows development in
Conservation/Resource Protection classified AECs, which is consistent with the State's
minimum use standards. The Wilmington -New Hanover County Land Use Plan contains
some policies, which exceed the State's minimum use standards, however none of these
policies are applicable to this project.
This project appears to be consistent with the 2006 Wilmington•New Hanover
County Joint Land Use Plan Update.

Dear Mr. Howell:
Reference the application by Parkside WF Investors, LLC to expand the authorized
dredging footprint to the northwest by addition of a 24 feet by 185 feet area (4,400 square feet)
to be dredge to -4 MLW at the 8-slip docking facility, dredging 818 cubic yards by the "bucket
to barge" method. The excavated material would be disposed at the Agnes Bean Site, a private
disposal area located adjacent to USACE DA 248, located approximately 0.90 miles south of the
project site at the confluence of the AI W W and Motts Channel.
The Federal agencies have completed review of the proposal as presented by the
application and your field investigation report.
We recommend that the following conditions be included in the State authorization:
Special Conditions
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plans must be
approved by the US Army Corps of Engineers (USACE) prior to implementation.
2. Prior to transporting spoil material to the Agnes Bean Site for disposal, the applicant
must get a "Consent to Cross" easement (for the Navigation Channel) from the Corps of
Engineers. Provide a written request and a map showing the disposal site and the crossing
location to Justin Arnette at Justin.R.ArnetteC@usace.armv.mil.
3. Except as authorized by this permit or any USACE approved modification to this permit,
no dredge, fill, or mechanized land -clearing activities shall take place at any time in the
construction or maintenance of this project within waters outside the designated
permitted boundary. This permit does not authorize temporary placement or double
handling of excavated or fill material within waters outside the permitted area.
4. Work in wetlands are prohibited during the dredging, material disposal, or any other
aspects of work associated with this project. All dredged material must be deposited on
high ground.
All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other
toxic materials. In the event of a spill of petroleum products or any other hazardous
waste, the permittee shall immediately report it to the N.C. Division of Water Resources
at (919) 733-5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil
Pollution and Hazardous Substances Control Act will be followed.
The permittee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall
provide each of its contractors and/or agents associated with the construction or
maintenance of this project with a copy of this permit. A copy of this permit, including all
conditions, shall be available at the project site during construction and maintenance of
this project.
The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the
permit area. This shall include, but is not limited to, the immediate installation of silt
fencing or similar appropriate devices around all areas subject to soil disturbance or the
movement of earthen fill, and the immediate stabilization of all disturbed areas.
Additionally, the project must remain in full compliance with all aspects of the
Sedimentation Pollution Control Act of 1973.
8. The activity must be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such
that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout
waters by the North Carolina Division of Environmental Management (NCDEM), 25
NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less
in trout waters, are not considered significant.
9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
permittee must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and
strictly adhere to all requirements therein. The guidelines can be found at
http://www.fws.gov/nc-es/mammal/manatee guidelines.nddf.
10. Violations of these conditions or violations of Section 404 of the Clean Water Act or
Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington

Regional Office (WiRO) take US Hwy 74/76 towards Wrightsville Beach just before crossing the drawbridge to
Wrightsville Beach. The property is approximately 800' north of the US Highway 74/76 drawbridge to Wrightsville
Beach. To locate the property from Military Cut -Off Road (NC Highwayl7), turn onto Eastwood Road towards
Wrightsville Beach. Travel east approximately 1 mile and turn left onto Summer Rest Road. Travel approximately
0.IS miles and the property of interest crosses over Summer Rest Road.
The project site is bordered to the north and south by existing single-family homes, a vacant lot to the west and the
AIW W to the east. There is an existing 6-slip docking facility to the north and a 10-slip community docking facility
to the south. The property is undeveloped, although it was previously the site of Bowden Nursing Home until it
was demolished in approximately 2012. In March 2018, DCM issued State Permit No. 23-18 to Susan Hale and 8a
Laurel Brooks, which permitted the construction of a 10 slip docking facility with a fixed pier, boat lifts, and
excavation of a 54' by 176' area to -4 at MLW, for 221 Summer Rest Road. On April 12, 2019, DCM authorized
a minor modification to State Permit No. 23-18, to the reduce the proposed 10 slip facility to 8 slips. The intent of
the reduction was to allow for a major modification to State Permit No. 23-18, for the construction of a 2 slip facility
for a newly subdivided waterfront lot at 230 Summer Rest Rd, which was parceled from the original 221 Summer
Rest property on May 30, 2019. Ms. Hale and Ms. Brooks sold the property to Parkside WF Investors LLC in April
2019, and State Permit No. 23-18 was transferred accordingly. An access and riparian easement was recorded for
shoreline allocation to support State Permit No. 23-18 and the major modification request for the 2 slip facility. On
September 26 2019 a major modification was issued authorizing the construction of a second docking facility with
a total of two formalized slips and dredging to a depth of -6 NLW. At this time no work has been completed on the
second docking facility. State permit number 23-18 is due to expire on December, 21, 2021.
The application states that the project site is approximately 0.17 acres with approximately 152' of shoreline frontage
and averages 6' in elevation above normal high water (NHW). Highground vegetation consists of ornamental
landscaping, lawn grasses, and Live Oak (Quercur virginiana), this transitions to high marsh vegetation, intermixed
with black needlerush (Jwwus roemerianus), bullrush (Scirpus sp.), and cattails (Typha sp.) into a low marsh,
dominated by Smooth Cordgrass (Spartina alternij7ora) that is approximately 110 ft. wide.
The New Hanover County and the City of Wilmington 2006 Land Use Plan Update classifies adjacent waters as
Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the
Molts Creek and Middle Sound are classified SB (Wrightsville Recreational Area) by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area by the N.C. Division of Marine Fisheries and they
are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to expand the authorized dredge footprint through a major modification to State Permit
No. 23-18. The application proposes excavation of an additional 24' by 185' area (4,400 sq. fl.) to 4' MLW,
landward and adjacent to the existing dredge footprint at the existing 8 slip docking facility (see Sheet 2, Plan
View Detail). According to the applicant, the proposed dredge footprint allows for larger vessels and would
connect bottom depth contours from the adjacent to the 8 slip facility, with excavation to -4 MLW permitted on
March, 13, 2018, to the 2 slip facility with excavation to -6 MLW, permitted with the Major Modification on
September 26, 2019. The applicant proposes to mechanically excavate an additional approximately 818 cy of
dredge spoil using bucket -to -barge method. The excavated material would then be hauled to the Agnes Beane
Site, a private disposal adjacent to USACE DA 248, located approximately 0.9 miles south of the project site at
the confluence of the AIW W and Molts Channel (US Army Corps of Engineers (USACE) Disposal Site No. DA-
0248). The application includes authorization from the property manager for use of the spoil disposal island on
the portion currently owned by Agnus Beane, see appendix C.

10. ANTICIPATED IMPACTS:
The proposed dredging footprint would impact approximately 4,440 ft' of Estuarine Waters and Pubic Trust Area
with excavation of approximately 4,440 ft' of shallow bottom area through the use of mechanical dredging. The
new dredging footprint would result in the removal of an additional approximately 818 cubic yards of material. The
disposal of the material would impact approximately 22,086 fl of highground outside the 75 ft AEC, which would
be located onto an existing spoil island at the confluence of the AIW W and Molts Channel (USACE Disposal Site
No. 0248).
Minor increases in turbidity should be expected during construction.

3.1 Section 6. a. Project Narrative
3.1.1 Project Location and Existing Conditions
The project is located on the Atlantic Intracoastal Waterway at 232 Summer Rest Road in Wilmington, New
Hanover County. The overall property previously operated as the Bowden Nursing Home but has since been
cleared and remained vacant for several years. On March 13, 2018 NC DCM issued a CAMA Major Permit to
Susan B. Hale & Laurel B. Brooks for the construction of a 10-slip docking facility that included a fixed pier, boat
lifts and dredging to -4MLW — located at 221 Summer Rest Road, Wilmington, INC 28405 (Permit # 23-18). On
April 12, 2019 a Minor Modification was authorized which reduced the 10-slip docking facility to 8-slip so that
the waterfront lot could apply for a private 2-slip docking facility. Ms. Hale & Ms. Brooks then sold the property
to Parkside WF Investors, LLC, a North Carolina limited liability company on April 15, 2019, and a CAMA Major
Permit transfer request was granted June 3, 2019. An access and riparian easement was recorded such that the
shoreline allocation would support both the previously issued CAMA Major Permit # 23-18 and the August 15,
2019 CAMA Minor Modification which allowed the reconfiguration of the authorized docking facility and the
addition of a covered Gazebo. A CAMA Minor Modification was issued on January 6, 2020 which changed the
use of the authorized boat slips to allow for the sale or lease of slips. Waters in the project area are classified
as SA and are not open to shellfishing. There are no SAV or shellfish resources present.
3.1.2 Proposed Action
There is no upland work proposed on the waterfront lot. Due to water depths surrounding the permitted 8-slip
facility and the large 39 - 40' center console and sport fishing boats favored by premium waterfront property
clientele, expansion of the -4 MLW dredging boundary is proposed. The original dredging footprint was
designed to accommodate fixed finger piers of 24' length. After the modification reduced the facility from 10
to 8 boat slips, the finger piers were changed to floating and lengthened to 30'. However, to remain a minor
modification, no change to the dredging footprint was requested at that time. To maintain the minimum
backing distance of 1.5 times boat length, an expanded dredging footprint is requested. The dredging area is
not located in ORW or PNA. An approximate 24-foot wide by 185-foot long box cut to -4' or -6' MLW will
generate approximately 818 cubic yards of dredge spoil. Dredging will extend to existing -4' MLW depths
adjacent to the existing permitted -6' MLW dredging boundary, and to -6' MLW within the existing permitted
dredging boundary. Bucket -to -barge excavation is proposed, and the excavated material will be placed on DA-
248 outside of the USACE right-of-way along and adjacent to the existing dike. It is understood that if needed,
a consent agreement must be obtained prior to crossing the USACE right-of-way to place spoil material. See
Appendix C for details.

Deed Restriction
3) This modification and the earlier permit (CAMA Major Permit No. 23-18) authorize the development of
a community boat dock on one parcel of land called Tract 2 ("Tract 2" or PID# R05704-003-003-000)
as described in Deed Book 5697, Page 1256 of the New Hanover County Registry. At this time, Tract 2
has an approximate shoreline length of 283' at Normal High Water. The community boat dock as
authorized in this modification totals 960 square feet of platform area. Rule 15A NCAC 7H .0208
(b)(6)(B) authorizes total platform area based on the length of a riparian property's shoreline to 8 square
feet of platform per linear foot of riparian shoreline. Under this modification, 120' of shoreline have
been allocated for the 960 square feet of platform area. In order to ensure consistency with this
requirement, and in accordance with commitments made by the permittee, a deed restriction shall be
placed on Tract 2 allocating 120' of shoreline of this lot to the authorized community docking
facility. This deed restriction shall be recorded with the New Hanover County Register of Deeds, and
copies of the recorded deed(s) provided to the Division of Coastal Management, prior to the initiation of
any construction.

4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This Minor Modification shall be attached to the original of Permit 23-18, which was issued on
03/13/18, and copies of both documents shall be readily available on site when Division personnel
inspect the project for compliance.
6) All conditions and stipulations of the active permit remain in force under this Minor Modification unless
specifically altered herein.
NOTE: This permit does not convey any rights, either in real estate or material.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.

Private Docking Facility
1) Unless specifically altered herein, this Major Modification authorizes the construction of a private
docking facility, in addition to the previously authorized 8-slip community docking facility on the
same parcel, and dredging associated with the private docking facility, all as expressly and
specifically set forth in the attached application and workplan drawings.
2) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this private docking facility without
permit modification. No non -water dependent uses of structures shall be conducted on, in or over
Public Trust waters without permit modification.

This permit action may be appealed by the permidee or other
qualified persons within twenty (20) days of the issuing date.
This permit most be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

3) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
private docking facility. Any sewage discharge at the private docking facility shall be considered a
violation of this permit for which the permittee is responsible. This prohibition shall be applied and
enforced throughout the entire existence of the permitted structure.
4) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six (6) feet in width and shall be elevated a minimum of three (3) feet over the wetland substrate
as measured from the bottom of the decking.
5) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors should be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
6) This permit authorizes a maximum of two (2) formalized boat slips at the private docking facility in
addition to the eight (8) permitted formalized slips at the community docking facility, for a total of ten
(10) formalized slips.
7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's area of riparian access, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property line meets the water's edge.
g) The authorized gazebo shall not be enclosed. Any material used on the sides shall not obstruct view and
shall be permeable to air and water. Lattice is specifically excluded from being used under this
authorization.
9) The roof of the gazebo shall not be designed for second story use.
10) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
11) The authorized structures shall not exceed the established pier head line as depicted on the attached
workplan drawings.
Excavation at Private Dockine Facility
12) Excavation at the private docking facility shall not exceed -6 feet below normal low water. In no case
shall the depth of excavation exceed the depth of connecting waters.
13) The temporary placement or double handling of excavated or fill materials within waters or vegetated
wetlands is not authorized.
14) No excavation or filling of any vegetated wetlands is authorized by this permit.

15) The Division of Coastal Management shall be notified in writing at least two (2) weeks in advance of
any maintenance excavation work authorized by this permit, and such notification shall include:
A. The number of the original permit.
B. A statement that no dimensional changes are proposed.
C. A copy of the original permit plans with cross -hatching indicating the area to be maintained, the
area to be used for spoil disposal, and the estimated amount of material to be removed. The
location, design and holding capacity of the spoil disposal site shall be approved by a representative
of the Division prior to the initiation of any maintenance dredging activities.
D. The date of map revision and the permittee's signature shown anew on the original plan.
.Spoil Disposal
16) All excavated materials shall be confined above mean high water and landward of regularly or
irregularly flooded marsh behind adequate dikes or other retaining structures to prevent spillover of
solids into any marsh or surrounding waters.
17) The spoil disposal area shall be inspected and approved by a representative of the Division of Coastal
Management prior to the commencement of any dredging activities.
General
18) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
19) The permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
20) The permittee shall obtain any necessary authorizations or approvals from the US Army Corps of
Engineers prior to initiation of any permitted activity. Unless specifically altered herein, the permittee
shall adhere to all conditions of the Federal approval.
21) This Major Modification shall be attached to the original of Permit No. 23-18, which was transferred to
the permittee on 06/03/19, as well as all the Minor Modification issued on 08/15/19, and copies of all
documents shall be readily available on site when Division personnel inspect the project for compliance.
22) All conditions and stipulations of the active permit remain in force under this Major Modification,
unless specifically altered herein.
NOTE: The permittee is advised that future upland development of the project area may require
stornwater approval. Please contact the Division of Energy, Mineral, and Land Resources at

Deed Restriction
3) This modification and the earlier permit (CAMA Major Permit No. 23-18) authorize the development of
a community boat dock on one parcel of land called Tract 2 ("Tract 2" or PIN R05704-003-003-000)
as described in Deed Book 5697, Page 1256 of the New Hanover County Registry. At this time, Tract 2
has an approximate shoreline length of 283' at Normal High Water. The community boat dock as
authorized in this modification totals 960 square feet of platform area. Rule 15A NCAC 7H .0208
(b)(6)(B) authorizes total platform area based on the length of a riparian property's shoreline to 8 square
feet of platform per linear foot of riparian shoreline. Under this modification,120' of shoreline have
been allocated for the 960 square feet of platform area. In order to ensure consistency with this
requirement, and in accordance with commitments made by the permittee, a deed restriction shall be
placed on Tract 2 allocating 120' of shoreline of this lot to the authorized community docking
facility. This deed restriction shall be recorded with the New Hanover County Register of Deeds, and
copies of the recorded deed(s) provided to the Division of Coastal Management, prior to the initiation of
any construction.
General
4) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
5) This Minor Modification shall be attached to the original of Permit 23-18, which was issued on
03/13/18, and copies of both documents shall be readily available on site when Division personnel
inspect the project for compliance.

I confirmed with the applicant that he would like to proceed with processing the application as is and not pursue
separating into two permits. He will transferthis permit to the future waterfront lot owner once the dredging is
complete and the HOA for the 8-slip dock and associated dredging will just apply for a GP for maintenance dredging
when needed in the future.

Attached is the digital copy of LAMA major modification application for 232 Summer Rest road on behalf of
Parkside WF Investors. A paper copy (including fee check) will be delivered to your office this afternoon or
tomorrow morning. The applicant proposes to expand the dredging boundary to accommodate 30-40' vessels
for the permitted boat slips. The original dredging footprint was designed to accommodate fixed finger piers of
24' length. After the modification reduced the facility from 10 to 8 boat slips, the finger piers were changed to
floating and lengthened to 30'. However, to remain a minor modification, no change to the dredging footprint
was requested at that time. To maintain the minimum backing distance of 1.5 times boat length an expanded
dredging footprint is requested. Dredging to -4 MLW is proposed. Adjacent notifications have been sent, and
