Raise and Repair/Replace of Non -Conforming Structure 1) This permit authorizes only the raising of the non -conforming structure and the associated structural components, and the repair/replace of existing components of the structure that are located in or over the water that are expressly and specifically set forth in the permit application. 2) All debris associated with this development must be contained within the authorized project area. The permittee shall be responsible for the immediate removal of any displaced debris, trash, or litter associated with the project site. 3) The non -conforming structure shall not be enlarged beyond the existing dimensions, except for the raising of the non -conforming structure authorized in Condition No. 1 of this permit. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Shoreline Stabilization — Bulkhead 5) The bulkhead shall be aligned immediately in front of the existing bulkhead, except at the location of the boat ramp to be filled. R FCE/CFO 6) The bulkhead shall be constructed prior to any backfilling activities. 7) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials,thmug Btl�e9 2019 structure. 8) The fill material shall be clean and flee of any pollutants except in trace quantities. 9) All backfrll material shall be obtained from a high ground source and confined behind the permitted bulkhead. Shoreline Stabilization — Rip Rap 10) The alignment of the toe of rip rap shall not exceed the alignment as depicted in the attached permit application and workplan drawings. 11) The rip rap shall consist of clean rock or masonry materials such as, but not limited to, granite, marl, or broken concrete. It shall be of a size sufficient to prevent its movement from the approved alignment by wave or current action. Marina Expansion 12) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this marina/docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 13) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the marina. Any sewage discharge at the manna shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 14) The marina shall display a sign showing the location of the nearest pumpout facility, including other appropriate waste disposal information, at the entrance and exit from the main pier(s). NOTE: It is strongly recommended that the permittee exercise all available precautions in the day-to-day operation of the facility to prevent facility waste from entering the adjacent waters. Such discharge, either directly or indirectly, to adjacent waters could contravene state water quality standards, thereby violating state law. The Ocracoke Foundation ADDITIONAL CONDITIONS Permit No. 90-18 Page 3 of 4 15) This permit authorizes an additional 5 formalized boat slips for a maximum of 21 formalized boat slips. Slips 19-21 are located adjacent to each of the three utility pedestals located in proximity to the non- conforming structure. 16) Should the Lot to the south be sold prior to the initiation of the marina expansion, or sold prior to the commencement of the marina expansion, the permittee shall obtain a written agreement from the new owner waiving the 15 foot riparian corridor setback and submit it to the Division of Coastal Management prior to initiating construction of the marina expansion. Easement 17) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. General 18) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 19) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 20) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 21) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 22) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 18-0807. NOTE: Future development of the permittee's property may require a modification of this permit. Major CAMA/Dredge and Fill permit application Date: 7 June 2018 Enclosed is a Major CAMA/Dredge and Fill permit application for redevelopment of the marina associated with the Ocracoke Community Square located off NC HWY 12 at 272 Irvin Garrish HWY adjacent Silver Lake in Ocracoke Village, Hyde County, North Carolina. The project includes installation of a new pile support system for the nonconforming "Willis Store and Fish House" that currently serves as the Watermen's Museum and the construction of 216' of bulkhead as well as some riprap seaward of the new bulkhead. The project also includes complete replacement of the two main dock structures, enlargement of existing platforms and proposes additional platform, slips and finger piers. The offshore end of the "main dock" (t34') currently extends into the USACOE setback in Silver Lake. There is no new slips or platforms proposed within the setback. A "Waiver of the 15' Riparian Area Setback" has been obtained from both (North and South) adjacent riparian property owners. Although the application package did not contain the information necessary to evaluate the work to be performed as replacement versus repair per 7J.0210(1)(a) or (b), Staff has reviewed the proposed improvements to the "Willis Store and Fish house" as if the proposed restoration plans for the building constituted a complete replacement thus subject to the four criteria found in 7J.0211 Staff has concluded that the structure will not be enlarged, and will continue to serve as the "Watermen's Museum". "There are no practical alternatives for replacing the structure to provide the same or similar benefits in compliance with the current rules" as the museum has several displays depicting the commercial fishing history on Ocracoke Island that must remain protected from the weather elements. The proposed repair is only that necessary to strengthen the foundation and other external components such as siding weakened by exposure to the elements over time. The structure is an iconic historical structure and part of the National Register of Historic Places. Staff is concerned with the lack of a marine pump out at this existing marina and the current marina policy to allow overnight and liveaboard dockage. Staff has conveyed to the applicant to expect delays in processing the permit until the matter of handling wastewater generated by liveaboard dockage is resolved. The Foundation has explored the possibility of putting wastewater from boats in the marina into the proposed septic system as well as into a proposed pump tank and was unsuccessful in obtaining authorization. There are three power pedestals shown along the Willis dock where seasonal"side to" mooring occurs by two skiffs and a charter fishing vessel that have not been accounted for in the slip total. Due to the existing commercial/public use of the marina staff supports the proposed platforms, docks and finger piers per 15A NCAC 7H.0208(b)(6XB). If there is resolution to the disposition of wastewater generated by boats in the marina and no further objections raised by the review agencies, DCM staff in the Washington office recommend issuance of the permit with the standard permit conditions for marinas, bulkheads and riprap. That would put them at 21 slips. Honestly if this slip configuration is built as shown it is going to be extremely congested and limit vessel size in slips 11-18. 1 am in the office today and available to discuss further. Project Overview: The project site is located at 272 Irvin Garrish Hwy, adjacent to Silver Lake in Ocracoke, Hyde County, North Carolina. The applicant is proposing to replace the two existing Community Square docks, increase the number of slips from 16 to 18. Construction includes: additional platforms for different types of water access, a vinyl bulkhead, placement of riprap, a new pile supported support system for the "Willis Store and Fish House" aka Waterman's Museum, as well as refurbish the structure. The project is located in the following Areas of Environmental Concern (AEC): Estuarine Waters (EW), Coastal Shoreline (CS), and Public Trust Area (PTA). The project is located on Silver Lake, that is designated as SC (Aquatic Life, Secondary Recreation, Salt Water) by the Environmental Management Commission and Coastal Waters by the Marine Fisheries Commission. The site is not a Primary Nursery Area (PNA), and is closed to shellfishing. A review of wetlands, SAV, historic, and archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include the shading of ± 7,649 SF of Sliver Lake bottom; while the bulkhead and riprap will fill 532 SF of Silver Lake bottom. Basis for Determination: The 2008 Hyde County CAMA Core Land Use Plan Future Land Use Map (FLUM) designates the project site on land as "Commercial", with the Ocracoke Historic District overlay, and all AECs as "Unbuildable Land", which limits development to 15A NCAC 7H use standards. Policies - Conservation P.30 Residential, commercial, and industrial development which meets 15A NCAC 7H use standards will be allowed in estuarine shoreline, estuarine water, and public trust areas. Ocracoke Community Square Revitalization Project (Docks) Silver Lake Hyde County Project Setting The 0.62-acre project site is owned by the Ocracoke Foundation Inc. and is located at 272 Irvin Garrish HWY (NC 12) adjacent Silver Lake off the Pamlico Sound in the village of Ocracoke, Hyde County, North Carolina. The site is known as the Community Square, a retail business center consisting of 5 buildings built around a central asphalt parking area. Individual businesses rent the buildings/retail space. Minor CAMA permit no. 01-16 was issued on 17 March 2016 to the Ocracoke Foundation for replacement of the asphalt pavement with a permeable concrete, repair of the existing septic system and the construction of a marine pump out with associated pump tank. The new drain field for the repaired septic system is to be in the center of the existing asphalt parking area. The repair of this system has been approved by the Hyde County Health Department. The Ocracoke Foundation was unsuccessful in obtaining authorization for the pump tank to support the proposed marine pump out. Construction of the permeable concrete and repair of the septic system has begun. The project site has ±200' of shoreline on Silver Lake of which 130' is hardened with a concrete bulkhead from the southern property line adjacent the Bluff Shoal motel to the existing damaged boat ramp next to the "Willis Dock". Other than a groin consisting of concrete and brick rubble, the shoreline from the old boat ramp to the northern property line adjacent Marion Dilday is an active sandy shoreline with erosion threatening the existing building known as the "Water Plant Office". The surge created by ferry vessels entering Silver Lake shifts the sand along this shoreline. The Community Square has an associated marina consisting of two docks/piers: the "main dock" located on the south side of the riparian area adjacent the Bluff Shoal motel and the "Willis Store dock". The riparian area of this commercially developed property is congested with piers and slips. The "main dock" is 6' wide x 154' long with an existing 12' x 18' platform at the end, 13 fixed slips defined by mooring pilings, 12 on the south side and 1 on the north side. There is space on the north side of the "main dock" available for temporary "side to" mooring. There are 3 existing finger piers on the south side of the main dock, the longest being 21'. There is a 6' wide x 50' long "Dingy Dock" that extends from the southern property line to an existing 2 story building known as the "William Ellis Williams house". There are two narrow (t3' wide) piers between the two aforementioned docks. The "Willis Dock" is t6' wide x 48' long leading to a nonconforming building over Silver Lake known as the "Willis Store and Fish House "that houses the Watermen's Museum. There is a 30'x32' platform at the end of the "Willis Dock". Water depths in the footprint of the manna range from minus 3' below the normal water level (NWL) next to the bulkhead and deepen gradually reaching T, 75' offshore the bulkhead, and minus 12' at the end of the two aforementioned docks. Silver Lake is classified as Coastal Waters by the Marine Fisheries Commission and SC by the Environmental Management Commission and is closed to shellfishing. Project Description The Ocracoke Foundation has received grant money from Golden Leaf Foundation, the Ocracoke Occupancy Tax Board, and the Marion Stedman Covington Foundation to assist in covering the cost to replace the two existing docks structures, increase the number of slips from 16 to 18, construct additional platforms for different types of water access, construct a new pile supported support system for the "Willis Store and Fish House" or Watermen's Museum as well as refurbish the aforementioned structure. The proposed support structure for the "Willis Store and Fish House" will raise the structure 23" and will result in the support system being separate from the adjacent dock and platforms. The purpose of this work is to continue the educational activities associated with the Watermen's Museum and to provide a base of operation for working watermen both commercial and charter vessels as well as provide dock space for visiting recreational boaters. A mixed type of boats currently utilizes the site from skiffs providing day trips to Portsmouth Island to +40' sailboats. Limited overnight and liveaboard dockage is allowed at the marina. A new vinyl bulkhead will replace the existing concrete bulkhead and will be constructed to the northern property line eliminating the existing boat ramp and stabilizing the unprotected shoreline in front of the "Water Plant Office" building. Granite or broken concrete is proposed to armor the toe of the proposed bulkhead from the existing concrete rubble groin to the northern property line. The purpose of this riprap is to defuse ferry wash and reduce scour along the bulkhead in this location. The "Willis Dock" will be replaced and widened from t6' wide to 10'wide. Platform no 4 that provides access to the front door of the "Willis Store and Fish House building will be enlarged to 12' x 32'. Platform no. 5 will be replaced in the existing 32' x 30' footprint. Seasonal "side to" mooring occurs at the "Willis dock" for skiffs conducting Portsmouth island tours as well as for one charter fishing vessel. Three utility pedestal are shown on the plans where this aforementioned mooring occurs and are not counted/designated as a slip(s). A new 12' wide x 44' long platform (Platform no. 3) is proposed at the foot of the "Willis Dock" extending along the new bulkhead from the old boat ramp across the front of the "Water Plant Office" building. Platform no. 3 will connect to proposed platform no. 2, an irregular shaped platform totaling 1,273 ft'that will provide access to 4 proposed 10' x 12' slips (slips no. 15-18) with 4 proposed 3' x 12' finger piers. A total of 13 perpendicular slips are proposed along the spine of the "main dock" with no new slips within the USACOE setback. The south side of the "main dock" is proposed to have 3-12' wide x 30' long slips accessed by 3-3'x 12' finger piers, two-16' wide x 40' long slips, one-20' wide x 40' long slip, one — 18' wide x 40' long slip and one - 12' wide x 40' long slip to be accessed by 5 — 3' wide x 16' long finger piers. There is a "side to" slip designated at the end of the "main dock" adjacent platform no. 1. The north side of the "main dock" is to have 2-12'wide x 30' long slips accessed by 2-3' x 12' finger piers, and 1-14'wide x30' long slips accessed by2-3' x 14' long finger piers. The "dingy dock" that extends from the southern property line along and -over the existing concrete bulkhead is to be replaced and widened from 6' to 8'. Anticipated Impacts The dock system and platform construction will result in a shading of f7,649 ft2 of Silver Lake bottom. The bulkhead and riprap construction will result in the filling of 532 ft2 of Silver Lake bottom. The new slip configuration will increase the fixed structural congestion in the project's riparian area. In some areas, the dock system congestion will limit the size of vessels that are able to reach a slip. The project may result in an increase in vessels using the marina and their associated impacts. Early island photographs depict how life was centered around the iconic Community Store [1918], the Will Willis Store & Fish House [ca. 1930], the Ice Plant and the island's first generator plant [ca. 1936]. In 1918, Amasa "Mace" Fulcher opened his grocery facing the harbor, appropriate for a business whose freight arrived by boat. Island men gathered on the porch to share stories, whittle birds, and ponder the ways of fish and weather. In the winter, they'd gather inside near the potbellied stove. The daily arrival of the mail boat 'Aleta' drew most islanders from their homes. Today, the Community Square is still a daily gathering space - stories are still shared, common goods are still sold, and community celebrations are still held. These are important to the heart and soul of any community. A century of storms has taken its toll on the 5 structures, 80-116 years old, all listed on the National Register of Historic Places, and the 2 docks. The impact of Tropical Storm Hermine in September 2016, followed by the record -setting flood/surge waters of Hurricane Matthew one month later, make it clear the buildings and 2 docks require the repairs, maintenance, replacement, flood mitigation, and restoration work necessary to preserve this iconic Eastern NC maritime heritage site and assure public use for future generations. The work to replace the two aging docks - the Main Dock and Willis Dock - will take place in two phases. It is anticipated that all the dock structures, including planks, pilings, platforms, electric wiring, and wiggCEIVED J iN`Yf 2018 DCM-MHD CITY pipes, will need to be replaced. Some reuse of materials that are salvageable may be considered. The initial focus will be the Willis Store & Fish House, and the surrounding Dock and support structure. The most threatened structure is the Will Willis Fish House and Store, with damage to the support piers, floors, walls and siding, as well as the surrounding dock and platform areas. Given the age and wear on the structure, it cannot be moved, nor is there any upland area on which to move and relocate it, if such a task was feasible. This best solution is to raise the structure 23 inches and secure it with a support structure that is independent of the surrounding dock. This will protect it from storm water and surge [there was 9" inside after Hurricane Matthew] as well as the daily wave action from the near -by NC Ferry Terminal, with 12-16 arriving/departing ferries daily to Swan Quarter/Cedar Island. Technical assistance, restoration guida0er and environmental review is being provided by the State Historic Preservation Office [SHPO] of the NC Department of Natural and Cultural Resources. Specific activities to further restoration and renovation to the Willis Structure include replacing several metal doors and vinyl windows [2 each], as well as replace exterior siding and roof shingles. Inside, the exhibit panels, artifacts, photos, historical and other display items for the Working Watermen's Exhibit will be updated, re -organized and better preserved. Ocracoke is a historic maritime community. Access to the water is crucial for water -based businesses, and the enjoyment of residents and visitors. With the exception of the National Park Service property, Silver Lake is completely surrounded by private property - both commercial and residential. The Ocracoke Foundation's focus is ensuring that water access to Silver Lake and Pamlico Sound will be available in perpetuity. The maintaining and repair of the docks, piers, and platforms for kayak, SUP, and small craft launch areas will continue to provide a base for maritime business, local watermen and recreational boaters. Future generations of watermen will be assured of a way -point for their livelihood. The design for dock improvements maintains essentially the same "footprint." The Main Dock design adheres to the setbacks required by the US Army Corps of Engineers: no changes are made to the current size and usage within the Setback Line of the US Army Corps of Engineers, which includes the outmost 40' of the Main Dock. The Main Dock is the same length [145'] with a Platform [Platform #1 - 18.5' x 11.5'] at the end, same as the current one. The Willis Dock remains 120' and is not within the *111S 2111 c)" 1 MNO ®�M i Corps of Engineers Setback Line. The existing Dinghy Dock remains 50' x 8.' The overall number of slips increases from 16 to 18, and is reconfigured for a few larger slips to accommodate charter and recreational fishing vessels. These include slips with widths of 2@14', 2@16', and 1 each at 18' and 20' on the Main Dock. A limited increase to existing platform launch areas [Platform #2, irregular shape, 1273 SF and #3] is needed for safely launching and maneuvering SUP's, kayaks, and canoes. It will also enhance water -side space for Outdoor Environmental Classes as well as accommodate and encourage pedestrian and bicycle traffic to view and photograph [a very popular photo angle] the Lighthouse, visit the Ocracoke Working Watermen's Exhibit, or just relax to view the sunset. Platform #4 is slightly enlarged, and Platform #5 remains the same. Updated, modern stabilization of the 216' shoreline along Silver Lake is needed. Currently all but approximately 40' is protected by an aging concrete wall that is deteriorating in several spots. A vinyl bulkhead will be placed in front of this older protection, and extended to cover the full 216' shoreline of the Community Square property. This will stabilize and protect this historic shoreline property from periodic storm surge and wash from the extensive daily ferry traffic [as noted above]. The Community Square is a focal point on the Outer Banks National Scenic Byway. As such it is an economic driver not only for Ocracoke, but also the economy of Eastern NC. These in -water and shoreline improvements within the larger Community Square Revitalization Project [CSRP] preserve and enhance waterfront access, public use, environmental stewardship, historic and cultural maritime preservation, and economic sustainability. Over $190,000 has been committed to this phase of the CSRP by the Golden LEAF Foundation and the Marion Stedman Covington Foundation. Included with this letter is our Application for a CAMA Major Development Permit, with required forms and support documents. Mace also built a dock for freight boats, fuel, fishermen and the mailboat `Aleta.' 1930 Will G. Willis builds the Willis' Fish House and Dock, #23 on the National Register of Historic Places. 1936 The Ocracoke Power and Light Company was formed, bringing electricity to the island. A generator plant and office were built next to the Community Store, along with an Ice Plant where ice was produced and sold, #21 on the National Register of Historic Places. 1936 A group of cisterns were built behind the Dixon -Williams House to pipe water, across what is now Highway 12, to the Ice Plant. 1936 A small commercial structure was built at the edge of the Willis Dock, where Ocracoke residents could pay their electric bills, and after a public water system was introduced in 1970, their water bills. #22 National Register of Historic Places. 1939 Cockle Creek is dredged by the Army Corps of Engineers and named `Silver Lake.' 1944 ca. A storm -ravaged Community Store is tom down and the present one is built in the same location. 1983 The William Ellis Williams House ca. 1900 is moved to the Community Square. #24 National Register of Historic Places. 1990 Ocracoke Historic District, including the Community Square, is listed on the National Register of Historic Places. Access to the water is crucial for water -based businesses, and the enjoyment of residents and visitors. With the exception of the National Park Service property, Silver Lake is com- pletely surrounded by private property — both commercial and residential. Our focus is ensuring that access will be available in perpetuity. The repair of the docks, piers, plat- forms and kayak launch ramp will continue to provide a base for maritime business, local watermen and recreational boaters. Future generations of watermen will be assured of a base for their livelihood. ENVIRONMENTAL STEWARDSHIP Storm water and wastewater improvements are nec- essary. In 2017, with help from a Golden LEAF Grant, we will install wastewater up- grades and repave the parking lot with water -absorbing pervious concrete. This costlier, environmentally significant option will vastly reduce run-off into Silver Lake to improve water quality, as well as enhance waterfront access and greenspace that is so welcoming to our residents and visitors. In partnership with the NC Coastal Federation, a "living shore- line" of wetland grasses and a rock wash wall of oyster bags will be designed as a demon- stration project to aid in storm water management. Enlarged shoreline platforms will en- hance OFFS Outdoor Environmental Education summer classes and provide space for oth- er events. HISTORIC PRESERVATION Architecture is a historic community's best advertisement, a testament to the strength of its past. It keeps locals and visitors alike connected to the com- munity, both presently and historically. This cluster of 5 National Register structures, the docks, and the shoreline will be restored to a setting typical of historic Ocracoke circa 1950's. The purpose/uses of The Community Square are the same today as they were in 1918 — goods were bought and sold, fishermen came and went, boats brought visitors and cargo, and people visited with one another. The historic town square atmosphere with its festive gatherings bring vitality and promotes a hometown feel, which is one of reasons vacationers continue to come to Ocracoke. PRESERVED IN PERPETUITY The historic, environmental and maritime importance of the Community Square will be preserved with easements and other legal protections. The creation of a Harbor Front Garden featuring benches, picnic tables and native plants will honor those who have worked to preserve the Community Square over past decades. ENDOWMENT FOR OCRACOKE ISLAND Since 2008, when the Ocracoke Foundation began to focus on acquiring the Community Square, the core goals were to protect, pre- serve and put this valuable asset to work for the community. Rather than paying $50,000 a year for 20 years in bank payments, once the interim loans are retired, OFI will ensure that the income from the Community Square becomes a permanent endowment for the Ocracoke community by directing rental income into a Community Fund. This can be a model for rural communities to harness their local assets for social entrepreneurship to benefit their community. Early island photographs depict how life was centered around the iconic Community Store, the Will Willis Store & Fish house, the Ice Plant and the island's first generator plant. In 1918, Amasa "Mace" Fulcher's grocery faced the harbor, appropriate for a business whose freight arrived by boat. Island men gathered on the porch to share stories, whittle birds, and ponder the ways of fish and women. In the winter, they'd gather inside near the potbellied stove. The daily arrival of the mail boat `Aleta,' drew most islanders from their homes.
