This permit, issued on . January 2, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Fishing Pier
1) Unless specifically altered herein, this permit authorizes the reconstructed fishing pier, all as
expressly and specifically set forth in the attached permit application and workplan drawings. Any
additional land disturbing activities and/or construction may require a modification of this permit.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

ADDITIONAL CONDITIONS
2) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the
N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood
Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are
inconsistent with any of the following AEC standards, the more restrictive standard shall apply.
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
All.new_pilings shall be not less_than.8 inches in diameter if round, or 8 inches to -a, side if square.
7) All new pilings shall have a tip penetration greater than eight feet below the lowest ground elevation
under the structures.
8) Dune disturbance shall be kept to a minimum. Any alteration of existing dunes shall be coordinated with
the Division of Coastal Management. All disturbed areas shall be restored to original contours and
configuration and shall be revegetated immediately following project completion in that specific area.
9) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently
threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled
within two (2) years of the time when it becomes imminently threatened, and in any case, upon its
collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place
within two (2) years of the time the structure becomes imminently threatened, so that the structure is no
longer imminently threatened, then it need not be relocated or dismantled at that time. This condition
shall not affect the permit holder's right to seek authorization of temporary protective measures allowed
under CRC Rules.

12) The Permittee shall require its contractors and/or agents to comply with the terms and conditions of this
permit in the construction and maintenance of this project, and shall provide each of its contractors
and/or agents associated with the construction or maintenance of this project with a copy of this permit.
A copy of this permit, including all conditions, shall be available at the project site during construction
and maintenance of this project.
13) The Permittee shall schedule an onsite preconstruction meeting between its representatives, the
contractor's representatives and the appropriate Corps of Engineers Project Manager prior to
undertaking any work within jurisdictional waters and wetlands to ensure that there is a mutual
understanding of all terms and conditions contained within the Department of the Army permit. The
Permittee shall notify the Corps of Engineers Project Manager a minimum of thirty (30) days in advance
of the scheduled meeting in order to provide the Corps with ample opportunity to participate in the
required meeting.
14) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as the
Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -
project condition _ -
15) A representative of the USACE, Regulatory Division will periodically and randomly inspect the work
for compliance with these conditions. Deviations from the permitted activities and permit conditions
may result in cessation of work until the problem is resolved to the satisfaction of the USACE. No
claim, legal action in equity or for damages, adjustment, or other entitlement shall be asserted against
the United States on account of any such required cessation or related action, by the permittee, its
agents, contractors, or other representatives.
16) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public

18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
19) No excavation or filling of any open water area is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.

It is the staffs recommendation that the applicant's proposal to install replace the existing fishing pier and
accessway appears to be CONSISTENT with the Rules of 15 NCAC 7H.0300 - Ocean Hazard Areas,
specifically, 15 NCAC 7H.0308(c)(4) SPECIFIC USE STANDARDS FOR OCEAN HAZARD AREAS,
and 15 NCAC 7H.0309(d)(1)(e)(1)-(7) SPECIFIC USE STANDARDS FOR OCEAN HAZARD AREAS:
EXEMPTIONS. As proposed, this office has no objection to the proposed project. In the absence of any
concerns from the commenting agencies, it is recommended that a permit be issued subject to the standard
conditions for bulkheads

Consistency Determination:
This project is consistent with the Town of Oak Island Comprehensive Land Use Plan.
The applicant proposes to rebuild the existing Yaupon fishing pier. The project is located
adjacent to and in the Atlantic Ocean at 705 Ocean Drive in Oak Island.
I have reviewed this proposal for consistency with the Town of Oak Island CAMA Land
Use Plan and offer the following comments.
The general area of the project is classified as Developed and Conservation. Waters at the
project site are classified as SB# and are not open to the harvesting of shellfish. The area
is not a Primary Nursery Area. Areas of Environmental Concern (AEC's) are OH.
Oak Island allows development in Developed and Conservation classified AECs, which
is consistent with the State's minimum use standards. The Oak Island Land Use Plan
contains some policies, which exceed the State's minimum use standards. However,
none of these policies appear to be applicable to this project.
This project is consistent with the Town of Oak Island Land Use Plan Update.

On April 13, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a
copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on
April 25, 2017 has determined that the development activities proposed at this time will not pose a threat to surface
water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by
the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater
management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are
informing you that this project will not require a stormwater management permit.
If the subject project disturbs one acre or more and has a point source discharge of stor iwater runoff, then it is also
subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You
are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary
built -upon area associated with the construction of the project must be removed within 30 days of completion of the
project, or when it is no longer needed, whichever occurs first.

9. PROJECT DESCRIPTION DCM- MHD CITY
The applicant's property is located at 705 Ocean Drive, adjacent to the Atlantic Ocean within the Town
of Oak Island, Brunswick County. Directions from Highway 133 (Country Club Drive) just over the
bridge on Oak Island: Turn Right onto E. Oak Island Drive and drive approximately 0.45 miles to
Womble St. Turn Left onto Womble St. and travel approximately 0.35 miles to the end of Womble St.
The project site will be located on the left side of the street.
The project site averages approximately 12' above mean high water (MHW). Highground vegetation
consists of maintained landscaping adjacent to the existing parking areas and restaurant building. The
oceanfront beach area consists of dune vegetation such as American Beach Grass (Ammophilia
breviligulata), Bitter Panicum (Panicum amarum), Pennywort (Hydrocotyle bonariensis), Seashore
Elder (Iva imbricate), and Sea Oats (Uniola paniculata).
The application states the project site is approximately 1.79 acres in size and is a single parcel, which
currently consists of a concrete service road (Womble St.), and a gravel parking area utilized for an
existing restaurant (dba The Flying Fish Cafe). The majority of the existing gravel parking area is
located approximately 60' landward of the First Line of Stable and Natural Vegetation (FLSNV),
however, most of the restaurant and approximately 785 sq. ft. of the parking area are waterward of the
Town's 1998 Static Line and Development Line.
The previous pier owner, David Beckner, received State Permit #135-92 on December 3, 1992,
authorizing the reconstruction of an existing pier that was damaged by a storm even in 1989. The permit
approved the reconstruction of a 914' long, 16' wide fishing pier, with a 40' long, 16' wide T-head
platform at the waterward end of the pier. 754' of the pier was built before a March storm halted
completing of the project. Due to the impending tourist season at the time, the original applicant
requested a modification to State Permit #135-92 to construct a 42' long, 14' wide T-head platform at
the end of the 754' pier. The applicant also requested to continue to the previously permitted pier length
and change the dimensions of the terminal T-head platform to 42' in length by 28' in width. These
requests were granted by the State through a Letter of Refinement on November 30, 1993. The pier was
completed sometime before State Permit #135-92 expired on December 31, 1995.
Permitting for the accessway was not located in the Wilmington Office archives, however, a survey
dated June 27, 1988 and received by the office on September 23, 1992 with the David Beckner's pier
application identifies the existence of an accessway prior to 1989. The survey and accessway are not
referenced in State Permit #135-92, but it is possible the accessway was either authorized by a previous
permit, or predates CAMA regulations.
Tax records indicate that ownership of the pier was transferred from David Beckner to Cape Fear
Trading Group VII, LLC in 2006, and then to Cooperative Bank in 2009. The Town of Oak Island
purchased the pier from Cooperative Bank in 2009 and is now the current owner as stated in the attached
deed.
The Town of Oak Island Land Use Plan classifies the adjacent waters as Conservation, and the adjacent
high ground portion of the project area as Developed. The waters of the Atlantic Ocean are classified
SB# by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by
the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish.

10. PROPOSED PROJECT: DCM- MHD CITY
The applicant proposes to restore the old public fishing pier and accessway known as Yaupon Fishing
Pier, which includes expanding the existing decking from 16' in width to 18' in width, to add structural
support for the handrails. The length of the pier will remain consistent with what was previously
permitted under State Permit #135-92, not to exceed 914' in length. The T-head platform at the body of
the pier, and the T-head at the terminal end of the pier, will be 48' in length by 29' in width, and 48' in
length and 15' in width, respectively. Both platforms will remain consistent with the dimensions of the
previous pier platforms.
The accessway will be reconstructed, starting at the most landward section of the fishing pier and ending
at the end of the access ramp in the parking area. The main components being replaced will be the piles,
girders, stringers, decking, and handrails of the existing access ramp, deck, stairs, and walkway. As
proposed, the repair/replacement of the accessway would not exceed the footprint of what was existing.
11. ANTICIPATED IMPACTS
The proposed expansion of the pier width from 16' to 18' would incorporate approximately an
additional 1,652 sq. ft. of Public Ocean Beach Area and Open Water. Access along the beach should not
be impeded by this structure. Ocean fishing piers are minimal in numbers, and they provide an
entertainment function not met in other ways.

On behalf of the Town of Oak Island, we request a permit to remove the remaining timber fishing pier and
approaches and replace the pier with a new timber fishing pier. The existing pier was damaged by Hurricane
Matthew. The existing pier was approximately 940' long prior to Hurricane Matthew. Approximately 150' of
the pier failed during Hurricane Matthew. The new pier will be constructed using top down construction from
the surface of the new pier.
Adjacent landowner notification is complete (the same landowner is on both sides if this property). The return

This fishing pier will be use by the visitors to Oak Island. It is open to the public.

This pier will be constructed by top down construction. The existing pier will be used during construction as a work platform.
A crane will be located on top of the pier and advance waterward as the pier is completed. Once a new pile bent is installed,
the existing peer will be demolished and removed for the site a section at a time.

Rebuild a 940'xl 8'timber fishing pier that was partially destroyed during Hurricane Matthew. The new pier width will
marginally increase to improve handrail safety. The new handrails will be at the same width as the existing handrails; the
deck band will be widened to support the outside of the handrail posts. Replacement will also include the access ramp and
stairs including; piles, girders, stringers, decking, and handrails.

Dear Mr. Pannkuk:
This letter is in response to the above referenced CAMA permit application, which was accepted
as complete by the Division's Wilmington office on April 5, 2017. Processing of the application
is ongoing. However, it has been determined that additional information will be required prior to
the Division taking final action on your application. These required items are summarized
below:
1) The U.S. Army Corps of Engineers has requested additional information by way
of the email received from NOAA dated May 31, 2017. Additionally, it has come
to our attention that formal consultation with NOAA is required as stated in the
email dated June 5, 2017.
Therefore, it is necessary that processing of your permit application be placed in abeyance to
give you an opportunity to address the request of NOAA via the U.S. Army Corps of Engineers.
Once the Army Corps of Engineers has notified the Division of Coastal Management Major
Permit Section in writing that no further actions are necessary on the part of the applicant, we
will resume processing of your application.
If you can provide to this office with the requested information within five working days from
the date of this letter, DCM staff will continue processing of the application and the processing
clock will not be suspended. If the required information is not received in this office within the
specified timeframe, processing of the application will be suspended in accordance with 15A
NCAC 07J.0204(d) until such time as the requested information is provided.

Reference the application of and the Town of Oak Island to replace the Yaupon fishing pier in
navigable waters of the United States, located.at 705 Ocean Drive Oak Island, Brunswick County, North
Carolina.
The Federal agencies have completed review of the proposal as presented by the application and
your field investigation report.
We recommend that the following conditions be included in the State authorization:
1. A moratorium on shoreline activities from April 1 to November 15 of any year will be instituted as
proposed in the permit application.
2. All work authorized by this permit must be performed in strict compliance with the attached plans,
which are a part of this permit. Any modification to these plans must be approved by the U.S. Army
Corps of Engineers (USACE) prior to implementation.
3. The Permittee shall require its contractors and/or agents to comply with the terms and conditions of
this permit in the construction and maintenance of this project, and shall provide each of its
contractors and/or agents associated with the construction or maintenance of this project with a copy
of this permit. A copy of this permit, including all conditions, shall be available at the project site
during construction and maintenance of this project.
4. The Permittee shall schedule an onsite preconstruction meeting between its representatives, the
contractor's representatives and the appropriate Corps of Engineers Project Manager prior to
undertaking any work within jurisdictional waters and wetlands to ensure that there is a mutual
understanding of all terms and conditions contained within the Department of the Arm permit. The

Permittee shall notify the Corps of Engineers Project Manager a minimurl MMP441)aJGhTY
advance of the scheduled meeting in order to provide the Corps with ample opportunity to participate
in the required meeting.
5. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, dredging or fill shall take place at any time in the construction or maintenance of this
project, in such a manner as to impair normal flows and circulation patterns within waters or
wetlands or to reduce the reach of waters or wetlands.
6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of
waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of
a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it
to the N.C. Division of Water Resources at (919) 733-5083, Ext. 526 or (800) 662-7956 and
provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be
followed.
The permittee shall advise the Wilmington District, Regulatory Division in writing prior to
beginning the work authorized by this permit. The contractors name, phone number, and address,
including any inspector's contact name and phone number must be provided to the Wilmington
District prior to initiating any work.
8. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an
increase in sedimentation or turbidity within waters and wetlands outside the permit area.
Additionally, the project must remain in full compliance with all aspects of the Sedimentation
Pollution Control Act of 1973 (North Carolina General Statutes Chapter 113A Article 4).
9. Violations of these permit conditions or violations of Section 404 of the Clean Water Act or Section
10 of the Rivers and Harbors Act must be reported in writing to the Wilmington Regulatory Field
Office, Attn: Mr. Tyler Crumbley, Wilmington District U.S. Army Corps of Engineers, 69
Darlington Ave., Wilmington, NC 28403, tyler.crumbley&usace.army.mil, (910) 251-4170 within
24 hours of the permittee's discovery of the violation.
10. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before
completion of the work will, without expense to the United States and in such time and manner as

the Secretary of the Army or his authorized representative may direct, restore the water or wetland to
its pre -project condition.
11. A representative of the USACE, Regulatory Division will periodically and randomly inspect the
work for compliance with these conditions. Deviations from the permitted activities and permit
conditions may result in cessation of work until the problem is resolved to the satisfaction of the
USACE. No claim, legal action in equity or for damages, adjustment, or other entitlement shall be
asserted against the United States on account of any such required cessation or related action, by the
permittee, its agents, contractors, or other representatives.
12. The permittee shall provide written notification of project completion immediately upon completion
of the work authorized by this permit.

15. The permittee understands and agrees that, if future operations by the United States require the
removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall
cause unreasonable obstruction to the free navigation of the navigable waters, the permittee will be
required, upon due notice from the USACE, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States. No claim shall be made against
the United States on account of any such removal, relocation, or alteration.
16. The authorized project must not interfere with the public's right to free navigation on all navigable
waters of the United States. No attempt will be made by the permittee to prevent the full and free
use by the public of all navigable waters at or adjacent to the authorized work for any reason other
than safety.
17. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by
the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further

information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-
2200.
18. In issuing this permit, the Federal Government does not assume any liability for:
a. Damages to the permitted project or uses thereof as a result of other permitted or unpermitted
activities or from natural causes.
b. Damages to the permitted project or uses thereof as a result of current or future Federal
activities initiated on behalf of the general public.
c. Damages to other permitted or unpermitted activities or structures caused by the authorized
activity.
d. Design and construction deficiencies associated with the permitted work.
e. Damage claims associated with any future modification, suspension, or revocation of this
permit.
19. The permittee shall notify NOAA/NATIONAL OCEAN SERVICE Chief Source Data Unit N
CS261, 1315 E West HWY- RM 7316, Silver Spring, MD 20910-3282 at least two weeks prior to
beginning work and upon completion of work. Upon completion of work, the permittee shall
complete the attached form, titled Permit/Public Notice Completion Report. The form shall be
submitted to the USAGE, Regulatory Division and to NOAA/National Ocean Service.
THREATENED AND ENDANGERED SPECIES (NMFS PRD)
20. BIOLOGICAL OPINION: This USACE permit does not authorize you to take an endangered
species, in particular green, Kemp's ridley, leatherback, loggerhead, and hawksbill sea turtles, shortnose
and Atlantic sturgeon, and the North Atlantic right whale. In order to legally take a listed species, you
must have separate authorization under the Endangered Species Act (ESA) (e.g., an ESA Section 10
permit, or a BO under ESA Section 7, with "incidental take" provisions with which you must comply).
The enclosed National Marine Fisheries Service (NMFS) Biological Opinion (BO) dated November 21,
2017 (Attachment A) contains the fallowing mandatory terms and conditions to implement the
reasonable and prudent measures that are associated with "incidental take":
To implement RPM No. 1 and No. 3, the Permittee must report all hook -and -line captures of
ESA -listed species and any other takes of ESA -listed species at the Yaupon Fishing Pier to the
NMFS's Southeast Regional Office.

ii. The email must state the species, date and time of the incident, general location
and activity resulting in capture (i.e., fishing from the Yaupon Pier by hook -and -
line), condition of the species (i.e., alive, dead, sent to rehabilitation), size of the
individual, behavior, identifying features (i.e., presence of tags, scars, or
distinguishing marks), and any photos that may have been taken.
b. Every three years, a summary report of capture, entanglement, stranding, or other take
of ESA -listed species must be submitted to NMFS's Southeast Regional Office by email
(takereport.nmfsser(r?noaa. gov):
i. The email and report must reference this Opinion by the NMFS PRD number for
.. . this. Opinion (SER-2017-18384 Yaupon Fishing Pier) and date of issuance.
ii. The report will contain the following information: the total number of ESA -listed
species captures, entanglements, strandings, or other take that occurred at or
adjacent to the pier included in this Opinion.
iii. The report will contain all information for any sea turtles taken to a rehabilitation
facility holding an appropriate U.S. Fish and Wildlife Native Endangered and
Threatened Species Recovery permit.
iv. The first report will be submitted by January 31, 2020, and cover the period of
time from pier opening to December 31, 2019. Thereafter, reports will be
prepared every other year, emailed no later than January 31 of any year, and
include, information for the previous two calendar years.
v. Reports will include current photographs of signs and bins required in T&Cs No.
2 and 3 below.
To implement RPM No. 2, the Permittee must:
a. Install and maintain the following 3 NMFS Protected Species Educational Signs: "Save
the Sea Turtle, Sawfish, and Dolphins," "Help Protect North Atlantic Right Whales," and
"Report Sturgeon."
i. Signs will be posted at the entrance to the pier and at terminal end of each side of
the T-head.
ii. Signs will be installed prior to opening the pier for public use.

Office by email (takereport.nmfssergnoaa.gov) with the NMFS PRD number for this
Opinion (SER-2017-18384 Yaupon Fishing Pier) and date of issuance.
iii. The applicant must regularly empty the bins and trash receptacles and make sure
they are functional and upright.
iv. Additionally, current photographs of the bins will be included in each report
required by T&C No. 1, above.
To implement RPM No. 4, the Permittee must:
a. Conduct an annual in -water and out -of -water cleanup to remove derelict fishing line and
associated gear from the pier structure. A volunteer group may be contacted. NMFS
recommends contacting the following volunteer groups: NC Coastal Federation,
Wrightsville Beach Turtle Project, and/or Ocean Conservancy.
b. Submit a record of each cleaning event to NMFS's Southeast Regional Office by email
(takereport.nmfsser cr,noaa.gov) with the NMFS PRD number for this Opinion (SER-2017-
18384 Yaupon Fishing Pier) and date of issuance.
Your authorization under this USACE permit is conditional upon your compliance with all of the
mandatory terms and conditions associated with incidental take of the attached BO, which terms and
conditions are incorporated by reference in this permit. Failure to comply with the terms and

conditions associated with incidental take of the BO, where a take of the listed species occurs, would
constitute an unauthorized take, and it would also constitute non-compliance with your USACE
permit. The NMFS is the appropriate authority to determine compliance with the terms and
conditions of its BO, and with the ESA.
THREATENED AND ENDANGERED SPECIES (USFWS)
21. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly
adhere to all requirements therein. The guidelines can be found at http://www.fws. og v/nc_

of the Department of Cultural Resources. In emergency situations, the permittee should
immediately contact Mr. Nathan Henry at (910-458-9042), Fort Fisher, so that a full
assessment of the artifacts can be made.
24. To the extent that any permit attachments and plans conflict with the permit special
conditions, the permit special conditions shall prevail.

replace and expand the Yaupon Fishing Pier located at 705 Ocean Drive, Oak Island, Brunswick
County, North Carolina.
Your proposal has been reviewed and found to be consistent with the provisions and
objectives of the CAMA-Corps Programmatic Permit process (copy attached) for construction
activities that receive authorization from the State of North Carolina. Therefore, you may
commence construction activity in strict accordance with submitted plans, applicable State
authorization, and attached Federal special conditions. Failure to comply with the State
authorization or conditions of the Federal permit could result in civil and/or administrative
penalties.
If any change in your work is required because of unforeseen or altered conditions or for
any other reason, plans revised to show the change must be sent promptly to this office and the
North Carolina Division of Coastal Management prior to performing any such change or
alteration. Such action is necessary as revised plans must be reviewed and the authorization

The Commission's rules on building standards, oceanfront
setbacks and dune alterations are designed to minimize, but not
eliminate, property loss from hazards. By granting permits, the
Coastal Resources Commission does not guarantee the safety of
the development and assumes no liability for future damage to
the development. Permits issued in the Ocean Hazard Area of
Environmental Concern include the condition that structures be
relocated or dismantled if they become imminently threatened
by changes in shoreline configuration. The structure(s) must be
relocated or dismantled within two (2) years of becoming
imminently threatened, and in any case upon its collapse or
subsidence.
The best available information, as accepted by the Coastal
Resources Commission, indicates that the annual long-term
average ocean erosion rate for the area where your property is
located is _1 feet per year.
The rate was established by careful analysis of aerial
photographs of the coastline taken over the past SO years.
S di also indicate that the shoreline could move as much as
feet landward in a major storm.
The flood waters in a major storm are predicted to be about
_ _2.1_ feet deep in this area.
Preferred oceanfront protection measures are beach nourishment
and relocation of threatened structures. Hard erosion control
structures such as bulkheads, seawalls, revetments, groins, jetties
and breakwaters are prohibited. Temporary sand bags may be
authorized under certain conditions.
The applicant must acknowledge this information and
requirements by signing this notice in the space below. Without
the proper signature, the application will not be complete.

SPECIAL NOTE: This hazard notice is required for
development in areas subject to sudden and massive storms and
erosion. Permits issued for development in this area expire on
December 31 of the third year following the year in which the
permit was issued. Shortly before work begins on the project
site, the Local Permit Officer must be contacted to determine the
vegetation line and setback distance at yout site. If the property
has seen little change since the time of permit issuance, and the
proposed development can still meet the setback requirement,
the LPO will inform you that you may begin work. Substantial
progress on the project must be made within 60 days of this
setback determination, or the setback must be remeasured. Also,
the occurrence of a major shoreline change as the result of a
storm within the 60-day period will necessitate remeasmement
of the setback. It is important that you check with the LPO
before the permit expires for official approval to continue the
work after the permit has expired. Generally, if foundation
pilings have been placed and substantial progress is continuing,
permit renewal can be authorized. It is unlawful to continue
work after permit expiration.

adjacent to the Atlantic Ocean in the Town of Oak Island, Brunswick County. It was received complete on
April 5, 2017, and appears to be adequate for processing at this time. The projected deadline for making a
decision is June 19, 2017. An additional 75-day review period is provided by law when such time is
necessary to complete the review. If you have not been notified of a final action by the initial deadline
stated above, you should consider the review period extended. Under those circumstances, this letter will
serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from April 5, 2017, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of
your project. Such a meeting will be held within five working days from the receipt of your written
request and shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the road
right-of-way where a private road would lead one into your property. Failure to post this notice could result
in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits in
Areas of Environmental Concern in Brunswick County: On April 5, 2017, the Town of Oak
Island proposed to rebuild Yaupon Fishing Pier, at 705 Ocean Dr., adjacent to the Atlantic
Ocean, in Oak Island, and on April 6, 2017 Brunswick Regional Water & Sewer H2GO
proposed the construction of an effluent discharge pipeline and diffuser into the Brunswick
River, and construction of a new water treatment plant along Gregory Road Copies of the
applications can be examined or copied at the office of Brooks Surgan, N.C. Dept. of
Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext., Wilmington,
NC 28405, (910-796-7270) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to May 6, 2017 will be considered in
making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public
and state and federal agencies. Notice of the permit decision in these matters will be provided
upon wntten request.
