This permit, issued on . January 2, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Fishing Pier 1) Unless specifically altered herein, this permit authorizes the reconstructed fishing pier, all as expressly and specifically set forth in the attached permit application and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. RECEIVED (See attached sheets for Additional Conditions) JAN 10 2018 This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee Town of Oak Island Permit No.1-18 Page 2 of 4 ADDITIONAL CONDITIONS 2) All construction within the Ocean Hazard AEC shall comply with all applicable requirements of the N.C. Building Code and the local flood damage prevention ordinance as required by the National Flood Insurance Program. If any provisions of the building code or the flood damage prevention ordinance are inconsistent with any of the following AEC standards, the more restrictive standard shall apply. 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. All.new_pilings shall be not less_than.8 inches in diameter if round, or 8 inches to -a, side if square. 7) All new pilings shall have a tip penetration greater than eight feet below the lowest ground elevation under the structures. 8) Dune disturbance shall be kept to a minimum. Any alteration of existing dunes shall be coordinated with the Division of Coastal Management. All disturbed areas shall be restored to original contours and configuration and shall be revegetated immediately following project completion in that specific area. 9) Any structure authorized by this permit shall be relocated or dismantled when it becomes imminently threatened by changes in shoreline configuration. The structure(s) shall be relocated or dismantled within two (2) years of the time when it becomes imminently threatened, and in any case, upon its collapse or subsidence. However, if natural shoreline recovery or beach re -nourishment takes place within two (2) years of the time the structure becomes imminently threatened, so that the structure is no longer imminently threatened, then it need not be relocated or dismantled at that time. This condition shall not affect the permit holder's right to seek authorization of temporary protective measures allowed under CRC Rules. Any modification to these plans must be approved by the U.S. Army W &rps CEEngineers (USACE) prior to implementation. � U 0 Town of Oak Island Permit No. 1-18 Page 3 of 4 ADDITIONAL CONDITIONS 12) The Permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 13) The Permittee shall schedule an onsite preconstruction meeting between its representatives, the contractor's representatives and the appropriate Corps of Engineers Project Manager prior to undertaking any work within jurisdictional waters and wetlands to ensure that there is a mutual understanding of all terms and conditions contained within the Department of the Army permit. The Permittee shall notify the Corps of Engineers Project Manager a minimum of thirty (30) days in advance of the scheduled meeting in order to provide the Corps with ample opportunity to participate in the required meeting. 14) The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre - project condition _ - 15) A representative of the USACE, Regulatory Division will periodically and randomly inspect the work for compliance with these conditions. Deviations from the permitted activities and permit conditions may result in cessation of work until the problem is resolved to the satisfaction of the USACE. No claim, legal action in equity or for damages, adjustment, or other entitlement shall be asserted against the United States on account of any such required cessation or related action, by the permittee, its agents, contractors, or other representatives. 16) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. The applicant proposes to rebuild the existing Yaupon fishing pier. The project is located adjacent to and in the Atlantic Ocean at 705 Ocean Drive in Oak Island. I have reviewed this proposal for consistency with the Town of Oak Island CAMA Land Use Plan and offer the following comments. The general area of the project is classified as Developed and Conservation. Waters at the project site are classified as SB# and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. Areas of Environmental Concern (AEC's) are OH. Oak Island allows development in Developed and Conservation classified AECs, which is consistent with the State's minimum use standards. The Oak Island Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these policies appear to be applicable to this project. This project is consistent with the Town of Oak Island Land Use Plan Update. REGAN Secretary TRACY DAVIS Director On April 13, 2017, the Wilmington Regional Office of the Division of Energy, Mineral, and Land Resources received a copy of the CAMA Major Permit Application for the subject project. Staff review of the plans and specifications on April 25, 2017 has determined that the development activities proposed at this time will not pose a threat to surface water quality from stormwater runoff. The Director has determined that projects that are reviewed and approved by the Division as not posing a water quality threat from stormwater runoff should not be subject to the stormwater management permitting requirements of 15A NCAC 21-1.1000, the stormwater rules. By copy of this letter, we are informing you that this project will not require a stormwater management permit. If the subject project disturbs one acre or more and has a point source discharge of stor iwater runoff, then it is also subject to the National Pollutant Discharge Elimination System (NPDES) stormwater discharge requirements. You are required to have an NPDES permit for stormwater discharge from projects meeting these criteria. All temporary built -upon area associated with the construction of the project must be removed within 30 days of completion of the project, or when it is no longer needed, whichever occurs first. PROJECT DESCRIPTION DCM- MHD CITY The applicant's property is located at 705 Ocean Drive, adjacent to the Atlantic Ocean within the Town of Oak Island, Brunswick County. Directions from Highway 133 (Country Club Drive) just over the bridge on Oak Island: Turn Right onto E. Oak Island Drive and drive approximately 0.45 miles to Womble St. Turn Left onto Womble St. and travel approximately 0.35 miles to the end of Womble St. The project site will be located on the left side of the street. The project site averages approximately 12' above mean high water (MHW). Highground vegetation consists of maintained landscaping adjacent to the existing parking areas and restaurant building. The oceanfront beach area consists of dune vegetation such as American Beach Grass (Ammophilia breviligulata), Bitter Panicum (Panicum amarum), Pennywort (Hydrocotyle bonariensis), Seashore Elder (Iva imbricate), and Sea Oats (Uniola paniculata). The application states the project site is approximately 1.79 acres in size and is a single parcel, which currently consists of a concrete service road (Womble St.), and a gravel parking area utilized for an existing restaurant (dba The Flying Fish Cafe). The majority of the existing gravel parking area is located approximately 60' landward of the First Line of Stable and Natural Vegetation (FLSNV), however, most of the restaurant and approximately 785 sq. ft. of the parking area are waterward of the Town's 1998 Static Line and Development Line. The previous pier owner, David Beckner, received State Permit #135-92 on December 3, 1992, authorizing the reconstruction of an existing pier that was damaged by a storm even in 1989. The permit approved the reconstruction of a 914' long, 16' wide fishing pier, with a 40' long, 16' wide T-head platform at the waterward end of the pier. 754' of the pier was built before a March storm halted completing of the project. Due to the impending tourist season at the time, the original applicant requested a modification to State Permit #135-92 to construct a 42' long, 14' wide T-head platform at the end of the 754' pier. The applicant also requested to continue to the previously permitted pier length and change the dimensions of the terminal T-head platform to 42' in length by 28' in width. These requests were granted by the State through a Letter of Refinement on November 30, 1993. The pier was completed sometime before State Permit #135-92 expired on December 31, 1995. Permitting for the accessway was not located in the Wilmington Office archives, however, a survey dated June 27, 1988 and received by the office on September 23, 1992 with the David Beckner's pier application identifies the existence of an accessway prior to 1989. The survey and accessway are not referenced in State Permit #135-92, but it is possible the accessway was either authorized by a previous permit, or predates CAMA regulations. Tax records indicate that ownership of the pier was transferred from David Beckner to Cape Fear Trading Group VII, LLC in 2006, and then to Cooperative Bank in 2009. The Town of Oak Island purchased the pier from Cooperative Bank in 2009 and is now the current owner as stated in the attached deed. The Town of Oak Island Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Developed. The waters of the Atlantic Ocean are classified SB# by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. PROPOSED PROJECT: DCM- MHD CITY The applicant proposes to restore the old public fishing pier and accessway known as Yaupon Fishing Pier, which includes expanding the existing decking from 16' in width to 18' in width, to add structural support for the handrails. The length of the pier will remain consistent with what was previously permitted under State Permit #135-92, not to exceed 914' in length. The T-head platform at the body of the pier, and the T-head at the terminal end of the pier, will be 48' in length by 29' in width, and 48' in length and 15' in width, respectively. Both platforms will remain consistent with the dimensions of the previous pier platforms. The accessway will be reconstructed, starting at the most landward section of the fishing pier and ending at the end of the access ramp in the parking area. The main components being replaced will be the piles, girders, stringers, decking, and handrails of the existing access ramp, deck, stairs, and walkway. As proposed, the repair/replacement of the accessway would not exceed the footprint of what was existing. 11. ANTICIPATED IMPACTS The proposed expansion of the pier width from 16' to 18' would incorporate approximately an additional 1,652 sq. ft. of Public Ocean Beach Area and Open Water. Access along the beach should not be impeded by this structure. Ocean fishing piers are minimal in numbers, and they provide an entertainment function not met in other ways. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the State authorization: 1. A moratorium on shoreline activities from April 1 to November 15 of any year will be instituted as proposed in the permit application. 2. All work authorized by this permit must be performed in strict compliance with the attached plans, which are a part of this permit. Any modification to these plans must be approved by the U.S. Army Corps of Engineers (USACE) prior to implementation. 3. The Permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 4.
