This permit, issued on March 22, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Dockine Facility 1) This permit authorizes only the reconfigured docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this reconfigured docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the reconfigured docking facility. Any sewage discharge at the reconfigured docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Normann Properties, LLC s w, Permit No. 25-18 Page 2 of 2 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 7) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations _undertaken by the United States in the public interest. 10) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2018-00180), which was issued on 3/20/18. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018- 0123. NOTE: An application processing fee of $250 was received by DCM for this project. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight square foot rule, the quarter width rule, and would not encroach into the 15' adjacent riparian corridor setback requirement. The proposed facility would meet the 80' AIWW setback. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The project is located at 8532 Bald Eagle Lane, adjacent to the AIWW in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, PT and ORW. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is a not Primary Nursery Area. I have reviewed this proposal for consistency with the New Hanover County Comprehensive Land Use Plan and offer the following comments. The general area of the project is classified as Resource Protection while the AECs impacted by the work are classified as Conservation. In general, New Hanover County allows development in conservation classified AECs, which is consistent with the State's minimum use standards. The New Hanover County Comprehensive Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project is consistent with the New Hanover County Comprehensive Land Use Plan. The project location is in public trust waters off the shoreline of 8532 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW). The project location is directly adjacent to designated primary nursery area (PNA) across the channel of the AIW W. The shoreline of Bald Eagle Lane is known for being suitable habitat for submerged aquatic vegetation (SAV). The current configuration of the docking facility consists of an access pier measuring approximately 20' in length by 10' in width. At the terminus of the pier is an access ramp and a floating dock measuring 23' in length and 8' in width oriented perpendicular to the channel. The application lists that the floating dock is located in water depths that range from -1' NLW on the shoreward side to -2.5' NLW on the waterward side of the floating structure. The applicant is proposing to add an addition to the floating structure measuring 20' in length and 8' in width to access deeper water depth and construct a boat lift. Upon a site visit conducted on January 25, 2018, measurements shoed that the floating dock is located in water depths that range from -.45' (3 inches) NLW on the shoreward side to -2.37' NLW on the waterward side of the floating structure. The insufficient depth in the location of the current floating dock, result in approximately 18.5' of the total 32' resting on the soft bottom habitat. Based on the site investigation, there were no indications of the presence of SAV or rhizomes within the footprint of the proposed addition. The depths at the proposed location of the boat lift were -2.62' at MLW. The project area is not unique when compared to the bathymetry and depth contours of the neighbors. During the site investigation, it was noted that both adjacent property owners with piers and floating structures had similar depths at corresponding distances from shore. It should be noted that neighbors on both sides have constructed significantly longer fixed piers to access appropriate water depths for floating structures. Shallow soft bottom is an important foraging habitat for juvenile and adult fish and invertebrates, and aids in storing and cycling of sediment, nutrients, and toxins between the bottom and water column. Soft bottom habitat is used to some extent by most native coastal fish species in North Carolina. The habitat is particularly productive and, by providing refuge from predators, is an important nursery area. Species dependent on shallow soft bottom include clams, crabs, flounder, spot, Atlantic croaker, sea mullet, and rays (CHPP 2010). Many benthic predators are highly associated with the shallow soft bottom habitat, including flounders, weakfish, red drum, sturgeon and coastal elasmobranchs, although almost all fish will forage on microalgae, infauna, or epifauna on the soft bottom. PROJECT DESCRIPTION: The project site is located at 8532 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highway 17), turn right onto Porter's Neck Road and continue east through the traffic circle approximately 2 miles. At the stop sign, turn left onto Bald Eagle Lane and travel south approximately 0.6 miles and the property of interest will be located on the right. The property is approximately 0.9 acres and is approximately 22' above normal high water (NHW). The upland area of the property is currently undeveloped. The approximately 136' of shoreline is stabilized by an existing vinyl bulkhead which was built in 2017 and authorized via General Permit 69317D. Waterward of the bulkhead on the southernmost end of the property is an area of Coastal Wetlands measuring approximately 15-20' in width and 25' in length consisting primarily of Smooth Cordgrass (Spartina alternii fora). The property is bordered by residential properties to the north, south and west. The properties to the north and south are developed with single family homes and private docking facilities. Mr. Normann owns the lot to the north as well, and the next riparian property is owned by Porters Neck HOA. Waterward of the existing bulkhead is an existing access pier, measuring approximately 20' in length by 10' in width, which extends towards the AIWW in an easterly direction. At the terminus of the pier an access ramp leads from the access pier onto a floating dock, measuring approximately 32' in length by 8' in width, which runs in the same alignment as the access pier. The pier was authiorized via General Permit 449765D issued to H. Ward (previous owner) in 2006. NHW meets the bulkhead. The application states that the existing docking facility currently accommodates up to two (2) vessels in water depths of approximately —2.8' to -4.6' at NLW (See Sheet 1 of 2). However, upon a site visit conducted by DCM on 1/11/18 at 10:30am water depths in the vicinity of the floating platform ranged from -1' to -2.5' at NLW. Although it is not growing season, there appeared to be some sparse dead SAV grass covered in brown algae located throughout the project area at the time of the site visit. The City of Wilmington/New Hanover County 2006 Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Resources. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: 9. The applicant proposes to expand an existing private docking facility within Middle Sound. The application states that an additional section of floating dock measuring approximately 20' in length by 8' in width would be added to the end of the existing floating platform running perpendicular to the channel in the same direction as the existing floating platform. A new 13' by 13' boat lift would be added to the southern terminus of the new floating dock section. The application states that the other portions of the existing facility would remain the same. The application states that the proposed expansion of the existing facility would accommodate up to four (4) vessels in water depths ranging from approximately -2.8' to -4.6' at NLW. However, upon a site visit conducted by DCM on 1/11/18 at 10:30am water depths in the vicinity of the floating platform ranged from -P to -2.5' at NLW. The facility would extend approximately 91' into a water body measuring 632', which would meet the quarter width requirement and would be 175' landward of the federal channel setback (see Sheet 1 of 2). 10. ANTICIPATED IMPACTS: The proposed new configuration would incorporate an additional approximately 329 ft of Estuarine Water and Public Trust Areas. The proposed new configuration would not encroach into the adjacent 15-foot Riparian Corridor Setback Area requirement. The proposed structures would extend approximately 91' into a waterbody measuring approximately 632' in width, which would conform with the 1/4 width distance rule and would not encroach into the 80' federal setback requirement from the AIWW channel. The proposed structures would allow the facility to accommodate up to four (4) vessels in water depths of ranging from approximately —1.0' to -2.5' at normal low water (NLW).
