No Wake Signs
1) The "No Wake" markers shall be.installed in accordance with the attached workplan drawings.
2) The "No Wake" markers shall conform with any and all appropriate regulations governing such
structures, including but not limited to marking and lighting requirements of the US Coast Guard.
3) The permittee shall maintain the authorized "No Wake" markers in good condition and in conformance
with the terms and conditions of this permit. The permittee is not relieved of this. requirement if he
abandons the permittedactivitywithout having it transferred to a third party.

ADDITIONAL CONDITIONS
4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
5) This permit does not authorize the interference with any existing orproposed Federal project, and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
that may be caused from existing or future operations undertaken by the United States in the public
interest.
General
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
7) This permit does not authorize any excavation or fill of any vegetated wetlands.
8) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required. .
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has assigned the proposed project DWR Project No.
2018-0977.
NOTE: The U.S. Army Corps of Engineers assigned the proposed project Action Id. No. SAW-2018-
01455, Nationwide Permit 1.

Hey .... so the only one that I have is the Sunset Beach No Wake Zone. Nav said they have no problem with the project,
we are reviewing under NWP 1 with no special conditions.
The other two sound familiar, but I don't have them. They may have been authorized by NWP and we just neglected to
copy you.
I am working in Fayetteville and Fort Bragg tomorrow, but have copied Christy on this email.
Christy: Can you see if we issued anything recently for BHI Conservancy and William Waddell?

Sunset Beach Land Use
The applicant proposes to install two "No Wake Zone" signs within the AIWW. The
signs will be located on each side of the Sunset Beach bridge in Brunswick County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Sunset Beach Land Use
Plan and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Sunset Beach allows development in Conservation classified
AECs which is consistent with the State's minimum use standards. The Town of Sunset
Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.
Provided all local, state and federal requirements can be met, this project appears to
be consistent with the Town of Sunset Beach Land Use Plan.

Recommendations for State Permit — NC WRC 6/28/18
The installation of the "No Wake Zone" signs would likely result in a temporary increase in turbidity. The
proposed locations for the signs do not appear to pose a threat to navigation. This office has no objections or
other concerns regarding the proposed development. It appears to be consistent with all other conditions of
NCAC 07H .0208. It is recommended that any permit issued should include conditions addressing navigation:

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has
reviewed the CAMA Major Permit application for proposed actions that impact fish and fish
habitats. The applicant is seeking to install two "No Wake' signs within the AIWW.
In order to ensure safe navigation and fishing activities, this office suggests that the
applicant reach out to the United States Coast Guard (USCG) Private Aids to Navigation
section to aid in public awareness of the new signage. It is also suggested that the applicant
coordinate with NOAA OCS to have their sites properly marked on all nautical charts.

PROJECT
The project site is located within the AIWW, in Sunset Beach, Brunswick County. To find the project site, travel
south (from Wilmington) on US Highway 17 past Shallotte, NC. Turn Left onto Seaside Rd. SW/NC-904 and
travel approximately 3.60 miles. Turn right onto Sunset Blvd N/NC -179 Bus and travel approximately 1.7 miles.
Take the 2nd exit at the traffic circle to stay on Sunset Blvd N. The project site will be located on the western and
eastern sides of the Sunset Beach bridge and can be accessed by the NC Wildlife Ramp at the end of Sunset Blvd.

The AIWW is approximately 500 linear feet across in this area. The established "No Wake Zone" extends 600
liner ft. and runs beneath the Sunset Beach bridge, adjacent to the NC WRC Sunset Beach Boating Access Area
and encompasses the USACE Federal Channel and Channel Setback areas. The area surrounding the AIWW is
undeveloped to the south and has one residential property and the NC WRC Public Boating Access to the north.
This section of the AIWW is bordered by Coastal Wetlands, which is vegetated primarily with Smooth March
Cordgrass (Spartina alterniora).
According to documentation provided by the applicant, this `No Wake Zone" was established by the NC WRC in
2017 and had USACE concurrence in December of 2017. General Permit NO. 70505D was issued on June 21,
2018 to install two buoys providing temporary "No Wake Zone" boundaries while the current project is under
review. The proposed plan would be to install two pilings with supporting information. A copy of the WRC
Ruling on this "No Wake Zone" area can be found under WRC's Rules at 15A NCAC 1 OF .0305. The NEPA
Statement of Compliance for No Wake Zone marker installation is included with this application
The waters of the AIWW are classified SA; HQW by the Division of Water Resources and ARE designated as a
Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of
shellfish.
10. PROPOSED PROJECT:
The applicant proposes to install two "No Wake Zone" signs within the AIWW. The signs are proposed to be 4
ft. long by 4 ft. wide and will be mounted via barge on 8" timber pilings (see Sheet 3 of 3). The first sign would
be located along the southern edge of the 80 ft. Federal Channel Setback approximately 50 yards west of the
Sunset Beach Bridge at 33' 52' 51.60" N, 78' 30'42.51" W. This sign would be located outside of the channel,
approximately 170 ft. from the adjacent shoreline to the south. The second sign would be located along the
southern edge of the 80 ft. Federal Channel Setback approximately 150 yards east of the Sunset Beach Bridge at
33° 52' 53.42" N, 78° 30'35.05" W. This sign would be located outside of the channel, approximately125 ft. from
the adjacent shoreline to the south (see Sheet 1 of 2).
11. ANTICIPATED IMPACTS
The installation of the two "No Wake Zone" signs will not result in permanent significant impacts to Estuarine
Waters and Public Trust Area. Minor increases in turbidity should be. expected. The proposed locations for the
two signs do not appear to pose a threat to navigation. As proposed, both signs would be located approximately 80
ft. feet from the federal channel.

CAMA Permit Narrative for Sunset Beach No Wake Zone Markers
June 2018
NCWRC proposes to install 2 new No Wake Zone markers at the boundaries of the Sunset Beach No
Wake Zone on the Intracoastal Waterway in Sunset Beach, Brunswick County, NC.
The purpose of this project is to regulate boat traffic and improve public safety around the NCWRC
public boat ramp and SR 1172/Sunset Boulevard Bridge by delineating the established No Wake Zone.
This No Wake Zone was established by NCWRC in 2017 and concurred with by US Army Corps of
Engineers in December 2017. The rules text is 15A NCAC 10F .0305. An exhibit with a map, the NCAC
rules text, and USACE concurrence is included with this application.
The coordinates of the western proposed marker are 330 52' S1.60" N, 780 30' 42.51" W. This location is
on the southern edge of the Federal Navigation Channel Setback and aligned with a bridge bent.
The coordinates of the eastern proposed marker are 33152' 53.42" N, 78130' 35.05" W. This location is
on the southern edge of the Federal Navigation Channel Setback and aligned with a bridge bent.
No upland development is proposed. No new impervious surfaces will be created. No above -water land
will be disturbed.

purpose of the No Wake Zone was to create a safety zone around the bridge and public boat ramp. This project will install

or revoked. If, prior to the expiration date identified below, the nationwide permit authorization is reissued and/or modified, this
verification will remain valid until the expiration date identified below, provided it complies with all requirements of the modified
nationwide permit. If the nationwide permit authorization expires or is suspended, revoked, or is modified, such that the activity would
no longer comply with the terms and conditions of the nationwide permit, activities which have commenced (i.e., are under construction)
or are under contract to commence in reliance upon the nationwide permit, will remain authorized provided the activity is completed
within twelve months of the date of the nationwide permit's expiration, modification or revocation, unless discretionary authority has

The Division of Coastal Management hereby acknowledges receipt of your application for State
approval for the development of two areas within the Atlantic Intracoastal Waterway (AIWW) located in
Sunset Beach, Brunswick County. It was received as complete on June 13, 2018 and appears to be
adequate for processing at this time. The projected deadline for making a decision is August 27, 2018.
An additional 75-day review period is provided by law when such time is necessary to complete the
review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of
an extended review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from June 13, 2018 you may
request a meeting with the Director of the Division of Coastal Management and permit staff to discuss the
status of your project. Such a meeting will be held within five working days from the receipt of your
written request and shall include the property owner, developer, and project designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a 'Notice of Permit Filing" postcard which must be
posted at the property of your proposed development. You should post this notice at a conspicuous point
along your property where it can be observed from a public road. Some examples would be: Nailing the
notice card to a telephone pole or tree along the road right-of-way fronting your property; or at a point
along the road right-of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted
by the appropriate State or Federal agency. Please contact me if you have any questions and notify me in
writing if you wish to receive a copy of my field report and/or comments from reviewing agencies.
