Jones St. 2"1 Floor, Raleigh, NC 27603 Authorizing development in Dare County at within Jockey's Ridge State Park and sound side adj. to Roanoke Sound , as requested in the permittee's application dated 2/8118 (ram-1, r to-2) & 2/21/18 (MP- 3), Incl. attached workplan drawings (5), CI00-101 dated "Revised 2/8/18", C102-C103 dated 1/26/18, & C104 dated "Revised 2/22/18". This permit, issued on May 21, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation >f these terms may be subject to tines, imprisonment or civil action; or may cause the permit to oe nuu ana voia. Jockey's Ridge Sand Relocation 1) In accordance with 15A NCAC 7H .0507, sand relocation authorized under this permit shall be deposited within Jockey's Ridge State Park. At no time during the authorized relocation shall sand be deposited outside the park boundaries. 2) The placement of sand at the estuarine beach shall be confined to those areas above Normal Water Level. The use of temporary silt fencing is authorized along NWL to confine sand within Jockey's Ridge State Park. The sand shall be graded to meet existing slopes at NWL. The temporary silt fencing shall be removed upon completion of the estuarine beach placement. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Property Office c/o NC State Parks Permit No. 49-18 Page 2 of 2 ADDITIONAL CONDITIONS Upland Development — Wooden Walkway -ss specifically altered herein, this permit authorizes the grading and other land disturbing activities ciated with the development of the above referenced property, including the wooden walkway iolition and relocation, all as expressly and specifically set forth in the attached permit application workplan drawings. wooden walkway shall stop a minimum of 30 feet from Normal Water Level. Sedimentation and Erosion Control E: An Erosion and Sedimentation Control Plan may be required for this project if upland disturbance is greater than 1 acre. If required, the plan must be filed at least thirty (30) days prior to the beginning of any land disturbing activity. Contact the Division of Energy, Mineral and Land Resources, Land Quality Section, 943 Washington Square Mall, Washington, NC 27889 for this determination. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the _written approval of the Division of Coastal Management. The permittee and/or his or her contractor shall meet with a representative of the Division prior to ,project initiation. This permit does not eliminate the need to obtainanyadditional state, federal or local permits, approvals or authorizations that may be required. The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-0415 issued 5/17/18. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 264-3901 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 160B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a -- contractor- it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. Up to 117,000 cubic yards of sand will be moved to the area near the old road bed, west of Carolista Drive. Approximately 3000 cubic yards of sand will be transported to the sound side beach area for renourishment and to cover exposed stumps/tree roots. An existing beach access wood walkway will be replaced 30 feet north of its current location. The development proposal involves the Unique Coastal Geologic Formation (UCGF) - Jockeys Ridge AEC and Estuarine Shoreline (ES) AEC. I have reviewed the Rules of the Coastal Resources Commission (CRC) as they pertain to this proposal, and my findings are as follows: 15A NCAC 07H .0507 UNIQUE COASTAL GEOLOGIC FORMATIONS (c) Management Objectives. The CRC's objective is to preserve unique resources of more than local significance that function as key physical components of natural systems, as important scientific and educational sites, or as valuable scenic resources. Specific objectives for each of these functions shall be related to the following policy statements either singly or in combination: (1) To ensure that the designated geologic feature will be able to freely interact with other components of the identified systems. These interactions are often the natural forces acting to maintain the unique qualities of the site. (3) To protect the values of the designated geologic feature as expressed by the local government and citizenry. These values should be related to the educational and aesthetic qualities of the feature. (e) Use Standards. Jockey's Ridge„ Development within the Jockey's Ridge AEC shall be consistent with the following minimum use standards: (1) Development which requires the removal of greater than ten cubic yards of sand per year from the area within the AEC boundary shall require a permit; (2) All sand which is removed from the area within the AEC boundary in accordance with 7H .0507(e)(1) shall be deposited at locations within the Jockey's Ridge State Park designated by the Division of Coastal Management in consultation with the Division of Parks and Recreation; All excavated sand will remain in the Jockeys Ridge AEC. The project proposal is consistent with the intent of these rules. (3) Development activities shall not significantly alter or retard the free movement of sand except when necessary for the purpose of maintaining or constructing a road, residential/commercial structure, accessway, lawn/garden, or parking area. The proposal includes the placement of silt fencing to protect adjacent properties, drainage features, roadways, and the Roanoke Sound. movement of sand. However, it has been noted by representatives of review agencies that methods should be taken to keep the sand along the shoreline in the AEC and out of the adjacent waterbody. 15A NCAC 07H .0209 COASTAL SHORELINES (a) Description. The Coastal Shorelines category includes estuarine shorelines and public trust shorelines. Estuarine shorelines AEC are those non ocean shorelines extending from the normal high water level or normal water level along the estuarine waters, estuaries, sounds, bays, fresh and brackish waters, and public trust areas as set forth in an agreement adopted by the Wildlife Resources Commission and the Department of Environment and Natural North Carolina Department of Environmental Quality MEMORANDUM Division of Coastal Management Page 3 of 5 NC State Property Office c/o NC State Parks; Jockey's Ridge State Park 03/13/18 Resources [described in Rule .0206(a) of this Section] for a distance of 75 feet landward... (b) Significance. Development within coastal shorelines influences the quality of estuarine and ocean life and is subject to the damaging processes of shore front erosion and flooding. The coastal shorelines and wetlands contained within them serve as barriers against flood damage and control erosion between the estuary and the uplands. Coastal shorelines are the intersection of the upland and aquatic elements of the estuarine and ocean system, often integrating influences from both the land and the sea in wetland areas. Some of these wetlands are among the most productive natural environments of North Carolina and they support the functions of and habitat for many valuable commercial and sport fisheries of the coastal area. Many land -based activities influence the quality and productivity of estuarine waters. Some important features of the coastal shoreline include wetlands, flood plains, bluff shorelines, mud and sand flats, forested shorelines and other important habitat areas for fish and wildlife. (c) Management Objective. The management objective is to ensure that shoreline development is compatible with the dynamic nature of coastal shorelines as well as the values and the management objectives of the estuarine and ocean system. Other objectives are to conserve and manage the important natural features of the estuarine and ocean system so as to safeguard and perpetuate their biological, social, aesthetic, and economic values; to coordinate and establish a management system capable of conserving and utilizing these shorelines so as to maximize their benefits to the estuarine and ocean system and the people of North Carolina. (d) Use Standards. Acceptable uses shall be those consistent with the management objectives in Paragraph (c) of this Rule. These uses shall be limited to those types of development activities that will not be detrimental to the public trust rights and the biological and physical functions of the estuarine and ocean system. Every effort shall be made by the permit applicant to avoid, mitigate or reduce adverse impacts of development to estuarine and coastal systems through the planning and design of the development project. In every instance, the particular location, use, and design characteristics shall comply with the general use and specific use standards for coastal shorelines, and where applicable, the general use and specific use standards for coastal wetlands, estuarine waters, and public trust areas described in Rule .0208 of this Section. Development shall be compatible with the following standards: (1) All development projects, proposals, and designs shall preserve and not weaken or eliminate natural barriers to erosion including peat marshland, 0 resistant clay shorelines, and cypress gum protective fringe areas adjacent to W vulnerable shorelines. > w The project proposal is consistent with the intent of these rules. (,1 W (2) All development projects, proposals, and designs shall limit the construction of impervious surfaces and areas not allowing natural drainage to only so much as is necessary to adequately service the major purpose or use for which the lot is to be developed. Redevelopment of areas exceeding the 30 percent impervious surface limitation may be permitted if impervious areas are not increased and the applicant designs the project to comply with the intent of the rule to the maximum extent feasible. The project proposal is consistent with the intent of these rules. (3) All development projects, proposals, and designs shall comply with the following mandatory standards of the North Carolina Sedimentation Pollution Control Act of 1973: (A) All development projects, proposals, and designs shall provide for a buffer zone along the margin of the estuarine water which is sufficient to confine visible siltation within 25 percent of the buffer zone nearest the land disturbing development. (B) No development project proposal or design shall permit an angle for graded slopes or fill which is greater than an angle which can be retained by vegetative cover or other erosion control devices or structures. (C) All development projects, proposals, and designs which involve uncovering more than one acre of land shall plant a ground cover sufficient to restrain erosion within 30 working days of completion of the grading; provided that this shall not apply to clearing land for the purpose of forming a reservoir later to be inundated. Silt fencing is proposed to be placed above NWL adjacent the Roanoke Sound in an effort to confine sand from entering into the adjacent waterbody. The project proposal is consistent with the intent of these rules. (4) Development shall not have a significant adverse impact on estuarine and ocean resources. Significant adverse impacts include development that would directly or indirectly impair water quality standards, increase shoreline erosion, alter coastal wetlands or Submerged Aquatic Vegetation (SAV), deposit spoils waterward of normal water level or normal high water, or cause degradation of shellfish beds. Recommend that silt fencing or other appropriate measures be taken to Prevent any sand fill from being placed in any and all vegetation. (5) Development shall not interfere with existing public rights of access to, or use of, navigable waters or public resources. The project proposal is consistent with the intent of these rules. (6) No public -facility shall be permitted if such a facility is likely to require public expenditures for maintenance and continued use, unless it can be shown that the -public purpose served by the facility outweighs the required public _ _ expenditures for construction, maintenance, and continued use. The project proposal is consistent with the intent of these rules. (7) Development shall not cause irreversible damage to valuable, historic architectural or archaeological resources as documented by the local historic commission or the North Carolina Department of Cultural Resources. The project proposal is consistent with the intent of these rules. (8) Established common law and statutory public rights of access to the public trust lands and waters in estuarine areas shall not be eliminated or restricted. Development shall not encroach upon public accessways nor shall it limit the intended use of the accessways. The project proposal is consistent with the intent of these rules. Based on my review of the applicable subsections of the North Carolina Administrative Code, the permit application and plans to relocate sand at Jockeys Ridge State Park and construct a new walkway at the sound side beach meet the intent of the rules of the CRC. DATE: March 27, 2018 Consistency Determination: The request is consistent with/not in conflict with the Town of Nags Head 2010 Land Use Plan certified by the CRC on February 24, 2011 as amended through December 12, 2013. Overview: Jockey's Ridge State Park is designated as a National Natural Landmark by the US Department of Interior and as a unique coastal geologic formation Area of Environmental Concern (AEC) by the state's Coastal Resources Commission. Jockey's Ridge State Park encompasses 409 acres of rolling sand dunes and scrub -shrub maritime forest with approximately 4,400 linear feet of shoreline along Roanoke Sound. Jockey's Ridge State Park is bounded by the Roanoke Sound to the west, S. Croatan Highway to the east, and residential housing to the north and south. Elevations across the park range from zero at Normal Water Level (NWL) along the shore to 65 feet at the top of the tallest dune. Northeast winds cause the dunes to move southeast each year. Existing site improvements include a Visitor's Center, garage, parking areas, walkways, picnic areas and nature trails. Existing shoreline improvements consist of a wooden walkway connecting a parking area to the soundside beach and wetland protection sills just offshore in the Roanoke Sound. None of the park's shoreline has been hardened. Project areas consist of a 700 foot by 175 foot dune area to the southeast, a 750 foot by 610 foot dune area to the north, and the soundside beach access area to the southwest. Removal of 120,000 cubic yards of sand from the southeast dune area, relocation of 117,000 cubic yards of sand to the northern dune area and 3,000 cubic yards of sand to a 1,600 foot long by 45 foot wide area along the shoreline, and installation of a 6 foot wide by 84 foot long walkway are proposed. Matting will be placed and silt fencing will be installed to protect adjacent properties, drainage features, roadways, and the sound. Dump trucks will transport the sand. Project Setting The development site(s) are located at the Jockeys Ridge State Park at 300 W. Carolista Drive, US 158 and West Soundside Road in Nags Head, Dare County, and adjacent to the Roanoke Sound to the west of the Park. The Park is currently developed with a Visitor's Center, garage, picnic areas, nature trails, elevated walkway/observation deck, parking lots, ADA access ramp/walkway, non-ADA walkway and wetland protection sills constructed of bagged oyster shells. Jockeys Ridge State Park was designated as a National Natural Landmark by the US Department of Interior. Historical data notes that the highest elevation has been at 100 feet, but currently varies from 0 at Normal Water Level (NWL) along the shore of the Roanoke Sound to 65 feet at the top of the tallest dune. This variation is due to the shifting nature of the sands within the Park. Jockeys Ridge State Park encompasses 4 parcels totaling 329± acres. The tall dune area of Jockey's Ridge is known as a medano—a massive, asymmetrical, shifting hill of sand lacking vegetation. Northeastern winds cause the dunes to move southeast each year; however, the dunes are somewhat stabilized by the surrounding areas of maritime thicket. The shrub thickets include southern wax myrtle (Myrica cerifera), eastern red cedar (Juniperus virginiana), southern live oak (Quercus virginiana), and red bay (Persea borbonia). To the west of the dunes and along West Soundside Road, you will find American beach grass (Ammophila breviligulata), agave plants, live oaks, shrubs, and loblolly pine (Pinus taeda). In the area of the sound side beach, the vegetation in the 30-foot and 75-foot AECs included fringes of sea oats (Unio/a paniculate), salt meadow cordgrass/salt meadow hay (Spartina patens) saltbush, southern wax myrtle, agave plants, and non -coastal wetland plants. The total shoreline of the tract is 4,400± feet. Previous CAMA Major and Minor permits issued for the project tract were for the development of wetland protection sills, minor sand relocation, garage, and ramps. The riparian property owner to the north is developed with condominiums/apartments, a clubhouse, pool, gazebo, pier, decking and wooden groins. The riparian property owner to the south is developed with a single-family residence, pier, deck, and wooden breakwaters. The Division of Environmental Management's water classification for Roanoke Sound is SA and High Quality Waters (HQW). Per the NCDEQ Shellfish Sanitation Maps, the areas of the Villa Condominium STP outfall (to the north of Jockeys Ridge) and Old Nags Head Cove (to the south of Jockeys Ridge) are closed to shellfish taking. The area of Jockeys Ridge State Park is not currently designated as closed. The descriptive boundary for the project area is designated as Coastal Waters and is in the Pasquotank River Basin. 4 4. Field Investigation Report: Jockey's Ridge State Park Page 3 A scoping meeting was held at the Washington Regional Office on December 13, 2017 to review preliminary plans of the proposal for the Park. The main concern for the project was erosion control for the southeast corner of the Park, as well as the sound side beach. The Representative of the Habitat Conservation Division, National Marine Fisheries Service (NMFS) Southeastern Region, was not able to attend the scoping meeting, but did send comments via email. Kenneth Riley noted that the NMFS concerns for the proposal would be focused on habitat impacts related to the nourishment of an estuarine shoreline. A request was made that any work reflect avoidance and minimization with regard to salt marsh or seagrass habitat. Development Proposal The applicant proposes to excavate an area (measuring approximately 700 feet in length and 175 feet in width) of dune that has migrated to the southeast corner of Jockeys Ridge State Park. This will result in the removal of up to 120,000 cubic yards of sand. The excavation area will be near US 158 and West Soundside Road. Matting will be placed at the construction entrance and silt fencing will be installed to protect adjacent properties, drainage features, roadways, and the Roanoke Sound. Dump trucks will be used to transport the sand to the northern reaches of the Park, as well as the sound side beach area. Sand relocated to the northern dunes of the Park will cover an area of 750 feet in length and 610 feet in width. It is estimated that between 97,000 to 117,000 cubic yards of sand will be placed in the area near the old road bed, west of Carolista Drive. Sand relocated to the sound side beach area will cover an area of 1600 feet in length and an average of 45 feet in width (it is noted that the depth of the shoreline varies from 5' to 100'). The estimated cubic yards of sand deposited on the shoreline is 3000. The silt fencing will be placed above NWL along the shoreline to prevent sand from sloughing off into the Sound. An existing beach access wood walkway will be removed from the sound side beach area to provide access for the sand renourishment. A replacement walkway will be built 30 feet north of the current walkway, and will be 84 feet in length and 6 feet in width. The new location will be closer to the existing parking lot. The proposed start date for the excavation project would not begin until after Veteran's Day weekend. Anticipated Impacts • Excavation of the southeast corner of the dunes will remove 122,500± square feet of sand (100,000 to 120,000 cubic yards) from the UCGF - Jockeys Ridge AEC. • Approximately 97,000 to 117,000 cubic yards of sand will be returned to the UCGF — Jockeys Ridge AEC in the northern dune area, covering 457,500± square feet. • Approximately 3000 cubic yards of sand will be moved to the sound side beach area, covering 72,000± square feet of ES AEC. This area is still within the UCGF — Jockeys Ridge AEC boundary. • 264 square feet of shading will occur in the 75' ES AEC with the construction of the new walkway. This sand will be relocated (by truck) to the northern reaches of the Park as illustrated on the Project Plans. The project will stage the excavation area near US 168 with access onto West Soundside Road and move north and westward with the excavation. Wood matting will be placed at the construction entrance and silt fencing will be installed to protect the adjacent neighbors, drainage features, sound, and roadways during sand relocation. The Park will also be renourishing the upland areas of their sound side beach with some of this material during this process. All sand placed on the beach will be above NWL. All sand excavated will remain within the Jockeys Ridge park boundaries. No stabilization of the relocated materials is planned or desired as this relocated sand provides renourishment to Jockeys Ridge. The excavated areas will be left in their natural state to be reshaped by nature. Due to the shifting nature of the sands within the Park, the final areas for excavation will be determined based upon the site conditions in the winter of 2018. This will be a unit cost project which will ultimately determine the amount of sand that can be relocated within the available construction funds. Just prior to the commencement of the project, a condition survey will be performed and final volumes and areas to be excavated will be confirmed. Disposal area will accept whatever final volumes are relocated with the designated areas. At the sound side beach area, the existing wooden walkway will be removed to provide access for the sand renourishment. A new 6'x84' wooden walkway will be constructed to the north of the existing walkway location in order to provide safer access between the existing parking lot and the beach area. The proposed project is for the relocation of approximately 2000 cubic yards of sand from the southeast section of the park to the northeast corner of the park. Movement of the dune in the last couple of years has left one park residence in Immediate danger of being covered over. Currently the sand is encroaching the rear of the property and has covered a split rail fence. The proposed project will be completed to LAMA specifications. Google maps offers historical aerial maps where this movement can be viewed. I've attached a photo which illustrates this point as well. From the parks inception, it bus always been an accepted fact that, at some point, mitigation of sand movement would be required. For the past two years, Nags Head has experienced vicious winter winds that have accelerated sand movement in the SE comer. This scud movement Is quickly becoming a threat to private and public property, and we need a quick solution to buy time until a more large-scale project can be launched. After consultation with our natural resources staff, EADI staff, and lung time privara Outer Banks residents, we've come to a conccnsus regarding a potential plan of action. no first part of this plan is the subject of this request. Approximately 2000 cubic yards of sand would be removed from the area indicated on the attached maps from behind 116 W. Soundside Road (35,9560,-75.6271). This sand would be taken to the area in the NE comer of the park indicated on the map (35.9644,-75.6371), when: it will be allowed to resupply the system, but not pose any additional threat to property for many years. The sand would best be removed by trackhoe or tractor with bucket, and transported by 4WD dump truck. To expedite workflow, 2 or more dump trucks are required, as well as some type of matting that will allow heavy trucks to drive on soft sand. Access behind 116 W. Sotmdside Road is extremely limited, so a trackhoe that can access sand from the dune itself is the optimal choice. It's been suggested that this project be carried out by force labor, but JORI staff is entering our busy season where every hour from every staff member is accounted for providing for over a million visitors in the next 6 months. A labor force would need to be organized to include labor from other parks, with EADI Maintenance Supervisor Johnson as lead. Another point worth considering is that the project is likely to take 20 work days. Our past experience has shown that removing 2000 cubic yards of sand will constitute approximately 400 dump truck loads. (5 yard dump truck/2000 cubic yards = 400 loads) It's possible to remove about 20 dump truck loads in a day. After the sand is removed, the area and the area immediately NW of the site will be heavily planted with beach grass, and sand fencing will be erected. The Friends of Jockey's Ridge have demonstrated a willingness to finance planting efforts and provide volunteer labor for large-scale planting and sand - fencing workdays. Their budget is limited however, so this is likely the extent of assistance they can . provide. it's my belief that a project of this scope would buy DPR enough time (approximately 2 years) to plan for a more involved sand relocation project for the SE comer of Jockey's Ridge State Park.
