This permit, issued on April 9, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Artificial Reef AR-398 1) In accordance with commitments made by the permittee, reef construction within the site shall be accomplished using Oyster Catcher mats & patties deployed over existing rubble mounds, as depicted in the attached Figures 5-8. All materials shall be free from loose dirt or pollutants except in trace quantities. 2) The permittee shall be required to repair, maintain and/or remove any components of the reef that are displaced from the reef site boundaries. The permittee shall be responsible for removing all portions of the reef should the site be terminated or displaced beyond repair. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Any expansion of the reef beyond the 25 rubble mounds described in the application shall require additional authorization. 4) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters adjacent to the authorized work. U.S. Army Corps of Engineers Conditions 5) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws. og v/ne- es/mammal/manatee puidelines.pri 6) The permittee understands and agrees that, if future operations by the United States requires the removal, relocation, or other alteration of the structure or work authorized by this permit, or if in the opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable obstruction to free navigation of the navigable waters, the pernittee shall be required, upon due notice from the Corps of Engineers, to remove relocate or alter the structural work or obstructions caused thereby, without expense to the United States or the state of North Carolina. No claim shall be made against the United States or the state of North Carolina on account of any such removal or alteration. General 7) The permittee shall install and maintain at his expense any signal lights, signals, or siguage prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized reef site. 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. NOTE: Future development at any of the permitted Artificial Reef site may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Any monitoring required by the various agencies, should be included if any CAMA permit is issued. The project appears to be CONSISTENT with Rules established by the CRC as well as the States Dredge and Fill Laws. Provided no other agency has any objections to the proposed project, and any/all monitoring requirements are in place, the Wilmington Regional Office has no objection to the issuance of a permit for the proposal if issued with the following conditions: DREDGE & FILL Include standard Dredge and Fill requirements. Note: If materials of cultural significance, such as the remains of a beached shipwreck are encountered during construction, work must move to another area and the Underwater Archaeology unit at (910) 458-9042 as well as the District Engineer with the U.S. Army Corps of Engineers at (910) 251-4725 must be contacted to assess the wreckage and determine the proper course of action. The NC Division of Marine Fisheries proposes to place a cultch/spat infused biodegradable composite mat on top of 25 existing concrete rubble mounds, as an oyster enhancement project. The project is located within the New River between Sneads Ferry and Jacksonville in Onslow County. Areas of Environmental Concern (AEC's) impacted by the proposal are Estuarine Waters and Public Trust Areas. Waters at the project site are classified as SC and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Onslow County Land Use Plan Update and offer the following comments. The general area of the project is classified as Conservation. In general, Onslow County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Onslow County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these more restrictive policies appear to be applicable to this project. This project appears to be consistent with the Onslow County Land Use Plan Update. Specifically, the applicant proposes to add seeded Oyster CatcherTM panels to existing concrete rubble mounds by draping 2 panels each over the top of 25 mounds, for a total of 100 m2 of panels. To abate concerns over movement, another form of Oyster CatcherTM called a patty will be attached to weight down each comer of the panels as needed. The patties are porous disks (-35cm diameter x 5cm high) created`from a loose aggregation of jute fiber bundles. Additionally, the applicant will place live oyster clusters on the mounds which will ultimately settle into pockets within the mounds. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.sov/nc- es/mammal/manatee guidelines.pdf. 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including,debris from land clearing activities), or unsightly debris will not be used. 9. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 10. The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. PROJECT The project site (NCDMF Artificial Reef - AR-398) is situated in New River proper, between the City of Jacksonville and Sneads Ferry, in Onslow County. The site, which is just west of Famell Bay in the center of the river, has a permitted history dating back to 2010. On October 29, 2010, DCM issued CAMA Major permit 128-10, authorizing AR-398, which encompasses approximately 31 acres, with approximately 1.5 acres of actual structure fill, consisting of concrete rubble mounds and concrete reef balls. Water depths in the vicinity of the reef range from 6.5' to 10.0' below the normal low water level. The area is subtidal in nature and consist of firm sandy bottom with no known vegetation and no existing shellfish resources. PROPOSED PROJECT: As previously indicated, the applicant is requesting authorization to place a cultch/spat infused biodegradable composite mat on top of 25 existing concrete rubble mounds, as an oyster enhancement project, at AR-398. According to the application package, proprietary cultch/substrate bundles or mats — called Oyster Catcherrm, each measuring approximately 3' x 6' (1 in x 2m x 0.5" thick), would be installed as "mats' or "panels". These pre -seeded structures would be lowered into the river (by vessel) and deployed on the river bottom on top of approximately 25 existing concrete rubble mounds. Two panels would be draped over each of the 25 mounds, for a total of 100 m2 of panels. As indicated, the panels are flexible and likely to "mold" to the contour of the rubble mounds. As a safe guard, an Oyster Catcherrm called a "patty" will be attached to weigh down each comer of the panel, if necessary. The "patties" are porous disks created from loose aggregate of jute fiber bundles (i.e. like concrete). These patties are also pre -seeded with oysters. See Figures 4, 5 and 6 for specifications on product. Following deployment and settlement, the reef would be monitored by NCDMF staff (as time allows) using bathymetric mapping, as an update to the Artificial Reef s program's artificial reef guide and habitat records. The application package also indicates SCUBA surveys would be conducted on reef sites to observe material condition, as time allows. In addition to the NCDMF monitoring, and for the first two years, researchers from UNC-IMS will make quarterly visits to all sites to: Evaluate oyster density, growth and survivorship; assess fish and crustacean use of the site; inspect site for marine debris and inspect the site for displaced Oyster Catcher TM material. For more information on both short term and long-term monitoring, please refer to NCDMF's memo to DCM dated 1/8/2018. 10. ANTICIPATED IMPACTS The proposed Oyster Catcheirm placement would result in approximately 1,225 sq. ft. of fill material within an area already disturbed and filled with concrete rubble. The fill portion of the project would result in the disturbance of approximately 1,225 sq. ft. of river bottom. Minor increases in turbidity is expected as a result of the project, but not long term effects are anticipated. AR-39B is included in a proposed oyster restoration effort in the New River led by the city of Jacksonville, called the "Oyster Highway (Figure 3). The projects objective is to create oyster brood stock populations up estuary from their present range by transplanting—500,000 large juvenileismall adult oysters to each of a series of stepping -stone reefs in mid/upper Farnell Bay that will facilitate oyster recruitment throughout the New River. The materials for live oyster seeding are produced by Sandbar Oyster Company. The Division of Marine Fisheries holds the CAMA permit for the creation of AR-398. In this instance, the Division will hold the peril for enhancements and ensure that materials meet the guidelines for reef construction and remain within the permitted reef boundaries at AR-398. C. Describe the proposed construction methodology, types of construction equipment to be used during construction, the number of each type of equipment and wham it is to be stored. A full description can be found in the attached narrative. For the seeding of AR-398 mounds, we propose to use woven panels of Oyster CatcharTe, each approximately 2 1 (1m x 2m x 0.5cm thick). Importantly, these panels will be "pre -seeded' with larvae of the region's wild oyster populations (Figure 4) and not a hatchery bred/raised stock. SANDBAR accomplishes the pre -seeding of the panels by deploying them as horizontally layered stacks (3-4 panels per stack) in the low intertidal zone of SANDBAR's shellfish leases in the Newport River and New River. We propose adding seeded Oyster Catchei panels to concrete rubble mounds by draping 2 panels each over the top of 25 mounds, for a total of 100 1 of panels. The seeded panels have a degree of flexibility that will allow them to "mold" to the contour of the rubble mound peak and sufficient weight and roughness to remain in place on top of the mounds. A seeded mat weighs 22-26lbs, depending on the number of oysters. For each mound to be draped with a pair of mats, the mounds will be located by divers, who will deploy weighed buoys at —1/4 perimeter distances around the base of the mound, thereby delineating the mounds shape and center. To deploy a mat, a'% -inch line will be threaded through two adjacent corners on the short axis of each mat. The mat will be lowered over the side of the boat and held near the surface as the boat is positioned over a mound as determined by the position of the mound marker buoys. Once the mat contacts the mounds, the boat will be backed up as the mound is lower onto the mound, leaving the lines in places, with a buoy on one end of each lowering line. Once the mat is on the mound, diver will follow the lowering lines to the mat and complete the final positioning and return to the surface. The lowering lines will then be pulled from the mat and returned to the boat for deployment of the next mat. The placement of the mats is shown in Figure 8. Twenty-five (25) of these sites are in the states estuaries, while 42 are in ocean waters. In 2016, the NC DMF released an artificial reef guide which outlines each of the artificial reefs and oyster sanctuaries. This document provides material information, latitude longitude information, and a figure of the material on the reef site. AR-398 is included in a proposed oyster restoration effort in the New River led by the city of Jacksonville, called the "Oyster Highway" (Figure 3). The project's objective is to create oyster brood stock populations up estuary from their present range by transplanting —500,000 large juvenile/small adult oysters to each of a series of stepping -stone reefs in mid/upper Farrell Bay that will facilitate oyster recruitment throughout the New River. The materials for live oyster seeding are produced by Sandbar Oyster Company. The Division of Marine Fisheries holds the CAMA permit for the creation of AR-398. In this instance, the Division will hold the permit for enhancements and ensure that materials meet the guidelines for reef construction and remain within the permitted reef boundaries at AR-398. Proposed Enhancements Enhancement plans include utilizing a new proprietary cultch/substrate — called Oyster CatcherTM. Oyster CatcherTM is a biodegradable composite consisting of plant fiber cloths, like jute erosion control cloth, infused with mineral -based binders, such as cement. Prior to hardening of the binder, Oyster CatcherTM is sculpted into a wide range of modular shapes. The different forms of Oyster CatcherTM are designed for oyster reef creation and enhancements across of wide range of estuarine environments. For the seeding of AR-398 mounds, we propose to use woven panels of Oyster CatcherTm, each approximately 2 m2 (lm x 2m x 0.5cm thick). Importantly, these panels will be "pre -seeded" with larvae of the region's wild oyster populations (Figure 4) and not a hatchery bred/raised stock. In the past 3 years, SANDBAR has commonly achieved oyster densities of 5000 per m2 of panel (Figure 5). To further enhance the survival of the transplanted juvenile oysters, transfers from the intertidal lease areas to AR-398 will occur during the late fall -early spring period when predation pressure on oysters is low and water column hypoxia is uncommon. The seeded patties weigh 10-12lbs, depending on the oyster densities. Over time, as the panels and patties age and biodegrade, single oysters and small clusters break free of the panels. These oysters will settle into the interstitial spaces between the concrete rubble pieces on the top of the mounds, where they will be sequestered away from bottom water hypoxia and afforded a degree of protection from predatory fishes and crabs. Currently, we plan to permit the use of 50 seeded panels and up to 200 seeded patties on the AR-398 reef site. As part of a study, seeded oyster patties were temporarily placed on the reef in December 2015. The seeded oyster patties have experienced mortality due to resource competition (average 597 oyster/m2 —> 21 oysters/m2) during their time at the reef site. During the same period, the surviving oysters have grown from an average 20.46 mm to 62.7 mm in length. Deployment Methodology Collection of panels from the intertidal seeding areas will occur at mid -to -high tide when a boat can be positioned next to the stacks of mats. Mats, will then be lifted onto a sheet of plywood on the boat deck. Mat will typically be stacked 10-15 high per sheet of plywood and the number of stacks determined by the boat size. The mats will be transported to a nearby boat ramp and transferred to a truck bed or trailer, secured and then driven to a beach access point on the west shore of the New River less than 0.5 km from AR-398 (with permission from Camp Lejeune). From the beach, these will be placed back on the boat for transport to the AR-398 mounds receiving the oyster -coated mats. If additional mats beyond what are currently available seeded with oysters, new mats will be deployed in late April/early May to either on Newport River leases, or, if approved, an intertidal lease in the lower New River. Oysters seeded in the late springlearly summer 2018, would likely be ready for placement on the mounds by early fall (September/October) 2018. We anticipate deploying mats on 10 mounds a day (i.e. 20 mats per d). Our experience working with the mats and with the skiff -type boats available for the project, suggests this is a workable number daily. This amount of time out of water has never resulted in the death of our oysters, even during the hot months of the year. This period of aerial exposure will in fact help reduce the transport of potential oyster pests from the lower portions of the Newport/New River estuaries to AR-398. Additionally, the mats will be rinsed with freshwater, further stressing/killing any attached oyster pests. Once sprayed with freshwater, the stacked mats will be covered with a light-colored sheet. Note that we are taking reasonable precautions within our control to reduce transfer of organisms other than oysters between the seeding locations and AR-398. Under existing rules in North Carolina, transfers of oysters from one location to another (within/among water bodies) are permitted and encouraged under a polluted area relay program and relays from seed oyster management areas (SOMAs). Further, there are no location restrictions regarding transfer of cultured oysters between leases. Under these permitted relocations of oysters and associated materials, there are no cleaning requirements to minimize transfers of associated organisms. Reef Monitoring During construction, NCDMF staff will serve as observer(s) to ensure proper permit and building compliance. Deployed materials will be surveyed with calibrated onboard sonar to verify compliance with vertical clearance requirements. When time allows, NCDMF staff will survey the sites with bathymetric mapping equipment, as an update to the Artificial Reef program's artificial reef guide and habitat records. Staff will also perform SCUBA surveys on reef sites to observe material condition, as time allows. The Artificial Reef program also employs an online survey for recreational users to provide feedback on Artificial Reefs through its website. Further, artificial reefs are included in MRIP survey questionnaires, which can offer valuable biological information. In the fast two years post -construction, researchers from UNC-IMS will make quarterly visits to all sites to: (1) evaluate oyster density, growth, and survivorship; (2) assess fish and crustacean use of sites; (3) inspect sites for marine debris; and (4) inspect sites and surrounding bottom for displaced Oyster Catcher material. In addition, staff from UNC-IMS also plan to coordinate with CCA NC to devise a standardized approach for, public -participation, hook -and - line recreational fish sampling of Oyster Highway sites. During each quarterly site visit, personnel from UNC-IMS will snorkel by all 180 reef structures at each site, removing any human debris such as bags, fishing gear, etc. If reef units are noticed to be missing materials, staff will also conduct a 50-m search (regardless of site boundaries) to locate and reposition displaced material. If continued monitoring funding cannot be secured for 2+ years post restoration, UNC-IMS internal resources to continue checking sites for debris and displaced material on an annual basis. Any deployment of reef materials during North Atlantic right whale calving season (November 15 through April 15 of any year( must comply with: a. Maximum speed for all vessels Involved in placing the reef material is 10 knots. b. Deployments must be conducted during daylight hours when lighting, weather, and sea conditions allow for visual monitoring of the project area. c. Deployment activities will not commence until NCDMF staff reports that no marine mammals or sea turtles have been sighted for at least 60 minutes. d. Deployment activities will cease Immediately if sea turtles or marine mammals are sighted within the protected area and will not recommence until the NCDMF staff reports that no mammals or sea turtles have been sighted for at least 60 minutes. 2. If a listed species is seen within IDO yards of the active daily construction operation or vessel movement, all appropriate precautions shall be implemented to ensure its protection. These precautions shall include cessation of operation of any moving equipment closer than 50 feet of a listed species. Operation of any mechanical construction equipment shall cease immediately If a listed species is seen within a 50-ft radius of the equipment. Activities may not resume until the protected species has departed the project area of its own volition. 3. Reef structures shall be sited and installed according to the historically permitted site clearances, listed in Table 1, relative to MLW. 4. Reef structures shall not be placed on natural hard -bottom habitat 5. Materials should be of sufficient sue and relative density to not move from the reef site post - deployment and be dean and free from asphalt, creosote, petroleum, other hydrocarbons and toxic residues, loose free floating material or other deleterious substances. 6. The use of explosives to deploy materials is not authorized. 7. Reef materials shall be selected to ensure that ESA -listed species do not become entrapped in reef structures, or entangled in debris (e.g., abandoned fishing tackle, nets, and lines) that may accumulate on artificial reefs: a. Materials used for artificial reef building shall conform to the recommendations in the Notional Artificial Reel Plan (as Amended): Guidelines for Marine Artificial Reef Materials, Second Edition (Atlantic and Gulf States Marine Fisheries Commissions 20D4). Except that derelict automobiles shall not be used and derelict vessels and military surplus shall have openings on all exposed sides adequate to prevent entrapment of ESA -listed species. Clean steel, concrete bridge or large building demolition materials such as slabs or pilings may be used provided that all steel reinforcement rods are cut at the base of the concrete so no rebar or metal is protruding. 8. Underwater reef cleanup will be performed by NCDMF divers during annual reef site monitoring events. Cleaning reefs In lour visibility/high current dive conditions may present diver safety Issues with the potential of divers being entangled or snagged. Staff will make every reasonable attempt to clean reef materials of debris during regulary, scheduled assessments, without compromising the safety of the crew and divers. The applicant will send confirmation of cleanup to NMFS's Southeast Regional Office (takereport.nmfsser@noaa.gov), including dates of cleanup efforts and results of the dean -up. 9. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at httpj/www.fws4ov/nc- es/mammaVnianatee_guidehnes.pdf. 10. The applicant shag follow NMFS's Sea Turtle and Smalltooth Sowfish Construction Conditions in order to further reduce Interaction risk, and require all construction workers watch for sturgeon and sea turtles.
