RE: EXEMPTED PROJECT REDISTRIBUTION OF SAND WITHIN THE OCEAN HAZARD
AREA OF ENVIRONMENTAL CONCERN (15A NCAC 07K .0103(c)).
PROJECT LOCATION/ADDRESS — 224 Seashore Dr., North Topsail Beach
Dear Mr. Ruiz,
I have reviewed the information submitted by your authorized agent to our office concerning the
redistribution of sand against and near your residence at 224 Seashore Dr., and have determined that the
activity you propose of a 4' area on the oceanward side of the house to be redistributed within the
property and on the existing engineered, man-made berm exempt from needing a CAMA Minor
Development Permit as long as it remains consistent with your project drawing, dated "RECEIVED
DCM-MHD CITY" January 5, 2021, and it also meets the conditions specified below. If your plans
should change and your project will no longer meet these conditions, please contact me before proceeding.

CONCERN EXEMPTED
l . All redistribution shall be located no greater than 4' oceanward of the support pilings and shall
redistribute the sand within the ocean hazard AEC, on the property of 224 Seashore Dr., and shall
not exceed the footprint of the engineered man-made berm.
2. No ground disturbance or land disturbing activity shall occur outside the areas identified on the
workplan drawings.
5. This exemption does not allow for any development oceanward of the seaward toe of the
engineered man-made berm. Any proposal to modify or alter the development plan as proposed
will require additional authorization from the Division of Coastal Management.

This exemption does not eliminate your requirements to obtain any other State, Federal or Local
authorization. Construction of the structure authorized by this exemption shall be completed by
December 31 of the third year of the issuance date of this exemption.
