This permit, issued on September 28, 2018 , is subject to, compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
,i mese terms may oe suoject to noes, imprisonment or civil action; or may cause the permit to be null and void
Agricultural Drainage System
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the installation of the agricultural drainage system, including the culverts,
tide gates and flashboard riser brackets, all as expressly and specifically set forth in the attached
permit application and workplan drawings.
2) - No vegetated wetlands shall be excavated or filled, even temporarily, outside of the approved culvert
alignment.
3) This permit does not authorize any fill or excavation waterward of the approved culvert alignment
beyond what is necessary to install the agricultural drainage system.

qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered

Management Program.

ADDITIONAL CONDITIONS
4) The fill material shall be clean and free of any pollutants except in trace quantities.
5) All fill material shall be obtained from a high ground source:
6) In order to protect juvenile shrimp and finfish populations, a turbidity curtain shall be left immediately
downstream of the project area, and a 24-hour period after completion of excavation shall elapse prior to
silt screen removal to prevent unnecessary siltation into the adjacent water body.
Sedimentation and Erosion Control
7) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of
grading on cut or filled slopes to ensure that eroded materials do not enter adjacent wetlands,
watercourses or properties. At a minimum, a silt fence shall be properly installed between any disturbed
areas and adjacent wetlands or watercourses immediately following completion of backfilling activities.
Operations and Management Plan
8) In accordance with commitments made by the permittee in the Operations and Management Plan
prepared for this project, and in order to satisfy concerns of the resource agencies, the following
conditions shall be adhered to:
A. The flashboard risers shall only be used to service the tide gate.
B. Flashboard risers shall be limited to only one culvert at any time.
C. Placement of flashboard risers within any culvert shall not exceed 7 consecutive days.
D. In the event flashboard risers are used, the applicant or authorized agent shall notify the Division
of Coastal Management and the Division of Water,Resources.before installation and after..
removal.
9) Failure to comply with Condition No. 8 shall be considered a violation of this permit.
General
10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
11) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third parry.
12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Permit 198000291 (Action ID SAW-2018-01411) issued 9/24/18.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 18-1047.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior. to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150E with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the worts done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact. Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Earl Pugh (Middle Creek Farms) in Hyde County
Dear Mr. Brinn:
This letter is in response to the above referenced CAMA permit application for Mr. Earl Pugh,
which was accepted as complete by the Division's Elizabeth City office on June 28, 2018.
Processing of the application is ongoing. However, it has been determined that additional
information will be required prior to the Division taking final action on your application. These
required items are summarized below:
1) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking final action on a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). Based upon the attached hold for additional information from the DWR dated
August 2, 2018, it appears as though additional information from the applicant will be
required before a final decision on issuance of a Water Quality Certification can be made.
2) In addition, the Division of Coastal Management Fisheries Resource Specialist has
submitted concerns related to the retention of water by the flashboard risers.
Therefore, it is necessary that processing of your permit application be placed in abeyance until
such time as the resource concerns are satisfied, the required information is provided to the
DWR, a Water Quality Certification is issued for the project, and a copy of the approval supplied
to this office.

SUBJECT: Earl D. Pugh Jr./Middle Creek Farms

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct a water control structure in the channelized headwaters of Middle Creek a
designated primary nursery area, PNA. Two 30" x 30' culverts are proposed to be installed with flanges
to attach tide gates to the downstream portion of the culvert and flash board riser to the upstream portion.
The installation of the culverts will require the area be dredged to grade and then earthen fill will be
placed, over top the culverts. The primary purpose of the project is to preventsaltwater intrusion into the
agriculture drainage system upstream of this area. The project will result in the loss of access to
approximately 2,000 linear feet of canal and construction of the water control structure will fill
approximately 360ft2 of coastal wetlands
DCM fisheries has visited thd site in March of 2018 and in July of 2018. During the March visit the canal
at this location and upstream was dominated by filamentous algae and no other visible signs of aquatic
life. During the July visit fish and shrimp we seen throughout the channelized creek and upstream canal
with mullet, shrimp, crab, and killifish observed. The area where the water control structure is proposed is
the last portion of the canal that has signs of the natural channel and a riparian area consisting of
wetlands. Above this location the canal narrows and is flanked by the gravel road and earthen dyke the
south. While the tide gate installation at this location will cut off access to a portion of canal, this area is
marginalized as habitat being narrow, shallow, and pinched between a road and, a dyko.'DCM_fsheries
canal systems, particularly during dry periods of the summer, can cause the water to become anoxic
rapidly and can lead to the concentration of any run-off (chemical or sediment) from agricultural
practices. When riser boards are removed and anoxic water released it can cause mortality to larval and
juvenile fish in the downstream area and general avoidance of critical habitat afterward until conditions
stabilize.
DCM fisheries also recommends a moratorium on Tn-water work -from Apnll,.to Sepfember30'due to the
dredge and fill proposed that could negatively impact the nursery functions of Middle Creek for larval and
juvenile fish and shellfish with increased turbidity.

Division of Soil & Water Conservation. Mr. Pugh has committed to this management and it is subject to random
inspection by the Hyde Soil and Water Conservation District for 10 years upon installation.
I believe this is a good starting point for discussion of riser management at this location and I would look to you and
other DEQ staff to provide further input about concerns and desired actions to move forward.

Water Control Structure
Maintenance and Management Agreement
Addendum to NC-ACSP-2

This is an agreement between t)ekWStn Pu,S� and the '1 as Soil
and Water Conservation District for the purpose of managing the water level Me drainage system
by flashboard riser(s). Contract number: '1 �-20I6—a92 Structure location: see attached
map.
The objective for managing water control structure(s) is to reduce the amount of agriculture
pollutants leaving the farm through the drainage system. Water management may also improve
yields and crop production. In order to preserve water quality and to assure that the structures are
being maintained and performing the function for which they were originally designed, the
following requirements must be met:
1. Recommended depth from ground surface to water level in the chart below should be followed.
Other crops may require a different schedule.
2. The water level must be maintained within 36 inches of the ground surface along at least 50%
of the upstream ditch reach all year 4T order to reduce nitrate losses and maximize water quality
benefits. Short term adjustments shall be permitted to accommodate field access (trafficability)
and unusually high rainfall.
3. Have enough boards on the site and at the structure(s) to bring the water level in the ditch to
the designed maximum elevation. This is usually the top of the riser or the maximum water level
the structure was designed to handle.
4. Structure(s) will be checked after major storms but at least semi-annually.
5. As the ditch fills with sediment, it will be necessary to clean out the ditch. Vegetated borders
may be needed to reduce the input of sediment.
I agree to manage the water level in my drainage system as stated above. With the exception of
maintenance and repairs there will always be 1 Z, inches of boards above the sediment level
in the bottom of the ditch.

The plan Daniel sent is just the standard water management plan across the state for the best water levels to facilitate
better agricultural growth — not a management plan for surface waters. This is just guidance across the state for crops,
not water quality for surface waters. Although it provides a minimum water level for 50% of the ditch, this is more or
less to address nutrient loads rather than flows, dissolved oxygen, and other parameters important for the downstream
PNA habitats. The concerns NCWRC would need to have addressed would be more related to how much water would be
retained during warm months when flow, water temperature, and dissolved oxygen are crucial; what would trigger
retaining and release of water, how parameters would be monitored, etc. This a similar discussion previously had with
the county. I do not believe a detailed management plan would be necessary for only the tide gates.

Please find attached the operation and maintenance agreement signed by Mr. Pugh which is specific to the proposed
structure. This is the management regime that is used statewide on NC Ag Cost Shared Risers funded through the
Division of Soil & Water Conservation. Mr. Pugh has committed to this management and it is subject to random
inspection by the Hyde Soil and Water Conservation District for 10 years upon installation.
I believe this is a good starting point for discussion of riser management at this location and I would look to you and
other DEQ staff to provide further input about concerns and desired actions to move forward.

double barrel culvert with tidal gates on the downstream ends to combat salt intrusion into agricultural lands.

USACE No adverse comments have been received by the Corps, therefore, we do not have any objections or concerns

Enclosed is a Major CAMA/Dredge and Fill permit application submitted by Mr. Daniel Brinn,
Hyde County Water and Flood Control Coordinator, on behalf of Mr. Earl D. Pugh,
landowner/farmer, for the construction of a water con4l structure in Middle Creek canal off the
Pamlico Sound near the community of Middletown south of Engelhard in Hyde County, North
Carolina. The water control structure consists of 2-30" wide x 30' long culverts custom built to
have tidegates on the downstream end and flash board risers on the upstream end. The tidegates
are concave aluminum flaps that have a rubber gasket that seals to a collar bolted to the culvert so
when a wind tide flows up the creek to the channelization the tide gate seals preventing saltwater
from moving up the channelization past the water control structure. The flap props open when
drainage upstream is the greater hydraulic force. The flash board riser has two puposes: the riser
can hold fresh water upstream during dryer times and can also aide in blocking the movement of
saltwater upstream.
Installation of this structure will eliminate the movement of aquatic organisms upstream of the
water control structure therefore any habitat use in the canal will be permenately lost. This location
was chosen by the applicant because it also stops saltwater intrusion from entering another lateral
drainage canal to the north and allows for the road bed adjacent the northern lateral canal and
Middle Creek road to serve as a flood prevention dike.
If there are no significant objections from the review agencies concerning negative impacts to
water quality, loss of habitat or negative impacts to the primary nursery area in Middletown Creek,
DCM Staff in the Washington Regional Office recommends issuance of the permit. Coastal
Resource Commission rules that would support a denial or issuance of the permit include the use
standards for Coastal Wetlands 7H.0205d, Estuarine Waters 7H.0206(d), general use standards for
Public Trust Areas 7H.0208(a)(2)(A)-(G), and 7H.0208(b)(3)(D). Staff recommends the standard
conditions for culvert pipe installation with the exception that "the culvert shall be buried at least
one foot below normal bed elevation" as this will disrupt the function of the tide gates.

Middle Creek (35°28'52.7"N, 76001'22.1"W) off Pamlico Sound adjacent to SR 1107, in Middletown, Hyde
County, North Carolina.
Areas of Environmental Concern in the project area include EW, PTA, ES, PTS, and CS. The canal is
approximately 20' wide and 2.5' deep at NWL. Middle Creek is designated SA;HQW, is a PNA, and is closed
to shellfishing. There was no SAV observed during the site visits in the spring. There are Coastal Wetlands
marsh vegetated predominately with black needlerush, salt grass, and salt meadow hay associated with
Middle Creek. A review cultural or archaeological resources was not provided.
Anticipated impacts resulting from this project as proposed will result in the loss of any estuarine
dependent species from utilizing the canal upstream of the project site. The proposed culvert will fill 360
ft2 of Coastal Wetland march and the excavate and fill 600 ft2 of canal bottom.
Basis for Determination:
The project site is in Hyde County and is subject to the 2008 Hyde County CAMA Core Land Use Plan. The
Future Land Use Map (FLUM) designates the project site as Agricultural Low Density Residential and Lake

Landing National Register Historic District; and all AECs as "Unbuildable Land", which limits development

The following policies may be applicable to this project.
P.53 Hyde County supports reducing soil erosion, runoff, and sedimentation to minimize the adverse
effects on surface and subsurface water quality. -

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed
the subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct a water control structure in the channelized headwaters of Middle Creek a
designated primary nursery area, PNA. Two 30" x 30' culverts are proposed to be installed with flanges
to attach tide gates to the downstream portion of the culvert and flash board riser to the upstream portion.
The installation of the culverts will require the area be dredged to grade and then earthen fill will be
placed over top the culverts. The primary purpose of the project is to prevent saltwater intrusion into the
agriculture drainage system upstream of this area. The project will result in the loss of access to
approximately 2,000 linear feet of canal and construction of the water control structure will fill
approximately 360ft of coastal wetlands
DCM fisheries has visited the site in March of 2018 and in July of 2018. During the March visit the canal
at this location and upstream was dominated by filamentous algae and no other visible signs of aquatic
life. During the July visit fish and shrimp we seen throughout the channelizcd creek and upstream canal
with mullet, shrimp, crab, and killifish observed. The area where the water control structure is proposed is
the last portion of the canal that has signs of the natural channel and a riparian area consisting of
wetlands. Above this location the canal narrows and is flanked by the gravel road and earthen dyke the
south. While the tide gate installation at this location will cut off access to a portion of canal, this area is
marginalized as habitat being narrow, shallow, and pinched between a road and a dyke. DCM fisheries
does not object to the culvert and tide gate installation at this location for limiting saltwater intrusion.
However, removal of the proposal to install flashboard risers is requested as this water management
practice can have negative impacts on the PNA waters downstream of the structure. Holding water in
canal systems, particularly during dry periods of the summer, can cause the water to become anoxic
rapidly and can lead to the concentration of any run-off (chemical or sediment) from agricultural
practices. When riser boards are removed and anoxic water released it can cause mortality to larval and
juvenile fish in the downstream area and general avoidance of critical habitat afterward until conditions
stabilize.
DCM fisheries also recommends a moratorium on in -water work from April 1 to September 30 due to the
dredge and fill proposed that could negatively impact the nursery functions of Middle Creek for larval and
juvenile fish and shellfish with increased turbidity.

6. Operation and Maintenance Plan (0&M)
The applicant shall adhere to the following conditions in order to install the proposed 2-30 inch
culverts with flashboard risers of upstream end and tidal gates on the downstream end of the
culverts. Placement of riser boards to impede full culvert capacity will be limited to one culvert of
the two at a time and only for the purpose of servicing of the tidal gate. The placement use of riser
boards within the riser will be limited to no more than 7 consecutive days. If servicing of the tidal
gates is required, then the Permittee or authorized agent are required to contact the DWR
Washington Regional Office (252-946-6481). (15A NCAC 02B .0221)
This approval is for the purpose, and design described in your application. The plans and
specifications for this project are incorporated by reference as part of the Certification. If you change
your project, you must notify the Division and you may be required to submit anew application
package with the appropriate fee. If the property is sold, the new owner must be given a copy of this
approval letter and General Certification and is responsible for complying with all conditions. [15A
NCAC 02B .0507(d)(2)]
These Certifications can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a
written petition for an administrative hearing to the Office of Administrative Hearings (hereby known as
OAH). A petition form may be obtained from the OAH at htto://www.ncoah.com/ or by calling the OAH
Clerk's Office at (919) 4313000 for information.
Within sixty (60) calendar days of receipt of this notice, a petition must be filed with the OAH. A petition
is considered filed when the original and one (1) copy along with any applicable OAH filing fee is received
in the OAH during normal office hours (Monday through Friday between 8:00am and 5:00pm, excluding
official state holidays).

The project will prevent salt water intrusion into the agricultural properties upstream which can yeild cropland sterile. Tide
gates will act as automatic check valve allowing excess water from rainfall to flow out but preventing saltwater from the
pamlioo sound to flow in. Flashboard risers will allow the applicant to manage drainage water in accordance with Soil &
Water Conservation guidelines to reduce nutrient loading by up to 30%.

Thanks for the opportunityto do the conference call with all the resource folks, it was very helpful to hear the concerns.
Mr. Pugh would be willing to agree to a conditional permit in order to be able to install the structures with risers as
originally presented.
The risers would only be used in the event that a tide gate needed to be serviced,
Placement of riser boards would occur in only one of the two risers at a time, ensuring no water was being held/backed
up.
Placement of boards would be limited to no more than 7 consecutive days.
Notification would be made to the CAMA field rep. before boards were place.

This letter is in response to the above referenced CAMA permit application for Mr. Earl Pugh,
which was accepted as complete by the Division's Elizabeth City office on June 28, 2018.
Processing of the application is ongoing. However, it has been determined that additional
information will be required prior to the Division taking final action on your application. These
required items are summarized below:
1) In accordance with 15A NCAC 07H.0208(a)(2)(B), it is the policy of this Division that,
prior to taking final action on a project of this nature, a Water Quality Certification for
the proposed development must first be approved by the Division of Water Resources
(DWR). Based upon the attached hold for additional information from the DWR dated
August 2, 2018, it appears as though additional information from the applicant will be
required before a final decision on issuance of a Water Quality Certification can be made.
2) In addition, the Division of Coastal Management Fisheries Resource Specialist has
submitted concerns related to the retention of water by the flashboard risers.
Therefore, it is necessary that processing of your permit application be placed in abeyance until
such time as the resource concerns are satisfied, the required information is provided to the
DWR, a Water Quality Certification is issued for the project, and a copy of the approval supplied
to this office.

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed•
the subject permit application for proposed actions that impact fish and fish habitats. The applicant
proposes to construct a water control structure in the channalized headwaters of Middle Creek a
designated primary nursery area, PNA. Two 30" x 30' culverts are proposed to be installed with flanges
to attach tide gates to the downstream portion of the culvert and flash board riser to the upstream portion.
The installation of the culverts will require the area be dredged to grads: and then earthen fill -will be
placed over top the culverts. The primary purpose of the project is to prevent saltwater intrusion into'the
agriculture drainage system upstream of this area. The project will result in the loss of access to
approximately 2,000 linear feet of canal and construction of the water control structure will fill
approximately 360ft of coastal wetlands
DCM fisheries has visited the site in March of 2018 and in July of 2018. During the March visit the canal
at this location and upstream was dominated by filamentous algae and no other visible signs of aquatic
life, During the July visit fish and shrimp we seen throughout the channelized creek and upstream canal
with mullet, shrimp, crab, and killifish observed, The area where the water control structure is proposed is
the last portion of the canal that has signs of the natural channel and a riparian area consisting of
wetlands. Above this location the canal narrows alid is flanked by the gravel road and earthen dyke the
south. While the tide gate installation at this location will out off access to a portion of canal, this area is
marginalized as habitat being narrow, shallow, and pinched between a road and, a dyke: DCM fisheries
does not object to the culvert and tide gate installation at this location for limiting saltwater. intrusion.
'However, removal of the proposal to install flashboard rigors is requested as this water management
practice can have negative impacts on the PNA waters downstream of the structure: Holding water in
canal. systems, particularly during dry periods of the summer, can cause the water to become anoxic
rapidly and can lead to the concentration of any ran -off (chemical or sediment) from agricultural.
practices. When riser boards are removed and anoxic water released it can cause mortality to larval and
juvenile fish in the downstream area and general avoidance of critical habitat afterward until conditions
stabilize. .
DCM fisheries also recommends a moratorium on in -water work from April I to September 30 due to the
dredge and fill proposed that could negatively impact the nursery functions of Middle Creek for larval and
juvenile fish and shellfish with increased turbidity.

Project Setting
The project site is located at the channelized head of Middle Creek off the Pamlico Sound
adjacent SR 1107, Middle Creek Road, in the community of Middletown south of Engelhard in
Hyde County, North Carolina. Middle Creek at its headwaters is channelized and parallels Middle
Creek road and appears to be a borrow canal used for fill to construct the Middle Creek road. The
barrow canal interfaces with the head of Middle Creek. The borrow canal/channelization is
approximately 20' wide and 2.5' deep at normal water levels (NWL). The project site is located
immediately downstream of an intersection of another drainage canal that drains cropland to the
north of Middle Creek road. A ±30" culvert, open without riser or tide gate, connects this drainage
canal to Middle Creek under Middle Creek road. There is a spoil road that parrels the
aforementioned drainage canal north of the project site. The spoil road has an elevation t2' higher
than the surrounding land elevation. Middle Creek is bordered by Middle Creek road to the north
and a flood prevention dike to the south. Both are t2.5' high above the NWL in Middle Creek.
The drainage ditch system in the cropland south of this dike is contained inside the dike and drains
to Middle Creek thru a culvert in the dike downstream of the project site. This pipe is equipped
with a tide gate. There are Coastal Wetlands marsh vegetated predominately with black needlerush
(Juncus roemerianusl, salt grass Distichlis s icata and salt meadow hay S artinapatens
associated with Middle Creek. The widths of this associated marsh vary and marsh is more
.prevalent where the stream has not been channelized downstream of the project site. At the project
site the southside of the canal has an area of Coastal wetland marsh (t12' wide x 116' long)
vegetated primarily with salt meadow hay S artina atens . Upstream of the project site the canal
bank gains elevation and Coastal Wetlands marsh is not present to the terminus of the drainage
feature. The Middle Creek channelization narrows upstream of the project site.
Water depths at the project site minus 2.5' to 3.0' below NWL. There was no submerged
aquatic vegetation observed during site visits this spring. Middle Creek is designated as a primary
nursery area (PNA) by the Marine Fisheries Commission and SA HQW by the Environmental
Management Commission and is closed to shellfishing.
Project Description
The applicant is the landowner on the southside of Middle Creek adjacent the project site.
The applicant also owns a parcel and farms the cropland on the north side of Middle Creek road.
The applicant proposes to construct a water control structure consisting of dual custom built
aluminum 30" wide x 30' long culverts equipped with tide gates and a flash board riser for the
primary purpose of preventing saltwater intrusion into the agricultural drainage ditch system north
of Middle Creek road as well as further up Middle Creek canal and ultimately into the ditch system
in cropland to the south. This location is advantageous to the applicant in that it allows for the
spoil road on the east side of the drainage canal across Middle Creek road to the north to serve as

a flood prevention dike for the cropland to the west. The tide gates are concave aluminum flaps
with a rubber gasket that seals to a flange bolted to the pipe that seals off the pipe preventing the
flow of water upstream when the hydraulic pressure from an incoming wind tide exceeds hydraulic
pressure from drainage upstream. When hydraulic pressure from gravity flow drainage upstream
is greater the flap opens allowing water flow to move downstream. The riser on the upstream end
has a twofold purpose: It can hold water to maintain a higher water table for crops during dry
periods in the growing season as well as serve as a backup to the tide gate in slowing or stopping
the movement of saltwater upstream of the water control structure. By placing the gated culverts
in this location also allows for Middle Creek road also to serve as a flood protection dike for land
north of the road bed. An excavator will excavate out the muck in the culvert footprint, t30'long
x 20'wide. This area will then be backfilled most likely with gravel to provide a stable foundation
to support the culverts. Fill dirt will be placed over the culverts to an elevation of 1.7' from the
top of the culvert pipe contained by an aluminum headwall on the upstream side. The fill dirt will
be sloped at a minimum 2' to l' on the downstream side with the toe of the fill at the collar
supporting the tide gates. The fill dirt will be sloped and graded then seeded and covered with
mulch to provide a vegetated ground cover to prevent erosion. Riprap may also be placed on the
slope on the downstream side to stop erosion of the fill dirt. An area of high marsh will be filled
on the south side of the canal 12' x 30' maintaining the elevation of the fill over the water control
structure to the existing earthen dike in adjacent cropland.
Anticipated Impacts
The project as proposed will result in the loss of any estuarine dependent species from
utilizing the canal upstream of the project site. The proposed culvert will result in the filling of
±360 ftz of Coastal Wetland marsh and the excavation and filling of 600 ft= of canal bottom.

Mr. Earl Pugh Jr. and his son Earl (Dawson) Pugh III are applying for a Major CAMA permit to
install a water control structure in Middle Creek Canal at 1265 Middle Creek Rd Engelhard, NC 27824.
The site is strategically located based upon existing Hydrology and infrastructure. Dawson Pugh has
worked with the North Carolina Agricultural Cost Share Program to design and help fund the installation
to Natural Resource Conservation Service Standards.
At the Proposed site the structure would provide protection from salt water intrusion and
drainage water management to approximately 240 acres of mostly crop land, with some pine plantation
included. This location is strategic because it would allow the Pugh's to utilize an existing dike to the
south and existing culverts and a Road bed to the north to act as barriers to saltwater intrusion.
There is a proposed fill of coastal wetlands of +/- 360 sqft in this proposal and upstream of the
structure is a manmade canal with no wetlands within the watershed. Moving the structure upstream
would require the Pugh's to construct an additional 1600ft of dike,1600ft of canals, require a new
culvert be installed under and bisecting Middle Creek Rd, and result in 16 acres of land being removed
from the watershed

Dear Middle Creek Farms:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1107 at 1265 Middle Creek Rd. at
head of Middle Creek near Engelhard in Hyde County, North Carolina. It was received on 28 June
2018, and appears to be adequate for processing at this time. The projected deadline for making a
decision is 11 September 2018. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day. Steve Trowell, Field Representative for the
Division of Coastal Management is responsible for processing your permit and he can be reached
at 252-948-3854 or via email at Steve.TrowellAancderingov if you have any questions.
If this agency does not render a permit decision within 70 days from 28 June 2018, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS I I3A-119(b) requires that Notice of an application be posted at the location of the

CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as required by N.C.G.S.
113A-119(b) that an application for a development permit in an Area of Environmental Concern as designated under
the Coastal Area Management Act (CAMA) was received on 28 June 2018. According to the said application
submitted by Mr. Daniel Brinn on behalf of Mr. Earl D. Pugh, applicant proposes to construct a water control structure
consisting of dual custom build aluminum 30" wide 30" long culverts equipped with tide gate sand flash board riser
for the primary purpose of preventing saltwater intrusion into the agricultural drainage ditch system north of Middle
Creed road as well as further up Middle Creek canal.
A copy of the entire application may be examined or copied at the office of Jonathan R. Howell, District
Manager, Washington Regional Office, 943 Washington Square Mall, Washington, NC, during normal business hours.
Public comments received by 28 July 2018 will be considered. Later comments will be accepted and considered up to
the time of permit decision. Project modifications may occur based on further review and comments. Notice of the
permit decision in this matter will be provided upon written request.
