Mayo III 53 Mill Rd., Aurora NC 27806 Authorizing development in Beaufort County at on Bond Creek, at 53 Mill Road. near Aurora as requested in the permittee's application dated 9/4/18, including attached workplan drawings (4) all dated 9/4/18. This permit, issued on December 13, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation >f these terms may be subject to fines, imprisonment or civil action; or may cause the permit to De nurr ana voma. Shoreline Stabilization - Bulkhead 1) The bulkhead shall be constructed in accordance with the alignment depicted on the attached workplan drawings. 2) The alignment of the authorized bulkhead shall be staked by the permittee and verified by a representative of the Division of Coastal Management within a maximum of 30 days prior to the start of construction 3) The bulkhead shall be constructed prior to any backfilling activities. 4) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires ftuther Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Mayo III Permit No.133-18 Page 2 of 3 - ADDITIONAL CONDITIONS 5) The fill material shall be clean and free of any pollutants except in trace quantities. 6) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 7) No backfill material is to be placed within 30 feet of the normal water line, except that which will be used to backfill the area behind the permitted bulkhead. Sedimentation and Erosion Control 8) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Boathouse 9) This permit authorizes only the boathouse over the existing slip and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 10) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 11) The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. 12) The authorized boathouse shall be single story, and shall not be designed to allow for second story use. 13) This permit does not authorize any additional formalized boat slips. General 14) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 15) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 16) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. Mayo III ADDITIONAL CONDITIONS Permit No.133-18 Page 3 of 3 This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198000291 (Action ID SAW-2018-02067) issued 12/13/18. E: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-1470 issued 12/11/18. E: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many land disturbing activities are not authorized within 50 feet of the normal water level unless specifically exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer regulations in place at the time of such development. An application processing fee of $400 was received by DCM for this project. This fee also satisfied the Section 401 application processing fee requirements of the Division of Water Resources. The original (buff -colored form) is retained by you and it must be available on site when the project is inspected for compliance. Please sign both the original and the copy and return the copy to this office in the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal described below. If you object tp the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. Staff has reviewed the proposed project regarding rules found in Subchapter 7H concerning development in Estuarine Water and Public Trust Areas. It is staff s recommendation that the proposed project appears consistent with 15A NCAC 07H .0208 as described below. This office feels the development is consistent with 15A NCAC 07H .0208(b)(6)(B) which states in part that "The total square footage of shaded impact for docks and mooring facilities allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet". The applicant has proposed a total of 1,072 square feet of platform. The total platform allowed on this property with 248 linear feet of shoreline is 1,984 square feet. This office feels the construction of the bulkhead is consistent with 15A NCAC 07H .1105(a)(3) which states in part" When replacing an existing bulkhead, the new alignment shall not be positioned so as not to exceed a maximum distance of two feet waterward of the current bulkhead alignment". Staff recommends the following conditions be included if the project is permitted. No attempt will be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 2. This permit authorizes only the structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, may become a permanent part of this docking facility without permit modification. Stallings DATE: August 21, 2018 Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood Damage Prevention Ordinance (see policy 2.2.3). Overview: The .86-acre site is located at 53 Mill Road, Aurora off Bond Creek in Beaufort County. The site has 248 linear feet of shoreline. Existing site improvements include a single family residence, bulkhead, pier, platform, boathouse and an uncovered boatlift. The site is approximately 4' above NWL. The site is mostly vegetated with lawn grasses, pines and various hardwood trees. The applicant proposes to cover the existing uncovered boatlift with a 16' wide x 25' long roof. The new boathouse will be located no further waterward than the existing pier. Additionally, the applicant proposes to replace 208 linear feet of bulkhead 2' waterward of the existing bulkhead. AECs involved include: Coastal Shoreline and Estuarine Water. The project is located within in Tar -Pamlico River Basin and is subject to the Tar -Pamlico Buffer Rule. Bond Creek is classified as SA HOW NSW, is a Special Secondary Nursery Area, and is closed to shellfishing. The site is in Special Flood Hazard Area AE (EL7) according to the Beaufort County FIRM (Map # 3720658800J Panel 6588). A review of shellfish, SAV, Coastal Wetlands, 404 Wetlands and archaeological/cultural resources in the area was not provided. Anticipated impacts resulting from this project are expected to include: filling ±416 ft2 of creek bottom due to the replacement of the bulkhead. The installation of the dead -men and tie back system will result in the high ground disturbance of±3,400 ft2. The construction of the 16'x25' roof will result in an additional D_E North Caroline. The lot is approximately 0.86 acres (37,500 ft2) in size and has 248 linear feet of shoreline on Bond Creek. Man-made features on the lot include a single family residence, bulkhead, pier, platform, boathouse and an uncovered boatlift. The lot is approximately 4.0' in elevation above the Normal Water Level. The lot is mostly vegetated with lawn grasses, pines and various hardwood trees. Both the downstream and upstream properties are developed with single family dwellings with piers and bulkheads. Bond Creek is classified as SA HQ W NSW by the Environmental Management Commission at the project location. Bond Creek is classified as both coastal fishing waters and a special secondary nursery area at the project location. The property is subject the Tar -Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources. Project description The applicant proposes to cover the existing uncovered boatlift with a 16' wide x 25' long roof. The new boathouse will be located no further waterward than the existing pier. Additionally, the applicant proposes to replace 208 linear feet of bulkhead 2' waterward of the existing bulkhead. Anticipated impacts The construction of the replacement bulkhead will result in the filling±416 ft2 of Creek bottom. The installation of the dead -men and tie back system will result in the high ground disturbance of f3,400 ft2. The construction of the 16'x25' roof will result in an additional ±400 ft2 boathouse coverage. The total combined square fcotage of both the existing and the proposed boathouse is 712 ft.
