Drawer 870 Powells Point, NC 27966 tmurahv(aguible.com Dear Troy: NORTH CAROLINA Environmental Quality LETTER OF REFINEMENT Permit #43-21 This letter is in response to your email dated Friday, April 8, 2022, regarding a refinement for Oregon Inlet Fishing Center, LLC's, boardwalk project. In your correspondence, it was requested that Major Permit #43-21 be modified to adjust the location of the boardwalk such that no more than 6 feet would be positioned over coastal wetlands, as well as account for an existing light post. Major Permit #43-21 was issued to Oregon Inlet Fishing Center, LLC, and The National Park Service on April 13, 2021. This Permit authorized maintenance excavation and an expansion to the marina that included a new fuel dock, finger piers, and fuel stations, and upland development that included an 8- foot wide boardwalk, pavilion, fish cleaning building, and fishing center building. This project is located at 8770 Oregon Inlet Road near Nags Head, Dare County. I conducted a site visit on Friday, April 8", to confirm your delineation of the wetlands, as well as the stakes set in place verifying that the boardwalk would be landward of those areas flagged. These flags correlated with your drawing dated and submitted on April 8, 2022. Your request on behalf of the Oregon Inlet Fishing Center is hereby authorized as a refinement to CAMA Major Permit #43-21. All existing conditions remain in effect, including the expiration date of December 31, 2024. This letter is provided to you and your client as a record of the authorization, and should be included with the Permit file. Good Morning Yvonne, One Tuesday April Sth, I completed a coastal wetland delineation for the Oregon Inlet Fishing Center in regards to the section of boardwalk permitted near the NPS boat ramp. As part of the permit condition, no more than 6' of boardwalk can be over coastal wetlands. After completing the delineation, I staked the boardwalk per the permit plans. Adjustment needed to be made as to not exceed 6' over wetlands and account for an existing light post. Attached is an exhibit of the delineated wetland line and adjusted boardwalk location. We were hoping to move forward with this as a letter of refinement, to meet the permit condition. Let me know what you think of this and let me know if you have any questions.
