5/2/18 (MP-4) including attached workplan drawings (3) all dated "Received DCM MHD City 3/14/18".
This permit, issued on May 11, 2018 is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation
of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility Reconfiguration
1) This permit authorizes only the docks, piers, and other structures associated with the reconfigured
docking facility and uses located in or over the water that are expressly and specifically set forth in
the permit application. No other structure, whether floating or stationary, shall become a permanent
part of this reconfigured docking facility without permit modification. No non -water dependent uses
of structures shall be conducted on, in or over Public Trust waters without permit modification.
2) All parts of the reconfigured docking facility shall not exceed a maximum of 122 feet waterward
from the waterward edge of the existing bulkhead.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

approvals or authorizations that may be required.
The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit
197800056 (Action ID SAW-2018-00704) issued 4/12/18.
The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 2018-0385.
Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is farther advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
An application processing fee of $250 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150E with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

Hi Ed,
I'm checking in on the Tom Long project- we need just a couple more things- I'm not seeing the green cards for the
project and I also have a question regarding the dimensions. You list the finger pier dimensions on the MP-4 form as
20'x7', 24'x8', and 24'x7'- shouldn't it be 24'x8' and (2) 20'x7' docks, as is shown on the plan? Can you please send me
the green cards and also confirm whether this is the case re: dock dimensions? If so, would you also email us
authorization to make the correction to the MP-4 form?
I'm also copying Gregg Bodnar on this- as I believe he is going to take over management of the project and issuance of
the permit. I'm not sure if you've heard, but I've moved into a new position with the Division and will now be handling
all the beach nourishment and inlet dredging projects. You can reply to Gregg directly, or to me and I'll get it to Gregg.

The total square footage of the platform and floating dock was calculated as follows:
Shoreline length = 100' x 8 ft2 = 800 ft2 allowable.
Proposed fixed platform = (12' x 12') + (10' x 18') = 324 ft2
Proposed new floating docks = (8' x 24') + 2 (7' x 20') = 472 ft2
Total = 796 ft2
It is the staffs recommendation that the proposed new configuration would allow the facility to accommodate five (5)
vessels at this location. It appears that the project is CONSISTENT with most of the use standards set forth in NCAC 07H
.0208(b)(6), including the eight -square foot rule and would not encroach into either 15' adjacent riparian corridor
setback requirement. The proposed facility would not meet the X width rule. However, the proposed facility would not
extend beyond 1/3 the width of the water body, would stay within the current footprint of the existing facility, would
serve the same use, and would comply with the rules to the maximum extent possible, which is CONSISTENT with 15A
NCAC 07.1.0211 Non -conforming Development. The proposed structure would be located entirely over open water and
incorporate 6 more square feet than the existing facility, but would occur within the existing footprint. This office has no
objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. It is
recommended that any permit issued should include standard conditions for docking facilities.

This project is consistent and not in confect with the 2016 New Hanover County
Comprehensive Land Use Plan Update.
The applicant is proposing to reconfigure an existing private docking facility within
Middle Sound. The project is located at 67 Beach Road on Figure Eight Island in New
Hanover County.
Areas of Environmental Concern (AEC's) impacted by the proposal are PT and EW.
Waters at the project site are classified as SA-ORW and are open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2016 New Hanover County
Comprehensive Land Use Plan and offer the following comments.
The general area of the project is classified as Conservation.
In general, New Hanover County allows development in Conservation classified AECs,
which is consistent with the State's minimum use standards. The 2016 New Hanover
County Comprehensive Land Use Plan contains some policies, which exceed the State's
minimum use standards. However, none of these standards appear to be applicable to this
proposal.

9. PROJECT DESCRIPTION uuT'(
The project site is located at 67 Beach Road South on Figure Eight Island, adjacent to Banks ChgGMJAhAPsd(;'und, in
New Hanover County. The island is accessed from the mainland at the end of Edgewater Club Road (SR 1402), by private
bridge over the Atlantic Intracoastal Waterway (AIWW) and an earthen causeway, which traverses Middle Sound. Heading
east on the causeway, turn right on Beach Road South and travel approximately 0.74 miles until you reach the property
of interest located on the right side of the road.
The property is adjacent to residential properties on the south and north sides. The property is bordered on the east side
by Beach Road South and Banks Channel to the west. The project site is approximately 0.39 acres in size and has an average
elevation of approximately 5.0' above Normal High Water (NHW). There is currently a single-family home under
construction on the lot. The only upland vegetation consists of a few Wax Myrtles (Morelia cerifera) along the southern
edge of the existing timber bulkhead. The project site has approximately 100' of shoreline frontage along Banks Channel,
which is currently stabilized by a timber bulkhead. Waterward of the existing bulkhead there is sandy bottom and NHW
meets the bulkhead. No SAV or shellfish were observed in the project area. There is an existing private docking facility
extending in a westerly direction into Banks Channel. There is a fixed pier measuring approximately 112' in length by 6' in
width terminating in a fixed "T-head" platform measuring approximately 40' in length by 8' in width. Approximately 14'
landward of the "T-head" platform are two (2) floating platforms each measuring approximately 8' in width by 24' in length
one extending perpendicularly to the north of the fixed pier and one extending perpendicularly to the south of the fixed
pier. There is one existing boat lift measuring approximately 13' by 14' in the southwestern slip authorized via CAMA
General Permit No. 62582D issued to Tom Long on 8/12/13. No other permit history was located for this property.
According to the application current water depths range from -3.0' to -7.0' at NLW. From review of aerial photographs, it
appears the facility has been in place since at least 1993.
The Wilmington -New Hanover County 2006 Land Use Plan classifies adjacent waters and high ground portion of the
property as Conservation. The waters of Banks Channel and Middle Sound are classified SA-ORW by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they
are OPEN to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to reconfigure an existing private docking facility. The applicant proposes to maintain the current
6' by 112' fixed pier in the same footprint, and would construct a new approximately 30' by 30'-12' "T-head" platform. A
new 8' by 24' float extending off the southern edge of the fixed pier would be constructed in the same footprint as the
existing 8' by 24' southern float. The boat lift would remain in the same footprint. A new "L-shaped" float would be
constructed from the northern edge of the fixed pier, in the same footprint as the current northern 8' by 24' float, and
would consist of a 7' by 20' float extending perpendicularly to the fixed pier and another 7' by 20' float would extend from
the western terminus of the first 7' by 20' float, extending towards Banks Channel. The docking configuration would
provide docking space for up to five (5) vessels at this location within water depths ranging from approximately -3.0' to
-7.0' at NLW. The docking facility would extend approximately 122' into a waterbody which measures approximately 470'
across, which exceeds the ''/. width limitation by 5', but would meet the established pierhead line and would not be any
further waterward than the existing facility.
10. ANTICIPATED IMPACTS
The structures would incorporate approximately 1,462 ft2 of Estuarine Waters and Public Trust Area. The proposed
structures would extend approximately 122' into a waterbody which measures approximately 470' across, which would
exceed the width limitation by 5', but would not extend any further waterward than the existing facility and would meet
the established pierhead line. The proposed structures would allow the existing docking facility to accommodate up to
five (5) vessels in water depths ranging from approximately -3.0' to -7.0' at NLW. Based on the application, the proposed
structures would not encroach into either adjacent 15' riparian corridor setback area. Minor increases in turbidity should
be expected during construction.

The enclosed CAMA Major Permit application for Mr. Tom Long, 678each
Road South, Wilmington, N. C. 28411 is to modify the existing pier/dock
facility.
The modification includes reconfiguring the existing "T head, making it
smaller, replacing the existing floating dock on the south side of the pier
and replacing the existing floating dock on the north side of the pier with a
new X "shaped dock.
The dock will not extend any further waterward than existing and meets the
side fine setbacks
The new dock layout is to provide access and dockage for the applicants'
family use.

The Division of Coastal Management hereby acknowledges receipt of your application, as acting agent for Tom Long,
for State approval for development of the subject property located at 67 Beach Road South, adjacent to Banks
Channel, on Figure 8 Island, New Hanover County. It was received as complete on March 2, 2018 and appears to be
adequate for processing at this time. The projected deadline for making a decision is May 16, 2018. An additional 75-
day review period is provided by law when such time is necessary to complete the review. If you have not been
notified of a final action by the initial deadline stated above, you should consider the review period extended. Under
those circumstances, this letter will serve as your notice of an extended review. However, an additional letter will be
provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from March 2, 2018, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a
meeting will be held within five working days from the receipt of your written request and shall include the property
owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.

DEVELOPMENT PERMIT
The Department of Environmental Quality hereby gives public notice as required by
NCGS 113A-119(b) that the following applications were submitted for development permits to
reconfigure existing docking facilities adjacent to Banks Channel, on Figure 8 Island, in
New Hanover County Areas of Environmental Concern as designated under the CAMA: On
March 2, 2018, Tom Long, at 67 Beach Road South and on March 8, 2018, Dan Kugler at
6 Sounds Point, on March 6, 2018, Craig Myatt proposed to construct a new docking
facility at 902 Bayshore Dr., adjacent to Pages Creek, in Wilmington, New Hanover County.
Copies of these applications can be examined or copied at the office of Courtney Spears, N.C.
Dept. of Environmental Quality, Division of Coastal Management, 127 Cardinal Drive Ext.,
Wilmington, NC 28405, (910-796-7423) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400
Commerce Avenue, Morehead City, NC 28557-3421, prior to April 5, 2018 will be considered in
making the permit decision. Later comments will be accepted and considered up to the time of
permit decision. Project modification may occur based on review and comment by the public
and state and federal agencies. Notice of the permit decision in these matters will be provided
