This permit, issued on September 6.2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may

1) Unless specifically altered herein, this Minor Modification authorizes the reconfiguration of the
docking facility and construction of kayak racks, all as expressly and specifically set forth in the
attached letter and workplan drawings. Any additional land disturbing activities and/or construction
may require a modification of this permit. Contact a Division of Coastal Management representative
at (910) 796-7215 for this determination.
2) No Coastal Wetlands or open water areas shall be excavated or filled, even temporarily, without
permit modification.
3) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
(See Attached Sheet for Additional Conditions.)
This permit action may be appealed by the perminee or
other qualified persons within twenty (20) days of the issuing
date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees
that your project is consistent with the North Carolina Coastal
Management Program.

3) This Minor Modification shall be attached to the original of Permit 31-18, which was issued on 4/6/18,
and copies of both documents shall be readily available on site when Division personnel inspect the
project for compliance.
4) All conditions and stipulations of the active permit remain in force under this Minor Modification unless
specifically altered herein.
NOTE: This permittee is advised that the kayak racks may require a Special Use Permit from New
Hanover County. Please contact Ben Andrea at 910-798-7571 for additional information.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: The N.C. Division of Water Resources has authorized the proposed project under DWR Project
No. 2000-0569.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project under COE Action Id. No.
SAW-2018-01659.
NOTE: A minor modification application processing fee of $100 was received by DCM for this project.

In reviewing the minor modification request for 31-18; we have no objection to the proposal but it shouid`be noted that
the kayak racks must not be two or more layers of vertical storage of kayaks or a special use permit is required since that
would constitute "dry stack storage' pursuant to a court order from a few years back.

I'm not sure if they intend to stack kayaks. If they do want to create stackable storage, are they able to apply for a
special use permit? Is there any information I can direct them to for that process or should I just give them your contact
information?
I feel like with the number of lots in the S/D they will likely want to create vertical storage, but I will check with the agent
to see.

I just spoke with Navigation regarding the revisions to the Loder Landing dock. As long as they stay behind the setback,
Navigation has no objections. I'm going to add the request to the existing file, but will not be writing a mod letter on this
one. I would like to request as -built drawings once complete, so that we can ensure compliance with the setback policy.
The Corps Action ID for this project is SAW-2017-01659.
I'll have to get back with you on the Porter's neck HOA, that one involves a little more research on my end.

Just wanted to check in on two mods. Unfortunately we've had about 7 mods submitted in the past couple weeks so I
apologize for all the emails. I've had calls from Loder Landing HOA and Porters Neck HOA looking for a decision. Once I
get your comments I should be able to issue, but please take the time you need - I just told them I would ask.
Loder Landing is looking to modify the width and spacing of their finger piers, add kayak racks, and push their boat lifts
to slightly deeper water. It would all stay in the same current footprint.
PNHOA is the one I emailed about last week - mostly upland, adding a section of concrete boat ramp (9'x15', �uP�lo�ad
pour and slide into place) current authorized dredge depth is -Tat NLW and they're requesting to mai i ,dge
in the authorized footprint.

Mr. Stephen Conway, Owner of Southeastern Coastal Construction Company, is
requesting on behalf of Loder Landing HOA, to modify State Permit No. 31-18. State Permit No.
31-18 was issued to Loder Landing HOA c/o John Ford, on April 6, 2018 to reconfigure the existing
docking facility at that location. State Permit 31-18 was issued to reconfigure docks, piers, and
structures at the existing facility. State Permit No. 31-18 is now due to expire on December 31,
2021.
Mr. Conway is requesting to allow for the reconfiguration of the slips #1 -12. These slips
were originally designed with varying finger dock widths and independent pilings for each slip to
support a boat lift. Mr Conway is proposing to change the design to allow all finger docks to be
constructed 4ft wide, eliminating the 3 ft wide finger docks for safety reasons. The proposed
changes also include utilizing shared pilings in slips #4-9, instead of independent pilings per slip.
This reconfiguration of slips #1-12 would reduce the square footage of the total design from 2,072
to 2,002 sq ft and not increase the number of slips.
With the new piling configuration, the lifts at slips #1-12 will be 2.5' waterward of the
original proposed locations, and therefore in deeper water. Mr. Conway recorded water depth
measurements at 12:00 noon on July 9th 2018, which is consistent with low tide, and reported 39"
of water for the location of the stern pilings, and 30" of water for the location of the bow pilings.
The new location of the boatlifts in deeper water would negate the need for stops on the boat lifts,
due to there being enough depth to meet DCM regulations. With this modification, the applicant
is requesting that the condition requiring stops for slips #1-12 be removed from the permit.

Mr. Conway is also proposing to install 10 kayak racks over the 7ft wide section of deck,
stored on top of the platform space. Mr. Conway is also requesting to move the 4 southern single
pile lifts as far to the south as possible, between 2-3 feet, while remaining north of the southern
15' setback from the riparian corridor. This change is to provide adequate space between the
walkway and boatlifUslip #18.
The agent has submitted a check (ck# 10877) in the amount of $100.00 for the
modification request. This office has no objection to the permit modification request.
By copy of this memo, DCM is requesting that any comments provided by your agency
(USACOE, NHC, DWR, and DCM Fisheries) be directed to Courtney Spears of DCM's
Wilmington Regional office within 10 days of receipt of this memo.

REQUEST FOR MINOR MODIFICATION
PERMIT #31-18 issued to Loder Landing HOA- c/o John Ford, 237 Loder Ave
Wilmington, NC 28409 issued on April 6, 2018.
On behalf of Loder Landing HOA I would like to make several changes to the original permit:
1. Since the HOA now wants to replace all of the other boat lift pilings, we would like to
use shared pilings on the rest of the lifts in order to create space to allow all of the finger
docks to become 4 ft. wide fingers for safety reasons. This would still not create more
footage than the original floating design because we would be reducing the (2) 5 ft. wide
proposed finger docks to 4 ft. wide also. This would give the entire structure a total
square footage of 2,002 sq. ft. for the new design compared to the original 2,072 sq. ft.
with the floating dock design.
2. They would like to request kayak racks on the 7 ft. wide section in front of the boat lifts
in between the finger piers. The storage would be over the existing 7 ft. wide walkway.
3. Due to the new placement of the boadifts in deeper water there is no reason for stops for
the lifts closest to the water waterway. The stern pilings would be in 39 in. of water at
low tide and the bow pilings would be in 30 in. of water at low tide. These measurements
were taken Monday, July 9d' at 12:00 noon. These measurements are consistent with
current regulations which would boat lifts without stops. It is not possible to install stops
under water.
4. We would also like to request to be able to move the 4 southern single pile lifts as far to
the South as possible to make room for the 6 R wide walkway where the ramp to the
floating dock used to be. The lift to the right of the ramp as you face the waterway was
extremely close to the ramp when the boat was on lift. We hope we can shift all 4 of the
lifts to the South at least 2-3 ft
