This permit, issued on April 6, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may )e subject to tmes, imprisonment or civil action; or may cause the permit to be null and void. Boat Ramp & Kayak Launch 1) This permit authorizes only the expanded boat ramp & kayak launch facility and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded boat ramp & kayak launch facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Page 2 of 3 ADDITIONAL CONDITIONS 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded boat ramp & kayak launch facility. Any sewage discharge at the expanded boat ramp and kayak launch facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) The kayak launch shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owner's riparian access corridor to the north. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The boat ramp shall either be poured at an upland location and pushed into place once hardened, or poured entirely within a watertight containment structure. Live concrete shall not be allowed to contact waters of the State or waters that will enter waters of the State. General 8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) No excavation or filling of any vegetated wetlands is authorized by this permit. NOTE: If water taps are provided and the source is a well, it may be public water system. Please contact the Division of Water Resources, Public Water Supply Section, at (910) .796-7441 before installing any water taps at this facility. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permits 197800125 (Action ID No. SAW-2018-00245), which was issued on 3/5/18. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018- 0194. NOTE: An application processing f6e of $400 was received by DCM for this project. (2) = 320 sq. ft. Proposed floating kayak launch = 6.5 ft. x 8 ft. = 52 sq. ft. Total = 372 sq. ft. The installation of the proposed concrete boat ramp extension and floating kayak launch appear to be CONSISTENT with use standards outlined in 15A NCAC 07H .0208(b)(6). As proposed, the floating kayak launch and boat ramp extension also appear to be consistent with the other use standards set forth in 07H.0207(d), including the 8-square foot rule, the'/a width rule, the 15' riparian corridor setback. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued and include standard conditions for a community boat ramp and docking facility. The applicant proposes to extend an existing concrete boat ramp and install a new floating kayak launch. The project is located off of Genoe's Point Road, adjacent to the Lockwood Folly River in Brunswick County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PTA. Waters at the project site are classified as SA, HQW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Brunswick County Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. In general, Brunswick County allows development in Conservation classified AECs which is consistent with the State's minimum use standards. The Brunswick County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project is consistent and not in conflict with the 2007 Brunswick County Land Use Plan. The shoreline is stabilized by riprap that is bordered by Coastal Wetlands extending approximately 40' into the adjacent LFR. The high ground of the tract is located approximately 6' above Normal High Water and consists of gravel drive that leads to the existing boat ramp. The existing boat ramp measures approximately 15' in width and a total of approximately 70' in length, of which approximately 44' extends beyond Mean High Water (MHW) into the LFR. Existing vinyl sheet pile breakwaters border each side of the existing concrete ramp. The existing boat ramp is also bordered by two (2) pier accesses, 1 (one) on either side of the existing ramp. Each access consists of a pier measuring approximately 4' in width by 24' in length and ramp measuring approximately 3' in width by 16' in length. The ramp located on the northwest side of the facility leads to a floating pier access measuring approximately 5' in width by 52' in length. The ramp located to the southeast side of the facility leads to a floating pier access measuring approximately 5' in width by 42' in length. Each of the floating pier accesses connect to floating platforms, each measuring approximately 8' in width by 20' in length, creating an L- shape floating configuration on either side of the existing boat ramp (See Sheet 2 of 3). NCDOT aerial imagery shows the existing boat ramp facility was constructed prior to 1995. Reconstruction of the existing docking structures was authorized under Emergency General Permit #67958-D after damage by Hurricane Matthew. The waters of Lockwood Folly River, adjacent to the project site, are classified as SA;HQW by the North Carolina Division of Water Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are CLOSED to the harvest of shellfish. According to the application, the proposed 15' in width by 14' in length concrete boat ramp extension has already been cured on uplands and will be maneuvered into place at the waterward end of the existing boat ramp. The proposed boat ramp extension would not exceed the waterward distance of the bordering docking structures. The submitted cross -sectional site plan (See Sheet 3 of 3) indicates that the proposed concrete boat ramp extension would be "pushed into place on grade" with no associated excavation proposed. A 6.5' in width by 8' in length floating kayak launch is proposed to be installed on the landward side of the existing floating dock located on the northwest side of the existing boat ramp. Approximate water depths in the vicinity of the proposed kayak launch measure approximately - 2' to -3' @ Normal Low Water (NLW). The proposed floating kayak launch and concrete boat ramp extension would both meet the U.S. Army Corps of Engineers Setback for the adjacent Federal Navigation Channel and would not exceed the'/4 width distance of the waterbody. There are no proposed encroachments into either 15' Adjacent Riparian Corridor Setback, however there are existing encroachments of the floating platforms and a portion of the existing access pier and ramp on the northeast side of the facility (See Sheet 2 of 3). 10. ANTICIPATED IMPACTS The proposed floating kayak launch would incorporate approximately 52 sq. ft. of Estuarine Waters and Public Trust Area. The proposed concrete boat ramp extension would fill approximately 210 sq. ft. of shallow bottom habitat. Minor increases in turbidity should be expected as a result of the construction process.
