Anv violation of these terms may be subject to tines, imprisonment or civil action; or may cause the Docking Facility to be null and void. 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) i nis pemut action may be appealed by the permittee or other qualified persons within twenty, (20) days of the Issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires.further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee JP Double H Properties, LLC ADDITIONAL CONDITIONS Permit No. 66-18 Page 2 of 3 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 2 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors, 7) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 8) The bridge, as depicted on attached workplan drawings 2-3 of 3, shall be elevated a minimum of six (6) feet above normal high water level as measured to the bottom of the decking. 9) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 10) An as -built survey shall be performed on the docking facilities, including elevations of the bridge, and' copies of the survey provided to the Division of Coastal Management, within 60 days of completion of construction of these portions of the project. General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation.' 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 14) No excavation or. filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the % width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should include standard permit conditions for private docking facilities. REGAN Secmary BRAXTON DAVIS Director A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The applicant is proposing to construct a new docking facility adjacent to Montgomery Slough, in Oak Island. The proposed project will consist of a 485' pier terminating in a fixed platform and a floating dock connected by a ramp. The project area is within waters classified as SA high (HQW) by the NC Division of Water Resources, and approved for the harvest of shellfish by the NCDMF Shellfish Sanitation Section. This project is located close to the inlet complex of Lockwood Folly Inlet which has a dynamic flow and unpredictable rates of shoaling and erosion along the shoreline. Properties on both sides of the proposed project have demonstrated loss of use for periods of time and permanently in the case of the property to the east where marsh has grown around the boatlift and platform. Vertical structures placed in the water cause currents to slow and result in the deposition of sediments. These floating platforms have the potential to shoal after construction leading to decreased depths in slip areas. Formalized slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in; aquatic vegetation or shellfish bed loss, anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. In addition, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to soft bottom habitat. The applicant has not reached the terminus of the Y4 width of the waterbody, this office would suggest seeking deeper waters away from the marsh edge to avoid any future impacts to habitat and a prevent a loss of use. A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed the CAMA Major Permit application for proposed actions that impact fish and fish habitats. The applicant is proposing to construct a new docking facility adjacent to Montgomery Slough, in Oak Island. The proposed project will consist of a 485' pier terminating in a fixed platform and a floating dock connected by a ramp. The project area is within waters classified as SA high (HQW) by the NC Division of Water Resources, and approved for the harvest of shellfish by the NCDMF Shellfish Sanitation Section. This project is located close to the inlet complex of Lockwood Folly Inlet which has a dynamic flow and unpredictable rates of shoaling and erosion along the shoreline. Properties on both sides of the proposed project have demonstrated loss of use for periods of time and permanently in the case of the property to the east where marsh has grown around the boatlift and platform. Vertical structures placed in the water cause currents to slow and result in the deposition of sediments. These floating platforms have the potential to shoal after construction leading to decreased depths in slip areas. Formalized slips in shallow water can allow vessels to repeatedly contact the bottom, resulting in; aquatic vegetation or shellfish bed loss, anoxia in the sediment which can kill benthic invertebrates and reduction of shallow bottom habitat during low tide. In addition, vessels moving to and from these shallow water docks can cause propeller disturbance impacts to soft bottom habitat. The applicant has not reached the terminus of the '/4 width of the waterbody, this office would suggest seeking deeper waters away from the marsh edge to avoid any future impacts to habitat and a prevent a loss of use. To find the project site from the Wilmington District Office, turn left off Cardinal Drive on to Market Street. Travel 0.4 miles and turn right on to Martin Luther King Jr. Pkwy (US-74). Travel 5.3 miles and merge right on to NC-133. Travel 0.7 miles, crossing over the Isabel Holmes Bridge, until you reach US-17. Turn left on US-17 and travel 1.1 miles, keep right and merge on to NC-133 S/US-17 S. Travel 2.6 miles and take the US-17 exit toward Shallotte /Myrtle Beach. Continue 0.8 miles onto US-17 S/ Ocean Hwy E. Travel 13.1 miles and then turn left onto US-17 BUS. Travel 1.7 miles and turn left onto NC-906. The property is approximately 0.5 acres (21954 sq.ft.) and is currently an improved north facing lot with an existing two-story single family dwelling, pool, and driveway. To the East of the subject property is a vacant lot and to the west is a developed lot with a single-family residence and docking facility. To the south of the subject property is Kings Lynn Drive, and to the north is a large marsh expanse leading to Montgomery Slough. The property has an average elevation of approximately 12 feet above normal high water (NHW). Upland vegetation on this lot primarily consists of various vine and grass species as well as cedar and wax myrtle. Coastal wetlands extend waterward from the upland area approximately 21 feet to the normal high water line, and then 391 feet toward Montgomery Slough. A small marsh islet is located waterward from the edge of the marsh and is separated by small channel measuring 40 feet across. The channel is navigable at normal high tide. The total width of Montgomery Slough at this location is 460 feet, measured from the edge of the marsh islet to the opposing marsh islet. Coastal Wetland species on site include Saltwort (Salicomia sp.), Sea Oxeye (Borrichia frutescens), Saltmeadow Cordgrass (Spartina patens), and Smooth Cordgrass (Spartina altemiflora). Periwinkle snails (Littoraria irroata) and fiddler crabs (Uca pugilator) were also found on site within the fidal marsh. The property has approximately 50 linear feet of natural shoreline. The Town of Oak Island 2017 Land Use Plan classifies the high ground portion of the property as Single Family Residential. The waters of Montgomery Slough are classified SA; HQW by the Division of Water Resources, and they are OPEN to shellfishing. This section of Montgomery Slough IS NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. PROPOSED PROJECT �'' �f77 r The appfclant proposes to install anew private docking facility adjacent to Montgomery Slough. The project consists of constructing a 4' wide by Ong fixed access way leading from the existing pool to the landward edge of the coastal wetlands. A 4' wide byA+1'l long fixed elevated pier would connect to the access way and continue north towards Montgomery Slough over coastal wetlands to the edge of the marsh. A 4' wide by 40' long bridge would be constructed 6' above normal high water over the channel dividing the marsh and marsh islet. A 4' wide by 35' long fixed elevated pier would continue across the marsh islet and terminate at a 16' wide by 12' long "T- head" fixed platform. An 8' wide by 16' long floating platform is proposed on the west side of the "T-head" and will be accessed by a 3' wide by 16' long aluminum ramp. The.new floating platform will provide for two (2) boat slips within existing water depths of approximately -3.0 ft. to -6.0 ft. at NLW (See Sheet 2 of 3). As proposed, the docking facility extends approximately 31' into the waterbody. The bend in the natural shoreline prevents the dock from aligning with adjacent docks, however the proposed dock does not exceed '/. width nor encroach on the deep -water channel. Adjacent property notifications were sent and received to both riparian property owners. The property owner to the east has signed no objection to the project and wants to retain their 15' riparian corridor setback. The neighbor to the west received the notice via certified mail on April 13, 2018 but has not returned a signed notice or green card. 10. ANTICIPATED IMPACTS The proposed docking facility would shade approximately 1,713 sq. ft. of Coastal Wetlands, and incorporate approximately 580 sq. ft. of Estuarine Waters and Pubic Trust Area. The proposed structures would extend approximately 37' in to the channel measuring 460' across, conforming to the 1/4 width rule or 115 feet. The proposed docking facility would provide two (2) docking spaces within existing water depths between -3.0 ft. and -6.0 ft. at NLW. The proposed pier includes a 40' long bridge section to traverse over the 40' wide channel between the main marsh and the marsh islet. The bridge would be constructed 6' above NHW to allow for navigation through the channel. The proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area. If this is the proposed location of the pier and dock, it will block an existing navigable waterway and will extend beyond the established pier length along the shoreline. Another concern is that the pier and dock will be built closer to the property line and riparian corridor of 6906 West Beach, LLC to avoid crossing the navigable water and extending over the coastal wetlands or parcel of land. If this is the proposed location of the pier and dock, the pier and dock will violate the fifteen foot (15') minimum setback between the proposed pier and dock and 6906 West Beach, LLC's area of riparian access, particularly if the floating dock is located to the left of the fixed dock configuration. Such a location will interfere with and impede access to the pier and docking facility of 6906 West Beach, LLC, which is immediately adjacent and to the left of the Applicant's proposed project location. I can't really tell, but looking at aerial imagery I can't imagine they have up to 6' of water at NLW... • Pier dimensions are not included on the MP-4 and this is a pretty complicated fixed pier with a bridge in the middle • Bio report says dock will extend 31' into water body in one place and 37' into water body in another place There are many different "received by" dates on these pages so it looks like this.project was pieced together, and Heather mentioned that the agent was difficult to work with in the past. However, that does not really explain the inconsistencies in our bio-report. Also, the discrepancy in water depths is concerning and I can't tell if the depths were ever actually field verified. I know it's not PNA or anything, but given the fact that the marsh is prograding, recent aerials show a significant sandbar, and Curt's comments are to extend as far waterward as possible, it would be good to know that we have accurate depths. Additionally, we just reviewed a project to the east of this one a few lots where the marsh encapsulated a facility within a matter of a couple of years. Also, the location of the channel would be good to know so if it is recommended to push it as far waterward as possible, we know that the facility won't be in the channel. I have a meeting with Gary Ahlberg from 10a-11a, and other in -office meetings from 1pm-3pm, but other than that I should be free.
