Any violation of these terms may De suoiect to Imes, imprisumiietiL ur civu au.wu, UL uiay a auac ua y...u... w ..- Shoreline Stabilization — Bulkhead 1) The bulkhead shall not extend waterward more than 2 feet from the existing bulkhead alignment at any point along its alignment at the time of construction. 2) The bulkhead shall be constructed prior to any backfilling activities. 3) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. Permit No.123-18 1* Page 2 of 3 ADDITIONAL CONDITIONS 4) The fill material shall be clean and free of any pollutants except in trace quantities. 5) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 6) All fill material to be placed below normal high water level shall be confined behind the permitted bulkhead. Upland Development 7) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the boardwalk and the removal of sections of the keystone wall, all as expressly and specifically set forth in the attached permit application and workplan drawings. Sedimentation and Erosion Control 8) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of any phase of grading on cut or filled slopes. At a minimum, a silt fence shall be properly installed immediately landward of the bulkhead cap immediately following completion of backfilling activities. Stormwater Management 9) The Division Energy, Mineral and Land Resources (DEMLR) approval of this project under stormwater management rules of the Environmental Management Commission is covered by way of Stormwater Permit No. SW 181001, which was modified on 2/25/19. Any violation of the permit approved by the DEMLR shall be considered a violation of this CAMA permit. USACE Condition 10) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. General 11) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 12) This Minor Modification shall be attached to the original Permit No. 123-18, which was issued on 11/16/18, and copies of both documents must be readily available on site when Division personnel inspect the project for compliance. 13) All conditions and stipulations of the active permit remain in force unless specifically altered herein. Staff review of the plans and specifications has determined that the project, as proposed, will comply with the Stormwater Regulations set forth in Title 15A NCAC 2H.1000 effective January 1, 2017. We are forwarding Permit No. SW8 181001 dated October 23, 2018, for the construction, operation and maintenance of the stormwater control measures (SCMs), built -upon areas, as well as the Stormwater collection system and/or vegetated conveyance system associated with the subject project. This permit shall be effective from the date of issuance until October 23, 2026 and shall be subject to the conditions and limitations as specified therein, and does not supersede any other agency permit that may be required. The designated permit holder, Hyde Investors, LLC, shall be responsible for meeting the conditions and limitations specified therein. As required for compliance, a copy of the final deed listing Hyde Investors, LLC as the property owner must be submitted within 30 days of the property being purchased. Please pay special attention to the permit conditions regarding the operation and maintenance of the SCMs, stormwater collection system, and/or vegetated conveyances; the limitation of built -upon area; modification of the project; the procedures for changing ownership of and/or transferring the permit; and the need to renew the permit. Please also pay attention to the permit conditions that requires the recordation of deed restrictions and protective covenants, easements, and the maintenance agreement, which must all be provided along with certification upon completion of the project. Failure to comply with these requirements will result in future compliance problems. This permit shall be effective from the date of issuance until October 23, 2026 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS 1. This permit is effective only with respect to the management and volume of stormwater described in the approved plans and specifications. The maximum amount of built -upon area (BUA) allowed for the entire project is 33,301 square feet. To remain under the existing amount of BUA, this project proposes 10,177 square feet of infiltrating permeable pavement designed to meet the requirements of 15A NCAC 02H.1055. 2. The redevelopment portion of this project is exempt from State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the plans submitted to this Office, 2) the proposed redeveloped BUA of 33,301 square feet does not exceed the existing BUA of 33,301 square feet; and 3) The proposed stormwater control (vegetated sheet flow, vegetated swales, and infiltrating permeable) pavement provides equal protection of surface waters as the existing stormwater control (limited vegetated sheet flow). 3. The drainage areas for the on -site stormwater systems will be limited to the amounts of built - upon area indicated in this permit and the approved plans and specifications. The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control measures. The stormwater control measures labeled Lots 1A, 1 B, 2A, 2B, 3A, 3B, 4, 5A, 58, 6A, 6B, 7A, 7B, 8A and 8B are treated by Drainage Areas 1-7 (some SCMs have the same Drainage Area size and BUA). These Drainage Areas have been designed using the runoff treatment method to handle the runoff from 552, 1,104, 552, 552, 552, 552, and 552 square feet of built -upon area, respectively. Where a project or lot is located within CAMA's Area of Environmental Concern (AEC), the Division of Coastal Management (DCM) may calculate a different maximum built -upon area based on CAMA regulations. The more restrictive BUA limit of DCM or DEMLR will apply to the project. 5. A 30-foot wide vegetative setback must be provided and maintained adjacent to all surface waters, measured horizontally from the normal pool elevation of impounded structures, from the top of bank of each side of streams or rivers, and from the mean high waterline of tidal waters, perpendicular to the shoreline in accordance with the stormwater rules and the approved plans and specifications. 6. The stormwater control measures are permitted based on the design criteria presented in the sealed, signed and dated supplements and as shown in the approved plans and specifications. These stormwater control measures must be provided and maintained at the design condition. The approved supplements are incorporated by reference into this permit. 7 The stormwater control measures provides runoff treatment without discharging in excess of the pre -development conditions during the one-year, 24-hour storm event. The excess runoff is released at a non -erosive velocity at the edge of the vegetated setback or to an existing stormwater drainage system. 8. The peak flow from the 10-year storm event shall not cause erosion downslope of the stormwater outlet discharge point. 9. Runoff from adjacent.pervious areas shall be prevented from reaching the permeable pavement. 10 It is recommended that during the installation of the permeable pavement, care is taken to avoid compaction of the underlying subgrade soils. To confirm compaction has not occurred, it is recommended that a direct measurement of the soil's infiltration rate be conducted after excavation and before the aggregate is placed. If the infiltration rate has diminished, it is recommended to scarify, rip, or trench the subgrade to restore the infiltration rate. 11. 1 It is recommended that during the installation of the underground SCM, photos be taken documenting the construction and demonstrating that the constructed SCM meets the approved design. It is further recommended that these photos be submitted with the required Designer's Certification. 12. After installation, the permeable pavement shall be protected from sediment deposition until the site is completed and stabilized. 13. Concentrations of oils, grease, heavy metals, and toxic chemicals shall not be stored or handled where they may enter the permeable pavement. 14. At no time shall the approved permeable pavement be paved over or repaired with any type of conventional paving material. II. SCHEDULE OF COMPLIANCE A copy of the final deed listing Hyde Investors, LLC as the property owner must be submitted within 30 days of the property being purchased. The on -site stormwater system shall be entirely constructed and operational prior to the construction of any development within the drainage area, per the approved plans and specifications. 5. During construction, erosion shall be kept to a minimum and any eroded areas of the on -site stormwater system will be repaired immediately. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 6. All stormwater control measures, stormwater collection systems, vegetated conveyance systems, and/or maintenance accesses must be located in public rights -of -way, dedicated common areas that extend to the nearest public right-of-way, and/or permanent recorded easements that. extend to the nearest public right-of-way for the purpose of inspection, operation, maintenance, and repair. 7. The permittee shall provide and perform the operation and maintenance necessary, as listed in the signed Operation and Maintenance Agreement, to assure that all components of the permitted on -site stormwater system functions at the approved design condition. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. 8. The operation and maintenance agreement must be recorded with the Office of the Register of Deeds. 9. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. 10. The final plats for the project must be recorded with the Office of the Register of Deeds. The recorded plat must reference the Operation and Maintenance Agreement and must also show all public rights -of -way, dedicated common areas, and/or permanent drainage easements, in accordance with the approved plans. 11. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the maximum allowed by this permit. Upon completion of the project, the permittee shall determine whether or not the project is in compliance with the permitted plans and take the necessary following actions: a. If the permittee determines that the project is in compliance with the permitted plans, then within 45 days of completion, the permittee shall submit to the Division one hard copy and one electronic copy of the following: i. The completed and signed Designer's Certification provided in Attachment A noting any deviations from the approved plans and specifications. Deviations may require approval from the Division, ii. A copy of the recorded maintenance agreement; iii. Unless already provided; a copy of the recorded deed restrictions and protective covenants: and iv. A copy of the recorded plat delineating the public rights -of -way; dedicated common areas and/or permanent recorded easements, when applicable. b. If the permittee determines that the project is not in compliance with the permitted plans, the permittee shall submit an application to modify the permit within 30 days of completion of the project or provide a plan of action, with a timeline, to bring the site into compliance. 13. No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below: a. Any modification to the approved plans and specifications, regardless of size including the stormwater control measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading or resizing of any component of the approved stormwater control measure, stormwater collection system and/or vegetative conveyance system shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement for BUA credit that was not included in the approved plans and specifications. g. The construction of any #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. h. Other modifications as determined by the Director." 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. 15. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on -site stormwater system complies with the permit conditions. Any items not in compliance must be repaired, replaced restored, or resolved prior to the transfer. Records of maintenance activities performed to date may be requested. Ill. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. The issuance of this permit does not preclude the permittee from complying with and obtaining any other permits or approvals that are required for this development to take place, as required by any statutes, rules, regulations, or ordinances, which may be imposed by any other Local, State or Federal government agency having jurisdiction. Any activities undertaken at this site that cause a water quality violation or undertaken prior to receipt of the necessary permits or approvals to do so are considered violations of NCGS 143-215.1, and subject to enfilEM ED procedures pursuant to NCGS 143-215.6. OCT 2 6 2018 Page 4 of 5 DCM-MHD CITY State Stormwater Management Permit No. SW8 181001 If the facilities fail to perform satisfactorily, -the permittee shall take immediate correctiveactions. This includes actions required by this Division and the stormwater rules such as the construction of additional or replacement on -site stormwater systems. These additional or replacement measures shall receive a permit from the Division prior to construction. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed State Stormwater Request Form for Permit Transfer or Permit Information Update, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events. a. Any ownership change including. i. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; ii. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or NCGS 57D-6-07: b. Bankruptcy; c. Foreclosure, subject to the requirements of Session Law 2013-121, d. A name change of the current permittee; e. A name change of the project, f. A mailing address change of the permittee; 5. The permittee is responsible for compliance with all terms and conditions of this permit until the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 6 The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission, however, these actions do not stay any permit conditions. 8. Approved plans, application documents, supplements, calculations, operation and maintenance agreement, and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of this permit, application, supplements, operation and maintenance agreement, and approved plans and specifications shall be maintained on file by the permittee. 9. Unless specified elsewhere, permanent seeding requirements for the on -site stormwater system must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. The issuance of this permit does not prohibit the Director from reopening and modifying the permit, revoking and reissuing the permit, or terminating the permit for cause as allowed by the laws, rules, and regulations contained in Title 15A NCAC 2H.1000 and NCGS 143-215.1 et.al. 11. A permit renewal request must be submitted at least 180 days prior to the expiration date of this permit. The renewal request must include the appropriate application, documentation and the processing fee as outlined in Title 15A NCAC 02H.1045(3). Permit issued this the 231 day of October 2018. This permit shall be effective from the date of issuance until October 23, 2026 and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the management and volume of stormwater described in the approved plans and specifications. The maximum amount of built -upon area (BUA) allowed for the entire project is 33,301 square feet. To remain under the existing amount of BUA, this project proposes 8,707 square feet of infiltrating permeable pavement designed to meet the requirements of 15A NCAC 02H.1055. The redevelopment portion of this project is exempt from State Stormwater permitting requirements under the following conditions: 1) The project must be constructed as shown on the plans submitted to this Office; 2) the proposed redeveloped BUA of 33,301 square feet does not exceed the existing BUA of 33,301 square feet; and 3) The proposed stormwater control (vegetated sheet flow, vegetated swales, and infiltrating permeable pavement) provides equal protection of surface waters as the existing stormwater control (limited vegetated sheet Vow). The drainage areas for the on -site stormwater systems will be limited to the amounts of built - upon area indicated in this permit and the approved plans and specifications The runoff from all built -upon area within the permitted drainage areas of this project must be directed into the permitted stormwater control measures. The stormwater control measures labeled Lots 1A, 1 B, 2A, 26, 3A, 3B, 4A, 46, 5A, 513, 6A, 6B, 7A, and 713 are treated by Drainage Areas 1-7 (some SCMs have the same Drainage Area size and BUA). These Drainage Areas have been designed using the runoff treatment method to handle the runoff from 540, 486, 486, 486, 486, 486, and 486 square feet of built -upon area, respectively. The more restrictive BUA limit of DCM or DEMLR will apply to the project. 5. A 30-foot wide vegetative setback must be provided and maintained adjacent to all surface waters, measured horizontally from the normal pool elevation of impounded structures, from the top of bank of each side of streams or rivers, and from the mean high waterline of tidal waters, perpendicular to the shoreline in accordance with the stormwater rules and the approved plans and specifications. & The stormwater control measures are permitted based on the design criteria presented in the sealed, signed and dated supplements and as shown in the approved plans and specifications. These stormwater control measures must be provided and maintained at the design condition. The approved supplements are incorporated by reference into this permit. 7. The stormwater control measures provides runoff treatment without discharging in excess of the pre -development conditions during the one-year, 24-hour storm event. The excess runoff is released at a non -erosive velocity at the edge of the vegetated setback or to an existing stormwater drainage system. The peak flow from the 10-year storm event shall not cause erosion downslope of the stormwater outlet discharge point. Runoff from adjacent pervious areas shall be prevented from reaching the permeable pavement. 10. It is recommended that during the installation of the permeable pavement, care is taken to avoid compaction of the underlying subgrade soils. To confirm compaction has not occurred, it is recommended that a direct measurement of the soil's infiltration rate be conducted after excavation and before the aggregate is placed. If the infiltration rate has diminished, it is recommended to scarify, rip, or trench the subgrade to restore the infiltration rate. 11. It is recommended that during the installation of the underground SCM, photos be taken documenting the construction and demonstrating that the constructed SCM meets the approved design. It is further recommended that these photos be submitted with the required Designer's Certification. 12. After installation, the permeable pavement shall be protected from sediment deposition until the site is completed and stabilized. 13. Concentrations of oils, grease, heavy metals, and toxic chemicals shall not be stored or handled where they may enter the permeable pavement. 14, At no time shall the approved permeable pavement be paved over or repaired with any type of conventional paving material. II. SCHEDULE OF COMPLIANCE A copy of the final deed listing Hyde Investors, LLC as the property owner must be submitted within 30 days of the property being purchased. However, please be reminded that if the purchase agreement or contract between Hyde Investors, LLC and The Pirate Group, LLC and The Reserve at Channel Bay, LLC is dissolved, cancelled or defaults, and the Division is not notified by Hyde Investors, LLC to transfer the permit, then the responsibility for permit compliance reverts to the property owners, The Pirate Group, LLC and The Reserve at Channel Bay, LLC. As the property owners, The Pirate Group, LLC and The Reserve at Channel Bay, LLC must notify the Division immediately of the permit ownership change and submit a completed Name/Ownership form to the Division within 30 days. Otherwise The Pirate Group, LLC and The Reserve at Channel Bay, LLC will be operating a stormwater treatment facility without a valid permit which is a violation of NC General Statue 143-215.1 and may result in appropriate enforcement action in accordance with North Carolina General Statute §143-215.6A through §143-215.6C being taken against the property owners, The Pirate Group, LLC and The Reserve at Channel Bay, LLC. 3. The project and SCM(s) shall be constructed, operated and maintained in accordance with the conditions of this permit and the approved plans and specifications. 4. The on -site stormwater system shall be entirely constructed and operational prior to the construction of any development within the drainage area, per the approved plans and specifications. 5. During construction, erosion shall be kept to a minimum and any eroded areas of the on -site stormwater system will be repaired immediately. If the stormwater system is used as an Erosion Control device, it must be restored to design condition prior to operation as a stormwater treatment device, and prior to occupancy of the facility. 6. All stormwater control measures, stormwater collection systems, vegetated conveyance systems, and/or maintenance accesses must be located in public rights -of -way, dedicated common areas that extend to the nearest public right-of-way, and/or permanent recorded easements that extend to the nearest public right-of-way for the purpose of inspection, operation, maintenance, and repair. 7. The permittee shall provide and perform the operation and maintenance necessary, as listed in the signed Operation and Maintenance Agreement, to assure that all components of the permitted on -site stormwater system functions at the approved design condition. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. & The operation and maintenance agreement must be recorded with the Office of the Register of Deeds. 9. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. 10. The final plats for the project must be recorded with the Office of the Register of Deeds. The recorded plat must reference the Operation and Maintenance Agreement and must also show all public rights -of -way, dedicated common areas, and/or permanent drainage easements, in accordance with the approved plans. 11. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the maximum allowed by this permit. If the permittee determines that the project is in compliance with the permitted plans, then within 45 days of completion, the permittee shall submit to the Division one hard copy and one electronic copy of the following: i. The completed and signed Designer's Certification provided in Attachment A noting any deviations from the approved plans and specifications. Deviations may require approval from the Division; ii. A copy of the recorded maintenance agreement, iii. Unless already provided, a copy of the recorded deed restrictions and protective covenants: and iv. A copy of the recorded plat delineating the public rights -of -way, dedicated common areas and/or permanent recorded easements, when applicable. b. If the permittee determines that the project is not in compliance with the permitted plans, the permittee shall submit an application to modify the permit within 30 days of completion of the project or provide a plan of action, with a timeline, to bring the site into compliance. 13. No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below: a. Any modification to the approved plans and specifications, regardless of size including the stormwater control measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area or to the drainage area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading or resizing of any component of the approved stormwater control measure, stormwater collection system and/or vegetative conveyance system shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement for BUA credit that was not included in the approved plans and specifications. g. The construction of any #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. h. Other modifications as determined by the Director. 14. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. 15. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on -site stormwater system complies with the permit conditions. The permittee is responsible for compliance with all terms and conditions of this permit until the Division approves the transfer request, Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 6. The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. 7. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, renewal, or rescission; however, these actions do not stay any permit conditions. 8. Approved plans, application documents, supplements, calculations, operation and maintenance agreement, and specifications for this project are incorporated by reference and are enforceable parts of the permit. A copy of this permit, application, supplements, operation and maintenance agreement, and approved plans and specifications shall be maintained on file by the permittee. 9. Unless specified elsewhere, permanent seeding requirements for the on -site stormwater system must follow the guidelines established in the North Carolina Erosion and Sediment Control Planning and Design Manual. 10. Included is an updated drawing set reflecting the revisions requested. Upon review of the site plan by the Town of Atlantic Beach, it was brought to our attention that the proposed building separations did not meet the ordinance requirement of fifteen feet. The site plan had to be revised and resulted in losing a building along Bogue Sound. This reduced the number of units to eighteen (nine buildings) and a density of 7.89 units per acre. The four buildings along the canal are now proposed four feet narrower so that the separation can be met to avoid losing another building. The porches on the fronts of all buildings now extend the full width. Pervious pavement driveways are still proposed for buildings 1-7 and treat the front half of each adjacent unit. The Town of Atlantic Beach also requires a sidewalk along the project, now shown, and is included in the impervious allocation. These changes reduced the proposed BUA within the 75' AEC by 1,655 to 12,292 square feet. The overall impervious coverage remains at 33,301 square feet with updated allocations. The developers have also decided they would like to construct a new bulkhead a maximum of two feet waterward from the existing bulkhead. The proposed vinyl sheet pile bulkhead will follow the existing alignment while removing the existing jogs. By constructing the bulkhead one to two feet higher than the existing bulkhead, the keystone wall previously proposed along the waterfront is no longer needed or desired. However, the keystone retaining walls remain adjacent Buildings 1 and 7 as well as one proposed at Building 9. Subsequent to the issuance of this permit, and due to the fact the proposed building separations are not consistent with the Town of Atlantic Beach's 15' ordinance requirement, the applicant is proposing to reduce the number of units from 20 (ten buildings) to eighteen (9 buildings) and a density of 7.89 units per acre. The four buildings along the canal (south east side) are four feet narrower (reduced from 40' to 36') than previously permitted. The porches on the fronts of all buildings are proposed to extend the full width also. The pervious pavement driveways for buildings 1-7 are still proposed and treat the front half of each adjacent unit. Sidewalks are now proposed due to a Town of Atlantic Beach requirement and are included in the impervious allocation. These proposed changes have reduced the proposed BUA within the 75' AEC by 1,655sf from 13,947 sf to 12,292 sf with the overall impervious coverage remaining at 33,301sf. The applicant is also requesting to construct a proposed bulkhead a maximum of 2' beyond NHW (existing bulkhead) and up to one to two feet higher than the existing bulkhead height. By constructing the bulkhead 2' higher, the previously permitted keystone wall along the waterfront is no longer needed except for the area adjacent to buildings 1, 7 and 9. The previously permitted keystone walls within these locations would remain. A 6' wide wood or composite, raised 592 LF boardwalk is also proposed and would run parallel with the proposed bulkhead. The proposal is consistent with the specific guidelines found in 15A NCAC 07H.0208 and 15A NCAC 07H.0209. What I see in all the drawings and plans, is a great effort to remove any excess water from the higher property and allow it to run into a trench adjoining our properties. If at anytime due to heavy rain or tidal surge and this trench holds water( meaning non flowing water) at any depth, a situation will occur by which mosquitoes will breed, foul smells will occur and the grass will grow to a point to which it can not be properly maintained . The ground in this area will not absorb any excess water, as proven by soil test. This trench is only feet from our standing dwelling. It is my understanding from the meeting with Mr. Cullipher that the purpose of this trench is to reroute the excess water from the higher elevation to the sound. If this is correct, the solution to this problem is to reroute the water underground to avoid standing water.
