:R K1 Permit Class MODIFICATION/MAJOR STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Vermt"t for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 X Excavation and/or filling pursuant to NCGS 113-229 Issued to Windfare Condominiums LLC., 8504 Towneley Place, Raleigh, NC 27615 Permit Number 123-18 Authorizing development in Carteret County adi. Bogue Sound. at 403 Old Causeway Rd., in Atlantic Beach , as requested in the permittee's application dated 5/4/20, including attached workplan drawings (1), dated "Revised 8/26/20". This permit, issued on September 11, 2020 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facilities 1) This permit authorizes only the docks, piers, boat lifts and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of these docking facilities without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. (See attached sheets for additional conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2023 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. ADDITIONAL CONDITIONS Permit No. 123-18 Page 2 of 3 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facilities. Any sewage discharge at the docking facilities shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. 3) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 4) This permit authorizes a maximum of 18 formalized boat slips with boat lifts as shown on that attached workplan drawing. 5) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 6) The authorized structure and associated activity shall not cause an unacceptable interference with navigation and shall not exceed the dimensions shown on the attached permit drawings. In no case shall the structures exceed the ''/< width limit. 7) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the eastern adjacent property owner's area of riparian access. 8) To reduce direct impacts to oyster resources, the permittee shall, in consultation with the NC Division of Marine Fisheries, relocate all oysters falling within the footprint of pilings to an area immediately adjacent to the project area. 9) In accordance with commitment made by the permittee, the eastern edge of the channel shall be marked at the -3 foot contour at normal low water level with PVC or similar material less than 4 inches in diameter, until such a time as permanent markers can be established. Any permanent markers shall require additional authorization from the Division of Coastal Management. Easement 10) An Easement from the Department of Administration's State Property Office may be required under N.C.G.S. 146-12(e). The permittee shall contact the State Property Office prior to the initiation of construction of any structures over state-owned submerged lands to determine if such an easement will be required. Any required easements shall be obtained, and a copy provided to the Division of Coastal Management, prior to the construction of any new boat slips or other docking facilities authorized under this permit. USACE Conditions 11) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. ADDITIONAL CONDITIONS General Permit No. 123-18 Page 3 of 3 12) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 13) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 14) This Major Modification shall be attached to the original Permit No. 123-18, which was transferred to the permittee on 11/16/18, as well as all subsequent renewals, and copies of all documents must be readily available on site when Division personnel inspect the project for compliance. 15) All conditions and stipulations of the active permit remain in force, under this Major Modification, unless specifically altered herein. NOTE: The U.S. Army Corps of Engineers assigned the proposed project COE Action Id. No. SAW- 2018-02052. NOTE: The Division of Water Resources assigned the proposed project DWR Project No. 2020-0932. As you are aware from historical communication from Ron Cullipher to your Staff this documentation has been provided in both electronic and physical maps and indicated the most narrow width after our facilities are installed to be 64' at 3' of water at the Normal Low Water, occurring twice in a 24 hour period. 1 After we received those maps Sammy Ballou reached out to the Board of Directors at Crows Nest to arrange for a meeting to discuss our findings. We had that meeting at 4:00 pm on Friday August 29th at the Crows Nest Yacht Club. The outcome of that meeting was very positive. All parties were considerate to each other and the various concerns of each group. We did share that had Windfare known of any potential concerns whether from Crows Nest or any neighbors prior to submitting our Application we would have done this outreach earlier in the process. We are glad we have been able to both meet with these men and constructively work on a solution that benefits the entire Community. SUMMARY 1. The Crows Nest Board shared their willingness to support our Project and the Permit as submitted, and also offered to send a letter to DCM indicating the same. 2. Windfare Townhomes, LLC agreed to install 3 temporary pvc pipes with green tape on the top to mark the eastern edge of the channel across from our 6 proposed piers to better assist boaters in the appropriate navigation of the same. Also, Windfare Townhomes has asked DCM to help guide us in how best to permit three permanent channel markers in the same location to accomplish the same purpose. Roy Brownlow had some guidance on this process and as such Windfare will begin a new permitting process in the next 30 days or sooner to select, permit, purchase, and install these new channel markers at the sole expense of Windfare. Windfare intends to copy Crows Nest on these submittals and their progress. 3. Windfare Townhome LLC and Crows Nest agreed to equally share in the costs and efforts to formally request a dredging permit from DCM in order that either party or any party finds it is necessary to dredge the same channel. The intent is that a valid permit would z remain in place for perpetuity available to any party to orchestrate dredging within the conditions of that future permit. Both parties will work in good faith to submit that new permit request to DCM within the next 30 calendar days. It is the understanding of both parties that once obtained DCM has a 5 renewal process that allows for the permit to be renewed and hence would not expire if that process was followed accordingly. Roy Brownlow (and I am sure Greg Bodnar as well) had verbally offered their guidance to assist both parties on the various permits and processes to achieve this goal. We did discuss the various options available to both parties and the Community on how best to fund the expenses of a future dredging if that is desired. Although we did not arrive at a conclusion, we are hopeful the Town will consider adding this channel to their dredging efforts they undertake currently given the importance of this waterway and the tax base derived from the Community. We are thankful to be a new member of the Old Causeway/Moonlight Community and intend to add value anywhere we can. LLC to construct 9 docking facilities associated with the Windfare Condominium development project, located at 402 Old Causeway Road, in Atlantic Beach, Carteret County, North Carolina. Specifically, the applicant proposes to construct 9 docking facilities to service the 9 condo/duplex buildings. Six docks along the canal would each have 6'X30' access pier and 2 12'X12' boat lifts. The remaining three docking facilities would each have a 6'X50' access pier and 2 12'X12' boat lifts. A total of 18 slips are proposed. The access piers would shade a total of 1,980 square feet of shallow bottom habitat. The Federal agencies have completed review of the proposal as presented by the application and your field investigation report. We recommend that the following conditions be included in the modification to the State authorization: 1. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at http://www.fws.gov/nc-es/mammal/manatee guidelines.ndf. 2. The permittee must install and maintain, at his expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910) 772-2191. 3. All work authorized by this permit must be performed in strict compliance with the submitted plans, which are a part of this permit. Any modification to these plans must be approved by the US Army Corps of Engineers (USACE) prior to implementation. -2- 4. Except as specified in the plans attached to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, in such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce the reach of waters or wetlands. 5. Except as authorized by this permit or any USACE approved modification to this permit, no excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or maintenance of this project, within waters or wetlands. This permit does not authorize temporary placement or double handling of excavated or fill material within waters or wetlands outside the permitted area. This prohibition applies to all borrow and fill activities connected with this project. 6. All mechanized equipment will be regularly inspected and maintained to prevent contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials. In the event of a spill of petroleum products or any other hazardous waste, the permittee shall immediately report it to the N.C. Division of Water Resources at (919) 733- 5083, Ext. 526 or (800) 662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will be followed. 7. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands shall be generated from an upland source and will be clean and free of any pollutants except in trace quantities. Metal products, organic materials (including debris from land clearing activities), or unsightly debris will not be used. 8. If the permittee discovers any previously unknown historic or archeological remains while accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who will initiate the required coordination procedures. 9.The permittee shall require its contractors and/or agents to comply with the terms and conditions of this permit in the construction and maintenance of this project, and shall provide each of its contractors and/or agents associated with the construction or maintenance of this project with a copy of this permit. A copy of this permit, including all conditions, shall be available at the project site during construction and maintenance of this project. 10. The permittee shall employ all sedimentation and erosion control measures necessary to prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area. This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter I I3A Article 4). 11. The activity will be conducted in such a manner as to prevent a significant increase in turbidity outside the area of construction or construction -related discharge. Increases such that the turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by -3- the North Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant. 12. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration before completion of the work will, without expense to the United States and in such time and manner as the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its pre -project condition. 13. Violations of these conditions or violations of Section 404 of the Clean Water Act or Section 10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps of Engineers within 24 hours of the permittee's discovery of the violation. Through the authorized re- development, the existing docks have been removed or will be removed before construction of any new docking facilities. The tract elevation is 3' above NHW. The property has 631' of shoreline and a canal width along the east side of the property at the most constrictive point of 136' which was field verified. The area within the canal area has been previously dredged. The applicant is proposing 9 docking facilities and 18 boatlifts. Each docking facility has 2 slips, for a total of 18 slips. Six of the proposed docks and 12 slips with boatlifts would be located along the east side of the property within the canal. The otherthree proposed docks and six slips with boatlifts would be located along the north side of the property and would be shore perpendicular along Bogue Sound. AECs onsite include ES (Estuarine Shoreline). Bogue Sound surface water classification is "SA, HQW". Basis for Determination: The project is subject to the 2008 Town of Atlantic Beach Core Land Use Plan. The Town of Atlantic Beach Future Land Use Map (FLUM) designates the site as a "Mixed -Use Residential". The proposed development is consistent with the future land use designation. Policies — Conservation P.22 - The Town of Atlantic Beach supports 15A NCAC 7H for the protection of all AECs. P.29 - The Town of Atlantic Beach supports the construction of all marinas, docks, and piers which minimize or eliminate adverse effects on coastal wetlands and subacluatic vegetation and comply with 15A NCAC 7H minimum use standards. The applicant is requesting to add 9 docks and 18 individual boatlifts along the parcel of property to accommodate the previously permitted 9 duplex buildings. The previous land use was a mobile home park that had several docking facilities along the property but were removed during the re -development and construction of the duplexes. Proiect Description The existing 2.3-acre tract is located at 402 Old Causeway Road, Atlantic Beach, Carteret County. The project area is found by turning off Highway 70 East in Morehead City (Arendell Street) onto the on -ramp for Atlantic Beach. Follow the Atlantic Beach Causeway for approximately 2,774.41' (.53 miles) then turn right onto Old Causeway Road. Follow Old Causeway Road for approximately 3,138' (.59 miles). The entrance to Windfare Condominiums (formally Channel Bay MHP) is on the right. The property was originally developed in the 1960's as a leased mobile home park. The property is permitted for upland re -development through CAMA Major Development Permit 123-18. The authorized upland construction is still in progress. The land survey shows the existing BUA within the 75' AEC is 31.93% (13,966 sf) and a tract total BUA of 33.53% (33,301.78sf). The site is located along the south side of Bogue Sound and the west side of the existing canal and is contiguous with Bogue Sound. The property shoreline is stabilized with a bulkhead. The previous use as a mobile home park had several existing docking facilities. Through the authorized re -development, the existing docks have been removed or will be removed before construction of any new docking facilities. The tract elevation is 3' above NHW with no wetlands on the property. The property has 63l' of shoreline and a canal width along the east side of the property at the most constrictive point of 136' which was field verified. The waters of Bogue Sound adjacent to the project areas are classified as "SA, HQW" by the Division of Water Resources and have been previously dredged within the canal area. There are no nearby Primary Nursery Areas. According to the maps provided by the Shellfish Sanitation Section of the NC Division of Marine Fisheries, the waters of Bogue Sound are predominately open to shellfish harvesting adjacent to the proposed project however, the canal area is closed to shellfish harvesting. No SAV were observed within the project area. There is no dredging proposed within navigable waters and there are no know historic or archaeological areas of value known within the project sites. 10. Proposed Proiect The applicant is proposing 9 docking facilities and 18 boatlifts. Six of the proposed docks, each with two slips for a total of 12 slips with boatlifts would be located along the east side of the property within the canal. The canal has a width 136' at the most constrictive point which has been field verified. The '/4 rule would limit dock length to a maximum of 34' from NHW, which is the bulkhead. The 6 proposed docks along the canal would be spaced out along the existing bulkhead with the most southern proposed dock starting approximately 45' from the southeast property corner. The docks along the canal would have a 6' x 30' pier access perpendicular to the shore with a 12' x 12' boatlift along each side of the pier access. The most northern dock within the canal area would remain a distance of approximately 88' from the northeast property comer to prevent navigation interference with ingress and egress to the entrance of the canal. The other three proposed docking facilities along the north side of the property would be shore perpendicular along Bogue Sound. These docks would not exceed a maximum of 50' waterward of the existing bulkhead based upon the length of the previous allocated riparian access area. -All three docks would have a 6' x 50' pier access and two 12' x 12' boatlifts per dock for a total of 6 slip areas. The most western pier along Bogue Sound would be a minimum of 15' from the Seacrest/ Windfare Condominium, LLC Riparian Access Line. The spacing between the three docking facilities would be approximately 30' in between the adjacent boatlifts. 11. Anticipated Impacts: The development would shade 1,800 sf and incorporate 4,392 sf of shallow bottom habitat. The proposed docking facilities would not interfere with navigation and would meet the '/< width rule and not extend into the channel portion of the canal and Bogue Sound. The bathymetric map representing the aforementioned survey was submitted with this survey certification. This survey was primarily a single beam hydrographic survey. Measurements were obtained using Real Time Kinematic (RTK) GNSS corrections from the North Carolina CORS (Continuously Operating Reference Station), which provides continuous position and tide corrections for all hydrographic survey observations. The expected accuracy for this method is approximately 0.2' horizontally and vertically. Soundings were collected with an Odom CV-100 echo sounder at 200 kHz end collecting 20 soundings per second. Bulkhead and upland topographic observations were collected with a Trimble R8s GNSS receiver and Trimble TSC3 data collector, again using the NC CORS system for GNSS positioning. Before proceeding with any survey TI Coastal crew members "check into" a known North Carolina Geodetic Survey monument to ensure all equipment is calibrated and recording accurate observations. A tide check is performed in the survey vessel to make sure the GNSS tide correction is accurate before surveying begins. Additionally, a bar check is performed to ensure the transducer's draft and speed of sound is correct. These calibration checks are performed again after the survey effort is complete to make sure conditions have not changed over the course of the survey. On August 24, the R8s rover was checked at the monument "anchorage" located at the corner of East Fort Macon Road and Money Island Drive. The boat was launched at Anchorage Marina where a tide calibration point was set using the Us GNSS receiver. After launching the vessel, a tide check was performed based off that calibration point. The bar check was conducted in Bogue Sound near the project area. These quality control processes were again performed after the survey was complete. Datum conversions from NAVD88 to Mean Low Water were performed post processing. The datum shift of 1.7' between NAVD88 and Mean Low Water was determined using NOAA's VDATUM webpage (https://vdatu m. noaa.gov/). TI Coastal Services has extensive hydrographic survey experience in South Eastern North Carolina. We currently work with clientele ranging from large dredge companies (Great Lakes Dredge and Dock, Weeks Marine, Norfolk Dredging) to smaller dredge companies (Southwind Construction, Marcol Dredging, Cottrell Construction).
