,1) Unless specifically altered herein, this permit authorizes one concrete boat ramp and associated
stabilization, as indicated on the attached workplan drawings.
The boat ramp shall either be poured at an upland location and pushed into place once hardened, or
poured entirely within a watertight containment structure. Live concrete shall not be allowed to
contact waters of the State or waters that will enter waters of the State.

adequate ramp slope and provide a ramp no greater in size than specified in the attached permit

ADDITIONAL CONDITIONS
TE: In order to satisfy concerns with the resource agencies, the permittee may wish to consider
developing a dredge footprint to reduce the frequency of potential shallow bottom impact
through prop kicking.

4) The authorized boat lift shall not exceed the quarter width of the water body as measured from the
waterward edge of the existing bulkhead at the most restrictive point along the property.

This permit authorizes a maximum of 1 formalized boat slip.
No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable

HOWELL, BOATLIFT AND BOAT RAMP, NEWPORT, CARTERET COUNTY
The following are my comments and recommendations regarding the aforementioned
proposal. The proposal is for a boatlift and boat ramp.
There is currently an existing dirt boat ramp that has naturalized over time along a canal that
connects to Bogue Sound. The property does not currently have any slips and therefore the
owner is proposing one slip with a boatlift. The water depths within the canal is -2.0' to — 3' nlw
depending on location. The canal width at the moist constrictive point along the property is 47'.
The development conforms to the guidelines set forth under 15A NCAC 07H .0208. Assuming
that state and federal agencies concur with the proposal, the District recommends the project
be authorized as proposed, contingent upon the following conditions:
• A total number of one slip is authorized by this permit.
• Due to the canal width along the most constrictive section within the proposed
slip area (47' wide canal), the boatlift width dimension shall not exceed 12'.

Consistency Determination: The Future Land Use Map (FLUM) designates the proposed
development site as Limited Transition (land) and Conservation due to the sites location in
Estuarine Waters and Public Trust AECs (Areas of Environmental Concern). Land uses allowed in
Areas of Environmental Concern are those consistent with the State's minimum use standards and
state and federal regulations. Additionally, the LUP Policy 2.4.1 defers to CRC Rules regarding
development in estuarine and public trust waters. As the FLUM designation and policy 2.4.1 defer
to CRC Rules, the request is found to be consistent with the Carteret County Land Use Plan certified
by the CRC on December 20, 2010, provided the applicant is granted a variance to this rule by the
CRC.
Overview: The applicant is proposing a to construct a 11' x 25' concrete boat ramp within an
existing dirt boat ramp that has naturalized with wetlands over time, and a 13' x 13' boatlift along
a canal adjacent to Bogue Sound at 113 Dixon Lane, Newport, Carteret County, North Carolina.
The project site is a .34-acre parcel that abuts an existing canal that connects to Bogue Sound. The
canal bottom substrate is sand, and it is 35' to 50' wide depending on the location. The width of
the canal at the site of the proposed 13' x 13' boatlift is 47' wide; the proposed boatlift exceeds
the % width of the canal at 12'.
The upland vegetation consists of lawn grasses, and a few trees along a separate adjoining parcel
owned by the applicant to the north. A 132 sf of wetlands are present in the existing dirt boat
ramp. The wetland species include: Spartina alterniflora, Spartina patens, Distichilis spicata, and
non -coastal wetlands.
The project is located in the following Areas of Environmental Concern (AEC): Estuarine Water (EW)
and Public Trust Area (PTA). The waters in this area classified as ORW/SA, are not designated a

Primary Nursery Area (PNA), and are open to the taking of shellfish. The field report did not specify
if there was any Submerged Aquatic Vegetation (SAV) or cultural resources.
Anticipated impacts resulting from the boat ramp are expected to include: the shading and
incorporation of 143 ft2 of shallow bottom habitat and would remove 132 ft2 of naturalized coastal
wetlands/jurisdictional wetlands. The boatlift would incorporate 169 ft2 of open water. The
proposed 13' x 13' boat lift exceeds the t/a width of the canal as proposed, due to the 47' width of
the canal. One quarter of the canal width in this area is 12'. Future dredging/excavation would be
needed to maintain water depths. There would also be incidental excavation with the use of the
boat ramp by power boats onto the trailer when retrieved at low tide.
Basis for Determination:
The project site is located in Carteret County and is subject to the 2005 Carteret County Land Use
Plan Update. The Future Land Use Map (FLUM) designates the site as Limited Transition (land) and
Conservation due to the sites location in Estuarine Waters and Public Trust AECs (Areas of
Environmental Concern). Land uses allowed in Areas of Environmental Concern are those
consistent with the State's minimum use standards and state and federal regulations.
Land Use Policies: The following LUP policies may be applicable to this request.
2.0 Land Use Compatibility
Policy 2.1, pg. 71: Carteret County's policies for development in coastal and non -coastal ("404," "401," or
jurisdictional) wetlands are as follow:
1. Carteret County will allow only land uses in coastal wetlands that require water access, cannot
function elsewhere, and are consistent with state and federal regulations.
3. Carteret County concurs with state and federal standards for residential, commercial, and
industrial development in freshwater wetlands except as prohibited by this plan.
4. Carteret County will cooperate with the U.S. Army Corps of Engineers in the
regulation/enforcement of the "404" wetlands permit process. The County will require that areas
of non -coastal wetlands be shown on all new subdivision plats.
Policy 2.4, pg. 71: Carteret County's policies for development in estuarine and public trust waters area as
follows:
1. "Carteret County will only allow development in estuarine and public trust waters that are
associated with water -dependent uses, consistent with state and federal standards, and meet all
local polices contained in this plan."

A North Carolina Division of Coastal Management (DCM) Fisheries Resource Specialist has reviewed,.
the subject permit application for proposed actions that impact fish and fish babitats.. The applicant is
proposing to construct a new concrete boat ramp in a canal adjacent to Bogue Sound along Dixon Lane
within the bounds of an existing dirt boat ramp that has naturalized with coastal wetland species totaling
113 square feet. The terminus of the boat ramp is proposed in approximately -2' ® NLW. The applicant
is also proposing a 13'x 13' boat lift along the canal bulkhead in approximately -2 to -2.5' @ NLW.
This office does not object to the removal of the small area of incidental coastal wetlands that have
occurred simply due to the lack of a bulkhead'across the area formerly -used as a boat ramp. However,
there are concerns about the water depths of the proposed ramp and placement of the boat lift. It is
preferred that ramps terminate in at least -3' to prevent scour and bottom kicking when retrieving boats.
Since connecting water depths of -3' are available in the center of the canal it would be recommended to
add excavation to the project to provide better access to the ramp. This could result in a single disturbance
to excavate and less repeated bottom disturbances during each vessel retrieval: The same could be done in
the area of the boat lift. Additionally, the proposed boat lift should be reduced in width the be within the
quarter width of the canal to allow upstream access or a basin could be excavated from the high ground
on the property if reducing the size of the boat lift is not acceptable.
In the event dredging were added to the permit a moratorium on dredging from April-1 to September 30
would likely be requested to reduce potential negative impacts to juvenile fish, shellfish, and the SAV
beds existing at the mouth of the canal.

North Carolina.
Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the
permit application with, regard to impacts on fish and wildlife resources. The project site is
located at 113 Dixon Lane adjacent to a canal that leads to Bogue Sound in Newport, NC. Our
comments are provided in accordance with provisions of the Coastal Area Management Act
(G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act,
as amended, and the Fish and Wildlife Coordination Act (48 Stat. 401, as amended, 16 U.S.C.
661 et seq.).
The applicant proposes to construct a new boat ramp within an existing dirt boat ramp and install
a boatlift within a canal. The new 11' by 25' concrete ramp would be installed within the dirt
ramp, requiring the removal of 132 ft of coastal wetlands. Water depths at the terminus of the
ramp would be -2' NWL. In addition to the ramp, a boat lift extending 16' into the water body is
proposed The canal width at the project site is 47'. The Bogue Sound and canal at this location
are classified SA ORW by the Environmental Management Commission and are open to
shellfish harvesting.
The NCWRC has reviewed the permit application and recommends changes to the project design
to minimize impacts to environmental and public resources. In general, our agency does not
support boat ramps that terminate in water depths less than -3' NWL. The application states the
connecting water depths are -3' NWL. We recommend the applicant excavate a narrow channel

from the ramp to the -3' NWL depths. This would minimize chronic sediment disturbance from
power loading, prop wash, and hull scraping in minimal water depths. This could likely be done
from shore while installing the ramp. NCWRC would support any recommended moratoria
requested by the NC Division of Marine Fisheries representative for dredge activities. In addition
to the ramp recommendations, the boat lift should be reduced from 16' to 12'. This would allow
the structure to be at or less than the quarter width of the water body, reducing its hindrance to
navigation.

9. Narrative Description:
The David R. Howell project is located behind 113 Dixon Lane within Newport, Carteret
County. The site is found by following Highway 24 east or west (depending on where you
are coming from) to the Broad Creek Loop Road. Follow Broad Creek Loop Road
(approximately 4500 feet) until you reach Dixon Drive. Turn onto Dixon Drive and
continue until you reach Dixon Lane on the right. The vacant parcel is located behind 113
Dixon Lane. The old boat ramp is along the southern side of the parcel.
The residential property is .34 acres (16117.2 sf) in its entirety and l' above nhw. There is an
existing canal that abuts the property and connects to Bogue Sound. The upland vegetation
mainly consists of lawn grasses, and a few trees along a separate adjoining parcel to the north
owned by the applicant. The only wetlands along this parcel are naturalized within the existing
dirt boat ramp (132 sf). They consist of Spartina alterniflora, Spartina patens, Distichlis spicata
and non -coastal wetlands.
The Division of Water Resources classifies this area as ORW/SA Waters. This area of Bogue
Sound and canal is not designated as a Primary Nursery Area and is open to the taking of
shellfish. The Carteret County Land Use Plan classifies this area as Single-family Residential
with Conservation within the AECs. Water depths within this project location are-2'nlw/mlw
to -2.5' nlw/mlw, depending on location, with connecting water depths of -3' nlw/mlw. The
bottom substrate is sand. The existing canal is 35' to 50' wide depending on location.
10) Proposed Development:
Due to the naturalization of the existing dirt boat ramp with 132 sf of wetlands, and no
slips along the property, the applicant is proposing the construction of a I Vx 25' concrete
boat ramp with the existing boat ramp area and the placement of a 13' x 13' boatlift along
the northern section of the property. The canal width within the proposed boatlift area is
47' (field verified) with the width becoming more narrow the farther north you go along
the canal.
The 11' x 25' boat ramp would consist of concrete and would not extend more than 9.5'
from normal high water within the canal. The applicant proposes to install a coffer dam
and would. pump out the water within this area during construction. They would then
construct a concrete form in place until it hardens. The dam would then be removed. The
proposed 13' x 13' boatlift would be located along the northern section of the parcel
(47'eanal width) and located a distance of 22' from the northern riparian line.
11. Anticipated Impacts:
The proposed concrete boat ramp would shade and incorporate 143sf of shallow bottom
habitat and would remove 132sf of naturalized coastal wetlands/jurisdictional wetlands.
The proposed boatlift would incorporate 169 ft2 of open water. The proposed size of the
boatlift exceeds the '/< width of the canal as proposed, due to the 47' width of the canal.

One quarter of the canal width within this area is 12' therefore a smaller 12' wide boatlift
is recommended to accommodate the narrow canal size. Future dredging/excavation would
be needed to maintain water depths. There would also be incidental excavation with the
use of the boat ramp by power boats onto the trailer when retrieved at low tide.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development at 113 Dixon Lane in Newport, Carteret County. The complete package was
received on 11/14/17. The projected deadline for making a decision it 1/28/18. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 11/14/17, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

The NC Division of Coastal Management hereby acknowledges receipt of your application for State
approval for development at 113 Dixon Lane in Newport, Carteret County. The complete package was
received on 10/4/17. The projected deadline for making a decision is 12/18/17. An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 10/4/17, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of my field report and/or comments from reviewing agencies.

approval for development at 113 Dixon Lane in Newport, Carteret County. The complete package was
received on 11/14/17. The projected deadline for making a decision is 1/28/12 An additional 75-day
review period is provided by law when such time is necessary to complete the review. If you have not
been notified of a final action by the initial deadline stated above, you should consider the review period
extended. Under those circumstances, this letter will serve as your notice .of an extended review.
However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from 11/14/17, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed
development. Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the
property of your proposed development. You should post this notice at a conspicuous point along your
property where it can be observed from a public road. Some examples would be: Nailing the notice card
to a telephone pole or tree along the road right-of-way fronting your property, or at a point along the
road right-of-way where a private road would lead one into your property. Failure to post this notice
could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing
if you wish to receive a copy of m fi d report and/or comments from reviewing agencies.

We are applying for a major CAMA permit for the addition of a 11' x 25'
concrete boat ramp and 13' x 13' boat lift. The proposed boat ramp will require
excavtion of a small area of coastal wetlands. The existing property has an area
that was used for the launching of boats but never had concrete. Due to no being
used over time the area is now populated with coastal wetlands. The property has
approximately 82' of linear shoreline. The location of the work is at 113 Dixon
Lane in Newport, NC. The landowners name is David Howell. Enclosed are
