Dear Ms. Kempton,
This correspondence is with reference to the request you submitted on April 7, 2022, to modify State Permit No.
86.16, which authorized the excavation and renovation of the western portion of the existing Carolina Beach
municipal marina, including the replacement and relocation of the existing docking facility. A Major Modification
was issued on February 24, 2022, for new sidewalks, the replacement of the existing bulkhead, the reconfiguration
and excavation of the existing docking facility on the southern and eastern side of the existing municipal marina
for a total of 34 formalized slips. The permit is due to expire on December 31, 2025
The action proposed in your request is to relocate an existing authorized slip and install two temporary pilings
within an existing marina as depicted in your email and drawing (dated as received by DCM 4/7/2022). The
authorized slip is currently located on the southern side of the basin where the authorized bulkhead work Is taking
place. The submittal states the authorized slip currently houses the Island Cruiser, which is very active with
passengers and school trips, and to alleviate any conflicts with construction, the Island Cruiser would be moved
to the east side of the basin and to safely moor the Island Cruiser two temporary tie -pilings are needed. The tie -
pilings would be located in an area usurped by the authorized east -side marina renovation and would be removed
following completion of the south side bulkhead work adjacent to the originally authorized slip. No change in
formalized slip count or encroachment into the USACE channel setback is proposed.
Upon reviewing the information provided, the Division of Coastal Management has determined that the proposed
action is consistent with existing State rules and regulations and is in keeping with the original purpose and intent
of the permit. This Letter of Refinement authorizes the modification of State Permit No. 86-18 as described in your
email and drawing dated received Thursday April 7, 2022. Please note this refinement does not alleviate the need
to obtain any other local, state or federal permits.

Hi Bryan,
Thank you again for meeting us out at the marina on Tuesday. It was very nice to meet you.
The town is making every effort to work with the boat captains in order to accommodate them during the construction
phase of the project as much as permittable and we are trying to alleviate any impediments that can be addressed in
assisting them regarding the moving of the boats from the slips.
The Island Cruiser Boat is one our longest boats and is currently very active with passengers/school trips. We are making
every attempt to allow him to keep operating through the process and one alternative is to move him to the west side
wile the contractor works on the south side. This would require approval for two pylons to be temporarily placed
approximately 40 feet from walkway to the pier line on the west side pier. The two pylons would be removed before the
completion of the construction project. I have attached a map for your review.
Would you please review the map and let me know if there are any issues with this specific activity and/or if it would be
allowable by CAMA through a permit process.
