This permit, issued on December 3, 2018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subject to fines, imprisonment or civil action; or may cause the permit to be null and void. Docking Facility Expansion 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility expansion without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other Signed by the _ authority of the Secretary of DEQ and the qualified persons within twenty (20) days of the issuing date. Any maintenance work or project modification not covered hereunder requires further Division approval. Signature of Permittee II Paxon Holz Permit No.131-18 Page 2 of 3 ADDITIONAL CONDITIONS 3) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes an additional 8 slips for a maximum of 9 formalized boat slips. 6) The construction and/or operation of the authorized facilities shall not directly result in any closure of any waters that are open to the taking of shellfish. Any such closure directly attributable to the community marina facility shall require that the permittee undertake corrective actions to remedy the situation. Such actions may include, but are not limited to, a removal of any unauthorized slips or mitigative measures to reduce or eliminate the cause(s) of the closure. 7) This permit does not authorize any dredging or fill activities within open waters or Coastal Wetlands. 8) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. USACE Condition 9) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish & Wildlife Service's Guidelines, and strictly adhere to all requirements therein. General 10) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 11) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The pernttee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. Paxon Holz Permit No.131-18 Page 3 of 3 .. ADDITIONAL CONDITIONS NOTE: The U.S. Army Corps of Engineers authorized the project by of Programmatic General Permit 198000291 (Action ID SAW-2017-02074) issued 11/21/18. NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4144 and assigned the project DWR Project No. 2018-1243, issued 12/3/18 NOTE: Future development of the permittee's property may require a modification of this permit.. Contact a representative of the Division at (M) 808-2808 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. NOTE: An application processing fee of $400 was received by DCM for this project. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if questions arise concerning permit conditions, environmental safeguards, or problem areas, you may contact Department personnel at any time for assistance. The waters of this area of Bogue Sound are classified as Outstanding Resource Waters (ORW), open toshellfish harvest and is not a Primary Nursery Area. Pending other state and federal agencies review of the proposal, the Morehead City District staff recommend the project be authorized as proposed and in addition to the standard conditions, contingent upon the following conditions: 1 Must meet all NC Shellfish requirements in order to not cause an increase in adjacent shellfish closure areas. 2 Due to the waterbody width and use of the area, the docking facility shall not exceed a maximum of 40' from waterward edge of the marsh. 3 The pier access shall be elevated a minimum of three feet above the marsh substrate measured from the marsh substrate to the bottom of the pier decking. 4 Due to the Outstanding Resource Water (ORW) classification, the number of formalized docking spaces on this property, whether authorized by this permit and/or existing on the property, shall not exceed nine (9) in sum total. 5 The remnant existing pilings offshore shall be removed prior to completion of the proposed docking facility. Biologists with the North Carolina Wildlife Resources Commission (NCWRC) reviewed the permit application with regard to impacts on fish and wildlife resources. The project site is located at 326 Live Oak Drive in Cape Carteret, NC adjacent Bogue Sound. Our comments are provided in accordance with provisions of the Coastal Area Management Act (G.S. 113A-100 through 113A-128), as amended, Sections 401 and 404 of the Clean Water Act, as amended, and the Fish and Wildlife Coordination Act (48 Stat 401, as amended; 16 U.S.C. 661 et seq.). The applicant proposes to construct an eight -slip docking facility to an existing slip to create a nine -slip facility for commercial use. A fixed parallel to shore pier would be waterward shoreline coastal marsh approximately 5'. A 5' by 30' access would bisect the 5' by 110' pier to access four 5' by 40' finger piers, creating eight slips. Water depths within the slip areas are -4' to -5.7' NLW. No upland development, including parking, is included in this proposal. A NCDEQ scoping meeting was conducted for this project. Bogue Sound at this location is classified SA HQ ORW and is open to shellfish harvesting. The NCWRC participated in the NCDEQ scoping meeting and has reviewed the permit application. We do not have specific comment or concerns regarding the docking facility, its orientation, or impacts to aquatic resources. However, we request that since the facility will have leased slips, that information regarding owner contact and emergency response be posted. We also request that information regarding parking be presented. Since these slips are not directly associated with a residence, vehicle access is likely. The Town will not permit commercial uses in connection with marinas and docking facilities. This policy exceeds CAMA 711 use standards since CAMA regulations will allow commercial activities with marina development". Overview: The project is contiguous to Bogue sound and is located at 326 Live Oak Drive, Cape Carteret, Carteret County, North Carolina. The site is 5.68 acres in entirety, has 520' of shoreline, and is an average of 2' above NHW. Existing development onsite includes one house, one slip docking facility, a dilapidated dock platform and four (4) remnant pilings offshore to the southwest of the property. Proposed development includes construction of a private eight -slip docking facility with four finger piers, and eight (8) boatlifts to the northwest portion of the property. The slips would be available for lease. There would be a total of 9 slips for the parcel including the existing docking space at the existing dock. There are coastal wetlands consisting of Salt Grass (Distichlis spicata), Salt Meadow Cordgrass (Spartina patens), Black Needlerush (Juncus roemarianus) and dominated by Smooth Cordgrass (Spartina altenuflora). Substrate is sand and silt and No SAV'sor shellfish beds were observed within the proposal project area, although there is an area of submerged aquatic vegetation (SAV) approximately 90' feet west and beyond the extents of the project site. A review of archaeological resources was not provided. Anticipated impacts resulting from this project are expected to include: shading of 1,225 ft2 and incorporation of 4,725 ftz of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be not exceed a distance of 40' from NHW in a 535' wide water body. All portions of the proposed development would not exceed a maximum of 40' and remain, within the % limitation for the 535' wide water body as well as not hinder ingress and egress from surrounding canals and channel areas. All portions of the docking facility would meet the minimum 15' setback from the riparian access lines. Basis for Determination: The project site is located in the Town of Cape Carteret their 2007 Core Land Use Plan Update. The Future Land Use Map (FLUM) designates the site as Medium Density MF Residential (land) and Conservation (Areas of Environmental Concern and non -coastal wetlands) and Limited Transition (land). Uses allowed in Areas of Environmental Concern are those consistent with the State's minimum use standards and state and federal regulations. The following LUP policies may be applicable to this request: 4.2.2 Land Use Compatibility Policy 17: Cape Carteret will only allow development activities in estuarine and public trust waters that are associated with water -dependent uses, consistent with state and federal standards, and meet all local policies contained in this plan. Policy 18: Marinas and other docking. facilities may be permitted where it is consistent with local zoning and must be constructed in accordance with the Division of Coastal Management guidelines. 4.2.6 Areas of Environmental Concern Policy 2: Only certain uses which require water access and cannot function elsewhere will be permitted in coastal wetlands. Such uses include utility easements, navigation channels, dredging projects, marinas, piers, boat ramps, noncommercial docks, navigational aids, groins, culverts, and bridges. Each proposed use shall be evaluated for compliance with the CAMA 7H Use Standards and town ordinances. Policy 4: The town's policy is to restrict development in estuarine waters and public trust waters to those uses which will not cause significant degradation of the natural function nor condition of the estuarine waters and public trust areas. Any development within estuarine or public trust waters must be consistent with CAMA 7H Use Standards and local development regulations. In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all requirements therein. The guidelines can be found at hhq ://www.fws. og v/nc- es/mammal/manatee gj idelines.ndf. 2. The permittee must install and maintain, at their expense, any signal lights and signals prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. This permit shall be effective from the date of issuance until rescinded and shall be subject to the following specified conditions and limitations: I. DESIGN STANDARDS This permit is effective only with respect to the management of stormwater described in the approved plans and specifications. The overall percent of built -upon area (BUA) permitted for the project must not exceed 12% per the requirements of the stormwater rules. The overall percent of built -upon area permitted for the portion of project within 575 feet of SA-ORW waters must not exceed 12% per the requirements of the stormwater rules. This permit covers the construction of a total of 27,259 square feet of new BUA, which includes 1,800 square feet of proposed BUA, and 25,459 square feet of future BUA allocation. This permit excludes 17,174 square feet of existing built -upon area for purposes of calculating the project's density, in accordance with 15A NCAC 02H.1003(1)(b). 2: Where a project or lot is located within CAMA's Area of Environmental Concern (AEC), the Division of Coastal Management (DCM) may calculate a different maximum built -upon area based on CAMA regulations. The more restrictive BUA limit of DCM or DEMLR will apply to the DEMLR project. 3. A 50-foot wide vegetative setback must be provided and maintained adjacent to all surface waters, measured horizontally from the normal pool elevation of impounded structures, from the top of bank of each side of streams or rivers, and from the mean high waterline of tidal waters, perpendicular to the shoreline in accordance with the stormwater rules and the approved plans and specifications. All stormwater runoff shall be released as dispersed flow no closer than at the edge of the vegetated setback. At no time shall stormwater runoff be piped into or through the setback. This project has maximized dispersed flow of stormwater runoff through vegetated areas and minimized the channelization of flow. Stormwater runoff that could not be released as dispersed flow may be transported by vegetated conveyances with minimum side slopes of 3:1 (H:V) designed to not erode during the peak flow from the 10-year storm event as defined in the stormwater rules and approved by the Division. 5. No piping shall be allowed except those minimum amounts necessary to direct stormwater runoff beneath a BUA such as a road or driveway when it cannot be avoided. 6. This project does not propose any stormwater outlet discharge points and therefore will not have the opportunity to cause erosion during the 10-year storm event. IL SCHEDULE OF COMPLIANCE The project shall be constructed, operated and maintained in accordance with the conditions of this permit and the approved plans and specifications. Vegetated areas and vegetated conveyances shall be entirely constructed, vegetated, and operational prior to the construction of any development, per the approved plans and specifications. 3. During construction, erosion shall be kept to a minimum and any eroded areas of the on -site stormwater system will be repaired immediately. 4. All vegetated conveyance systems, stormwater collection systems, and/or maintenance accesses must be located in public rights -of -way, dedicated common areas that extend to the nearest public right-of-way, and/or permanent recorded easements that extend to the nearest public right-of-way for the purpose of inspection, operation, maintenance, and repair. 5. The permittee shall provide and perform the operation and maintenance necessary, as listed in the signed Operation and Maintenance Agreement titled Swale System Maintenance Requirements, a part of the Low Density Supplement, to assure that the permitted vegetated conveyance system functions at the approved design condition. The approved Operation and Maintenance Agreement is incorporated by reference into this permit and must be followed in its entirety and maintenance must occur at the scheduled intervals. 6. The operation and maintenance agreement must be recorded with the Office of the Register of Deeds. Records of maintenance activities must be kept and made available upon request to authorized personnel of the Division. The records will indicate the date, activity, name of person performing the work and what actions were taken. The final plats for the proiect must be recorded with the Office of the Register of Deeds The recorded plat must reference the Operation and Maintenance Agreement and must also show all public rights -of -way, dedicated common areas, and/or permanent drainage easements, in accordance with the approved plans. 9. The permittee is responsible for verifying that the proposed built -upon area for the entire project does not exceed the maximum allowed by this permit. Upon completion of the project, the permittee shall determine whether or not the project is in compliance with the permitted plans and take the necessary following actions: a. If the permittee determines that the project is in compliance with the permitted plans, then within 45 days of completion, the permittee shall submit to the Division one hard copy and one electronic copy of the following: i. The completed and signed Designer's Certification provided in Attachment A noting any deviations from the approved plans and specifications. Deviations may require approval from the Division; ii. A copy of the recorded maintenance agreement; iii. Unless already provided, a copy of the recorded deed restrictions and protective covenants; and iv. A copy of the recorded plat delineating the public rights -of -way, dedicated common areas and/or permanent recorded easements, when applicable. b. If the permittee determines that the project is not in compliance with the permitted plans, the permittee shall submit an application to modify the permit within 30 days of completion of the project or provide a plan of action, with a timeline, to bring the site into compliance. 11. No person or entity, including the permittee, shall alter any component shown in the approved plans and specifications. Prior to the construction of any modification to the approved plans, the permittee shall submit to the Director, and shall have received approval for modified plans, specifications, and calculations including, but not limited to, those listed below: a. Any modification to the approved plans and specifications, regardless of size including the stormwater control measures, built -upon area, details, etc. b. Redesign or addition to the approved amount of built -upon area. c. Further development, subdivision, acquisition, lease or sale of any, all or part of the project area as reported in the approved plans and specifications. d. Altering, modifying, removing, relocating, redirecting, regrading or resizing of any component of the approved stormwater control measure, stormwater collection system and/or vegetative conveyance system shown on the approved plan. e. The construction of any allocated future BUA. f. The construction of any permeable pavement for BUA credit that was not included in the approved plans and specifications. g. The construction of any #57 stone area, public trails, or landscaping material to be considered a permeable surface that were not included in the approved plans and specifications. h. Other modifications as determined by the Director. 12. The Director may notify the permittee when the permitted site does not meet one or more of the minimum requirements of the permit. Within the time frame specified in the notice, the permittee shall submit a written time schedule to the Director for modifying the site to meet minimum requirements. The permittee shall provide copies of modified plans and certification in writing to the Director that the changes have been made. 13. Prior to transfer of the permit, a file review and site inspection will be conducted by Division personnel to ensure the permit conditions have been met and that the project and the on -site stormwater system complies with the permit conditions. Any items not in compliance must be repaired, replaced restored, or resolved prior to the transfer. Records of maintenance activities performed to date may be requested. III. GENERAL CONDITIONS Any individual or entity found to be in noncompliance with the provisions of a stormwater management permit or the requirements of the stormwater rules is subject to enforcement procedures as set forth in NCGS 143 Article 21. The issuance of this permit does not preclude the permittee from complying with and obtaining any other permits or approvals that are required for this development to take place, as required by any statutes, rules, regulations, or ordinances, which may be imposed by any other Local, State or Federal government agency having jurisdiction. Any activities undertaken at this site that cause a water quality violation or undertaken prior to receipt of the necessary permits or approvals to do so are considered violations of NCGS 143-215.1, and subject to enforcement procedures pursuant to NCGS 143-215.6. In the event that the project fails to meet the stormwater rule requirements for a low density project, the permittee shall take immediate corrective actions. These additional or replacement measures shall receive a permit from the Division prior to construction. 4. This permit is not transferable to any person or entity except after notice to and approval by the Director. The permittee shall submit a completed and signed State Stormwater Request Form for Permit Transfer or Permit Information Update, accompanied by the supporting documentation as listed on the form, to the Division at least 60 days prior to any one or more of the following events: a. Any ownership change including: i. The assignment of declarant rights to another individual or entity; ii. The sale or conveyance of the project area in whole or in part, except in the case of an individual lot sale that is made subject to the recorded deed restrictions and protective covenants; iii. Dissolution of the partnership, corporate, or LLC entity, subject to NCGS 55-14-05 or NCGS 57D-6-07: b. Bankruptcy; c. Foreclosure, subject to the requirements of Session Law 2013-121. 5. The permittee shall submit a completed Permit Information Update form to the Division at least 30 days prior to any one or more of the following events: a. A name change of the current permittee; b. A name change of the project; c. A mailing address change of the permittee; 6. The permittee is responsible for compliance with all terms and conditions of this permit until the Division approves the transfer request. Neither the sale of the project, in whole or in part, nor the conveyance of common area to a third party constitutes an approved transfer of the permit. 7. The permittee grants Division Staff permission to enter the property during normal business hours to inspect all components of the permitted project. 8. The permit issued shall continue in force and effect until the permittee files a request with the Division for a permit modification, transfer, or rescission; however, these actions do not stay any permit conditions. 9. Approved plans, application documents, supplements, calculations, operation and maintenance agreement, and specifications for this project are incorporated by reference and are enforceable parts of the permit. The parcel has an existing house, one -slip docking facility, a dilapidated dock platform and four (4) remnant pilings offshore to the southwest of the property. There is also riprap and a bulkhead along the shoreline, and a dilapidated paved boat ramp. The current proposal is to add a docking facility with eight (8) formalized docking spaces to the northwest portion of the parcel for a total slip count of 9 (one Paxon Holz Page 2 of 3 existing and eight proposed). The applicant is also proposing eight (8) boat slips within each of the proposed docking spaces. No high ground work is proposed other than the water and pier access. The project site is located approximately 400 feet east of the former DOT mainland ferry terminal. 9. Narrative Description The Paxon Holz Bayshore Boat Dock project is located contiguous with Bogue Sound in Cape Carteret, Carteret County, NC at 326 Live Oak Drive. From Hwy 24•, turn south onto Live Oak Drive and continue south to the end of Live Oak Drive. The tract is on the west side of Live Oak Drive and is bordered by Harborlight Guest House to the South, undeveloped property to the north, and developed single family residences to the east of Live Oak Drive across from the project site. The Holz project parcel is 247,287 square feet (5.68acres) in its entirety, has a shoreline length of 520' and is an average of 2' above NHW. The parcel has an existing house, one - slip docking facility, a dilapidated dock platform and four (4) remnant pilings offshore to the southwest of the property. There is also riprap and a bulkhead along the shoreline, and a dilapidated paved boat ramp. There are coastal wetlands consisting of Salt Grass (Distichlis spicata), Salt Meadow Cordgrass (Spartina patens), Black Needlerush (Juncus roemarianus) and dominated by Smooth Cordgrass (Spartina alterniflora). There is typical high ground vegetation (yard grass) on this developed tract. The Cape Carteret Land Use Plan classifies this property as commercial and undeveloped, with all AEC's classified Conservation. This section of the Bogue Sound is not designated as Primary Nursery Area, is open to the taking of shellfish and carries a water classification of ORW. The riparian corridors were determined through channel alignment as well as existing use of the area. Substrate is sand and silt and No SAV's or shellfish beds were observed within the proposal project area, although there is an area of submerged aquatic vegetation (SAV) approximately 90' feet west and beyond the extents of the project site. Water depths within the location are 4' to-5.7'nlw depending on location. The waterbody width is 535' across in the area closest to the project site. There is a public observation pier maintained by the Town of Cape Carteret approximately 212 feet to the west of the project extents. Maintenance excavation was last performed under CAMA General Permit #60355-C, issued July 2, 2012. 10. Proiect Description: The applicant's proposal is to construct a private eight -slip docking facility with four finger piers to the northwest portion of the property. The slips would be available for lease. The proposed boatlifts eight (8) would be installed within the formalized docking spaces. There would be a total of 9 slips for the parcel including the existing docking space at the existing dock. The applicant is proposing the placement of a pier access which would originate 30' from high ground and cross over a 7' wide area of marsh. The access would continue to a fixed open -water pier that would be parallel to the shoreline and waterward edge of the marsh for a north and south orientation. The east, or landward edge of the dock would be an average of 5' waterward of the edge of marsh. The 5' wide x 30' long access would Paxon Holz Page 3 of 3 intersect the 5' x 110' shore -parallel pier that would access the four (4) 5' x 30' finger piers and the eight (8) formalized docking spaces. The four 5' x 30' finger piers would be perpendicular to the pier and eight 10.4' x 12' boatlifts. All portions of the proposed development would not exceed a maximum of 40' and remain within the 1/4 limitation for the 535' wide water body as well as not hinder ingress and egress from surrounding canals and channel areas. All portions of the docking facility would meet the minimum 15' setback from the riparian access lines. The average existing water depths within the slip areas is an average of -4'to -5.7' nlw depending on location. The tidal amplitude within this area is 2.5'. The total length of the shoreline is 520'. According to the applicant, the typical boat would be. 18' — 2l' with an recreational design. 11. Anticipated Impacts: The proposed docking facility would shade 1,225 Wand incorporate 4,725 ft2 of open waters. The setting of pilings would cause temporary turbidity. There would be no hindrance to navigation due to the fact that the docking facility would be not exceed a distance of 40' from NHW in a 535' wide water body: Name: Heather Styron Date: 9/4/18 Morehead City Bayshore Boat Docks Project Narrative This project plans to build eight (8) boat slips, with lifts if there is a demand for them (see attachment ) located in ORW waters adjacent to property in the Bayshore Park subdivision of the Town of Cape Carteret. The parcel is in the vicinity of the old free N. C. State Ferry landing that transported passengers and autos between Emerald Isle and the mainland prior to the construction of the B. Cameron Langston Bridge. Prior to the construction of the bridge, a marina was constructed at the then larger site to dock boats and other equipment. T. A. Lovin Company won both contracts for the bridge: the piers and the deck. W. B. McLean allowed his property to be used by T.A. Lovin Company as a staging area and to dock all their construction boats and barges. McLean leased spaces to T. A. Lovin employees to bring in their personal mobile homes for $15.00 per month. The small two story waterfront dwelling, called the Penthouse, was built by the applicant's father, W. B. McLean, while the ferry was running, so that if he missed the last ferry to the island, he could spend the night on the mainland, rather than driving all the way to Morehead City, crossing over on the Atlantic Beach Bridge, and driving down Bogue Banks to his house on Emerald Isle. The dwelling was made available as an office and to house the T.A.Lovin foreman during construction of the bridge. The intent was always to have a marina there, indicated in part by the three-phase electrical power, and there was a walk-in cooler attached to the dwelling, now removed, for bait, or to store fish and other seafood. The 3-story Harborlight Restaurant, located on the same parcel of land, was operating at the time. Some elements of the marina remain, including bulkheading and docks adjacent to the Penthouse. The bridge was completed in 1971. Applicant and her husband moved into the Penthouse in 1972, and lived there for about three years. The Harborlight, after closing as a restaurant, served as an apartment dwelling for several years, and was sold on approximately 1.25 acres of land to Samuel R. Fox and wife Dorothy E. Fox on August 9tl', 1976. Dredging was completed at the site under a general CAMA permit #60355, issued July 2, 2012. The remaining 5.38 acre parcel, now in single ownership, is zoned residential single family and multi -family. Parking for up to e5W cars will be provided on the grassy land adjacent to the boat slips. Town ordinances permit the construction of 10 slip boat docks in all residential districts. While town ordinances limit boats to 24 feet in length, this project will limit length to 21 feet in compliance with DWR rules for ORW waters. Cabins or heads are not permitted. Additionally, town ordinances prohibit refueling, restroom facilities, overnight stays aboard vessels, overnight mooring and other commercial structures such as office, ice machines or drink machines. The land parcel adjacent to the proposed boatdocks is unsuitable for septic systems, making k unusable for residential use for which it is zoned. Slips or lifts will be leased by the owner with conditions of local ordinances explicitly included in the agreement. The town has a public ramp available for a fee for town residents as well as residents of the Towns of Peletier, Bogue and Cedar Point. The project will build eight (8) boat slips in the water adjacent to the land. The water is of sufficient depth (4.2 feet to 6 feet) so that no dredging will be required. Construction will be of concrete hog slats supported by 4"x10" girders. Each slip will be designed so that it can be used as either a wet slip or with a powered lift depending on the preferences of the leasing customer. Project requests permitting for eight (8) lifts. Sufficient underground electric power (240 volt) will be provided to the site to power eight (8) lifts and provide a 120 volt outlet for charging batteries and operating small hand tools. Additionally a potable water supply will be provided for each slip. The shoreline will not be bulk headed and the only land based construction will be a pervious hog slat boardwalk to access the piers and a grassy parking area which increases the impervious coverage to .79% after reducing the project area by the recorded amount of coastal wetlands (see application/site plan). The grassy parking area will be maintained by the property owner. There are no plans at this time to improve the existing boat ramp site north of the marina. There is navigable water from the boatdock location to the old ferry charnel and along the south shore of Cape Carteret to Deer Creek. Both channels provide direct access to the Intracoastal Waterway (ICW). Preliminary estimates for the cost of the project total $62,000 for the docks and access pier which includes electric power and water.
