Docking Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. .;2) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. Signature of Petmittee Permit No.100-18 Page 2 of 2 ADDITIONAL CONDITIONS This permit authorizes a maximum of 4 formalized boat slips at the authorized docking facility. The boathouse shall not be completely enclosed or have side coverage more than one half the height of the side, from the roof waterward. The footprint of the boathouse shall not exceed the dimensions on the authorized workplans. The authorized boathouse shall be single story, and shall not be designed to allow for second story use. No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. Thepermittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. The permittee and/or his or her contractor shall meet with a representative of the. Division prior to project initiation. The total area of shading from the project will be 1,176sf of open water and 102sf of high ground. This will be the fourth pier extending from the Hare property if approved. Open Water Shading from existing platform and piers is 743sf. Total shading from the existing pier structures and the proposed pier and docking structure will be 1,919sf. The total number of formal mooring facilities will be four. I have reviewed the rules and would like to offer the following: 15 NCAC 07H .0208 Use Standards (b) Specific Use Standards (6) Piers and Docking Facilities. (A) Piers shall not exceed six feet in width. Piers greater than six feet in width shall be permitted only if the greater width is necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur; Consistent: 6' max requested. (B) The total square footage of shaded impact for docks and mooring facilities (excluding the pier) allowed shall be eight square feet per linear foot of shoreline with a maximum of 2,000 square feet. In calculating the shaded impact, uncovered open water slips shall not be counted in the total. Projects requiring dimensions greater than those stated in this Rule shall be permitted only if the greater dimensions are necessary for safe use, to improve public access, or to support a water dependent use that cannot otherwise occur. Size restrictions shall not apply to marinas; Consistent: The combined area of proposed and existing structures will be within limit of this rule. (C) Piers and docking facilities over coastal wetlands shall be no wider than six feet and shall be elevated at least three feet above any coastal wetland substrate as measured from the bottom of the decking; Consistent: None proposed. Measurements of square footage shall be taken of the greatest exterior dimensions. Boathouses shall not be allowed on lots with less than 75 linear feet of shoreline. Size restrictions do not apply to marinas; Consistent: Proposed boathouse will be 420sf. The applicant currently has a 25' boat. A 30' long boathouse allows only 2.5' on each side to protect the vessel from the elements. (E) The total area enclosed by an individual boatlift shall not exceed 400 square feet except to accommodate a documented need for a larger boat lift; Consistent: No proposed lift will exceed 400sf. (F) Piers and docking facilities shall be single story. They may be roofed but shall not be designed to allow second story use; Consistent: Single story proposed. (G) Pier and docking facility length shall be limited by: (i) not extending beyond the established pier or docking facility length along the same shoreline for similar use; (This restriction does not apply to piers 100 feet or less in length unless necessary to avoid unreasonable interference with navigation or other uses of the waters by the public); Consistent: the proposed pier and platform will not exceed established pier length. (i) not extending into the channel portion of the water body; and, Consistent: The proposed pier and platform will be outside of any navigation channel. (iii) not extending more than one-fourth the width of a natural water body, or human made canal or basin. Measurements to determine widths of the water body, canals or basins shall be made from the waterward edge of any coastal wetland vegetation that borders the water body. The one-fourth length limitation does not apply in areas where the U.S. Army Corps of Engineers, or a local government in consultation with the Corps of Engineers, has established an official pier -head line. The one-fourth length limitation shall not apply when the proposed pier is located between longer piers or docking facilities within 200 feet of the applicant's property. However, the proposed pier or docking facility shall not be longer than the pier head line established by the adjacent piers or docking facilities, nor longer than one-third the width of the water body. (H) Piers or docking facilities longer than 400 feet shall be permitted only if the proposed length gives access to deeper water at a rate of at least 1 foot each 100-foot increment of length longer than 400 feet, or, if the additional length is necessary to span some obstruction to navigation. DATE: July 10, 2018 Consistency Determination: The request is consistent with/not in conflict with the Chowan County/Town of Edenton 2008 Core Land Use Plan certified by the CRC on July 24, 2008. Overview: The 17.14 acre subject property has approximately 535 linear feet of shoreline along the Chowan River. Water depths range from -1 foot at the shoreline to -4.5 feet a distance of 84 feet offshore. The property is elevated an average of 14 feet above Normal Water Level (NWL). The site is divided by Gilbert's Beach Road, a private dirt road, with cropland on 12 acres to the east and grassed area with some trees on the remaining 5.14 acres along the dirt road and to the west between the dirt road and the river. Existing site improvements consist of five (5) residential structures and seven (7) out buildings. Existing shoreline improvements consist of a 6 foot wide by 16 foot long pier, a 4 foot wide by 77 foot long pier with a 211 sq. ft. platform for a total length of 102 feet, and a 4 foot wide by 32 foot long pier. Construction of a 6 foot wide by 17 foot long pier access and installation of a 6 foot wide by 68 foot long pier with a 16 foot by 16 foot terminus platform, a 4 foot wide by 16 foot long stepdown, a 14 foot by 30 foot boathouse with boatlift, a personal water craft (PWC) lift and seven (7) tie pilings are proposed. The pier access will connect the pier to high ground. The tie pilings will accommodate two (2) boat slips. Andy Hare Field Investigation Report Page 2 Project Setting The applicant's project site is located on Gilbert's Beach Road, adjacent to the Chowan River in Tyner, Chowan County. The property consists of 17.14 acres, with 553.5' fronting on the Chowan River. Located on the property are five dwelling structures, seven out building, and three existing piers. Mr. Hare's property is bisected by Gilberts Beach Road, a private dirt road. All residential structures are located on the west side (riverside) of the road. The east side of the road is farm land, with 12 acres currently in crops. Gilberts Beach is a 7-lot private family subdivision with lots ranging from 2.33 acres to 17.34 acres. Dwellings on the applicant's property are rented apart from the applicant's residence that was constructed in 2017. Existing piers on the property include a 16' x 6' pier (96sf) behind the southernmost dwelling, a second pier is located 373' north (also behind a dwelling) that consists of a 77' x 4' pier with a 211sf platform (519sf) and a total length of —102'. The final (existing) pier is located on the north end of the property behind a third dwelling that is 32' x 4' (128sf). The total area of open water shaded by existing piers is 743sf. There are no formal mooring slips associated with the existing piers. Vegetation on the property is primarily crop land, with domestic grass and ornamentals on the west side of the road around the dwellings. Elevation of the property is an average of 14' above normal water level (NWL). Water depths range from -1' at the shoreline to -4.5' 84' offshore. The Chowan River, adjacent to the project site is not shown as a known submerged aquatic habitat, and no vegetation was found within the proposed work area. The waters within Chowan River adjacent to the applicant's property are "Joint", and as such are classified as Estuarine Waters. The closest known historic sites (CO 0315 and CO 1003) are documented as being .84 to .91 miles from the applicant's property along Dillard's Mill Road. There are no known geologic formations or archaeological sites associated with the applicant's property. Development Proposal Applicant Andy Hare is requesting a permit to construct a private pier and docking facility behind his residence in Tyner, North Carolina, on the Chowan River.
