ADDITIONAL CONDITIONS
3) This permit authorizes two additional formalized boat slips for a maximum of 4 formalized boat slips.
General
4) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
5) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Nationwide Permit
197800056 (Action ID SAW-2018-00734) issued 4/17/18.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 2018-0548.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level..
NOTE: An application processing fee of $250 was received by DCM for this project.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

The total area of the docking facility was calculated as follows:
Shoreline length = 225 x 8 sq. ft. = 1800 sq. ft. allowable.
Existing Floating Platform: 5' x 40' = 200 sq. ft.
Existing Floating Platform: 8' x 20' = 160 sq. ft.
Proposed New Boatlift: 16' x 19' = 304 sq. ft. (not calculated in allowable platform area).
Proposed New Boatlift: 11.5 x 16'= 184 sq. ft. (not calculated in allowable platform area).
Total = 360 sq. ft.
It is the staff s recommendation that the installation of the two proposed boatlifts appears
CONSISTENT with the rules in 15A NCAC 071-1.0208 (b) (6) (G) which limit docking facility length.
The proposed boatlifts would not exceed the width distance of the waterbody and would not appear to
extend into the Town of OIB maintained dredge channel. The adjacent docking facilities to the east and
west measure less than 100' in length and should not be referenced for a pier head alignment in this
case.
The installation of the proposed boatlifts would provide two (2) additional dry slips allowing the facility
to accommodate a total of four (4) vessels in waters that are closed to the harvest of shellfish. The
existing floating dock measuring approximately 5' in width by 40' in length may be considered capable
of accommodating 2 vessels, especially considering no permit history was found documenting necessary
accommodations for a larger vessel. In this case, the total slip count for the facility as proposed may be
calculated as five (5) slips by state and federal review agencies. The Project Narrative notes that the
landward sides of the existing floating docks would not allow for permanent or transient docking and the
applicant has indicated willingness to install handrails or marine lockers to obstruct any docking in these
locations (See Project Narrative).
Provided there are no concerns from any other commenting agency, it is recommended that a permit be
issued to include standard permit conditions.

Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA.
Waters at the project site are classified as SA; HQW and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the Town of Ocean Isle Land Use Plan
and offer the following comments.
The general area of the project is classified Residential, while the AECs impacted by the
work are classified as Conservation.
In general, the Town of Ocean Isle Beach allows development in Conservation classified
AECs, which is consistent with the State's minimum use standards. The Town of Ocean
Isle Beach Land Use Plan contains some policies, which exceed the State's minimum use
standards. However, none of these standards appear to be applicable to this proposal.

9. PROJECT DESCRIPTION
The applicant's property is located at 55 Scotland Street, adjacent a man-made canal contiguous with the
Atlantic Intracoastal Waterway (AIWW) in the Town of Ocean Isle Beach, Brunswick County. Directions
from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6
miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd
St. and travel approximately 0.8 miles. Turn left onto Raeford St. and travel approximately 0.3 miles. The
project site will be located on the right side of the street.
The project site is a comer lot measuring approximately 0.26 acres in area with canal shoreline frontage on
two sides totaling approximately 225' in length. The shoreline is void of Coastal Wetland vegetation and is
stabilized by an existing concrete bulkhead. High ground vegetation consists primarily of lawn grass and
ornamental landscaping. Existing upland development includes a single-family home, gravel driveway, and
pool. The property maintains separate docking facilities on the north and west sides of the shoreline. The
west side docking facility consists of a ramp measuring approximately 3' in width by 16' in length which
leads to a floating dock measuring approximately 8' in width by 20' in length. The existing floating dock is
aligned parallel to the channel approximately IT-18' waterward of the Normal High Water (NHW) mark on
the concrete, in alignment with the established pier head line. The docking facility on the north side shoreline
consists of an existing ramp measuring approximately 6' in width by 18' in length which leads to an existing
floating dock measuring approximately 5' in width by 40' in length. A search of DCM and Town records did
not reveal any prior permit history for this longer floating dock, which appears to have been existing since
2007. The existing floating dock is located approximately 23' waterward of NHW aligned parallel to the
canal and has an existing ramp landing measuring approximately 50 sq. ft. in area. According to the
application, existing water depths at the waterward end of the existing floating platforms measures
approximately -4' to -6' @ Normal Low Water (NLW).
The waters of the manmade canals and adjacent AIWW are classified SA; HQW by the Division of Water
Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries. They are CLOSED to the harvest of shellfish.
PROPOSED PROJECT:
The applicant proposes to install two (2) new boatlifts at an existing private docking facility. One of the
proposed boatlifts (slip #3), would measure approximately 16' in width by 19' in length and would be
installed on the east side of the existing 5' x 40' floating dock which is located on the north side of the
property's shoreline. This proposed location would measure approximately 24'-25' waterward of the NHW
mark and approximately 36' west of the applicant's east side riparian line. The applicant has proposed the
removal of an existing tie piling in in the area of proposed slip #3, as noted on the site plan (See Page 1 of 1).
The other proposed boatlift (slip #4), would measure approximately 11.5' in width by 16' in length would be
installed on the south side of the existing 8' x 20' floating dock which is located on the west side of the
property's shoreline. This proposed location would measure approximately 19' waterward of the NHW mark
on the concrete and approximately 28' north of the applicant's south side riparian line. Neither of the
proposed boatlifts would exceed the applicable V4 width distance of the waterbody and would not appear to
encroach into Town Ocean Isle Beach's dredge channel, which is located approximately 23' waterward of
NHW off the east side shoreline and approximately 25' waterward of NHW off the west side shoreline.

The proposed installation of the two boadifts would incorporate approximately 488 sq. ft. of Estuarine
Waters and Public Trust Area. The proposed boadifts would increase the slip count to a total of four (4) for
the property. Minor increases in turbidity should be expected during the proposed construction.

Location:
The project site is 270 ft. of shoreline adjacent to man-made canals leading to the
Intracoastal Waterway (ICW W). The project property contains a single family residential structure
with an assigned address of 55 Scotland Street, Ocean Isle Beach, NC. The property contains two
existing floating docks. One dock is located on the northern main canal and the other sited on the
western finger canal. The floating docks are separated by 75 linear feet of shoreline. The property
serves only as a private residence. The adjacent lots to the south and east are fully developed
residential properties with existing docking facilities. The property is stabilized by way of an
existing concrete bulkhead and vegetated (grass) cover. The shoreline at the proposed project is
entirely concrete with no existing visible or submerged vegetation.
Purpose and Need:
The purpose of the project is to construct a 16'x 19' boat lift on the northern main canal
and an I I'x16' boat lift on the western finger canal. The primary objective of the project is to
provide the owner with a safe and functional residential docking facility. The proposed project will
provide safe boat access for the applicant without encroaching on any existing riparian corridors.
The proposed lifts will provide the applicant with a total of four (4) boat slips; two (2) wet slips
and two (2) dry slips. Please note that the existing floating docks will not allow for transient or
permanent docking on the landward sides. No bumper guards, cleats or similar hardware will be
installed on the landward side of either existing floating dock. Furthermore, handrails and/or
marine lockers will will be installed on the landward sides of both floating docks. As shown on
the plan, an existing tie piling will be removed to make way for the proposed northern boatlift. No
additional tie pilings are proposed. All proposed construction will occur within the designated pier

agent for Harvey Gouch, for State approval for development located at 55 Scotland St. adjacent to a manmade canal contiguous
with the AIWW, in Ocean Isle Beach, Brunswick County. The application was received as complete on March 13, 2018, and
appears to be adequate for processing at this time. The projected deadline for making a decision is May 27, 2018. An additional
75-day review period is provided by law when such time is necessary to complete the review. If you have not been notified of a
final action by the initial deadline stated above, you should consider the review period extended. Under those circumstances,
this letter will serve as your notice of an extended review. However, an additional letter will be provided on or about the 75th
day.
If this agency does not render a permit decision within 70 days from March 13, 2018, you may request a meeting with
the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such a meeting will
be held within five working days from the receipt of your written request and shall include the property owner, developer, and
project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from a public
road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way fronting your
property, or at a point along the road right-of-way where a private road would lead one into your property. Failure to post this
notice could result in an incomplete application.

The Department of Environmental Quality hereby gives public notice as required by NCGS 113A-
119(b) that the following applications were submitted for development permits in Areas of Environmental
Concern, adjacent to man-made canals off the AIWW, in Ocean Isle Beach, Brunswick County as
designated under the CAMA: On March 9, 2018, Johnny Mina proposed to replace a failing bulkhead
at 65 Monroe Street, and on March 13, 2018, Harvey Gouch proposed to install two boatlifts at an
existing docking facility at 55 Scotland Street. Copies of these applications can be examined or copied at
the office of Sean Farrell, N.C. Dept. of Environmental Quality, Division of Coastal Management, 127
Cardinal Drive Ext., Wilmington, NC 28405, (910-796-7424) during normal business hours.
Comments mailed to Braxton C. Davis, Director, Division of Coastal Management, 400 Commerce
Avenue, Morehead City, NC 28557-3421, prior to April 9, 2018 will be considered in making the permit
decision. Later comments will be accepted and considered up to the time of permit decision. Project
modification may occur based on review and comment by the public and state and federal agencies. Notice
of the permit decision in these matters will be provided upon written request.
