Wrightsville Beach , as requested in the permittee's application dated 08/10/18, including
attached workpian drawings (4) 1-4 of 4 dated 08/10/18.
This permit, issued on October 25, 2018 , is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or civil action; or may cause the permit to be null and void.
Docking Facility
1) This permit authorizes only the docks, piers, and other structures and uses located in or over the
water that are expressly and specifically set forth in the permit application. No other structure,
whether floating or stationary, shall become a permanent part of this docking facility without permit
modification. No non -water dependent uses of structures shall be conducted on, in or over Public
Trust waters without permit modification.
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
docking facility. Any sewage discharge at the docking facility shall be considered a violation of this
permit for which the permittee is responsible. This prohibition shall be applied and enforced
throughout the entire existence of the permitted structure.

this permit action may be appealed by the permittee or other Signed by the authority of the 5

ADDITIONAL CONDITIONS
3) The permittee shall maintain the. authorized work in good condition and in conformance with the terms
and conditions of this permit. The permitteeds not relieved of this requirement if he abandons the'
permitted activity without having it transferred to .a third parry.
4) The permittee 'shall install and maintain at his expense any signallights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owner's riparian access corridor, which is determined by
drawing a line parallel to the channel, then drawing a line perpendicular to the channel line that
intersects with the shore at the point where the upland property he meets the water's edge.
6) The authorized structures and'associated activity shall not cause an unacceptable interference with
navigation and shall not exceed the established Wrightsville Beach pier head line.
7) This permit authorizes a maximum of three (3) formalized boat slips.
General
8) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
.9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
10) This permit does not authorize the interference with any existing or proposed Federal project, and the
permittee shall, not be entitled to compensation -for damage to the authorized structure or work, or injury
which may be caused from existing or future.operations undertaken by the United States in the public
interest.
11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at (910) 796-7215 prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This. permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit
197800056 (Action ID No. SAW-2018-01895), which was issued on 10/22/18.
NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2018-
1225.

The total area of floating dock and platform was calculated as follows:
Shoreline length =57' x 8 ft2 = 456 ft2 allowable
Existing covered platform =14' x 14' =196 ft2
Proposed Sundeck = 8' x 16' =128 ft2
Existing floating dock = 24' x 6' =144 ftZ (Not counted due to alignment)
Proposed floating docks = (14' x 6') {Not counted due to alignment) & (6' x 81 = 48 ft2
Total = 372 ft2
The docking facility would provide potential docking space for up to three (3) vessels at this
location. It appears that the project is CONSISTENT with the use standards set forth in NCAC
07H .0208(b)(6), including the eight-square'foot rule and the pier width rule. Specifically, the
project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6)(G)(iii), including
the official pierhead line established by the Town of Wrightsville Beach, the 1/4 width and channel
location. The proposed structures would be located entirely over open water. The facility would not
encroach into either 15' riparian corridor setback area. In the absence of any concerns from the
commenting agencies, it is recommended that a permit be issued subject to the standard conditions
for private docking facilities.

The applicant proposes to expand an existing docking facility. The project is located at
16 N. Channel Drive, adjacent to Banks Channel in Wrightsville Beach, New Hanover
County.
Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SB# and are not open to the harvesting of
shellfish. The area is not a Primary Nursery Area.
I have reviewed this proposal for consistency with the 2005 Town of Wrightsville Beach
Land Use Plan and offer the following comments.
The general area of the project is classified Developed, while the AECs impacted by the
work are classified as Conservation/Resource Protection.
In general, the Town of Wrightsville Beach allows development in
Conservation/Resource Protection classified AECs which is consistent with the State's .
minimum use standards. The Town of Wrightsville Beach Land Use Plan contains some
policies, which exceed the State's minimum use standards including those for piers and
marinas. However, none of these more restrictive policies seem to be applicable to this
project.
This project is consistent with the 2005 Town of Wrightsville Beach Land Use Plan.

The North Carolina Natural Heritage Program (NCNHP) appreciates the opportunity to provide information
about natural heritage resources for the project referenced above.
A query of the NCNHP database indicates that there are records for rare species, important natural
communities, natural areas, and/or conservation/managed areas within the proposed project boundary. These
results are presented in the attached 'Documented Occurrences' tables and map.
The attached 'Potential Occurrences' table summarizes rare species and natural communities that have been
documented within a one -mile radius of the property boundary. The proximity of these records suggests that
these natural heritage elements may potentially be present in the project area if suitable habitat exists. Tables of
natural areas and conservation/managed areas within a one -mile radius of the project area, if any, are also
included in this report.
If a Federally -listed species is documented within the project area or indicated within a one -mile radius of the
project area, the NCNHP recommends contacting the US Fish and Wildlife Service (USFWS) for guidance.

Through coordination with the North Carolina Division of Coastal Management we have
learned of your request to expand an existing private docking facility located at 16 N. Channel
Drive in Wrightsville Beach, New Hanover County, North Carolina. Coordinates are: 34.2107 N,
-77.7980 W.
On January 1, 2017, we renewed general permit No. 197800056, (copy enclosed), that
authorizes the maintenance, repair, construction and installation of piers, docks, boathouses and
boat shelters, mooring piles, dolphins, jetties and breakwater structures in navigable waters of the
United States in the State of North Carolina pursuant to Section 10 of the Rivers and Harbors Act
of 1899.
Your work is authorized provided it is accomplished in strict accordance with your
submitted plans, the enclosed general conditions, and the following special conditions. The
expiration date of your DA permit is December 31, 2021.
1. All work authorized by this permit must be performed in strict compliance with the
submitted plans received on September 10, 2018, which are a part of this permit.
Please read the enclosed permit to prevent an unintentional violation of Federal law. As
this Department of the Army regional general permit does not relieve you of the responsibility to
obtain any other required approvals, you should contact appropriate State and local agencies
before beginning work.

The total area of floating dock and platform was calculated as follows:
Shoreline length =57' x 8 ft2 = 456 ftz allowable
Existing covered platform = 14' x 14' = 196 ft2
Proposed Sundeck = 8' x 16' =128 ft2
Existing floating dock = 24' x 6' =144 ft2 (Not counted due to alignment)
Proposed floating docks = (14' x 6') f Not counted due to alignment) & (6' x 8') = 48 ft2
Total = 372 ft2
The docking facility would provide potential docking space for up to three (3) vessels at this
location. It appears that the project is CONSISTENT with the use standards set forth in NCAC
07H .0208(b)(6), including the eight-square'foot rule and the pier width rule. Specifically, the
project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6)(G)(iii), including
the official pier -head line established by the Town of Wrightsville Beach, the 1/4 width and channel
location. The proposed structures would be located entirely over open water. The facility would not
encroach into either 15' riparian corridor setback area. In the absence of any concerns from the
commenting agencies, it is recommended that a permit be issued subject to the standard conditions
for private docking facilities.

9. PROJECT DESCRIPTION
The project site is located at 16 N. Channel Drive, adjacent to Banks Channel in the Town of
Wrightsville Beach, New Hanover County. To locate the project site from the WiRO take US Hwy
74/76 to Wrightsville Beach. Travel across the drawbridge and keep right on Causeway Drive. Turn
left on N. Channel Drive, just before the Causeway Bridge leading to the barrier island. Travel 0.07
miles and the property of interest is located on the right side of the road.
The project site is approximately 0.11 acres in size, on which the applicant currently maintains a
single-family residence. The high ground is vegetated primarily with maintained lawn grass,
ornamental landscaping and oak trees. The project site has approximately 57' of shoreline frontage
along Banks Channel, which is stabilized by a wooden bulkhead, and Normal High Water (NHW) is at
the bulkhead. Waterward of the bulkhead is an area of Coastal Wetlands consisting primarily of
Smooth Cordgrass (Spartina aiterniflora) measuring approx. 30' in width that extends the length of
the property. The applicant also maintains a private docking facility, which consists of a fixed pier (6'
x 160') that extends in an easterly direction into Banks Channel. At the terminus, there is a fixed %-
head" covered platform (14' x 14% which connects (via ramp) to a floating dock (6'x 24') extending
perpendicular to the shoreline. The property to the south is developed with a single-family residence,
bulkhead and a docking facility that is approximately 24' from the subject docking facility. According
to the application package, existingwater depths surrounding the existing docking facility range from
approximately -T to -4.0' at normal low water (NLW). The original facility was authorized via
General Permit No. 47409D issued to the previous owner (A. C. Ingram) on 1/8/07.
The Town of Wrightsville Beach Land Use Plan classifies adjacent waters and high ground portion of
the property as Conservation. The waters of Banks Channel are classified SB by the Division of Water
Resources. They are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries and they are CLOSED to the harvest of shellfish.
PROPOSED PROJECT
The applicant proposes to expand an existing private docking facility into Banks Channel. The
configuration of the existing docking facility currently provides dockage for up to two (2) vessels.
The application states the existing pier, gazebo and floating dock would remain in place and the
decking would be replaced and any worm-eaten pilings would be replaced as needed. As proposed a
new sun deck measuring approx. 8' in width by 16' in length would be installed on the landward side
of the existing gazebo. Located on the waterward end of the existing floating dock would be a new 6'
in width by 14' in length floating dock extension. Extending from the waterward end of the proposed
floating dock would be another floating dock measuring approx. 6' in width by 8' in length creating
an "L-head" configuration. As proposed, the facility would provide dockage for up to three (3) vessels.
The application states that existing water depths in the vicinity of the proposed docking facility
expansion
range from 4 to -6.0' at NLW. As proposed, the docking facility would extend approximately 220'
into a waterbody measuring approximately 840' in width.

10. ANTICIPATED IMPACTS
The proposed structures would incorporate approximately 260 ftz of additional Estuarine Waters
and Pubic Trust Area. The proposed structures would extend approximately 220' into a waterbody,
which measures approximately 840' across. This distance conforms to the quarter width of the
waterbody and the established Wrightsville Beach pier -head alignment. The proposed structures
would not encroach into either adjacent 15' Riparian Corridor Setback Areas. The facility would
accommodate up to three (3) vessels within water depths ranging from approximately -4' to -6.0' at
NLW. Minor increases in turbidity should be expected during construction.

The Division of Coastal Management hereby acknowledges receipt of your application, submitted on behalf of
Stuart Gans, requesting authorization under the Rules of the N.C. Coastal Resources Commission for development
activities at 16 N. Channel Drive, adjacent to Banks Channel, in Wrightsville Beach, New Hanover County. It was
received as complete (with the exception of the signed green return receipt cards) on August 15, 2018, and appears
to be adequate for processing at this time. The projected deadline for making a decision on your permit application
is October 29, 2018. An additional 75-day review period is provided by law when such time is necessary to
complete the review. If you have not been notified of a final action by the initial deadline stated above, you should
consider the review period extended. Under those circumstances, this letter will serve as your notice of an extended
review. However, an additional letter will be provided on or about the 75th day.
If this agency does not render a permit decision within 70 days from August 15, 2018, you may request a meeting
with the Director of the Division of Coastal Management and permit staff to discuss the status of your project. Such
a meeting will be held within five working days from the receipt of your written request and shall include the
property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your proposed
development. You should post this notice at a conspicuous point along your property where it can be observed from
a public road. Some examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-
way fronting your property; or at a point along the road right-of-way where a private road would lead one into your
property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the appropriate
State or Federal agency. Please contact me if you have any questions and notify me in writing if you wish to receive
a copy of my field report and/or comments from reviewing agencies.
