Dockine Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of expanded this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Samuel Cross Permit lyo. 35-J8 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he or she abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expenseany signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 3 formalized boat slips. 6) No portion of the authorized docking facility shall extend -more than one quarter of the width of the water body. Measurements to determine the width of the water body sball be made from the waterward edge of any coastal wetland vegetation which borders the water body. 7) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable . waters at or adjacent to the authorized work. General 8) The peruiittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the pemuttee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised.that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project byway of General Permit 197800056 (Action ID No. SAW-2018-00351), which was issued on 3/5/18. It is the staff's recommendation that the relocation of the existing 6' in width by 30' in length floating dock approximately 4' waterward appears CONSISTENT with the rules in 15A NCAC 07H.0208 (b) (6) (G) which limit docking facility length. The proposed docking facility would not exceed the 1/4 width distance of the waterbody and would not appear to extend into the Town of OIB maintained dredge channel. The adjacent docking facilities to the east and west measure less than 100' in length and should not be referenced for a pier head alignment. The installation of the proposed boatlift would provide an additional slip allowing the facility to accommodate a total of three (3) vessels in waters that are closed to the harvest of shellfish. The project is located at 50 Raeford Street in Ocean Isle Beach. Areas of Environmental Concern (AFC's) impacted by the proposal are EW and PTA. Waters at the project site are classified as SA; HQW and are not open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the Town of Ocean Isle Land Use Plan and offer the following comments. The general area of the project is classified Residential, while the AECs impacted by the work are classified as Residential. Directions from Highway 17 south of Shallotte: Turn Left onto Ocean Isle Beach Rd. and travel approximately 3.6 miles and continue straight onto Causeway Dr./ NC-904 for approximately 1.12 miles. Turn left onto E. 2nd St. and travel approximately 0.8 miles. Turn left onto Raeford St. and travel approximately 0.3 miles. The project site will be located on the right side of the street. The project site is a comer lot measuring approximately 0.2 acres in area with canal shoreline frontage on two sides totaling approximately 204' in length. The shoreline is void of Coastal Wetland vegetation and is stabilized by an existing concrete bulkhead. High ground vegetation consists primarily of lawn grass and ornamental landscaping. Existing upland development includes a single-family home, gravel driveway, and pool which abuts the existing concrete bulkhead. The property maintains separate docking facilities on the north and east sides of shoreline. The east side docking facility consists of a pier measuring approximately 4' in width by 8' in length and ramp measuring approximately 4' in width by 16' in length which leads to a floating dock measuring approximately 8' in width by 16' in length. The existing floating dock is aligned parallel to the channel approximately 20' waterward of NHW and in alignment with the established pier head line. An existing jet dock measuring approximately 5' in width by 10' in length is connected to the north side of the existing floating dock. The docking facility on the north side shoreline consists of an existing ramp measuring approximately 4' in width by 16' in length which leads to an existing floating dock measuring approximately 6' in width by 30' in length. The floating dock is aligned parallel to the canal and has an existing ramp landing measuring approximately 44 sq. ft. in area. Existing water depths at the waterward end of the existing floating platform measure approximately -2' to -3' @ Normal Low Water (NLW). The waters of the manmade canals and adjacent AIWW are classified SA; HQW by the Division of Water Resources and are NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries. They are CLOSED to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to install a new boatlift and relocate an existing floating dock 4' waterward. As proposed, the relocation of the existing floating dock located on the north side would require an addition to the floating ramp landing measuring approximately 6' in width by 4' in length. The existing pilings located on either side of the floating dock are proposed to be relocated to the landward side of the floating dock, where no dockage is proposed. The proposed relocation of the existing floating dock located on the north side of the property's shoreline would align the waterward edge of the structure approximately 26' from the NHW mark on the existing concrete bulkhead. This distance would not exceed the 1/4 width distance of the waterbody, which measures approximately 120' and would not encroach into the Town of Ocean Isle Beach's dredge channel, which is located approximately 36' waterward of the NHW mark. As proposed, a boatlift measuring approximately 12' in width by 12' in length would be installed approximately 10' east of the proposed relocated floating dock.
