Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the fill of
1,192ft2 of section 404 wetlands, all as expressly and specifically set forth in the attached permit
application and workplan drawing.

ADDITIONAL CONDITIONS
Sedimentation and Erosion Control
3) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to
ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
4) A ground cover sufficient to restrain erosion shall be provided within 30 calendar days of completion of
any phase of grading on cut or filled slopes.
General
5) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the
written approval of the Division of Coastal Management.
6) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.
NOTE: The U.S. Army Corps of Engineers authorized the project by way of Programmatic General
Pennit 198000291 (Action ID SAW-2018-01716) issued 9/24/18.
NOTE: The N.C. Division of Water Resources authorized the proposed project by way of General Water
Quality Certification 4144 and assigned the project DWR Project No. 18-1188.
Future development _of -the permittee's, property.may require a modification of this permit.
Contact a representative of the Division at (252) 946-6481 prior to the commencement of any
such activity for this determination. The permittee is further advised that many land disturbing
activities are not authorized within 50 feet of the normal high/low water level unless specifically
exempted by Environmental Management Commission's (EMC) Tar Pamlico buffer
regulations in place at the time of such development.
NOTE: An application processing fee of $400 was received by DCM for this project. This fee also
satisfied the Section 401 application processing fee requirements of the Division of Water
Resources.

The enclosed permit constitutes authorization under the Coastal Area Management Act,
and where applicable, the State Dredge and Fill Law, for you to proceed with your project
proposal. The original (buff -colored form) is retained by you and it must be available on site
when the project is inspected for compliance. Please sign both the original and the copy and
return the copy to this office in the enclosed envelope. Signing the permit and proceeding
means you have waived your right of appeal described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant
to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with
NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center,
Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your
permit. You should also be aware that another qualified party may submit an objection to the
issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise,
all work must be carried out in accordance with your application. Modifications, time extensions,
and future maintenance requires additional approval. Please read your permit carefully prior to
starting work and review all project plans, as approved. If you are having the work done by a
contractor, it would be to your benefit to be sure that he fully understands all permit
requirements.
From time to time, Department personnel will visit the project site. To facilitate this
review, we request that you complete and mail the enclosed Notice Card just prior to work
initiation. However, if questions arise concerning permit conditions, environmental safeguards,
or problem areas, you may contact Department personnel at any time for assistance. By
working in accordance with the permit, you will be helping to protect our vitally important coastal
resources.

the jurisdiction of the USACOE Permit on his property located off SR 1321 at 332 Shady Banks
Beach Road near the City of Washington in Beaufort County, North Carolina.
This office has reviewed the proposed project with regard to rules found in
Subchapter 7H concerning development in a Coastal Shoreline. It is stafFs recommendation
that the proposed project appears consistent with 15A NCAC 07H .0209 as long as the project
is approved N.0 Division of Water resources and the U.S. Army Corps of Engineers rules and
regulations. This office recommends issuance of the Permit.
This office has received an objection (attached) to this CAMA Major Permit application.

Consistency Determination: The request is consistent with/not in conflict the Beaufort County Joint Land
Use Plan 2006 Update certified by the CRC on January 13, 2010, provided that the land development and
land use activities comply with the requirements of the Tar -Pamlico Buffer Rule, unless located in the
exempted or allowed areas (see policy 2.1.5), and that development meets the Beaufort County Flood
Damage Prevention Ordinance (see policy 2.2.3).
Overview: The .57-acre (25,000 ft2) site is located at 332 Shady Banks Beach Rd, near the City of
Washington in Beaufort County. The site has approximately 90 linear feet of shoreline on the Pamlico
River. Existing site improvements include a concrete bulkhead, rip rap groin, and septic tank. The site is
apprimetly 4' in elevation above NWL. The site is mostly vegetated with lawn grasses and various
hardwood trees. Approxietly 1,192 ft2 has been delineated as section 404 wetlands by the U.S. Army Corps
of Engineers (USACOE). Previous filling and mowing activities have occurred on site according to USACOE
representative Raleigh Bland.
The applicant is proposing to fill and grade low and depressed areas which total ±4,400 ft2, of which ±1,192
ft2 are 404 wetlands. Approximately 190 ft2 of the Section 404 wetlands to be filled are located within the
Coastal Shoreline AEC.
AECs involved include: Coastal Shoreline. The project is located within in Tar -Pamlico River Basin and is
subject to the Tar -Pamlico Buffer Rule. Pamlico River is classified as SB NSW, and is not a Primary Nursery
Area, and is not open to shellfishing. The site is in Special Flood Hazard Area AE (EL10) according to the
Beaufort County FIRM (Map # 37205694001 Panel 5694). A report of SAV, shellfish, and
archaeological/cultural resources in the area was not provided.

Anticipated impacts resulting from this project are expected to include: filling and grading of ±4,400 ft2,
of which ±1,192 ft'are USACOE wetlands.
Basis for Determination:
The project is subject to the Beaufort County Joint Land Use Plan 2006 Update. The counties Future Land
Use Map (FLUM) classifies the site as Transition (land), Conservation I (water protected by Tar -Pam Buffer),
and Conservation II (100-year flood plain).
The following LUP policies may be applicable to this request:
2.1 Conservation I
2.1.5 Unless in the exempted or allowed, land development and land use activities must comply with the
requirements of the Tar -Pamlico Buffer Rule (15A NCAC 02B .0259).
2.2 Conservation II
2.2.2 Only development that is consistent with the use standards for the estuarine shoreline AEC and the
public trust shoreline AEC (15A NCAC 07H .0209(d) is allowed.
2.2.3 Development in any flood hazard zone delineated on a Beaufort County FIRM or in an area that is
subject to storm inundation as illustrated on Beaufort County storm surge maps must meet the location
and construction requirements of the Beaufort County Flood Damage Prevention Ordinance.

The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of Engineers (USACE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it.
In accordance with the attached General Certification #4144 (GC 4144), the impacts described in your
application do not require written authorization to utilize GC 4144. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150B by filing a written
petition for an administrative hearing to the Office of Administrative Hearings (hereby known as OAH). A
petition form maybe obtained from the OAH at http://www.ncoah.com/or by calling the OAH Clerk's Office
at (919) 431-3000 for information.

This letter is in response to your correspondence, which was received by the Division of Coastal
Management on August 20, 2018, regarding your concerns about the proposed development
by James F Hill, at 332 Shady Banks Beach Rd., adjacent to the Pamlico River, near Washington,
Beaufort County. The proposed project consisted of filling federally regulated 404 wetlands.
The proposed project has been determined to comply with the Rules of the Coastal Resources
Commission and as such, a permit has been issued to authorize the development. I have
enclosed a copy of the permit.
If you wish to contest our decision to issue this permit, you may file a request for a Third Party
Appeal. The Chairman of the Coastal Resources Commission will consider each case and
determine whether to grant your request to file for a Contested Case Hearing. The hearing
request must be filed with the Director, Division of Coastal Management, in writing and must
be received within twenty (20) days of the disputed permit decision.
If you wish to object to the actions taken on this permit application, you may request an appeal
of this decision within twenty (20) days of the permit decision. If you would like copies of the

This letter is in response to your request for comment with regard to James Hill's permit
application to fill wetlands adjacent to my property.
I object to the proposal.
5 i of the permit application states that stormwater or wastewater will be discharged into a
wetland, that wetland is on my property.
Because I have allowed and encouraged natural wetland plants to grow on my property
(instead of the mowed mats of alligator weed my neighbors encourage) one might well think
that the additional water that will come onto my property should not be a problem. I claim
that it is a problem and this is how I support the claim.
In 2003, when I purchased the home and discontinued the mowing routine of the previous
owner, the water level in the wetland area rarely came up to my knee. Since that time, as a
result of a) development on the other side of Jamaka road and b) the rising water table due to
climate change, I have seen an increase in the water level from below the knee to as high as the
top of my thigh.
The fill dirt for Mr. Hill's project has already been delivered to the lot. It came in three dump
truck loads. When the ground reaches saturation which occurs increasingly and often during
rain events it is reasonable to expect that extra water equivalent to the volume of the fill dirt
will drain into the wetland on my property. This will likely result in an increase in water level by
several inches in some areas.
Along with the water coming from my neighbor's yards are their pesticides and their fertilizers.
Why someone would fertilize a mat of alligator weed is beyond comprehension, but it
continues to take place. These chemicals affect the flora and fauna of the wetland. This
wetland contains the highest concentration of spotted turtle, a species of concern, in the
known literature.

In 2016, 1 became aware that a nutria was visiting the wetland to feed in the winter and early
spring. The animal has not returned in subsequent years, but the destruction of carex in tWCEIVED

wetland and subsequent muddy mess made the area susceptible to colonization by alligator
weed which I continue to battle. Bulrush has also spread, but it could just as easily have been
phragmites, as the seed could have been carried to the area and deposited in nutria stool. The
higher water level, as a result of neighboring developments, have made my wetland area more
attractive to nutria, which can be controlled by keeping water levels below two feet*. The
additional water which will come from Mr. Hill's filling of his adjoining wetland area will
exacerbate the problem.
My neighbors are not pleased with my management of the wetland area. They feel the
overgrowth has contributed to the mosquito population, even though a body of scientific
literature points to the opposite conclusion. My neighbors view the naturalized wetland area
with derision even though during the last hurricane the buffer I allowed to flourish protected
their property from the wave action during the storm surge. I ask you, Mr. Howell, for your
support. Please consider denying this permit on the basis that it will result in a change in
hydrology, that it will further degrade a special place, a small space of remaining coastal
wetland.

The project site is located off SR 1321 at 332 Shady Banks Beach Road near the City of Washington
in Beaufort County, North Carolina. The lot is approximately 0.57 acres (25,000 ft2) in size and has 90
linear feet of shoreline on the Pamlico River. Man-made features on the lot include a concrete bulkhead, rip
rap groin, and septic tank. The lot is approximately 4.0' in elevation above the Normal Water Level. The lot
is mostly vegetated with lawn grasses and various hardwood trees. Approximately 1,192 square feet has been
delineated as section 404 wetlands by the U.S. Army Corps of Engineers (USCOE). This wetland is the
upper end of a wetland system that is separated from the Pamlico River with a sand over wash berm which
runs parallel to the River. The wetland on this lot historically has been impacted through the years by
previous owners. Impact includes mowing and previous filling activities according to the USCOE
representative Raleigh Bland.
Both the downstream and upstream properties are developed with single family dwellings. The
downstream property includes a single-family residence that is separated from the River by the same wetland
system as described above. The wetland on this property does not appear to have been impacted by mowing
or filling. This lot does have a pier with a boatlift. The developed upstream lot has single family residence
with a bulkhead, pier and boadift.
The Pamlico River is classified as SB NSW by the Environmental Management Commission at the
project site. The Pamlico River is classified as coastal fishing waters. The property is subject the Tar -
Pamlico Riparian Buffer rules enforced by the N.C. Division of Water Resources.
Proiect description
The applicant proposes to fill and grade low and depressed areas which total approximately t4,000
ft2of which t1,192 ft2 are wetlands under the jurisdiction of the USACOE. Approximately 190 ft2 of the
Section 404 wetlands to be filled are located within the Coastal Shoreline Area of Environmental Concern.
Anticipated impacts
The project will result in the filling and grading of ±4000 ft2 of which t1,192 ftz is USACOE
jurisdictional wetlands.

Dear Mr. Howell,
Please find enclosed an application for a CAMA Major permit for a lot located at 332 Shady Banks Beach
Road adjacent to the Pamlico River in Beaufort County, N.C. Specifics of the proposed work are
described in the enclosed application forms and drawings.
This approximately 0.6-acre lot is located in a developed single-family residential area and has
established lawn grass and several species of hardwood trees.
Jurisdictional wetlands on this site have been impacted by fill activities dating back several property
owners. There is a minimum 8-10 inches of fill over the majority of the wetlands area which is currently
vegetated with several types of lawn grasses, some penny wort and a couple of cypress trees with cut-
off root systems.
The area has been maintained in a mowed state and only exhibits a water table during significant rain
events. The area has been a yard for 20+ years and is the extreme upper portion of the depressioned
feature behind the river berm. The site formerly supported a single-family residence including a water
supply well and septic tank.
This project is simply to fill and grade existing swales and depressions to generally existing ground
elevations to facilitate property maintenance and grounds keeping.

Dear Mr. Hill:
The NC Division of Coastal Management hereby acknowledges receipt of your
application for State approval for development of your property located off SR 1321 at 332
Shady Banks Beach Road near the City of Washington in Beaufort County, North Carolina. It
was received on 7 August 2018, and appears to be adequate for processing at this time. The
projected deadline for making a decision is 21 October 2018. An additional 75-day review
period is provided by law when such time is necessary to complete the review. If you have
not been notified of a final action by the initial deadline stated above, you should consider
the review period extended. Under those circumstances, this letter will serve as your notice
of an extended review. However, an additional letter will be provided on or about the 75th
day. Kelly Spivey, Field Representative for the Division of Coastal Management is
responsible for processing your permit and he can be reached at 252-948-3853 or via email
at Kelly.Spf�vCc)ncdenr.gov if you have any questions.
If this agency does not render a permit decision within 70 days from 7 August 2018,
you may request a meeting with the Director of the Division of Coastal Management and
permit staff to discuss the status of your project. Such a meeting will be held within five
working days from the receipt of your written request and shall include the property owner,
developer, and project designer/consultant
NCGS 113A-119(b) requires that Notice of an application be posted at the location of
the proposed development Enclosed you will find a "Notice of Permit Filing' postcard which
must be posted at the property of your proposed development You should post this notice
at a conspicuous point along your property where it can be observed from a public road.
Some examples would be: Nailing the notice card to a telephone pole or tree along the road
right-of-way frontingyour property, or at a point along the road right-of-way where a private
road would lead one into your property. Failure to post this notice could result in an
incomplete application.

OF APPLICATION FOR
CAMA MAJOR DEVELOPMENT PERMIT
The Department of Environment and Natural Resources hereby gives public notice as
required by N.C.G.S. I I3A-119(b) that an application for a development permit in an Area of
Environmental Concern as designated under the Coastal Area Management Act (CAMA) was
received on 7 August 2018. According to the said application submitted by James F. Hill, applicant
proposes to fill and grade low and depressed areas. Property located off SR 13621 at 332 Shady
Banks Beach Road near the City of Washington in Beaufort County, North Carolina.
A copy of the entire application may be examined or copied at the office of Jonathan R.
Howell, District Manager, Washington Regional Office, 943 Washington Square Mall,
Washington, NC, during normal business hours. Public comments received by 10 September 2018
will be considered. Later comments will be accepted and considered up to the time of permit
decision. Project modifications may occur based on further review and comments. Notice of the
permit decision in this matter will be provided upon written request.
