This permit; issued on January 9,1018 is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may be subiect to fines, mivrisonmenl or civil action; or may cause the permit to be null and void. - Docking Facility 1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this expanded docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the expanded docking facility. Any sewage discharge at the expanded docking facility shal(be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessibleon-site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on . Signature of Permittee Walter & Susan Caudill Permit No. 5-18 Page 2 of 3 ADDITIONAL CONDITIONS 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this. requirement if he abandons the permitted activity without having it transferred to a third parry. 4) The permittee shall install and maintain at his expense any signal lights or signals presoribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 4 formalized boat slips, 2 jet ski platforms, and. a kayak platform. 6) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. 7) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation within the PNA shall be permitted. General 8) The .permittee and/or big or her contractor shall meet with a representative of the Division prior to project initiation. 9) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 10). This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations, undertaken by the United States in the public interest. 11) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. The addition of the EZ Dock sections would increase the platform area by 298 ft2, but would not increase the slip count at the facility. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the X width rule, the eight -square foot rule and the pier width rule. The proposed structures would be located entirely over open water. The proposed structures would not encroach into either adjacent 15' riparian corridor setback requirement. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. The applicant proposes to expand an existing private docking facility within Whiskey Creek. The project is located at 334 Cabbage Inlet Lane, adjacent to Whiskey Creek in Wilmington. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, and PTA. Waters at the project site are classified as SA and are open to the harvesting of shellfish. The area is not Primary Nursery Area. I have reviewed this proposal for consistency with the 2006 Wilmington -New Hanover County Joint Land Use Plan and offer the following comments. The general area of the project is classified as Resource Protection while the AECs impacted by the work are classified as Conservation. In general, Wilmington -New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The 2006 Wilmington -New Hanover County Joint Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. PROJECT DESCRIPTION: The project site is located at 334 Cabbage Inlet Road, adjacent to Whiskey Creek, in Wilmington, New Hanover County. To locate the property traveling south on College Road, take a left onto Mohican Trail and travel approximately 1.3 miles. Turn left onto Masonboro Loop Road and travel north approximately 1 mile. Turn right onto Masonboro Sound Road and travel east for approximately 0.3 miles, until you reach Cabbage Inlet Road and make a right. Travel approximately 0.5 miles until you reach the property of interest located at the end of Cabbage Inlet Lane. The applicant currently maintains a single-family residence with detached 3-car garage on the project site. The property is adjacent to residential properties with existing single family structures and private docking facilities. The lot is approximately 2.17 acres in size and has an average elevation of approximately 19' above normal high water (NHW). Highground vegetation consists of ornamental landscaping, lawn grass and native oak and pine trees. The project site has approximately 693 linear feet of shoreline frontage with a natural shoreline. The property slopes steeply from north to south, with an abrupt transition from upland vegetation to wetlands. There is a small (<1') erosion escarpment at the transition area. The vegetation transitions from upland species into an area approximately 10-15' in width consisting primarily of Smooth Cordgrass (Spartina alternifloro) with some Black Needlerush (Juncus roemerianus) along the southeast shoreline. Waterward of the low marsh are areas of oyster beds that are visible at low water. The application states that existing water depth within the project area ranges from -30" to -36" at normal low water (NLW), however, during a site visit conducted on 10/31/17 by DCM the water depths in the project area ranged from -24" to -26" at NLW. The applicant currently maintains an existing docking facility within Whiskey Creek. An access pier, measuring approximately 100' in length by 6' in width extends in a southwesterly direction. The pier terminates onto a fixed uncovered platform, measuring approximately 12' in length by 14' in width, which is centered creating an "T- head" configuration. An access ramp leads from the platform onto a floating dock, configured in a "U-shape" with the main spine running parallel to the shoreline and measuring approximately 32' in length by 5' in width. From the northwest and southeast waterward ends of the main spine are two finger piers running perpendicular to the shore each measuring approximately 24' in length and 4' in width. In the center of the "U-shape" floating dock along the southeast finger pier is a boat lift measuring approximately 13' in width by 13' in length. The existing docking facility currently accommodates up to four (4) vessels. CAMA General Permit No. 43390D was issued on 12/15/2005 for construction of the fixed pier, sundeck, 5' x 30' portion of the U-shaped float and one (1) 4' by 24' finger pier. CAMA Major Permit No. 107-06 was issued for the reconfiguration and expansion of the docking facility through the addition of the second 4' by 24' finger pier. The City of Wilmington and New Hanover County Land Use Plan classifies the adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. In the project area, the waters of Whiskey Creek are classified as SA by the NC Division of Water Resources, and they are CLOSED to the harvest of shellfish. These waters are designated as a Primary Nursery Area (PNA), by the Division of Marine Fisheries. PROPOSED PROJECT: The applicant proposes to expand an existing private docking facility within Whiskey Creek. The existing facility would remain and the proposed project consists of the addition of five (5) sections of EZ Dock floating platforms. All five (5) sections would be connected creating one floating EZ Dock platform area..e( ifV&;1® platform would each measure 5' in width by 14' in length, two (2) of which would support jet skis and one (1) of which NOV 0 3 2017 DCM- MHD CITY kZ Walter & Susan Caudill Page 3 would be a kayak launch. Two (2) connecting pieces of EZ Dock, one of which would measure 40" in width by 10' in length would connect the two jet ski pieces, and the second of which would measure 5' in width and 10' in length and would connect the jet ski section to the kayak launch (see Sheet 2 of 3). The EZ Dock structure would be situated along the northwest side of the existing "U-shaped" floating dock. The kayak launch portion would be installed on the landward -most northwest corner of the "U-shaped" floating dock allowing access to both ends of the 5' by 14' section. The remaining sections of EZ Dock would be installed along the landward -most 18' of the northwest edge of the finger pier with the jet skis stored parallel to the shoreline (see Sheet 2 of 3). 10. ANTICIPATED IMPACTS: The proposed structure would incorporate an additional 298 sq. ft. of Estuarine Waters and Public Trust Areas. The EZ dock structure would be located in waters ranging in depth from -24" to -26" at NLW according to a site visit conducted by DCM. Zhe application states the water depths range from -30" to -36" at NLW. The addition of the EZ dock structure would not increase the formalized slip count, because vessels stored on these structures are not considered in the slip count, but rather accounted for as additional platform area per DCM regulations. The proposed structure would not encroach into either adjacent 15' Riparian Corridor Setback Area requirement. The current facility extends approximately 117.5' into a waterbody, which measures approximately 515' across. The proposed EZ Dock would not encroach any further into the waterbody than the existing structures, and conforms to the 1/4 width rule. Minor increases in turbidity should be expected during construction.
