This permit, issued on May 8, 2019 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to tines, rmprlsVIIrleml Vr ImVU RNIVII, v..uay wUav me VV...... .., 1) Unless specifically altered herein, this Minor Modification authorizes the replacement/enlargement of the stormwater outfall and repair of the bulkhead, all as expressly and specifically set forth in the attached email, application, and workplan drawings. Any additional land disturbing activities and/or construction may require a modification of this permit. Contact a Division of Coastal Management representative at (910) 796-7215 for this determination. 2) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. (See Attached Sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2022 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Town of Carolina Beach Permit No. 86-18 Page 2 of 2 ADDITIONAL CONDITIONS Shoreline Stabilization — Bulkhead 3) The authorized bulkhead shall be constructed in the same alignment as depicted on the attached workplan drawings. 4) The bulkhead shall be constructed prior to any backfilling activities. 5) The bulkhead shall be structurally tight so as to prevent seepage of backfill materials through the structure. 6) This permit does not authorize any excavation waterward of the approved alignment. 7) The fill material shall be clean and free of any pollutants except in trace quantities. 8) All backfill material shall be obtained from a high ground source and confined behind the permitted bulkhead. 9) No backfill material is to be placed within 30 feet of the normal high water line, except that which will be used to backfill the area behind the permitted bulkhead. General 10) This permit does not authorize the excavation or filling of any wetland areas. 11) This Minor Modification be attached to the original of Permit No. 86-18, which was issued to the permittee on 08/10/18, and copies of both documents shall be readily available on site when Division personnel inspect the project for compliance. 12) All conditions and stipulations of the active permit remain in force under this Minor Modification unless specifically altered herein. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers assigned the project Action ID No.. SAW-2009-01187. NOTE: The N.C. Division of Water Resources assigned the project DWR Project No. DWR-1989- 00510. Wilson 9 g DCM District Manager, Wilmington DATE: March 20, 2019 SUBJECT Permit Modification Request to State Permit No. 86-18, the Town of Carolina Beach, 1121 N Lake Park Blvd, Carolina Beach, in New Hanover County E.J. Gwinn, of Criser Troutman Tanner Consulting Engineers, and acting as agent for the Town of Carolina Beach, is requesting a Minor Modification to State Permit No. 86-18. This request was submitted in a letter dated March 7, 2019 with five (5) drawings, labeled CO, C1, and C2, dated February 13, 2019, and C3 and S3, dated February 4, 2019. State Permit No. 86-18 was originally issued August 10, 2018 for the excavation and renovation of the western portion of the existing municipal marina, including the replacement and relocation of all foxed and floating docks within the Carolina Beach Yacht Basin. State Permit No. 86-18 was issued as Phase 3 of a 5 Phase project designed to continue improvements to the facility over time. The work for phases 1 and 2 was completed in CAMA emergency general permits issued in 2016 and 2017. Phases 4 & 5 will require additional authorization from this office and are not authorized by this modification. State Permit No. 86-18 is due to expire on December 31, 2021. The Minor Modification request consists of the replacement of approximately 51 LF of an existing 12' diameter stormwater pipe located on the north eastern comer of the yacht basin, to be replaced with 24" HDPE pipe with a junction box and replacement of the existing drop inlet on Canal Drive in the same footprint. The minor modification request also includes the replacement of 34.5 LF of existing deteriorating timber bulkhead surrounding the outfall pipe, with 34.5 LF of vinyl bulkhead with helical anchors to be installed within 2' waterward of the failing bulkhead. The proposed modifications appear to be consistent with NCAC 07H .0208(b)(7) and NCAC 07H .0209, which include the use standards for bulkheads and coastal shorelines. This minor modification request will rat negatively impact coastal wetlands. This office has no objection to the modification of State Permit No. 86-18, provided it is consistent with all other local, state, and federal regulations. King Engineering Associates have submitted a check (check No. 6786) in the fee amount of $100. The minor modification will include the repair of a stormwater pipe at Canal Dr. discharging into the Town of Carolina Beach Marina Basin. The nearest address is 315 Canal Dr, Carolina Beach, NC 28428. The Town of Carolina Beach plans on replacing an existing damaged 12 inch stormwater pipe that discharges directly into the Town of Carolina Bach Marina Basin. The new pipe will be 24 inch HDPE with a junction box on Canal Dr. The catch basin located along Canal Dr will also be replaced to allow a 24 inch pipe to enter. A one way check valve will also be installed near the discharge point to prevent tidal waters from entering the storm pipe. These repairs are designed to alleviate some of the flooding issues on Canal Street. Along with the drainage repairs, this project will include bulkhead repairs. Approximately 34.51-F of bulkhead will be installed within 2ft of the existing deteriorated bulkhead to the west of the wooden deck off of Canal Dr. This submittal package includes the signed notice to the adjacent property owner notifying him of the planned construction. A portion of the existing stormwater pipe enters the adjacent property. Permission was requested from the adjacent property owner to enter his properly to remove the existing pipe and the adjacent property owner has not yet responded. Because the Town of Carolina Beach would like to move forward with this project, the current plans abandon the section of pipe within the adjacent property without entering the property.
