This permit, issued on January 30, 2018 , is subject to compliance with the application (where
consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation

Wetland Fill
1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing
activities associated with the development of the above referenced property, including the fill of
1,75OW of section 404 wetlands, all as expressly and specifically set forth in the attached permit
application and workplan drawing.
Sedimentation and Erosion Control
2) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented
to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties.
(See attached sheet for Additional Conditions)
This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires farther Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program.

Quality Certification 4097 and assigned the project DWR Project No. 2017-1413 issued 1/26/18.
Future development of the permittee's property may require a modification of this permit.

such activity for this determination. The permittee is further advised that many non -water
dependent activities are not authorized within 30 feet of the normal water level.

The enclosed permit constitutes authorization under the Coastal Area Management Act, and
where applicable, the State Dredge and Fill Law, for you to proceed with your project proposal. The
original (buff -colored form) is retained by you and it must be available on site when the project is
inspected for compliance. Please sign both the original and the copy and return the copy to this office in
the enclosed envelope. Signing the permit and proceeding means you have waived your right of appeal
described below.
If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS
113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter
150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714,
[phone] within twenty (20) days of this decision on your permit. You should also be aware that
another qualified party may submit an objection to the issuance of this permit within twenty (20) days.
The project plan is subject to those conditions appearing on the permit form. Otherwise, all work
must be carried out in accordance with your application. Modifications, time extensions, and future
maintenance requires additional approval. Please read your permit carefully prior to starting work and
review all project plans, as approved. If you are having the work done by a contractor, it would be to your
benefit to be sure that he fully understands all permit requirements.
From time to time, Department personnel will visit the project site. To facilitate this review, we
request that you complete and mail the enclosed Notice Card just prior to work initiation. However, if
questions arise concerning permit conditions, environmental safeguards, or problem areas, you may
contact Department personnel at any time for assistance. By working in accordance with the permit, you
will be helping to protect our vitally important coastal resources.

After consultation with Doug Huggett and coordination with Kevin Hart, it was requested for Mr. Cahoon tc
remove the fill within the 30ft buffer pursuant to 7H .0209 (10)(G). Mr. Cahoon was contacted and he
provided amended MP-2, workplan and adjacent riparian property owner notifications. The original
documents identifying the fill within the 30ft buffer were voided and are available in the permit file, as well
as the any pertinent correspondence.

Dear Mr. Cahoon:
The Division of Water Resources (DWR) has received a copy of your CAMA Major application modification
request. DWR issues approval in the form of a Water Quality Certification (WQC) in conjunction with the
CAMA Major Permit and General Permit(s) 198000291 issued by the US Army Corps of Engineers (USACE).
This Certification allows you to use the CAMA Major Permit when the Division of Coastal Management
issues it. Please note, this 401 Water Quality Certification (WQC) supersedes the 401 WQC issued on
November 14, 2017.
In accordance with the attached General Certification #4144 (GC 4144), the impacts described in your
application do not require written authorization to utilize GC 4144. However, you are required to follow
the conditions listed in the attached certification. You should get or otherwise comply with any other
federal, state and local requirements before you go ahead with your project including (but not limited to)
erosion and sediment control regulations.
This Certification can be contested as provided in Articles 3 and 4 of General Statute 150E by filing a

SUBJECT: Major Permit Request by Milton Cahoon to fill a 35 foot by 50 foot area of Section
404 wetlands near a man-made canal that connects to the Albemarle Sound; at
691 Beach Road, in Tyrrell County.
DATE: November 20, 2017
Consistency Determination: The request is consistent with/not in conflict with the Tyrrell
County/Town of Columbia Land Use Plan certified by the CRC
on March 25, 2010.
Overview: The 1.04 acre vacant property has approximately 370 linear feet of combined shoreline
along a man-made canal and the Albemarle Sound. The site is vegetated with lawn grasses and
contains a .2 acre area of Section 404 wetlands. The wetland area is located approximately 9 to
20 feet from the canal shoreline. The project site is located within an AE flood zone. Riprap
shoreline stabilization extends along the Albemarle Sound to the north and along the connecting
man-made canal to the west for approximately 220 feet.
Filling of a 35 foot by 50 foot area of Section 404 wetland is proposed. The area will be filled with
a mix of sand and dirt, raising the elevation approximately 8 to 12 inches. The area will then be
seeded and maintained as part of the property's lawn. A single-family house is to be constructed
on the site at least 75 feet from the shoreline and outside of the wetland area.
The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish
taking. The sound is over 9 miles wide at this location. A review of historic and archaeological
sites was not provided.
Note: Page 3 of the DCM MP-1 Application for Major Development Permit indicates that
construction of a pier is proposed. Pier construction is not included in the staff write-up, site plan
layout or applicant's narrative and therefore has not been included in this review.
Anticipated Impacts resulting from this project are expected to include: the filling of 1,750 sq. ft.
of Estuarine Shoreline Area of Environmental Concern (AEC).

PROJECT SETTING
Milton Cahoon has submitted a Major CAMA request to fill 404 wetlands on a lot adjacent the
Albemarle Sound. The one acre project site is located at 691 Beach Rd in Columbia, Tyrrell County
off SR 1209. The property is currently maintained lawn and 404 wetlands (mix of Typha and
Phragmites) and is protected with a rip rap revetment on the northern part of the property and has a
manmade canal to the west of the property. The Albemarle Sound is over 9 miles wide at the project
site. The property to the east has a boatramp and pier approximately 25ft from the property line.
The property to the southwest of the project site is wooded wetlands and maintained lawn and the
property to the east is single family residential with maintained lawn and protected with a rip rap
revetment. The properties to the west of the site are single family residences and are separated from
the project location by a manmade canal.
The Albemarle Sound at the project site is classified as SB by the Environmental Management
Commission and Coastal by the Marine Fisheries Commission. There is no Submerged Aquatic
Vegetation (SAV) or shellfish present in the project location.

I am planning to construct a home on a tract of land located on the Albemarle Sound. A portion
of the tract is adjacent to a small drainage canal and the Albemarle Sound, and is classified as
wetlands. To reduce the risk of flooding and improve the aesthetics of the property, I propose to
fill and level a 73 x 24 foot area of the wetland with a mix of sand and dirt (see attached work

Dear Mr. Cahoon:
The NC Division of Coastal Management hereby acknowledges receipt of your application for
State approval for development of your property located off SR 1209 at 691 Beach Road on the
Albemarle Sound in Columbia, Tyrrell County, North Carolina. It was received on 25 October
2017, and appears to be adequate for processing at this time. The projected deadline for making a
decision is 8 January 2018. An additional 75-day review period is provided by law when such
time is necessary to complete the review. If you have not been notified of a final action by the
initial deadline stated above, you should consider the review period extended. Under those
circumstances, this letter will serve as your notice of an extended review. However, an additional
letter will be provided on or about the 75th day. Kevin Hart, Field Representative for the Division
of Coastal Management is responsible for processing your permit and he can be reached at 252-
948-3936 or via email at Kevin.Hartknederingov if you have any questions.
If this agency does not render a permit decision within 70 days from 25 October 2017, you may
request a meeting with the Director of the Division of Coastal Management and permit staff to
discuss the status of your project. Such a meeting will be held within five working days from the
receipt of your written request and shall include the property owner, developer, and project
designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the
proposed development. Enclosed you will find a "Notice of Permit Filing" postcard which must
be posted at the property of your proposed development. You should post this notice at a
conspicuous point along your property where it can be observed from a public road. Some
examples would be: Nailing the notice card to a telephone pole or tree along the road right-of-way
fronting your property, or at a point along the road right-of-way where a private road would lead
one into your property. Failure to post this notice could result in an incomplete application.

Hey Kevin,
I was reviewing Cahoon and wanted to ask about the 404 fill within our 30ft buffer. I did an extension of the
buffer line on the workplan through the 404 and noted about 11x50 of the 404 wetland was inside the 30ft buffer. In
reading the rules for Coastal Shorelines (71-1 .0209 (10)(G)), it talks about grading, excavation and landscaping, with no
wetland fill except for shoreline stabilization. I wanted to get your take on it. Unfortunately, I am out on leave next
week, but Doug is CC'd on this for help.

Thanks again for your time this afternoon to go through the changes needed for your
project. As I mentioned in our phone call, and with your permission, I will place the application on
Applicant Hold as of today 1/2/18 until the forms and workplan has been changed to remove the fill
within the 30ft buffer. The Applicant Hold allows you to make the decision when the clock starts up
again, and you can simply call or email me when the time comes. Once those forms are complete Kevin
can send them my way and I'll distribute them to a few agencies and we can get comments back
asap. Soto review...
1. Update workplan to reflect the fill is outside the 30ft buffer.
2. Update the forms to reflect any changes in fill amounts.

Mr. Cahoon is revising the permit application to remove fill within DCM's 30ft buffer. This will change the fill area and
fill location slightly. Mr. Cahoon is in the process of modifying his application and workplans and I will provide them as
soon as they are available. I wanted to notify you all of the incoming change to make it easier to respond with any
additional modifications/comments or authorization numbers in hopes of not extending final permit decision too much.

I am planning to construct a home on a tract of land located on the Albemarle Sound. A portion
of the tract is adjacent to a small drainage canal and the Albemarle Sound, and is classed as
wetlands. To reduce the risk of flooding and improve the aesthetics of the property, I propose to
fill and level a 36 x 50 foot area of the wetland with a mix of sand and dirt (see attached work
plat). This will raise the elevation of the land approximately 8-12 inches. The area will then be
seeded and maintained as a part of the property's lawn.

foot platform on the end, and will be constructed of treated wood. It will be for residential use.
