Permit Class NEW Permit Number 12-18 STATE OF NORTH CAROLINA Department of Environmental Quality and Coastal Resources Commission Permit for X Major Development in an Area of Environmental Concern pursuant to NCGS 113A-118 Excavation and/or filling pursuant to NCGS 113-229 Issued to Milton V. Cahoon III, 3330 Thirty Foot Canal Road, Creswell, NC 27928 Authorizing development in Tyrrell County at adj. to the Albemarle Sound, at 691 Beach in Columbia as requested in the permittee's application dated 9/3/17 (MP-1) and 1/5/18 (MP-2), including attached workplan drawing, dated "Revised 1/5/18". This permit, issued on January 30, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Wetland Fill 1) Unless specifically altered herein, this permit authorizes the grading and other land disturbing activities associated with the development of the above referenced property, including the fill of 1,75OW of section 404 wetlands, all as expressly and specifically set forth in the attached permit application and workplan drawing. Sedimentation and Erosion Control 2) Appropriate sedimentation and erosion control devices, measures or structures shall be implemented to ensure that eroded materials do not enter adjacent wetlands, watercourses or properties. (See attached sheet for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires farther Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. The U.S. Army Corps of Engineers authorized the project by way of Programmatic General Permit 198006291 (Action ID SAW-2017-2347). The N.C. Division of Water Resources authorized the proposed project by way of General Water Quality Certification 4097 and assigned the project DWR Project No. 2017-1413 issued 1/26/18. Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (252) 946-6481 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal water level. If you object to the permit or any of the conditions, you may request a hearing pursuant to NCGS 113A-121.1 or 113-229. Your petition for a hearing must be filed in accordance with NCGS Chapter 150B with the Office of Administrative Hearings, 6714 Mail Service Center, Raleigh, NC 27611-6714, (919) 733-2698 within twenty (20) days of this decision on your permit. You should also be aware that another qualified party may submit an objection to the issuance of this permit within twenty (20) days. The project plan is subject to those conditions appearing on the permit form. Otherwise, all work must be carried out in accordance with your application. Modifications, time extensions, and future maintenance requires additional approval. Please read your permit carefully prior to starting work and review all project plans, as approved. If you are having the work done by a contractor, it would be to your benefit to be sure that he fully understands all permit requirements. From time to time, Department personnel will visit the project site. To facilitate this review, we request that you complete and mail the enclosed Notice Card just prior to work initiation. DATE: November 20, 2017 Consistency Determination: The request is consistent with/not in conflict with the Tyrrell County/Town of Columbia Land Use Plan certified by the CRC on March 25, 2010. Overview: The 1.04 acre vacant property has approximately 370 linear feet of combined shoreline along a man-made canal and the Albemarle Sound. The site is vegetated with lawn grasses and contains a .2 acre area of Section 404 wetlands. The wetland area is located approximately 9 to 20 feet from the canal shoreline. The project site is located within an AE flood zone. Riprap shoreline stabilization extends along the Albemarle Sound to the north and along the connecting man-made canal to the west for approximately 220 feet. Filling of a 35 foot by 50 foot area of Section 404 wetland is proposed. The area will be filled with a mix of sand and dirt, raising the elevation approximately 8 to 12 inches. The area will then be seeded and maintained as part of the property's lawn. A single-family house is to be constructed on the site at least 75 feet from the shoreline and outside of the wetland area. The waters of the Albemarle Sound in this area are classified as SB and are closed to shellfish taking. The sound is over 9 miles wide at this location. A review of historic and archaeological sites was not provided. Note: Page 3 of the DCM MP-1 Application for Major Development Permit indicates that construction of a pier is proposed. Pier construction is not included in the staff write-up, site plan layout or applicant's narrative and therefore has not been included in this review. Anticipated Impacts resulting from this project are expected to include: the filling of 1,750 sq. ft. of Estuarine Shoreline Area of Environmental Concern (AEC). I did an extension of the buffer line on the workplan through the 404 and noted about 11x50 of the 404 wetland was inside the 30ft buffer. In reading the rules for Coastal Shorelines (71-1 .0209 (10)(G)), it talks about grading, excavation and landscaping, with no wetland fill except for shoreline stabilization. A portion of the tract is adjacent to a small drainage canal and the Albemarle Sound, and is classified as wetlands. To reduce the risk of flooding and improve the aesthetics of the property, I propose to fill and level a 36 x 50 foot area of the wetland with a mix of sand and dirt (see attached work plat). This will raise the elevation of the land approximately 8-12 inches. The area will then be seeded and maintained as a part of the property's lawn. I also plan to construct a pier on the Albemarle Sound. It will measure 6 x 40 feet with a 16 x 16 foot platform on the end, and will be constructed of treated wood.
