This permit, issued on February 12, 2018 , is subject to compliance with the application (where consistent with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may to fines, imprisonment or civil action; or may cause the permit to be null and vora. Dockine Facility 1) This permit authorizes only the docks, piers, and other structures and uses located in or over the water that are expressly and specifically set forth in the permit application. No other structure, whether floating or stationary, shall become a permanent part of this docking facility without permit modification. No non -water dependent uses of structures shall be conducted on, in or over Public Trust waters without permit modification. 2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the docking facility. Any sewage discharge at the docking facility shall be considered a violation of this permit for which the permittee is responsible. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. (See attached sheets for Additional Conditions) This permit action may be appealed by the permittee or other qualified persons within twenty (20) days of the issuing date. This permit must be accessible on -site to Department personnel when the project is inspected for compliance. Any maintenance work or project modification not covered hereunder requires further Division approval. All work must cease when the permit expires on December 31, 2021 In issuing this permit, the State of North Carolina agrees that your project is consistent with the North Carolina Coastal Management Program. Signature of Permittee Norman Bullard Permit No.17-18 Page 2 of 3 ADDITIONAL CONDITIONS- 3) The permittee shall maintain the authorized work in good condition and in conformance with the terms and conditions of this permit. The permittee is not relieved of this requirement if he abandons the permitted activity without having it transferred to a third party. 4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S. Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent reflectors shall be attached to the structure in order to make it more visible during hours of darkness or inclement weather. 5) This permit authorizes a maximum of 5 formalized boat slips. 6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts of the structure and the adjacent property owners' riparian access corridors. 7) No portion of the authorized docking facility shall extend past the adjacent pier line, as depicted on the - attached plans. 8) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as measured from the bottom of the decking. 9) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee walls are permitted. Lattice is specifically excluded from being used under this authorization. 10) The authorized covered platform shall be single story, and shall not be designed to allow for second story use. 11) No attempt shall be made by the permittee to prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work. General 12) The permittee and/or his or her contractor shall meet with a representative of the Division prior to project initiation. 13) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third party without the written approval of the Division of Coastal Management. 14) This permit does not authorize the interference with any existing or proposed Federal project, and the permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury which may be caused from existing or future operations undertaken by the United States in the public interest. 15) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit. Norman Bullard Permit No. 17-18 Page 3 of 3 ADDITIONAL CONDITIONS NOTE: The permittee is advised that in accordance with 15A 07H .0208, the Rules of the Coastal Resources Commission prohibit new dredging or excavation of submerged aquatic vegetation (SAV). The presence of SAV has been identified around the project area. Dredging within any SAV habitat in any manner, including "kicking" with boat propellers, is not authorized. This prohibition shall be applied and enforced throughout the entire existence of the permitted structure. NOTE: Future development of the permittee's property may require a modification of this permit. Contact a representative of the Division at (910) 796-7215 prior to the commencement of any such activity for this determination. The permittee is further advised that many non -water dependent activities are not authorized within 30 feet of the normal high water level. NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits, approvals or authorizations that may be required. NOTE: The U.S. Army Corps of Engineers authorized the proposed project by way of General Permit 197800056 (Action ID No. SAW-2017-01591), which was issued on 8/3/17. NOTE: The N.C. Division of Water Resources assigned the proposed project DWR Project No. 2017- 0875. NOTE: An application processing fee of $250 was received by DCM for this project. Proposed main spine floating dock = 50' x 6' = 300 sq. ft. Proposed northern finger pier = 20' x 6' = 120 sq. ft. (not counted due to alignment) Proposed floating dock = 20' x 6' = 120 sq. ft. Total = 781 sq. ft. 7/7/2017 The proposed configuration would allow the facility to accommodate five (5) vessels at this location in water depths ranging from -2'8" to -314" at NLW. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6), including the eight - square foot rule, the quarter width rule, and would not encroach into the 15' adjacent riparian corridor setback requirement. The proposed facility would meet the 80' AIWW setback. This office has no objection to the proposed work, provided it is consistent with all other state and federal permitting requirements. In the absence of any concerns from the commenting agencies, it is recommended that a permit be issued subject to the standard conditions for private docking facilities. The applicant proposes to construct a five (5) slip private docking facility adjacent to the AIWW and Middle Sound. The project is located at. 8428 Bald Eagle Lane in New Hanover County. Areas of Environmental Concern (AEC's) impacted by the proposal are EW, ORW and PT. Waters at the project site are classified as SA-ORW and are open to the harvesting of shellfish. The area is not a Primary Nursery Area. I have reviewed this proposal for consistency with the 2016 New Hanover County Land Use Plan and offer the following comments. The general area of the project is classified as Conservation. In general, Wilmington -New Hanover County allows development in Conservation classified AECs, which is consistent with the State's minimum use standards. The 2016 New Hanover County Land Use Plan contains some policies, which exceed the State's minimum use standards. However, none of these standards appear to be applicable to this proposal. This project is consistent with the 2016 New Hanover County Comprehensive Land Use Plan. Jimmy was unable to obtain the waiver and has eliminated the pilings, but now wants to extend the proposed dock another 6' towards the 15' setback on the south side and obtain authorization to install boatlifts in Slips 2 & 3. Everything is still in the originally proposed footprint and there is no increase in slips. It would add 36 sq feet to the dock. I've attached a scan of the proposed and original plans. Would you all please let me know if you have any concerns or objections to the proposed modifications? If not, I'll have him submit a revised MP-4 with the new dimensions (and clean up the drawing to more accurately draw the 6' extension) to finalize the application. For your ease of reference, the AID # is SAW-2017-01591 and the DWR Project # is 2017-0875). Please let me know if you have any questions or need any additional info. Jimmy was unable to obtain the waiver and has eliminated the pilings, but now wants to extend the proposed dock another 6' towards the 15' setback on the south side and obtain authorization to install boatlifts in Slips 2 & 3. Everything is still in the originally proposed footprint and there is no increase in slips. It would add 36 sq feet to the dock. I've attached a scan of the proposed and original plans. Would you all please let me know if you have any concerns or objections to the proposed modifications? If not, I'll have him submit a revised MP-4 with the new dimensions (and clean up the drawing to more accurately draw the 6' extension) to finalize the application. The applicant is proposing to construct a five -slip docking facility, access pier, covered gazebo with a floating structure and finger piers. The location of the project is adjacent to primary nursery area (PNA) and in a known area of submerged aquatic vegetation (SAV). , PNAs are estuarine waters where initial post -larval development occurs. Species within this area are early post -larval to juvenile and include finfish, crabs, and shrimp. Species inhabit PNAs because they afford food, protection, and proper environmental conditions during vulnerable periods of their life history, thus protection of these areas are imperative. Docking facilities have the potential to shoal after construction leading to decreased depths in slip areas, and should be considered through the design process. Since this area is so closely located adjacent to PNA with the presence of SAV, future requests.to dredge will likely be opposed by the DCM Fisheries Resource Specialist. SAV is a vital component to the estuarine system and is prime nursery area for many fisheries species, such as gag grouper, flounder, red drum, black sea bass, weakfish and Atlantic croaker. SAV supports high diversity of foraging fish and invertebrates, and"provides valuable ecosystem services as a primary producer and enhancer of water quality. SAV is recognized as essential fish habitat due to its primary production, structural complexity, modification of energy regimes, sediment and shoreline stabilization; and nutrient cycling. Upon a site visit conducted on July 19, 2017, seagrass was located throughout the property area in sparse densities and sporadic frequencies. Two different species were located on the property, both Shoal Grass (Ralodule wrightii) and Eelgrass (Zostera marina). The grasses were not in high enough densities or within the proposed footprint of the proposed docking facility so the DCN"CDMF resource specialist has no opposition to the proposed activities. It is important to note that these seagasses have the possibility of growing around the proposed docking facility and could potentially limit the possibility of future development. PROJECT DESCRIPTION: The project site is located at 8428 Bald Eagle Lane, adjacent to the Atlantic Intracoastal Waterway (AIWW) and Middle Sound, in New Hanover County. To locate the property from Market Street (NC Highway17), turn right onto Porter's Neck Road and continue east through the traffic circle approximately 2 miles. At the stop sign, turn left onto Bald Eagle Lane and travel north approximately 0.4 miles and the property of interest will be located on the right. The property is approximately 0.8 acres and is approximately 10' above normal high water (NHW). The property is currently developed with a single-family home. The approximately 100' of shoreline is stabilized by an existing timber bulkhead. Waterward of the bulkhead is band of Coastal Wetlands measuring approximately 45' in width consisting primarily of Smooth Cordgrass (Spartina alterniora). The property is bordered by residential properties to the south and west, and an undeveloped lot to the north. Waterward of the existing bulkhead are remnant pilings (approximately 17 pilings) which extend towards the AIWW in an easterly direction. It appears to be pilings from a facility that was destroyed sometime between 1993 and 1998 per aerial photography. No permit history could be located for 8428 Bald Eagle Lane. The City of Wilmington/New Hanover County 2006 Land Use Plan classifies adjacent waters as Conservation, and the adjacent high ground portion of the project area as Resource Protection. The waters of the AIWW and Middle Sound are classified SA-ORW by the Division of Water Resources. The area is NOT designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine Fisheries and they are OPEN to the harvest of shellfish. PROPOSED PROJECT: The applicant proposes to construct a private five (5) slip docking facility. A 6' by 155' access pier would extend in an easterly direction approximately 20' from the northern shared property line. At the terminus of the pier on the southern side would be a 19' by 19' covered gazebo. From the end of the fixed pier would be a floating structure consisting of multiple sections accessed by a ramp. The main spine of the floating structure would measure 6' wide by 56' in length and run parallel to the shore. Two 6' by 20' finger piers would extend in an easterly direction from the main spine. One would be located at the northernmost end and the other would be located approximately 15' north of the southernmost end. Two boat lifts, one measuring 12' by 14' and the other measuring 15' by 16', would be located on either side of the southernmost end of the main spine of the floating structure (see Sheet 1 of 2). The application states that the facility would accommodate up to five (5) vessels in water depths measuring approximately -2'8" to -3'4" at NLW.
