This permit, issued, on April 20, 2018 is subject to compliance with the application (where consistent
with the permit), all applicable regulations, special conditions and notes set forth below. Any violation of these terms may
be subject to fines, imprisonment or,civil action; or may cause the permit to be null and void. -
Docking Facility
1) This permit authorizes only the expanded docks, piers, and other structures and uses located in or
over the water that are expressly and specifically set forth in the permit application. No other
structure, whether floating or stationary, shall become a permanent part of this expanded docking
facility without permit modification. No non -water dependent uses of structures shall be conducted
on, in or over Public Trust waters without permit modification
2) No sewage, whether treated or untreated, shall be discharged at any time from any boats using the
expanded docking facility. Any sewage discharge at the expanded docking facility shall be
considered a violation of this permit for which the permittee is responsible. This prohibition shall be
applied and enforced throughout the entire existence of the permitted structure.

This permit action may be appealed by the permittee or other
qualified persons within twenty (20) days of the issuing date.
This permit must be accessible on -site to Department
personnel when the project is inspected for compliance.
Any maintenance work or project modification not covered
hereunder requires further Division approval.
All work must cease when the permit expires on
December 31, 2021
In issuing this permit, the State of North Carolina agrees that
your project is consistent with the North Carolina Coastal
Management Program. . 'k

ADDITIONAL CONDITIONS
3) The permittee shall maintain the authorized work in good condition and in conformance with the terms
and.conditions of this permit. The permittee is: not relieved of this requirement if he or she abandons the
permitted activity without having it transferred to a third party.
4) The permittee shall install and maintain at his expense any signal lights or signals prescribed by the U.S.
Coast Guard, through regulation or otherwise, on the authorized facilities. At a minimum, permanent
reflectors shall be attached to the structure in order to make it more visible during hours of darkness or
inclement weather.
5) This permit authorizes a maximum of 4 formalized boat slips. Docking space on the landward side of the
eastern floating dock is not authorized under this permit. Cleats shall not be installed on the landward
side of the eastern floating dock.
6) The pier and associated structures shall have a minimum setback distance of 15 feet between any parts
of the structure and the adjacent property owners' ripariann access corridors.
7) Tie pilings are not authorized in association with Slip No. 4. ,
8) No portion of the authorized docking facility shall extend into the federal channel setback.
9) Any portion of the permitted access pier and docking facilities built over Coastal Wetlands shall not
exceed six feet in width and shall be elevated a minimum of three feet over the wetland substrate as
measured from the bottom of the decking.
10) The authorized covered platform shall not be enclosed. Any material used on the sides shall not obstruct
view and shall be permeable to air and water. Screen or wire on the sides along with benches and knee
walls are permitted. Lattice is specifically excluded from being used under this authorization.
11) The: authorized covered platform shall be single story, and shall not be designed to allow for second story
use.
12) Noattempt shall be made by the. permittee to prevent the full and free use by the public of all navigable
waters at or adjacent to the authorized work.
13) The authorized project is located within a primary nursery area (PNA). Therefore, in accordance with
T15A:07H.0208 of the Rules of the Coastal Resources Commission, no new dredging or excavation
within the PNA shall be permitted. Dredging in any manner, including "kicking" with boat propellers, is
not authorized. This prohibition shall be. applied and enforced throughout the entire existence of the
permitted structure.
U.S. Army Corps of Engineers Conditions
14) In order to further protect the endangered West Indian Manatee, Trichechus manatus, the applicant must
implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere to all
requirements therein. The guidelines can be found at htty://www.fws.gov/nc-

15) The.permittee understands and agrees that, if future operations by the United States require the removal,
relocation, or other alteration, of the structure or work herein authorized, or if, in the opinion of the
Secretary of the Army or his authorized representative, said structure or work shall cause unreasonable
obstruction to the free navigation of the navigable waters, the permittee will be required, upon due
notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work or
obstructions caused thereby, without expense to the United States.
16) Approval of the structure is based on determinations that there would be no obstruction to navigation.
The structure may be damaged by wave wash from passing vessels. Issuance of this permit should not
be construed, as relieving the permittee of taking proper steps to insure the structure and moored boats
will not be damaged by wave wash.
General
17) The permittee and/or his or her contractor shall meet with a representative of the Division prior to
project initiation.
18) This permit shall not be assigned, transferred, sold, or otherwise disposed of to a third parry without the
written approval of the Division of Coastal Management.
19) This permit does not authorize the interference with any existing or proposed Federal project,. and the
permittee shall not be entitled to compensation for damage to the authorized structure or work, or injury
which may be caused from existing or future operations undertaken by the United States in the public .
interest.
20) No excavation or filling of any open water area or vegetated wetlands is authorized by this permit.
21) No upland development is authorized by this permit.
NOTE: Future development of the permittee's property may require a modification of this permit.
Contact a representative of the Division at [phone] prior to the commencement of any
such activity for this determination. The permittee is further advised that many non -water.
dependent activities are not authorized within 30 feet of the normal high water level.
NOTE: This permit does not eliminate the need to obtain any additional state, federal or local permits,
approvals or authorizations that may be required.

9. PROJECT DESCRIPTION
The project site is located at 2544 Mariners Way SE within the St. James Plantation subdivision near Southport, adjacent to the
Intracoastal Waterway, in Brunswick County. To find the project site from the Wilmington District Office, turn left off Cardinal Drive on to
Market Street. Travel 0.4 miles and turn right on to Martin Luther King Jr. Pkwy (US-74). Travel 5.3 miles and merge right on to NC-
133. Travel 0.7 miles, crossing over the Isabel Holmes Bridge, until you reach US-17. Turn left on US-17 and travel 1.1 miles, keep right
and merge onto NC-133 S/US-17 S. Travel 2.6 miles and take the US-17 exit toward Shallotte /Myrtle Beach. Continue 0.8 miles onto
US-17 S/ Ocean Hwy E. Travel 13.1 miles and then turn left on to US-17 BUS. Travel 1.7 miles and turn left on to NC-906. Continue
9.5 miles and turn left on to Maxwell Drive. Travel 0.4 miles and continue straight on to St. James Drive SE for another 2.2 miles to a
traffic circle. Take the first street (Mariners Way) on the right within the traffic circle and proceed 0.5 miles, the property is on the right-
hand side.
The property is approximately 2.41 acres and is currently an unimproved south facing lot. To the East of the subject property is a vacant
lot that has a docking facility To the south of the subject property is a large marsh expanse leading to the Intracoastal Waterway. West
of the subject property are several vacant properties owned by First St. James Inc. The property has an average elevation of
approximately 4 feet above normal high water (NHW). Upland vegetation on this lot primarily consists of various pine and oak tree species
and lawn grass. 404 Jurisdictional wetlands border most of the upland area between the upland and coastal wetlands. Coastal wetlands
extend from the 404 wetland fringe and extend waterward approximately 315 feet toward the Intracoastal Waterway. Coastal wetland
species on site include Black Needlerush (Juncus roemerianus), Spike Grass (Distichlis spicata), Saltwort (Salicomia sp.), Wool Grass
(Scirpus cyperinus), and Smooth Cordgrass (Spartina altemrflora). Periwinkle snails (Littoraria irroata) and fiddler crabs (Uca pugilator)
were also found on site within the tidal marsh.
The property has approximately 270 linear feet of natural shoreline. A docking facility was authorized under General Permit #69419D on
December 15, 2017 and consists of a 400' in length and 6' in width elevated pier that connects to a 25' in length, 16' in width fixed,
partially covered platform. An access ramp leading from the west end of the existing fixed platform to a 40' in length and 6' in width
floating dock platform, running parallel to the shoreline and channel. A 16' in length by 16' in width boatlift is located on the north side of
the float. The docking facility is located within 200' of adjacent existing docking facilities to the west but has no other adjacent docks
immediately to the east. The applicants docking facility is authorized for up to two (2) vessels.
The St. James -Brunswick County 2007 Land Use Plan classifies adjacent waters and high ground portion of the property as Low Density
Residential. The waters of the Intracoastal Waterway are classified SA; HQW by the Division of Water Resources, and they are CLOSED
to shellfishing. This section of the Intracoastal Waterway IS designated as a Primary Nursery Area (PNA) by the N.C. Division of Marine
Fisheries.
PROPOSED PROJECT
The applicant proposes to install two (2) additional floating platforms at an existing docking facility adjacent to the AIWW. The applicant
proposes to install a floating platform measuring 6' in width by 24' in length and another floating platform measuring 6' in width and 19'
in length in an V-shape configuration. The floats will be accessed by a ramp leading from the on the east side of the previously
authorized fixed platform. The new floating platforms will provide for two (2) additional boat slips to the existing 2 slip docking facility for
a total of four (4) vessels within existing water depths of approximately -4.0 ft. to -5.0 ft. at NLW (See Sheets 1 of 5 and 5 of 5). As
proposed, the new floats would not extend beyond the end of the existing docking facility in to the waterbody. Two (2) pilings will be
installed 11' east of the fixed platform. Neither of the adjacent property owners object to this project and want to retain their 15' riparian
corridor setback.

10. ANTICIPATED IMPACTS
The proposed floating platforms would incorporate an additional approximately 258 sq. ft. of Estuarine Waters and Pubic Trust Area. The
additional floats are proposed in an alignment that would not exceed the most waterward extent of the existing docking facility measuring
approximately 104 feet into a waterbody, which measures approximately 450 feet across. This distance would conform to the 114 width
rule or 112.5 feet, and it appears not to exceed the established pier head line, which is consistent with the rules at the time of the issuance
of the permit for the existing docking facility. Additionally, the proposed floats would not encroach into the established Army Corps of
Engineers Federal channel setback. The proposed expansion of the existing docking would provide two (2) additional docking spaces
for a total of four (4) vessels within existing water depths between -4.0 ft. and -5.0 ft. at NLW. The length of both proposed floating
platforms creates an opportunity for more than the two proposed permanent slips. The applicant has agreed to install pilings on the north
side of the 6' x 24' floating platform to prevent permanent dockage. An additional two (2) mooring pilings would be set between the
existing fixed platform and the proposed floats, to prevent permanent dockage on the south side of the 6' x 24' floating platform. The
proposed structures would not encroach into the adjacent 15' Riparian Corridor Setback Area. Minor increases in turbidity should be
expected during construction.

The total area of the docking facility was calculated as follows:
Shoreline length = 270 ft. x 8 ft. = 2,160 sq. ft., 2000 sq. ft. max. allowable
Existing Platform =16 ft. x 25 ft. = 400 sq. ft.
Existing Floating dock= 6 ft. x 40 ft. = 240 sq. ft.
Proposed Floats = 6 ft. x 24 ft. =144 sq. ft.
6 ft. x 19 ft. =114 sq. ft. Total = 258 sq. ft.
Total = 898 sq. ft.
It is the staff s recommendation the expansion of the existing docking facility would provide two (2) additional docking space for a total of
four (4) vessels at this location. It appears that the project is CONSISTENT with the use standards set forth in NCAC 07H .0208(b)(6),
including the %width rule, the eight square foot rule and the pier width rule. The proposed structures would be located entirely over open
water. If the project is determined to be consistent with NCAC 07H .0208(b) and (6), it is recommended that any permit issued should
include standard permit conditions for private docking facilities.

The applicant proposes to install two (2) additional floating platforms at an existing
docking facility. The project is located at 2544 Manners Way SE, in St. James
Plantation, Brunswick County.
Areas of Environmental Concern (AEC's) impacted by the proposal are EW and PT.
Waters at the project site are classified as SA, HQW and are not open to the harvesting of
shellfish. The area is a Primary Nursery Area.
I have reviewed this proposal for consistency with the Brunswick County Land Use Plan
and offer the following comments.
The general area of the project is classified as Low Density Residential and Conservation.
In general, Brunswick County allows development in Conservation classified AECs
which is consistent with the State's minimum use standards. The Brunswick County
Land Use Plan contains some policies, which exceed the State's minimum use standards.
However, none of these standards appear to be applicable to this proposal.
This project is consistent and not in conflict with the 2007 Brunswick County Land Use
Plan.

Dear Mr. Haggett:
Reference the application of Kenneth and Jacqueline Boras to construct a private docking facility,
in waters adjacent to the AIWW, at 2544 Mariners Way, in St. James Plantation, Brunswick County,
NC.
Specifically, the applicant proposes to expand the docking facility to include two additional
floating platforms measuring 6-ft wide X 24-ft long and 6-ft wide X 19-ft long. The previously permitted
facility includes a 400-ft long X 6-ft wide access pier, which connects to a 25-ft long X 16-ft wide fixed,
partially covered.platform which then connects a 40-ft long X 6-ft wide floating dock platform that runs
parallel to the shoreline and includes a 16-ft X16-ft boat lift on the northern side of the float. The new
floating platforms would provide two additional boat slips.
The Federal agencies have completed review of the proposal as presented by the application and
your field investigation report. We recommend that the following conditions be included in the
modification to the State authorization:
1. In order to farther protect the endangered West Indian Manatee, Trichechus manatus, the
applicant must implement the U.S. Fish and Wildlife Service's Manatee Guidelines, and strictly adhere
to all requirements therein. The guidelines can be found at httn://www.fws. og v/nc-
es/mammal/manatee guidelines.pdf.
2. Dredging is not authorized.
3. The permittee must install and maintain, at his expense, any signal lights and signals
prescribed by the U.S. Coast Guard, through regulations or otherwise, on authorized facilities. For
further information, the permittee should contact the U.S. Coast Guard Marine Safety Office at (910)
772-2191.
4. All work authorized by this permit must be performed in strict compliance with the
submitted plans, which are a part of this permit. Any modification to these plarAmust I e an roved by

the US Army Corps of Engineers (USACE) prior to implementation.
5. The docks and piers extending over wetlands will be elevated sufficiently (a minimum of 3
feet) above the wetland substrate to prevent total shading of vegetation, substrate, or other elements of
the aquatic environment.
6. The permittee understands and agrees that, if future operations by the United States require
the removal, relocation, or other alteration, of the structure or work herein authorized, or if, in the
opinion of the Secretary of the Army or his authorized representative, said structure or work shall cause
unreasonable obstruction to the free navigation of the navigable waters, the permittee will be required,
upon due notice from the U.S. Army Corps of Engineers, to remove, relocate, or alter the structural work
or obstructions caused thereby, without expense to the United States.
7. Approval of the structure is based on determinations that there would be no obstruction to
navigation. The structure may be damaged by wave wash from passing vessels. Issuance of this permit
should not be construed, as relieving the permittee of taking proper steps to insure the structure and
moored boats will not be damaged by wave wash.
8. The authorized structure and associated activity must not interfere with the public's right to
free navigation on all navigable waters of the United States. No attempt will be made by the permittee to
prevent the full and free use by the public of all navigable waters at or adjacent to the authorized work
for reason other than safety.
9. Except as specified in the plans attached to this permit, no excavation, fill or mechanized
land -clearing activities shall take place at any time in the construction or maintenance of this project, in
such a manner as to impair normal flows and circulation patterns within waters or wetlands or to reduce
the reach of waters or wetlands.
10. Except as authorized by this permit or any USACE approved modification to this permit, no
excavation, fill or mechanized land -clearing activities shall take place at any time in the construction or
maintenance of this project, within waters or wetlands. This permit does not authorize temporary
placement or double handling of excavated or fill material within waters or wetlands outside the
permitted area. This prohibition applies to all borrow and fill activities connected with this project.
11. All mechanized equipment will be regularly inspected and maintained to prevent
contamination of waters and wetlands from fuels, lubricants, hydraulic fluids, or other toxic materials.
In the event of a spill of petroleum products or any other hazardous waste, the permittee shall
immediately report it to the N.C. Division of Water Resources at [phone], Ext. 526 or (800)
662-7956 and provisions of the North Carolina Oil Pollution and Hazardous Substances Control Act will
be followed.

12. Unless otherwise authorized by this permit, all fill material placed in waters or wetlands
shall be generated from an upland source and will be clean and free of any pollutants except in trace
quantities. Metal products, organic materials (including debris from land clearing activities), or
unsightly debris will not be used.
13. If the permittee discovers any previously unknown historic or archeological remains while
accomplishing the authorized work, he will immediately notify the Wilmington District Engineer who
will initiate the required coordination procedures.
14. The perririttee shall require its contractors and/or agents to comply with the terms and
conditions of this permit in the construction and maintenance of this project, and shall provide each of
its contractors and/or agents associated with the construction or maintenance of this project with a copy
of this permit. A copy of this permit, including all conditions, shall be available at the project site during
construction and maintenance of this project.
15. The permittee shall employ all sedimentation and erosion control measures necessary to
prevent an increase in sedimentation or turbidity within waters and wetlands outside the permit area.
This shall include, but is not limited to, the immediate installation of silt fencing or similar appropriate
devices around all areas subject to soil disturbance or the movement of earthen fill, and the immediate
stabilization of all disturbed areas. Additionally, the project must remain in full compliance with all
aspects of the Sedimentation Pollution Control Act of 1973 (North Carolina General Statutes Chapter
113A Article 4).
16. The activity will be conducted in such a manner as to prevent a significant increase in
turbidity outside the area of construction or construction -related discharge. Increases such that the
turbidity in the waterbody is 50 NTU's or less in all rivers not designated as trout waters by the North
Carolina Division of Environmental Management (NCDEM), 25 NTU's or less in all saltwater classes
and in all lakes and reservoirs, and 10 NTU's or less in trout waters, are not considered significant.
17. The permittee, upon receipt of a notice of revocation of this permit or upon its expiration
before completion of the work will, without expense to the United States and in such time and manner as
the Secretary of the Army or his authorized representative may direct, restore the water or wetland to its
pre -project condition.
18. Violations of these conditions or violations of Section 404 of the Clean Water Actor Section
10 of the Rivers and Harbors Act must be reported in writing to the Wilmington District U.S. Army Corps
of Engineers within 24 hours of the petmittee's discovery of the violation.

We are proposing'the addition of ( 6'x24' floating docks with a 3'x16' aluminum access ramp on the
north side of the permitted 16'x16' gazebo and 16'x9' sundeck (see attached drawings). The current
layout allows for both temporary mooring (while vessel is being used) and safe storage of a larger vessel
while on the lift. The permitted (2) slip design (which has not been constructed yet) does not allow for a
second smaller "run about" vessel or an area to launch canoes/kayaks, or fish if the south dock is being
utilized. We are proposing the additional docks to allow for (2) additional slips. The total number of
slips will increase from 2 to 4 slips total. This will allow a place to moor a second small vessel all while
being able to launch a canoe/kayak, fish or crab without having to shuffle boats around or put them in
and out of the water constantly. I have attached the general permit drawing along with the proposed
drawing for your review. I have labeled the slip numbers. Piles will be installed along the backside
(land) of the proposed additional docks so that the area may not be utilized as a slip. If you have any

Mr. Kronenthal:
we have been contracted by Jacqueline and Ken Boras to construct a retaining wall / bulkhead along
their'404 wetland line to prepare the property for the construction of their new home. We are also
proposing to construct a new recreational pier / dock. I have enclosed (2) packages for your review.
The first package details the proposed sizes and locations of house, wall and pier. We are applying for a
CAMA General Permit for the retaining wall, stationary pier, gazebo, sundeck, boatlift and 6' x 40'
floating dock. I have included a drawing showing their locations. The proposed pier will mimic the
existing pier to the west and will be placed in the center of the riparian corridor to ensure there is
adequate distance from both adjoining properties.
The second package enclosed is for the CAMA Major Permit. The Boras's own a larger vessel that will
require the south dock slips currently being proposed in the General Permit. One slip is necessary for
temporary mooring of the vessel and the other will be for safe storage on the boat lift. The Major
Permit application is for the addition of (2) 6' x 24' docks on the east side of the gazebo / sundeck to be
used for mooring a smaller run -about style boat. It will also give the homeowners a place to swim, fish,
canoe and kayak.
I have attached surveys and drawings depicting everything that is enclosed. Please don't hesitate to call

The Division of Coastal Management hereby acknowledges receipt of your application, acting as agent for
Kenneth and Jacqueline Boras, for State approval for development of the property located at 2544 Mariners
Way, within St. James Plantation, Southport, adjacent to the Intracoastal Waterway, Brunswick County. It was
received complete on January 25, 2018, and appears to be adequate for processing at this time. The projected
deadline for making a decision is April 10, 2018. An additional 75-day review period is provided by law when
such time is necessary to complete the review. If you have not been notified of a final action by the initial
deadline stated above, you should consider the review period extended. Under those circumstances, this letter
will serve as your notice of an extended review. However, an additional letter will be provided on or about the
75th day.
If this agency does not render a permit decision within 70 days from January 25, 2018, you may request a
meeting with the Director of the Division of Coastal Management and permit staff to discuss the status of your
project. Such a meeting will be held within five working days from the receipt of your written request and
shall include the property owner, developer, and project designer/consultant.
NCGS 113A-119(b) requires that Notice of an application be posted at the location of the proposed development.
Enclosed you will find a "Notice of Permit Filing" postcard which must be posted at the property of your
proposed development. You should post this notice at a conspicuous point along your property where it can be
observed from a public road, Some examples would be: Nailing the notice card to a telephone pole or tree along
the road right-of-way fronting your property, or at a point along the road right-of-way where a private road would
lead one into your property. Failure to post this notice could result in an incomplete application.
An onsite inspection will be made, and if additional information is required, you will be contacted by the
appropriate State or Federal agency. Please contact me if you have any questions and notify me in writing if
you wish to receive a copy of my field report and/or comments from reviewing agencies.

NCGS 113A-119(b) that the following applications were submitted for development permits in
Brunswick County Areas of Environmental Concern as designated under the CAMA: On
January 16, 2018, Lockwood Folly Country Club POA proposed to extend an existing boat
ramp and to install a kayak launch off Genoe's Point Rd, adjacent to Lockwood Folly River,
in Supply, and on January 25, 2018, Kenneth and Jacqueline Boras proposed to expand an
existing docking facility at 2544 Mariners Way SE, adjacent to the AIWW, in St. James
Plantation, near Southport Copies of these applications can be examined or copied at the office
of Sean Farrell (LFCC, POA), or Brooks Surgan (Boras), N.C. Dept. of Environmental
